which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prevent the purchase of ammunition by prohibited purchasers.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H3CFF580331B946D3ADD331BF44630591"><section section-type="section-one" id="HB48C01B62B15485181871FB48FE89E62"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Jaime’s Law</short-title></quote>.</text></section><section id="HE8F6DA77F1AF4819A311C1CA0D8DA5AA"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to enhance the background check process in the United States to prevent the purchase of ammunition by individuals who are prohibited from doing so under Federal and State law.</text></section><section id="H90E6661406734FB493B42BCC762C6798"><enum>3.</enum><header>Transfers of firearms or ammunition</header><subsection id="H0888D70502CC4467831796D1E3ABF0BF"><enum>(a)</enum><header>In general</header><text>Section 922 of title 18, United States Code, is amended—</text><paragraph id="H56C785588CDA46A9916A92DDAF26E0A4"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (s);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6b33a417bcf949b8a73d9189bd638082"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsection (t) as subsection (s);</text></paragraph><paragraph id="H12FA1F1DF93243968127F68DC3A607B3"><enum>(3)</enum><text>in subsection (s), as so redesignated—</text><subparagraph id="H43E8B5FBCD15461AAFDA404162ADE17C"><enum>(A)</enum><text>by inserting <quote>or ammunition</quote> after <quote>firearm</quote> each place it appears except in subparagraphs (B)(ii) and (C) of paragraph (1);</text></subparagraph><subparagraph id="H72FA5C2C3314449D8206D50D7E7C65D1"><enum>(B)</enum><text>in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="id38ca67135b124917a80e77c34db401a9"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (B)(ii), by inserting <quote>in the case of a firearm,</quote> before <quote>3</quote>; and</text></clause><clause id="HCFB05741B69B4DBD8F07F7FCAD8F9509"><enum>(ii)</enum><text>in subparagraph (C), in the matter preceding clause (i), by inserting <quote>the transfer of a firearm to</quote> before <quote>a person less</quote>; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4e58f77e27884094ad0d2ee9ccd5a633"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (3)(C)(ii), by striking <quote>the chief law enforcement officer (as defined in subsection (s)(8))</quote> and inserting <quote>the relevant chief of police, sheriff, or other equivalent official, or the designee of any such individual</quote>; and</text></subparagraph></paragraph><paragraph id="H9522F2C7343B4F2C89B1903B3CB45932"><enum>(4)</enum><text>by inserting after subsection (s), as so redesignated, the following:</text><quoted-block style="OLC" id="H3793299937F9467C81D5B147E0B5F01E"><subsection id="HB91FD8FD086849BD804388D415F6E1A8"><enum>(t)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HF9A08FEF16CA49139909A68519C94C33"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H335CEC4F01EE4DCEA6EF8D1F7E7B06CC"><enum>(A)</enum><text>It shall be unlawful for any person who is not a licensed importer, licensed manufacturer, or licensed dealer to transfer ammunition to any other person who is not so licensed, unless a licensed importer, licensed manufacturer, or licensed dealer has first taken possession of the ammunition for the purpose of complying with subsection (s).</text></subparagraph><subparagraph id="H91792D88C923411BADF224F715AEBA0A" indent="up2"><enum>(B)</enum><text>Upon taking possession of ammunition under subparagraph (A), a licensee shall comply with all requirements of this chapter as if the licensee were transferring ammunition from the inventory of the licensee to the unlicensed transferee.</text></subparagraph><subparagraph id="H16103F84915B446C8F1B16566EE3B17D" indent="up2"><enum>(C)</enum><text>If a transfer of ammunition described in subparagraph (A) will not be completed for any reason after a licensee takes possession of the ammunition (including because the transfer of the ammunition to, or receipt of the ammunition by, the transferee would violate this chapter), the return of the ammunition to the transferor by the licensee shall not constitute the transfer of ammunition for purposes of this chapter.</text></subparagraph></paragraph><paragraph id="H8CAF3EBFD2DF434C9E5FC65065F9590F" indent="up1"><enum>(2)</enum><text>Paragraph (1) shall not apply to—</text><subparagraph id="H6A43368B66204588AB63E5CFD3599D34"><enum>(A)</enum><text>a law enforcement agency or any law enforcement officer, armed private security professional, or member of the Armed Forces, to the extent the officer, professional, or member is acting within the course and scope of employment and official duties;</text></subparagraph><subparagraph id="H6115AE3B8060497EBFAD21784B98BBEF"><enum>(B)</enum><text>a transfer that is a loan or bona fide gift between spouses, between domestic partners, between parents and their children, between siblings, between aunts or uncles and their nieces or nephews, or between grandparents and their grandchildren;</text></subparagraph><subparagraph id="HC3B066254DD54A1282EB9F1F97A39E96"><enum>(C)</enum><text>a transfer to an executor, administrator, trustee, or personal representative of an estate or a trust that occurs by operation of law upon the death of another person;</text></subparagraph><subparagraph id="H0B1BCBA075D94E0CB0FDBAE97EABAEFB"><enum>(D)</enum><text>a transfer if the transfer is necessary to prevent imminent death or great bodily harm, if the possession by the transferee lasts only as long as immediately necessary to prevent the imminent death or great bodily harm; or</text></subparagraph><subparagraph id="H467B92F1CB3E4221AC1BE707E6C6CD1C"><enum>(E)</enum><text>a transfer, if the transferor has no reason to believe that the transferee will use or intends to use the ammunition in a crime or is prohibited from possessing ammunition under State or Federal law, and the transfer takes place and the transferee’s possession of the ammunition is exclusively—</text><clause id="HA14D0BF4832048B3BEB3B6EE451258B6"><enum>(i)</enum><text>at a shooting range or in a shooting gallery or other area designated for the purpose of target shooting;</text></clause><clause id="HFB80ADF9A7644A8DA39FABAF433C8DFA"><enum>(ii)</enum><text>while reasonably necessary for the purposes of hunting, trapping, or fishing, if the transferor—</text><subclause id="H459798923E11418FA549E92B015537C2"><enum>(I)</enum><text>has no reason to believe that the transferee intends to use the ammunition in a place where it is illegal; and</text></subclause><subclause id="H42DD7CE9BEAC4632B159618C12C1431A"><enum>(II)</enum><text>has reason to believe that the transferee will comply with all licensing and permit requirements for such hunting, trapping, or fishing; or</text></subclause></clause><clause id="H0308AD4E8A674B3A838BAFFA53F78012"><enum>(iii)</enum><text>while in the presence of the transferor.