<committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize additional district judges for the district courts and convert temporary judgeships.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Judicial Understaffing Delays Getting Emergencies Solved Act</short-title></quote> or the <quote><short-title>JUDGES Act</short-title></quote>.</text></section><section id="id82d2223a1c0e49648e89fc30666c2622"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id0c6ea0ba854c4390aca5aafc2f655fdf"><enum>(1)</enum><text>Article III of the Constitution of the United States gives Congress the power to establish judgeships in the district courts of the United States.</text></paragraph><paragraph id="id6d8db6fdf92c4c95875e6dcf97ca44ab"><enum>(2)</enum><text>Congress has not created a new district court judgeship since 2003 and has not enacted comprehensive judgeship legislation since 1990.</text></paragraph><paragraph id="id642c18aabe264ecfbf9d570d79d9ac6c"><enum>(3)</enum><text>This represents the longest period of time since district courts of the United States were established in 1789 that Congress has not authorized any new permanent district court judgeships.</text></paragraph><paragraph id="id131c66e098404d9ba111dee2394fe9b1"><enum>(4)</enum><text>By the end of fiscal year 2022, filings in the district courts of the United States had increased by 30 percent since the last comprehensive judgeship legislation.</text></paragraph><paragraph id="id0df3e246e7a74e30bd753cb0d78e1ee6"><enum>(5)</enum><text>As of March 31, 2023, there were 686,797 pending cases in the district courts of the United States, with an average of 491 weighted case filings per judgeship over a 12-month period.</text></paragraph><paragraph id="id08a46d2e550d424ea3091dc230a434b8"><enum>(6)</enum><text>To deal with increased filings in the district courts of the United States, the Judicial Conference of the United States requested the creation of 66 new district court judgeships in its 2023 report.</text></paragraph></section><section id="id9bb4f00aec484bac9bdc59cb9cfb393e"><enum>3.</enum><header>Additional district judges for the district courts</header><subsection id="id157370ea2f374bffb107c69c3548e996"><enum>(a)</enum><header>Additional judgeships</header><paragraph id="idfcea74c3776e46ff875a0055af6fee91"><enum>(1)</enum><header>2025</header><text>On or after January 21, 2025, the President shall appoint, by and with the advice and consent of the Senate—</text><subparagraph id="id8e44274eed5b415ba4809436825f84fe"><enum>(A)</enum><text>1 additional district judge for the district of Arizona;</text></subparagraph><subparagraph id="ide027230c9f1948c09283bb7aa85a98de"><enum>(B)</enum><text>5 additional district judges for the central district of California;</text></subparagraph><subparagraph id="id48ab8900599649d09f3ad7d84832f664"><enum>(C)</enum><text> 2 additional district judges for the eastern district of California;</text></subparagraph><subparagraph id="id538be02804504ed482d57b11f1882f2a"><enum>(D)</enum><text> 3 additional district judges for the northern district of California;</text></subparagraph><subparagraph id="id54ee977bc43249d993bc5bb732754a82"><enum>(E)</enum><text> 1 additional district judge for the southern district of California;</text></subparagraph><subparagraph id="idd7e098876e664ff7a5ce877e3d295e8c"><enum>(F)</enum><text> 1 additional district judge for the district of Colorado;</text></subparagraph><subparagraph id="id3d09fb8f8ae14b0897d49d93e93962da"><enum>(G)</enum><text> 1 additional district judge for the district of Delaware;</text></subparagraph><subparagraph id="idc184df7f7bab441ab67f6191d36dd1f9"><enum>(H)</enum><text> 2 additional district judges for the middle district of Florida;</text></subparagraph><subparagraph id="id5613b48bc71e490bb68762e3ec0a999a"><enum>(I)</enum><text> 1 additional district judge for the southern district of Florida;</text></subparagraph><subparagraph id="iddf672a0847644dc29ff47ba09e8e206d"><enum>(J)</enum><text> 1 additional district judge for the northern district of Georgia;</text></subparagraph><subparagraph id="id715bc2fdbe4a4c11ad43a3629bc73ef4"><enum>(K)</enum><text>1 additional district judge for the district of Idaho;</text></subparagraph><subparagraph id="id8fb924c92ba0410c84e03bc03d23b98f"><enum>(L)</enum><text> 1 additional district judge for the southern district of Indiana; </text></subparagraph><subparagraph id="id08edc28ea4b84526a239b661553531de"><enum>(M)</enum><text>1 additional district judge for the northern district of Iowa; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0f98538c103f450f848b3c4ae77eead5"><enum>(N)</enum><text>1 additional