which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide mandatory funding for hazardous fuels reduction projects on certain Federal land, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idA4BF629AE6C84416ADB33A64EC05C311"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wildfire Resilient Communities Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id8744E62DB33C4515A91C8A72F879956E"><enum>2.</enum><header>Funding for hazardous fuels reduction projects on certain Federal land</header><subsection id="idBC9E93F53E8A483BA838C8AE3D27992E"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idCC64A90336934691ABE24D9F5C810B07"><enum>(1)</enum><header>Agency head</header><text>The term <quote>agency head</quote> means—</text><subparagraph id="id592AFBF529F6411D80071ACE413C996B"><enum>(A)</enum><text>the Director of the National Park Service;</text></subparagraph><subparagraph id="id68773e78077a4014a767a44520a5633c"><enum>(B)</enum><text>the Chief of the Forest Service;</text></subparagraph><subparagraph id="ida309416403ba4c75a4d666cb465e1e26"><enum>(C)</enum><text>the Director of the Bureau of Land Management; </text></subparagraph><subparagraph id="idb68b0c5e0447470f845050fe9b7049eb"><enum>(D)</enum><text>the Director of the United States Fish and Wildlife Service; and</text></subparagraph><subparagraph id="id256EAC482B8B4F6BB52F1B009F80312F"><enum>(E)</enum><text>the Director of the Bureau of Indian Affairs.</text></subparagraph></paragraph><paragraph id="id9C81BECD07F54ECE91E41315B1AEE0EC"><enum>(2)</enum><header>At-risk community; fire regime I; fire regime II; fire regime III</header><text>The terms <term>at-risk community</term>, <term>fire regime I</term>, <term>fire regime II</term>, and <term>fire regime III</term> have the meanings given those terms in section 101 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>).</text></paragraph><paragraph id="id73B5A9F777D6418A8124674DD6A532D5"><enum>(3)</enum><header>Covered land</header><text>The term <quote>covered land</quote> means Federal land under the jurisdiction of the applicable agency head.</text></paragraph><paragraph id="id2B4692DA4554490B834A50177C8F764D"><enum>(4)</enum><header>Hazardous fuels reduction project</header><text>The term <term>hazardous fuels reduction project</term> means the removal or modification of flammable vegetation or woody debris through prescribed fire, thinning, brush removal, mastication, pruning, slash treatment, or a combination of those methods, on the condition that the method is ecologically appropriate, cost-effective, and selected on a site-specific basis.</text></paragraph></subsection><subsection id="idFC0D516A51FF465DAC6CA2EE7BE10547"><enum>(b)</enum><header>Hazardous fuels reduction projects</header><paragraph id="idFB551929DDAF45DEB2FC69E688D6F072"><enum>(1)</enum><header>In general</header><text>The agency heads shall carry out hazardous fuels reduction projects on covered land.</text></paragraph><paragraph id="idb665309413764a3e9114c890913078a6"><enum>(2)</enum><header>Project priorities</header><text>In carrying out paragraph (1), the agency heads shall prioritize hazardous fuels reduction projects that are—</text><subparagraph id="id373da1d466c2493b9e3bcfd19b13847c"><enum>(A)</enum><text>conducted in areas that—</text><clause id="id5f4eb6599e34490f8c2921be58f1fed9"><enum>(i)</enum><text>are within or adjacent to—</text><subclause id="id177d6576c8ca44a19dd60954b991d642"><enum>(I)</enum><text>at-risk communities; or</text></subclause><subclause id="id10a3891b60034737934b9bd6499b0f6c"><enum>(II)</enum><text>high-value watersheds;</text></subclause></clause><clause id="id7498eb83376b4f80b198a2f563f27e4b"><enum>(ii)</enum><text>have very high wildfire hazard potential; or</text></clause><clause id="idab2598d242bb4ebda6e75063864fd169"><enum>(iii)</enum><text>are in fire regime I, fire regime II, or fire regime III; or</text></clause></subparagraph><subparagraph id="idcbdbb885771a45eaac606bf0d01e5f8d"><enum>(B)</enum><text>designed to integrate and simultaneously advance 2 or more of the goals established in the report of the Secretary of Agriculture and the Secretary of the Interior entitled <quote>The National Strategy: the Final Phase of the Development of the National Cohesive Wildland Fire Management Strategy</quote> and dated April 2014 and the update entitled <quote>National Cohesive Wildland Fire Management Strategy Addendum Update</quote> and dated January 2023— </text><clause id="ida97db12e223446629ad9dce9e82d173e"><enum>(i)</enum><text>to create fire-adapted communities;</text></clause><clause id="id2626db8c2f8f4a209df9d2edc7b8c887"><enum>(ii)</enum><text>to restore and maintain resilient landscapes; and</text></clause><clause id="idaad1374b3ae7406f87d867c4297d1793"><enum>(iii)</enum><text>to achieve safe, effective fire response.