amend the Small Business Act regarding Federal contract requirements.</official-title></form><legis-body><section id="idbc4b804d54c14a54bdc8d436ae4cfee7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accountability and Clarity in Contracts to Engage Small Suppliers and Small Businesses Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id5df93e74cd5645d6960bbab15df221cc"><enum>2.</enum><header>Small Business Industrial Base Federal Contracting Matters</header><subsection commented="no" display-inline="no-display-inline" id="id6b1d2d8b9252411a839d54dd3acb94a4"><enum>(a)</enum><header>Accessibility and Clarity in Small Business Contracts</header><paragraph id="ide403c00aad4b4da4a13b77705cc7581a"><enum>(1)</enum><header>Definitions</header><text>In this section—</text><subparagraph id="idddc7dc5919ca46249a98adf4ba4c15bf"><enum>(A)</enum><text>the term <term>covered notice</term> means a notice pertaining to small business concerns, such as a sources sought notice or solicitation restricted to competition among small business concerns or covered small business concerns, published by a Federal agency on SAM.gov or any successor website marketing Federal contract opportunities;</text></subparagraph><subparagraph id="id84bec2effe154dbc913473bfc0fa595f"><enum>(B)</enum><text>the term <term>covered small business concern</term> means—</text><clause id="idabbcdc3755e7418eb3315750b5fc9230"><enum>(i)</enum><text>a small business concern owned and controlled by women, a small business concern owned and controlled by veterans, a small business concern owned and controlled by service-disabled veterans, or a qualified HUBZone small business concern, as those terms are defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>); and</text></clause><clause id="idf07d8b313ae54b3e803f57642cfbd53b"><enum>(ii)</enum><text>a socially and economically disadvantaged small business concern, as defined in section 8(a)(4)(A) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(a)(4)(A)</external-xref>); and</text></clause></subparagraph><subparagraph id="id374c25eb600148c19ef8f34082a78204"><enum>(C)</enum><text>the terms <quote>Federal agency</quote> and <quote>small business concern</quote> have the meanings given those terms in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></subparagraph></paragraph><paragraph id="id6b33c75ca66746ba94bc2acada92dc49"><enum>(2)</enum><header>Inclusion of key words in notices for small business contract actions</header><text>Each covered notice shall, to the maximum extent practicable, include key words and contract requirements in the title or description of the covered notice such that small business concerns seeking contract opportunities using the search function of SAM.gov or any successor website can easily identify and understand those opportunities.</text></paragraph><paragraph id="idb5e245b8cf734e0696340039c54cf12a"><enum>(3)</enum><header>Plain language</header><subparagraph commented="no" display-inline="no-display-inline" id="id4b95bd702ab94d439f4116419e0ac9ca"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each covered notice shall be written in a manner that is clear, concise, and accessible to the reader such that a small business concern can easily understand the intent of the Federal agency.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id65d99ccd4bcd4d65a302c927145b36c6"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">If the covered notice cannot meet the requirement under subparagraph (A) due to requirements applicable to the covered notice from regulation or law, the Federal agency shall include with the covered notice a cover page adequately summarizing the contents of the covered notice, written in a clear, concise, and accessible manner, such that a small business concern can easily understand the intent of the Federal agency. </text></subparagraph></paragraph><paragraph id="id740fb64099aa43838a3f3b6c95f4b3f1"><enum>(4)</enum><header>Attachments</header><text>A Federal agency may not meet the requirement in paragraph (2) by only including key words and contract requirements in a document that is attached to the covered notice.</text></paragraph><paragraph id="id6d4783a902644da8a06eb74ab0ee77a5" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Rulemaking</header><text>Not later than 90 days after the date of enactment of this Act, the Administrator of the Small Business Administration shall promulgate regulations to carry out this section.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9c490630873a48068cc3129627985612"><enum>(b)</enum><header display-inline="yes-display-inline">Prioritizing Engaging More Small Businesses in Federal Procurement</header><paragraph commented="no" display-inline="no-display-inline" id="id536c6bb4b50c4ae997f96d868116054b"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 15 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id91294ffa3a3444e9a6d242c31ce68f07"><enum>(A)</enum><text>in subsection (g)—</text><clause commented="no" display-inline="no-display-inline" id="id5fc205a86d6d4995834f11ad3c4d3435"><enum>(i)</enum><text>by inserting after <quote>(g)</quote> the following: <quote><header-in-text style="OLC" level="subsection">Goals for participation of small business concerns in procurement contracts</header-in-text>.