</text></clause></subparagraph></paragraph><paragraph id="H8340734037EA46888FED9D2F90A90BEF" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HEF220E7DFA564F82AF5F99A6B0D95340"><enum>(A)</enum><text>Notwithstanding any other provision of this chapter, the Attorney General may implement this subsection with regulations.</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="ida8f457f7b2df4af49b08011cf54fadd3"><enum>(B)</enum><text>Regulations promulgated under this paragraph may not include any provision—</text><clause commented="no" display-inline="no-display-inline" id="idbc3cc121da4b46c795c7e4e15374c8db"><enum>(i)</enum><text display-inline="yes-display-inline">requiring licensees to facilitate transfers in accordance with paragraph (1);</text></clause><clause commented="no" display-inline="no-display-inline" id="id9435b98c7cce4607804a3d90269f0204"><enum>(ii)</enum><text display-inline="yes-display-inline">requiring persons not licensed under this chapter to keep records of background checks of ammunition transfers; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id27b551aecab049fca5d5c83d71a241da"><enum>(iii)</enum><text display-inline="yes-display-inline">limiting the amount of any fee a licensee may charge to facilitate transfers in accordance with paragraph (1).</text></clause></subparagraph></paragraph><paragraph id="H63C433E5341649CB9A8B1C9DB10A4F2A" indent="up1" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>It shall be unlawful for a licensed importer, licensed manufacturer, or licensed dealer to transfer possession of ammunition to another person who is not so licensed unless the importer, manufacturer, or dealer has provided such other person with a notice of the prohibition under paragraph (1), and such other person has certified that such other person has been provided with this notice on a form prescribed by the Attorney General.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HD88B4CC4D7CB430FADE74B0151D0C51D"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph id="H62415AEB61B44C31B3B3065669C624D2"><enum>(1)</enum><header>United States Code</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id578ab86867b640319288b51229bc506d"><enum>(A)</enum><text display-inline="yes-display-inline">in section 922(y)(2), in the matter preceding subparagraph (A), by striking <quote>, (g)(5)(B), and (s)(3)(B)(v)(II)</quote> and inserting <quote>and (g)(5)(B)</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id85c6083fbf1f4ebc938f1631742ad07d"><enum>(B)</enum><text>in section 925A, in the matter preceding paragraph (1), by striking <quote>subsection (s) or (t) of section 922</quote> and inserting <quote>section 922(s)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddfc09d63257e42ea8670bf11c0b95751"><enum>(C)</enum><text display-inline="yes-display-inline">in section 925B—</text><clause commented="no" display-inline="no-display-inline" id="id8308f0a0f3ea43289e5dba8541810864"><enum>(i)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>922(t)</quote> and inserting <quote>922(s)</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id278f952cc1bf4ccb9ad15f4939ee2d48"><enum>(ii)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>922(t) of title 18, United States Code</quote> and inserting <quote>922(s)</quote>.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7974a31a843841afb192b7cf55d68947"><enum>(2)</enum><header>Brady Handgun Violence Prevention Act</header><text display-inline="yes-display-inline">Section 103(l) of the Brady Handgun Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901(l)</external-xref>) is amended, in the matter preceding paragraph (1), by striking <quote>(t)</quote> and inserting <quote>(s)</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id84c0c02195b54ccd91a0d481c1a7ce0d"><enum>(3)</enum><header>NICS Improvement Amendments Act of 2007</header><text>Section 103(f) of the NICS Improvement Amendments Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/34/40913">34 U.S.C. 40913(f)</external-xref>) is amended by striking <quote>922(t)</quote> and inserting <quote>922(s)</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9f0b546e566c457b92a9478b06ecf2fa"><enum>(4)</enum><header>Consolidated and further continuing appropriations act, 2012</header><text>Section 511 of title V of division B of the Consolidated and Further Continuing Appropriations Act, 2012 (<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901</external-xref> note) is amended by striking <quote>subsection 922(t)</quote> each place it appears and inserting <quote>subsection (s) or (t) of section 922</quote>.</text></paragraph></subsection></section><section id="H35B347568F3E4CEF8C383B61CD0F6678"><enum>4.</enum><header>Rules of construction</header><text display-inline="no-display-inline">Nothing in this Act, or any amendment made by this Act, shall be construed to—</text><paragraph id="H51243B397B1E4B3BB30F86500EA3EE8C"><enum>(1)</enum><text>authorize the establishment, directly or indirectly, of a national firearms or ammunition registry; or</text></paragraph><paragraph id="H84BA0982687C461DA1F2F256B2D6F818"><enum>(2)</enum><text>interfere with the authority of a State, under section 927 of title 18, United States Code, to enact a law on the same subject matter as this Act.</text></paragraph></section><section id="HF4513032155E4FC79ED37995965C9D9B"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on the date that is 180 days after the date of enactment of this Act.</text></section></legis-body></bill>