district judge for the district of Nebraska;</text></subparagraph><subparagraph id="id8c6ecc9a58e743fd93378d76fa7fffd6"><enum>(O)</enum><text>1 additional district judge for the district of New Jersey;</text></subparagraph><subparagraph id="id19d0f3df6dfa49a2afadfc2babfeba50"><enum>(P)</enum><text> 1 additional district judge for the eastern district of New York;</text></subparagraph><subparagraph id="id13db21451a494a1fa80f4a0397a06101"><enum>(Q)</enum><text> 1 additional district judge for the southern district of New York;</text></subparagraph><subparagraph id="id81864c692dca482bb2535985215dab66"><enum>(R)</enum><text> 1 additional district judge for the eastern district of Texas;</text></subparagraph><subparagraph id="id369bad86b6f24974aeff12795373a455"><enum>(S)</enum><text>1 additional district judge for the northern district of Texas; </text></subparagraph><subparagraph id="id9f0a1a265a4c4d859f57eea3b4d3c2eb"><enum>(T)</enum><text> 2 additional district judges for the southern district of Texas; and</text></subparagraph><subparagraph id="id6275c4b4d07a4095896b5c1e659beb26"><enum>(U)</enum><text> 3 additional district judges for the western district of Texas.</text></subparagraph></paragraph><paragraph id="id0c5ff193384444099b9a157d8488e3ae"><enum>(2)</enum><header>2029</header><text>On or after January 21, 2029, the President shall appoint, by and with the advice and consent of the Senate—</text><subparagraph id="idcd7069981ccd4239b63f059d83959f47"><enum>(A)</enum><text>1 additional district judge for the district of Arizona;</text></subparagraph><subparagraph id="id6f7aeda76e324637aeda050e3dcc7568"><enum>(B)</enum><text> 4 additional district judges for the central district of California;</text></subparagraph><subparagraph id="idc80fcc0969c94210b0521722e163b79b"><enum>(C)</enum><text>2 additional district judge for the eastern district of California;</text></subparagraph><subparagraph id="idcc9fd1c6e8f84e4896359809901b5cfb"><enum>(D)</enum><text>3 additional district judges for the northern district of California;</text></subparagraph><subparagraph id="idbc3fa17a5769462d9a11dfeb9a5de9ef"><enum>(E)</enum><text> 1 additional district judge for the southern district of California;</text></subparagraph><subparagraph id="id7229d201f74144c79371380030987013"><enum>(F)</enum><text> 1 additional district judge for the district of Colorado;</text></subparagraph><subparagraph id="id6c917c87d370484ca08f2f23583d7de0"><enum>(G)</enum><text>1 additional district judge for the district of Delaware; </text></subparagraph><subparagraph id="iddcf1dba77c524dddbaebfa2570b1d3b3"><enum>(H)</enum><text> 3 additional district judges for the middle district of Florida;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5753993537664a4db2c51f60d087cfb1"><enum>(I)</enum><text>1 additional district judge for the northern district of Florida;</text></subparagraph><subparagraph id="id2a57e928ee714830aa951a2475d88d69"><enum>(J)</enum><text> 2 additional district judges for the southern district of Florida;</text></subparagraph><subparagraph id="id2f88cdb6f1be4bbc9a133b7cec057e24"><enum>(K)</enum><text> 1 additional district judge for the northern district of Georgia;</text></subparagraph><subparagraph id="id7245509b617c4ef5a67b5c00c761c9cf"><enum>(L)</enum><text> 2 additional district judges for the district of New Jersey;</text></subparagraph><subparagraph id="id84ff36a32d6047cfab76b3a7f701b08c"><enum>(M)</enum><text> 1 additional district judge for the eastern district of New York;</text></subparagraph><subparagraph id="idf9eb923d5e854cd8bd911ac6c728fa26"><enum>(N)</enum><text>1 additional district judge for the southern district of New York;</text></subparagraph><subparagraph id="ide32966a1948349c093ee3f5b3d41fdc2"><enum>(O)</enum><text>1 additional district judge for the western district of New York;</text></subparagraph><subparagraph id="id3d101f3ad6004d7cbe26b3fbf477e2f1"><enum>(P)</enum><text>1 additional district judge for the eastern district of Texas;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc89db78b756942d895ece3d5b87d4355"><enum>(Q)</enum><text>2 additional district judge for the southern district of Texas; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id97bf80c0779e472cb65043cdb24d3cfa"><enum>(R)</enum><text display-inline="yes-display-inline">3 additional district judges for the western district of Texas.