—</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida83d5266c3544752aa77c46974053312"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (1)— </text><subclause commented="no" display-inline="no-display-inline" id="ideced428f480a45c8a2e550088d00e9f9"><enum>(I)</enum><text display-inline="yes-display-inline">in subparagraph (A)(i), by striking the second sentence; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id94ef152f804c4d268ff528bca0b2909c"><enum>(II)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA45471F893D042019B4C3C10CA17871B"><subparagraph commented="no" display-inline="no-display-inline" id="id4b0cf2be92b349f790f5f5ff5af9c37a"><enum>(C)</enum><header>Requirement</header><text>In meeting each of the goals under subparagraph (A), the Government shall ensure the participation of a broad spectrum of small business concerns from a wide variety of industries.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd9f783fdbbba460eac8a940f73c7a0a8"><enum>(B)</enum><text>in subsection (h)(1)—</text><clause commented="no" display-inline="no-display-inline" id="id2db980d63f474de1bfa2e6dc6fb8a347"><enum>(i)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end;</text></clause><clause commented="no" display-inline="no-display-inline" id="id5e312a9c0bc1427e8f057c80284fde38"><enum>(ii)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id46cd23b9740241bd82a57dabe17c7688"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id69429DB82C2E4ADCA270B885E0D3486B"><subparagraph commented="no" display-inline="no-display-inline" id="id3a9677895734460f9d819dd33fe075d1"><enum>(E)</enum><text>the information described in clauses (ii) through (iv) of subsection (y)(2)(B).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id676a03fff04d410eab0f9e1cda3b8ccb"><enum>(C)</enum><text>in subsection (y)—</text><clause commented="no" display-inline="no-display-inline" id="id56faede8ab93495fa9e12550eb9265e9"><enum>(i)</enum><text>in paragraph (2)—</text><subclause id="id09befb7aa5d54ad6933a4d6746c9c8d4"><enum>(I)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and adjusting the margins accordingly;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3362e77f1be44f459491bb9649488708"><enum>(II)</enum><text>by inserting before clause (i), as so redesignated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC4991147CA2F424EBD1F1CFC46B2F18B"><subparagraph commented="no" display-inline="no-display-inline" id="idadc98c4adbc54f69b3c99541690aad4b"><enum>(A)</enum><header>Goals</header></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause><subclause id="id6d9bbfb2f792473b8c486552ba9cec52"><enum>(III)</enum><text>in clause (i), as so redesignated, by inserting <quote><header-in-text style="OLC" level="clause">Prime contract goals</header-in-text>.—</quote> before <quote>A determination</quote>;</text></subclause><subclause id="id0ab2a45f6de84e3d9bbae601e2e30d27"><enum>(IV)</enum><text>in clause (ii), as so redesignated, by inserting <quote><header-in-text style="OLC" level="clause">Subcontract goals</header-in-text>.—</quote> before <quote>A determination</quote>;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0204c976e6b948b2a981164f340daad8"><enum>(V)</enum><text>by striking subparagraphs (C) and (D) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD14E6F3A591746469C4E05275BCAA8BB"><subparagraph commented="no" display-inline="no-display-inline" id="idc4e3d810b4ab4b53a0f4d266226a9175"><enum>(B)</enum><header>Composition of the small business industrial base</header><clause commented="no" display-inline="no-display-inline" id="id2a65381a9c58480bab034b8ce11a63ee"><enum>(i)</enum><header>Total number of small business concerns</header><text>The number of small business concerns, small business concerns owned and controlled by service-disabled veterans, qualified HUBZone small business concerns, small business concerns owned and controlled by socially and economically disadvantaged individuals, and small business concerns owned and controlled by women—</text><subclause commented="no" display-inline="no-display-inline" id="id390fc4eb56c545bba512e5e989129307"><enum>(I)</enum><text display-inline="yes-display-inline">awarded prime contracts during the fiscal year compared to the prior fiscal year, including a breakdown by North American Industry Classification System code, if available; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7689a2802b9d402a8f767c41812ec381"><enum>(II)</enum><text display-inline="yes-display-inline">awarded subcontracts during the fiscal year compared to the prior fiscal year, including a breakdown by North American Industry Classification System code, if available.