which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide paid family and medical leave to Federal employees, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H8AC0AD2A48864130A0F6B86B64213D31"><section commented="no" section-type="section-one" id="HDBFD859480254C4BA288DB2499A6A16D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Comprehensive Paid Leave for Federal Employees Act</short-title></quote>. </text></section><section id="HD6945934228D4D6886D3ED41BAEBF389"><enum>2.</enum><header>Paid family and medical leave for Federal employees covered by title 5</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">Chapter 63</external-xref> of title 5, United States Code, is amended—</text><paragraph commented="no" id="H72A9EAF3B92E436596FDD6FF55F02C54"><enum>(1)</enum><text>in section 6381, by amending paragraph (1)(B) to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="H71ECB95EF1A347FC821AB37EFB866DEB"><subparagraph id="HB60304E37E0348E48BF19E51169A86CF"><enum>(B)</enum><text display-inline="yes-display-inline">has completed at least 12 months of service—</text><clause display-inline="no-display-inline" id="HDED3438DB75B4CB3B06EEC15EAF264D1"><enum>(i)</enum><text display-inline="yes-display-inline">as an employee (as defined in section 2105) of the Government of the United States, including service with the United States Postal Service, the Postal Regulatory Commission, and a nonappropriated fund instrumentality as described in section 2105(c); or</text></clause><clause id="H9B8113523C6445A798624CABA70AE46F"><enum>(ii)</enum><text display-inline="yes-display-inline">on covered active duty as a member of the National Guard or Reserves that interrupts service described in clause (i);</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="H900EB12DDBDD4B3ABC27ABEE04B518EB"><enum>(2)</enum><text>in section 6382—</text><subparagraph commented="no" id="HE421CECE501B48E39DECE6B45011B69C"><enum>(A)</enum><text>in subsection (a)—</text><clause id="HF03EA79001154228BA2717100367EBF3"><enum>(i)</enum><text>in paragraph (1)—</text><subclause id="H01432B55FBE84B19BDF3483A69DF12BE"><enum>(I)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by striking <quote>12 administrative workweeks of leave</quote> and inserting <quote>12 administrative work weeks of leave plus any additional period of leave used under subsection (d)(2)(B)(ii)</quote>; and</text></subclause><subclause id="HAC6C7DACC7344B32BE14EC6DB2562DD3"><enum>(II)</enum><text>in subparagraph (B), by inserting <quote>and in order to care for such son or daughter</quote> before the period;</text></subclause></clause><clause commented="no" id="H4772ABB8B39C427DB732F86AB3A2FC66"><enum>(ii)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" id="H04BCE38F96284D52BFF78563F34738B3"><paragraph commented="no" id="H2758DB92367841B59AFD2D26A9C2FAE2"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H0945BBADD0164287860A7E54F77F8246"><enum>(A)</enum><text>The entitlement to leave under subparagraph (A) or (B) of paragraph (1) shall commence at time of birth or placement of a son or daughter and shall expire at the end of the 12-month period beginning on the date of such birth or placement.</text></subparagraph><subparagraph commented="no" id="HAF41F60FE89A45A58BA887B05DB9DBE0" indent="up1"><enum>(B)</enum><text>Notwithstanding subparagraph (A), the entitlement to leave under paragraph (1)(B) in connection with adoption may commence prior to the placement of the son or daughter to be adopted for activities necessary to allow the adoption to proceed.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" id="H75797DCCECDA49ACBDE44BF829BFD8E8"><enum>(iii)</enum><text>in paragraph (4)—</text><subclause id="H2386104C7A5746E28538C57CDE4FB4E1"><enum>(I)</enum><text>by striking <quote>Subject to subsection (d)(2), during</quote> and inserting <quote>During</quote>; and</text></subclause><subclause id="H5CFBC627C97D4852A33769B7F690B84D"><enum>(II)</enum><text display-inline="yes-display-inline">by inserting <quote>(or 26 administrative workweeks of leave plus any additional period of leave used under subsection (d)(2)(B)(ii))</quote> after <quote>26 administrative workweeks of leave</quote>; and</text></subclause></clause></subparagraph><subparagraph commented="no" id="HFD26D871FF3F4FE7976557175CF1A9B6"><enum>(B)</enum><text>in subsection (d)—</text><clause id="H0B3F517F51E042CA8EFEED4B1389C0B8"><enum>(i)</enum><text>in paragraph (1)—</text><subclause id="HD833324D9B54459BB904DB8CA3394582"><enum>(I)</enum><text>by striking the first sentence; and</text></subclause><subclause id="H7D10AB28095F481DB13FF73128D00895"><enum>(II)</enum><text>by striking <quote>under subchapter I</quote>; and</text></subclause></clause><clause commented="no" id="H6F16A344A99F4A63A2EA0415A5FCF4F2"><enum>(ii)</enum><text>in paragraph (2)—</text><subclause id="H418095B731114D1F8BD04EC762000B8A"><enum>(I)</enum><text>in subparagraph (A), by striking <quote>subparagraph (A) or (B)</quote> and