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8aa337126ba34f8ba5593075612cea8d"><enum>(b)</enum><header>Temporary judgeships</header><paragraph id="id1f98d10f29624290b23570da834a0870"><enum>(1)</enum><header>In general</header><text>The President shall appoint, by and with the advice and consent of the Senate—</text><subparagraph id="id76335248259e4edea9158610adb4a547"><enum>(A)</enum><text>2 additional district judges for the eastern district of Oklahoma; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcf1107181cfd4c888924413166b6acfd"><enum>(B)</enum><text display-inline="yes-display-inline">1 additional district judge for the northern district of Oklahoma.</text></subparagraph></paragraph><paragraph id="id0872f64d728847428e1245dae6693631"><enum>(2)</enum><header>Vacancies not filled</header><text>The first vacancy in the office of district judge in each of the offices of district judge authorized by this subsection, occurring 5 years or more after the confirmation date of the judge named to fill the temporary district judgeship created in the applicable district by this subsection, shall not be filled.</text></paragraph><paragraph id="id7ebf8b1ce9114f0299ea27b3dd141cac"><enum>(3)</enum><header>Effective date</header><text>This subsection shall take effect on January 21, 2025.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8e78f82b2a6b479f875770dc95e6b771"><enum>(c)</enum><header>Conversion of temporary judgeships</header><text>The existing judgeship for the eastern district of Missouri authorized by section 203(c) of the Judicial Improvements Act of 1990 (<external-xref legal-doc="public-law" parsable-cite="pl/101/650">Public Law 101–650</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/28/133">28 U.S.C. 133</external-xref> note) and the existing judgeships for the district of Arizona, the central district of California, the southern district of Florida, the district of New Mexico, the western district of North Carolina, and the eastern district of Texas authorized by section 312(c) of the 21st Century Department of Justice Appropriations Authorization Act (<external-xref legal-doc="public-law" parsable-cite="pl/107/273">Public Law 107–273</external-xref>, <external-xref legal-doc="usc" parsable-cite="usc/28/133">28 U.S.C. 133</external-xref> note), as of the date of enactment of this Act, shall be authorized under section 133 of title 28, United States Code, and the incumbents in those offices shall hold the office under section 133 of title 28, United States Code, as amended by this Act. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id63119b24e653442c9e1e69ae215d1cba"><enum>(d)</enum><header>Extension of temporary Federal district court judgeships for the northern district of Alabama and the district of Kansas</header><paragraph commented="no" display-inline="no-display-inline" id="id55660073acff4c7ea340840bcf3f172e"><enum>(1)</enum><header display-inline="yes-display-inline">Northern district of Alabama</header><text>Section 312(c)(2) of the 21st Century Department of Justice Appropriations Authorization Act (<external-xref legal-doc="public-law" parsable-cite="pl/107/273">Public Law 107–273</external-xref>, <external-xref legal-doc="usc" parsable-cite="usc/28/133">28 U.S.C. 133</external-xref> note) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1ed894548ecc46cf84c601faa21fdc6e"><enum>(A)</enum><text display-inline="yes-display-inline">in the first sentence, by striking <quote>California</quote> and inserting <quote>California, northern district of Alabama,</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idea4fc1f781be4cf69c77cae0485a9db5"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>The first vacancy in the office of district judge in the northern district of Alabama occurring 26 years or more after the confirmation date of the judge named to fill the temporary district judgeship created in that district by this subsection, shall not be filled.</quote> after the period at the end of the third sentence.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id67da2c5d116d42f8bdfa4c15d5c867f0"><enum>(2)</enum><header>District of Kansas</header><text>Section 203(c) of the Judicial Improvements Act of 1990 (<external-xref legal-doc="public-law" parsable-cite="pl/101/650">Public Law 101–650</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/28/133">28 U.S.C. 133</external-xref> note) is amended, in the matter following paragraph (12), in the second sentence, by striking <quote>32 years and 6 months</quote> and inserting <quote>37 years and 6 months</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id98dfbcc13d444381b4ba1cb41d01f6bb"><enum>(e)</enum><header>Technical and conforming amendments</header><text>The table contained in section 133(a) of title 28, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id8B113FC5F42F472191856FD72C8F5E92"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the item