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idbc4a085869e4436aad884d84d8abfea2"><enum>(ii)</enum><header>Maturity of small business concerns</header><text display-inline="yes-display-inline">A breakdown of the number of new small business entrants, recent small business entrants, and established small business concerns awarded prime contracts or subcontracts during the fiscal year, including a breakdown of such entities that are small business concerns owned and controlled by service-disabled veterans, qualified HUBZone small business concerns, small business concerns owned and controlled by socially and economically disadvantaged individuals, and small business concerns owned and controlled by women.</text></clause><clause id="idc4ca9621b8ae4d81a06c66ae09d5a1fb"><enum>(iii)</enum><header>Dollar distribution among small business concerns</header><text>The total dollar value of prime contract awards for the top 20 small business concerns that received the most Federal procurement funding in the fiscal year, compared to the combined total dollar value for the remaining small business concerns, and a comparison of that data with the prior fiscal year.</text></clause><clause id="id8daae148387948a2bdbf10240bb3a73c"><enum>(iv)</enum><header>Small business participation by industry</header><text>The total dollar value of prime contract awards made to small business concerns in all industry sectors and sorted by highest dollar amount per major industry sector to the least, including—</text><subclause commented="no" display-inline="no-display-inline" id="id1cac7d2ad10a432f96f371a34f853242"><enum>(I)</enum><text display-inline="yes-display-inline">the number of individual small business contractors awarded contracts in each industry sector; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idcd6678cd7eea4dcd9f3356515777382c"><enum>(II)</enum><text display-inline="yes-display-inline">the top 10 industries in which small business concerns, small business concerns owned and controlled by service-disabled veterans, qualified HUBZone small business concerns, small business concerns owned and controlled by socially and economically disadvantaged individuals, and small business concerns owned and controlled by women participate, compared to the 10 industries in which those concerns have the least participation.</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause><subclause commented="no" display-inline="no-display-inline" id="id4a3f31be31d246189f44edbeb91ba8fe"><enum>(VI)</enum><text>in subparagraph (E), by striking <quote>(E)</quote> and inserting <quote>(C) <header-in-text style="OLC" level="subparagraph">Other factors</header-in-text>.—</quote>; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idbc568418a28147348eb4758b871eb64a"><enum>(ii)</enum><text>in paragraph (3), by striking subparagraphs (A) and (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id71f146517e0145018278caa5b89eaa1b"><subparagraph id="id5b35860e0a864703b38aee0ab8b21f35"><enum>(A)</enum><text>not more than 40 percent of the score on the dollar value of prime contracts described in paragraph (2)(A), as determined by the Administrator;</text></subparagraph><subparagraph id="id8dcc051c3f484e9990e1d6ba82bdf89d"><enum>(B)</enum><text>not less than 30 percent of the score on the information provided in paragraph (2)(B), as determined by the Administrator; and</text></subparagraph><subparagraph id="ide6b4b3bc32e943eeb9507e88175a02d9"><enum>(C)</enum><text>the appropriate percent of the score on the information provided in paragraph (2)(C), as determined by the Administrator.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb0a5d1e6a6784912a5ed0b0fc2e60c57"><enum>(2)</enum><header>Regulations</header><text>Not later than 90 days after the date of enactment of this Act, the Administrator of the Small Business Administration shall issue regulations to define the terms <quote>new small business entrant</quote>, <quote>recent small business entrant</quote>, and <quote>established small business concern</quote> for purposes of subparagraph (B)(ii) of section 15(y)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(y)(2)</external-xref>), as added by paragraph (1).