inserting <quote>subparagraph (A) through (E)</quote>;</text></subclause><subclause id="H683EA0C5042342558366A33F7ED6AE54"><enum>(II)</enum><text>by striking <quote>parental</quote> in each instance;</text></subclause><subclause id="H102B754A9A004E368970A8A6C366CE3F"><enum>(III)</enum><text display-inline="yes-display-inline">in subparagraph (B)(i), by striking <quote>birth or placement involved</quote> and inserting <quote>event giving rise to such leave</quote>;</text></subclause><subclause id="HD54C675FF8794D2DA864B217CE753A61"><enum>(IV)</enum><text>by amending subparagraph (E) to read as follows:</text><quoted-block style="OLC" id="HD51866F25D674A59BDE3912C55F2991B"><subparagraph commented="no" id="HFF6502FEF3CA4FD59489EACA324DD969"><enum>(E)</enum><text>Nothing in this paragraph shall be construed to modify the service requirement in section 6381(1)(B).</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subclause><subclause id="H98AFE1B96EA24AE7B06E4882BF9470A6"><enum>(V)</enum><text>in subparagraph (F)(i), by striking <quote>An employee</quote> and inserting <quote>With respect to leave described under subparagraph (A) or (B) of subsection (a)(1), an employee</quote>; and</text></subclause><subclause commented="no" id="H764BE0A8CEFB47BA9943A7466AD1F20C"><enum>(VI)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HFDE4C6F627E94E918FEE721776B6B2AC"><subparagraph commented="no" id="H61C151579ABD45039A5907207199A376"><enum>(H)</enum><text display-inline="yes-display-inline">Notwithstanding paragraph (2)(B)(i), with respect to any employee who received paid leave for an event giving rise to such leave under any other provision of law and who becomes subject to this section during the period of eligibility for paid leave under this section with respect to such event, any paid leave for such event provided by this section shall be reduced by the total number of days of paid leave taken by such employee under such other provision of law.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subclause></clause></subparagraph></paragraph></section><section commented="no" id="H476CB60B4DF04301B3BE2ECE80DBBBF1"><enum>3.</enum><header>Congressional employees under the Congressional Accountability Act of 1995</header><text display-inline="no-display-inline">Section 202 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1312">2 U.S.C. 1312</external-xref>), is amended—</text><paragraph commented="no" id="H753E8AA675CE4223B4A3FD3063EFF1D7"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph commented="no" id="HC8DA656404F440A1945289207EE94BAA"><enum>(A)</enum><text>paragraph (1)—</text><clause id="H7E9A3068763A45B3A3D3BC9AB4723466"><enum>(i)</enum><text>in the second sentence—</text><subclause id="H6A98FD96E29545D5B090D0EC48DAEBC5"><enum>(I)</enum><text>by striking <quote>subsection (a)(1)(A) or (B)</quote> and inserting <quote>under any of subparagraphs (A) through (E) of subsection (a)(1)</quote>; and</text></subclause><subclause id="H407D2C0C9CF348E6914166D9969F6F67"><enum>(II)</enum><text display-inline="yes-display-inline">by inserting <quote>and in the case of leave that includes leave for such an event, the period of leave to which a covered employee is entitled under section 102(a)(1) of such Act shall be 12 administrative workweeks of leave plus any additional period of leave used under subsection (d)(2)(B) of this section</quote> before the period; and</text></subclause></clause><clause id="HB90A4E78082E4EDBB29730DCE0A76A9E"><enum>(ii)</enum><text>by striking the third sentence and inserting the following: <quote>For purposes of applying section 102(a)(4) of such Act, in the case of leave that includes leave under any of subparagraphs (A) through (E) of section 102(a)(1) of such Act, a covered employee is entitled, under paragraphs (1) and (3) of section 102(a) of such Act, to a combined total of 26 workweeks of leave plus any additional period of leave used under subsection (d)(2)(B) of this section.</quote>; and</text></clause></subparagraph><subparagraph commented="no" id="H35EDC8CB50A142E18C22D674773E0755"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by amending subparagraph (B) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE93C08EAC3D14E6CB8F37F1115BBC7DD"><subparagraph commented="no" id="HE91F8E89189D4B379D914D673A68DB08"><enum>(B)</enum><text display-inline="yes-display-inline">except for leave described under section 102(a)(3) of such Act, the term <term>eligible employee</term> as used in that Act means a covered employee.