</text></clause></subparagraph></paragraph></subsection><subsection id="idE8B66FB984954BA2A9EB14A3443B1E3F"><enum>(c)</enum><header>Funding</header><paragraph id="idB23A6E735C054F3B9204016DC3C00EA1"><enum>(1)</enum><header>In general</header><text>On the first October 1 following the date of enactment of this Act, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the agency heads, in accordance with an allocation formula established by the Secretary of the Treasury, $30,000,000,000, to remain available until expended.</text></paragraph><paragraph id="IDDDDB9AFAA4B2435EB9C6E3EA8D700BC2"><enum>(2)</enum><header>Receipt and acceptance</header><text>The agency heads shall be entitled to receive, shall accept, and shall use to carry out this section the funds transferred under paragraph (1), without further appropriation.</text></paragraph><paragraph id="id172e6b1dde924e5b8b807aca4d49df43"><enum>(3)</enum><header>Administrative and planning costs</header><text>Not more than 10 percent of funding made available under paragraph (1) may be used for administrative and planning costs.</text></paragraph></subsection></section><section id="idddf7b016bdee46d496bdd99a8860aa23"><enum>3.</enum><header>Additional amounts for community wildfire defense grant program</header><text display-inline="no-display-inline">In addition to amounts made available to the Secretary of Agriculture under section 40803(c)(12) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6592">16 U.S.C. 6592(c)(12)</external-xref>), there is authorized to be appropriated to the Secretary of Agriculture to carry out section 40803(f) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6592">16 U.S.C. 6592(f)</external-xref>) $3,000,000,000 for the period of fiscal years 2027 through 2031.</text></section><section id="id1b534b94fb364d5b9be0ba486721bcbd"><enum>4.</enum><header>Collaborative Forest Landscape Restoration Program reauthorization</header><text display-inline="no-display-inline">Section 4003 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/16/7303">16 U.S.C. 7303</external-xref>) is amended—</text><paragraph id="idDA1BFBD85C7049C5ABFF55B2BBEC8F58"><enum>(1)</enum><text>in subsection (b)(3)—</text><subparagraph id="idDE27B1A38F6140E0A8B9FEEF3E0DED28"><enum>(A)</enum><text>in subparagraph (D), by striking <quote>species;</quote> and inserting <quote>species or pathogens;</quote>;</text></subparagraph><subparagraph id="id18D5540822FE4B1CA56EB905DCDF9D2C"><enum>(B)</enum><text>in subparagraph (G), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id64B7AC82EA8F40DAA4822C764638BEA3"><enum>(C)</enum><text>in subparagraph (H), by adding <quote>and</quote> after the semicolon at the end; and</text></subparagraph><subparagraph id="id4453FD6634CC4943828F09F2157D8E16"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA51E28AAC42F4A069BEFFB8A316DBDBE"><subparagraph id="idFDC9BE233AA24DB58FF5B316FF6D0231"><enum>(I)</enum><text>address standardized monitoring questions and indicators;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idA472453E13E3477E81E299A570BC6588"><enum>(2)</enum><text>in subsection (c)(3)(A)—</text><subparagraph id="id89A7F3F41839439AAFDDA534F67FBEE7"><enum>(A)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id8A364FA6F38A46D6910D6EDC0F416868"><enum>(B)</enum><text>in clause (ii), by adding <quote>and</quote> at the end; and</text></subparagraph><subparagraph id="idAEF3829BD57141E3936CAB69D90C9457"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4C89187448EC4C6BB96A3564D270BF97"><clause id="id259F42D368DB49C9B023E3F5773375F1"><enum>(iii)</enum><text>include a Federal Government staffing plan for providing support to collaborative processes established pursuant to subsection (b)(2);</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idA3BA1632DBA04957AF21B6D333AD2154"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph id="idD046460AAE8D4ABA9BDAFE29BDFAD6CA"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="idD631423127DF4E2B855347FF30A5B3B1"><enum>(i)</enum><text>in subparagraph (E), by striking <quote>and</quote> at the end;</text></clause><clause id="idF3231C84340C468A95D42748291D5802"><enum>(ii)</enum><text>in subparagraph (F), by striking the period at the end and inserting a semicolon; and</text></clause><clause id="idA19431A8F4F948DD8EC9610CE5552D18"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB13244E6143944E485AC6E81C3861DC5"><subparagraph