</text></paragraph></subsection><subsection id="H4E3AB1284166443D87FA14BDE1AB563E"><enum>(c)</enum><header>Limitation on Federal agency credit for meeting contracting goals</header><text display-inline="yes-display-inline">Section 15(g) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(g)</external-xref>), as amended by subsection (b), is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5B41108881544D69A67E5032A05B3CB4"><paragraph id="id7aab68bda6e54ec5bcedeec760737685"><enum>(4)</enum><header>Limitation on credit for meeting contracting goals</header><subparagraph id="id86ba768975fc4ab38c00c665a634d543"><enum>(A)</enum><header>Definitions</header><text>In this paragraph—</text><clause id="idaef99555bc4c41039ca3c3190f123583"><enum>(i)</enum><text>the term <term>covered category of small business concern</term> means—</text><subclause id="id8a35444ab0934f2aaa8a4b0583087ef5"><enum>(I)</enum><text>a small business concern owned and controlled by service-disabled veterans;</text></subclause><subclause id="id91105504c8004cb097dbb6d94ea5a927"><enum>(II)</enum><text>a qualified HUBZone small business concern;</text></subclause><subclause id="id0e01d28ffa2d47e297aac83cbe5611f7"><enum>(III)</enum><text>a small business concern owned and controlled by socially and economically disadvantaged individuals; or</text></subclause><subclause id="id7a87c5f2198f42be98f63247bff1147f"><enum>(IV)</enum><text>a small business concern owned and controlled by women; and</text></subclause></clause><clause id="id59489f149a384b7ea6220c751f8ba4d8"><enum>(ii)</enum><text>the term <term>credit</term> means the value of a prime contract.</text></clause></subparagraph><subparagraph id="idc55f5c6170894afd9b6ea7da4091fb91"><enum>(B)</enum><header>General rule</header><text>A Federal agency may allocate credit for a single prime contract awarded to a small business concern not more than 2 times for purposes of demonstrating compliance with the goals of the Federal agency established under paragraph (2)(A).</text></subparagraph><subparagraph id="id83765bb4fc0d4c85a6336e9399ac768f"><enum>(C)</enum><header>Allocation of credit</header><clause id="id279c29fa8af449b29b4517c9d026e289"><enum>(i)</enum><header>First allocation</header><text>The first allocation of credit described in subparagraph (B) shall be applied towards the goal of the Federal agency established under paragraph (2)(A) for participation by small business concerns.</text></clause><clause id="id498207bf557244af8f6c80a9b5647582"><enum>(ii)</enum><header>Second allocation</header><text>A second allocation of credit described in subparagraph (B) shall be applied as follows:</text><subclause id="ide3bf4851e19d4a398021a7b4e7b0b276"><enum>(I)</enum><text>If the prime contract was awarded as a sole-source contract or through competition restricted to a covered category of small business concern, the credit shall be applied towards the goal of the Federal agency established under paragraph (2)(A) for participation by the applicable covered category of small business concern.</text></subclause><subclause id="id5ce1b80bb5824a6ba1a665af900ba2c8"><enum>(II)</enum><text>If the prime contract was not awarded as a sole-source contract or through competition restricted to a covered category of small business concern, the credit may only be applied towards a single goal of the Federal agency established under paragraph (2)(A), determined at the election of the contracting officer, for participation by a covered category of small business concern that is applicable to the recipient of the prime contract, without regard to whether the recipient of the prime contract qualifies as more than 1 covered category of small business concern.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id8e89dc39322f4b3ea4ecff72f997520f"><enum>(d)</enum><header>Testimony on Small Business Engagement before Congress</header><text display-inline="yes-display-inline">Section 15(g) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(g)</external-xref>), as amended by subsections (b) and (c), is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idab60817e349e4131920e9ba34fcab29a"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb26178fef6194a0d9311bcccfb9f82cd"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>(2) (A) The head</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF9262E931BF141EB8E0A4C0CD06C847A"><paragraph commented="no" display-inline="no-display-inline" id="id9972ae5b63a84844abee944b1958d459"><enum>(iii)</enum><text>by striking <quote>(ii) A procurement</quote> and inserting:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id264F029EC6144CE0BE5B4E7C3DCCDAA8"><clause commented="no" display-inline="no-display-inline" id="id8A430E10E9A24592BF6348B0847F2DF5"><enum>(ii)</enum><header>Procurement employee or program manager defined</header><text>A procurement</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3ab2425e161541149b3cafec06ca8a32"><enum>(H)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3ed016f2f157476581b1c9b1c6f15933"><subparagraph id="idc5ac32d1a29c415394b42925276d4a90"><enum>(G)</enum><header>Remediation</header><text>Any Federal agency failing to receive a score equivalent to a letter grade of <quote>A</quote> or above in a letter graded rating system, as established under subsection (y), in a fiscal year shall—</text><clause id="idf9ab2c4774f04bc7b8ad4139a6ec7d50"><enum>(i)</enum><text>submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives the report required under subsection (h)(1); and</text></clause><clause id="idb85faf82a5ae417ca79abe63d07b02d1"><enum>(ii)</enum><text>testify before the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives on the reasons for failing to meet a letter grade of <quote>A</quote> or above, and the details of the report submitted under clause (i), in particular the justifications and remediation plan described in subparagraphs (C) and (D) of subsection (h)(1).