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="HF1B543C9CAA0448A983AD589074014A5"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph commented="no" id="HDC9025C2142C4A579FF1B0188DC49835"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">parental leave</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">family and medical leave</header-in-text></quote>;</text></subparagraph><subparagraph commented="no" id="HC377FC38F12D46A985F2475BE7A50E2A"><enum>(B)</enum><text>in paragraph (1), by striking <quote>subparagraph (A) or (B)</quote> and inserting <quote>any of subparagraphs (A) through (E)</quote>; </text></subparagraph><subparagraph id="H83626F05B82641B0B8488DA972213F8C"><enum>(C)</enum><text>by striking <quote>parental</quote> each place the term appears; and </text></subparagraph><subparagraph commented="no" id="H36CCF4A887E24AFE9EECA81BE18C30A7"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (2)(A), by striking <quote>birth or placement involved</quote> and inserting <quote>event giving rise to such leave</quote>.</text></subparagraph></paragraph></section><section commented="no" id="HADE67DAF1C9B4A8E9497944D4B54D755"><enum>4.</enum><header>GAO, Library of Congress, Postal Service, and Postal Regulatory Commission employees</header><text display-inline="no-display-inline">The Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612</external-xref>), is amended—</text><paragraph commented="no" id="HC6D5AE818C3343F1B2E7BEEBD824824C"><enum>(1)</enum><text display-inline="yes-display-inline">in section 101(2)(E)—</text><subparagraph id="HF67DA327E5884D29891D93A674ED907D"><enum>(A)</enum><text>in the subparagraph heading, by inserting <quote><header-in-text level="subparagraph" style="OLC">USPS, and Postal Regulatory Commission</header-in-text></quote> after <quote><header-in-text level="subparagraph" style="OLC">GAO</header-in-text></quote>;</text></subparagraph><subparagraph id="HE17BADB6F4104F0480BFBF77660B00ED"><enum>(B)</enum><text>by inserting <quote>the United States Postal Service, or the Postal Regulatory Commission</quote> after <quote>Government Accountability Office</quote>; and </text></subparagraph><subparagraph commented="no" id="H4E86C6056B72489DB4C83D9E1281C2F3"><enum>(C)</enum><text>by striking <quote>section 102(a)(1)(A) or (B)</quote> and inserting <quote>any of subparagraphs (A) through (E) of section 102(a)(1)</quote>; </text></subparagraph></paragraph><paragraph id="HB3FE79479B1341EDBBB200CAB1F3FD3E"><enum>(2)</enum><text>in section 102(d)(3)—</text><subparagraph id="H81864E55536B480987F955E15E1D205A"><enum>(A)</enum><text>in the paragraph heading, by inserting <quote><header-in-text level="paragraph" style="OLC">USPS, and Postal Regulatory Commission</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">GAO</header-in-text></quote>; </text></subparagraph><subparagraph id="H3B0E3F3D2DC843518CCE882AFECD4C75"><enum>(B)</enum><text>by striking <quote>the Government Accountability Office</quote> and inserting <quote>the Government Accountability Office, the United States Postal Service, or the Postal Regulatory Commission</quote> each place the term appears;</text></subparagraph><subparagraph id="HF5442D64339F4332AC74D26F9044D2B2"><enum>(C)</enum><text>by striking <quote>parental</quote> and inserting <quote>family and medical</quote> each place the term appears; </text></subparagraph><subparagraph id="H86118F1B081F472B805EAD1B8CA3DB73"><enum>(D)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>subparagraph (A) or (B)</quote> and inserting <quote>subparagraphs (A) through (E)</quote>; and</text></subparagraph><subparagraph id="H328C41383FA74F8E9BCB60B8DB9BC85D"><enum>(E)</enum><text display-inline="yes-display-inline">in subparagraph (B)(i), by striking <quote>birth or placement involved</quote> and inserting <quote>event giving rise to such leave</quote>; and</text></subparagraph></paragraph><paragraph id="H98A566A89546400D8B25CBD9BE3C168A" commented="no"><enum>(3)</enum><text>by adding at the end of section 102(a) the following:</text><quoted-block style="OLC" id="H9565B5BE07544C868DE05973DA88FA85"><paragraph id="H0436A00763364360B1345A7CFB656102" commented="no"><enum>(6)</enum><header>Special rules on period of leave</header><text>With respect to an employee of the Government Accountability Office, the Library of Congress, the United States Postal Service, or the Postal Regulatory Commission—</text><subparagraph id="H712AA740FAAD4423AA2AAF0B82ED0789" commented="no"><enum>(A)</enum><text>in the case of leave that includes leave under subparagraph (A) through (E) of paragraph (1), the employee shall be entitled to 12 administrative workweeks of leave plus any additional period of leave used under subsection (d)(3)(B)(ii) of this section or section 202(d)(2)(B) of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1312">2 U.S.C. 1312(d)(2)(B)</external-xref>), as the case may be;</text></subparagraph><subparagraph id="H5BBB87961452448FA1B6AD128E5367C3" commented="no"><enum>(B)</enum><text>for the purposes of paragraph (4), the employee is entitled, under paragraphs (1) and (3), to a combined total of 26 workweeks of leave plus, if applicable, any additional period of leave used under subsection (d)(3)(B)(ii) of this section or section 202(d)(2)(B) of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1312">2 U.S.C. 1312(d)(2)(B)</external-xref>), as the case may be; and</text></subparagraph><subparagraph id="H65905F4F59A34E779F73F69C1823BFFF" commented="no"><enum>(C)</enum><text>the entitlement to leave under paragraph (1)(B) in connection with adoption may commence prior to the placement of the son or daughter to be adopted for activities necessary to allow the adoption to proceed.