id="id253d3cdb11214e168da533f420588aec"><enum>(G)</enum><text>whether the proposal seeks to use innovative implementation mechanisms, including conservation finance agreements, good neighbor agreements entered into under section 8206 of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/16/2113a">16 U.S.C. 2113a</external-xref>), and similar implementation mechanisms;</text></subparagraph><subparagraph id="id68fadca996114cd4999f55ea1da9ceb4"><enum>(H)</enum><text>whether the proposal seeks to reduce the risk of uncharacteristic wildfire or increase ecological restoration activities—</text><clause id="idE86A1ABDCA35406CBFBED59D4CC58970"><enum>(i)</enum><text>within areas across land ownerships, including State, Tribal, and private land; and</text></clause><clause id="id3EE8CCEAD1F6402098C5CA006A4D3AB3"><enum>(ii)</enum><text>within the wildland-urban interface; and</text></clause></subparagraph><subparagraph id="idad8168a8ca1b45f1b92e3f0a4d10c768"><enum>(I)</enum><text>whether the proposal seeks to enhance watershed health and drinking water sources.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id6C9FEA038E7E4511ABCED58140C5CCBB"><enum>(B)</enum><text>in paragraph (3)—</text><clause id="id9E531A53280743AE9D7C8251EC020D52"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>10</quote> and inserting <quote>20</quote>; and</text></clause><clause id="idB25C965BFE454800A6EEE6914386BF4A"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>2</quote> and inserting <quote>4</quote>;</text></clause></subparagraph></paragraph><paragraph id="idA3A3903DE9C74217AA6DE9478E57B581"><enum>(4)</enum><text>in subsection (e)(3), by inserting <quote>conflict resolution or collaborative governance,</quote> before <quote>and woody</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id06b6bddba1934a729d3bc667b1bcdd40"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (f)(6), by striking <quote>$80,000,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$100,000,000 for fiscal year 2024 and each fiscal year thereafter</quote>.</text></paragraph></section><section id="idAA504781C67D43ACBF5992CD0FF520AC"><enum>5.</enum><header>County Stewardship Fund</header><text display-inline="no-display-inline">Section 604 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6591c">16 U.S.C. 6591c</external-xref>) is amended—</text><paragraph id="id1D81BA11C08F4CC68A008AC78AED7DDD"><enum>(1)</enum><text>by redesignating subsection (j) as subsection (k); and</text></paragraph><paragraph id="idBA737B8DCEAF44CABA5F4407DE180BF0"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (i) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id348A3D980036495E8AD88061394C203E"><subsection id="id12af7a54fafa49c4b808660f8baf5047"><enum>(j)</enum><header>County Stewardship Fund</header><paragraph id="id980BD556A531491E86DC0BC0CEFBB7B3"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury of the United States a fund to be known as the <quote>County Stewardship Fund</quote> (referred to in this section as the <quote>Fund</quote>), to be administered by the Secretary.</text></paragraph><paragraph id="id5B06CCC97D0D4BFCA7CED612507E80AB"><enum>(2)</enum><header>Deposits</header><text>Each fiscal year, an amount equal to 25 percent of the amounts collected as receipts under subsection (e) during the preceding fiscal year shall be deposited in the Fund.</text></paragraph><paragraph id="id6C065F2DFC0441CFA09C2A94ED38AFBC"><enum>(3)</enum><header>Availability</header><text>Amounts in the Fund shall—</text><subparagraph id="idCE2218F4D22A4A739AFF25D1363DE76A"><enum>(A)</enum><text>be used only for purposes described in paragraph (4); and</text></subparagraph><subparagraph commented="no" id="id5FBB9D17AC7B48DF991E66C88D3CD367"><enum>(B)</enum><text>remain available until expended.</text></subparagraph></paragraph><paragraph commented="no" id="id01F0C5F5392746BE831A58838520A060"><enum>(4)</enum><header>Purposes</header><subparagraph commented="no" id="id82AC3B5D78DA48AAB05F56EE0247BAE7"><enum>(A)</enum><header>In general</header><text>Each fiscal year, the Chief or the Director, as applicable, shall distribute from amounts in the Fund to each county in which a contract under subsection (b) was carried out on Federal land in the county during the preceding fiscal year a payment of an amount equal to 25 percent of the receipts generated from that contract.</text></subparagraph><subparagraph commented="no" id="id6E138B90B82946D7916E3FB38122D971"><enum>(B)</enum><header>Use of funds</header><text>A county receiving a payment under subparagraph (A) may use the payment for any governmental purposes.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