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H37CCF7A90D6B4066BC6379E5539BECFF"><enum>5.</enum><header>Employees of the Executive Office of the President</header><text display-inline="no-display-inline">Section 412 of title 3, United States Code, is amended—</text><paragraph commented="no" id="H103BF3A839B346F5B84B8AA7AEC9B776"><enum>(1)</enum><text>in subsection (a)(3), by striking <quote>or (B)</quote> and inserting <quote>through (E)</quote>; and</text></paragraph><paragraph id="H8B08E40562BB4D0EB739BFE76B208136"><enum>(2)</enum><text>in subsection (c), by striking <quote>or (B)</quote> and inserting <quote>through (E)</quote> each place the term appears.</text></paragraph></section><section id="H9B88C2E1F5CF47B4B395D3240111D6C7"><enum>6.</enum><header>FAA and TSA employees</header><text display-inline="no-display-inline">Section 40122(g)(5) of title 49, United States Code, is amended—</text><paragraph id="H82CDD4E7224247CF9882DBFB0B522C49"><enum>(1)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="USC">parental</header-in-text></quote>; and</text></paragraph><paragraph id="HC4F63B9D1C41448282DF6DE0A4AEA06C"><enum>(2)</enum><text>by striking <quote>parental</quote> in each instance. </text></paragraph></section><section id="H7BBDD00786BD40BA92E74DBA0B9BACC8"><enum>7.</enum><header>Title 38 employees</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, the Secretary of Veterans Affairs shall modify the family and medical leave program provided by operation of section 7425(c) of title 38, United States Code, to conform with this Act and the amendments made by this Act. </text></section><section id="H7116EF9E6DBA4FEDA6ABE13759A6E3C4"><enum>8.</enum><header>District of Columbia courts and District of Columbia public defender service</header><subsection id="HF07AD62505C5400083AE83AF38AC8D1C"><enum>(a)</enum><header>District of Columbia courts</header><text>Subsection (d) of section 11–1726, District of Columbia Official Code, is amended to read as follows:</text><quoted-block style="OLC" id="HBDEC6E20624A4EE19B2B4FB961E12DEF"><subsection id="H2A7B945206DF4D858DBCD69C8698E3FC"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id3D3DEFDEF15E4C5C999C2A16361E9046"><enum>(1)</enum><text display-inline="yes-display-inline">In carrying out the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2601">29 U.S.C. 2601 et seq.</external-xref>) with respect to nonjudicial employees of the District of Columbia courts, the Joint Committee shall, notwithstanding any provision of such Act, establish a paid family and medical leave program for the leave described in subparagraphs (A) through (E) of section 102(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>). </text></paragraph><paragraph id="id97EDD87947534BC59E743797BE4728A3" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In developing the terms and conditions for the paid family and medical leave program under paragraph (1), the Joint Committee may be guided by the terms and conditions applicable to the provision of paid family and medical leave for employees of the Federal Government under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code, and any corresponding regulations.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H85CF9FCA469241DAB9DC20CFCCB87642"><enum>(b)</enum><header>District of Columbia public defender service</header><text>Subsection (d) of section 305 of the District of Columbia Court Reform and Criminal Procedure Act of 1970 (sec. 21605, D.C. Official Code) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H616EFA41D53B4624853137E34D388019"><subsection id="H2AA91D257AD54D3D8FEC985010C47ACD"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id5EB0065C2CB043DB8547968EB0A20C81"><enum>(1)</enum><text display-inline="yes-display-inline">In carrying out the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2601">29 U.S.C. 2601 et seq.</external-xref>) with respect to employees of the Service, the Director shall, notwithstanding any provision of such Act, establish a paid family and medical leave program for the leave described in subparagraphs (A) through (E) of section 102(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>). </text></paragraph><paragraph id="idC5AB3363F32F4F9691FFC0856A6E69DF" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In developing the terms and conditions for the paid family and medical leave program under paragraph (1), the Director may be guided by the terms and conditions applicable to the provision of paid family and medical leave for employees of the Federal Government under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code, and any corresponding regulations.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