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf49b3f6effc64065861a607652ca3650"><enum>(2)</enum><text>by striking <quote>(3) First</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id13266DD6D9964F9887C792CD1B866391"><paragraph commented="no" display-inline="no-display-inline" id="id9af53b582ff04382a2dacb1f57c183bb"><enum>(3)</enum><header>Department of Energy subcontracts</header><text>First</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide6c60a996b2349348cb3f734875685b3"><enum>(e)</enum><header>Evaluation of offers for contracts including subcontracting plans</header><text display-inline="yes-display-inline">Section 8(d)(4) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(d)(4)</external-xref>) is amended—</text><paragraph id="id40f2b1afe9c94d938518a6396895dc85"><enum>(1)</enum><text>by moving subparagraph (G) 2 ems to the left; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id43561d80e1f54af9aaf820de26c2559d"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (G)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb4999b533cfb4498ab18b0bbc784c51a"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), by striking <quote>bundled contract where the head of the agency determines that the contract offers a significant opportunity for subcontracting</quote> and inserting <quote>contract that includes a subcontracting plan required under this paragraph or paragraph (5)</quote>; and</text></subparagraph><subparagraph id="id03a07d6af63142069a501e918d11b603"><enum>(B)</enum><text>in clause (i), by striking <quote>the rate provided under the subcontracting plan for small business participation</quote> and inserting <quote>a description of the extent to which the offeror proposes to use small business concerns as subcontractors at any tier</quote>. Applies Before Using a Multiple Award Contract</header><text display-inline="yes-display-inline">Section 15(r) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(r)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id3677DE1E6AE443BD80C855A981D73A37"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and adjusting the margins accordingly;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id480a5da33c72492fbefa9b16cc658462"><enum>(2)</enum><text display-inline="yes-display-inline">in the matter before subparagraph (A), as so redesignated, by striking <quote>Not later than</quote> and all that follows through <quote>discretion—</quote> and inserting the following:</text></paragraph><paragraph id="id4AEB315C6A1545BCBB6CAD12F2BC146D" commented="no" display-inline="no-display-inline"><enum/><text display-inline="yes-display-inline"><quote>(1) <header-in-text style="OLC" <quote>; and</quote> and inserting a period;</text></paragraph><paragraph id="id2e90603dde5d43cfbb53abafac7559af" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">by striking paragraph (3); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1E4406C133F844D0AA32A12CF7DCE9A5"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block id="id1F84ED489D894B64BEDD73A439B4C593" display-inline="no-display-inline" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="idCD867B02127B4456A0CEEADB4541BF65"><enum>(2)</enum><header>Exceptions</header><text>The requirements in paragraph (1) shall not apply—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbe53109f8fd24a199509dcb5c43d2842"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of contracts, including orders, awarded under subpart 8.4 of the Federal Acquisition Regulation (or any successor regulation); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id838faed97d50498ab71f3bb09cbc739d"><enum>(B)</enum><text display-inline="yes-display-inline">if the contracting officer is unable to obtain offers from 2 or more small business concerns that are—</text><clause commented="no" display-inline="no-display-inline" id="id90076334a05c40d1b74406748b1ff926"><enum>(i)</enum><text display-inline="yes-display-inline">competitive with market prices; and </text></clause><clause id="id5042e2d12f2545ff8106cb119e1865d3" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">competitive with regard to the quality and delivery of the goods or services being purchased.</text></clause></subparagraph></paragraph><paragraph id="id9cb2fb5f5abf4a92ae70f51352e6bf1c"><enum>(3)</enum><header>Small Business Reserve</header><text>Notwithstanding paragraphs (1) and (2), a Federal agency may reserve 1 or more contract awards for small business concerns under full and open multiple award procurements, including the subcategories of small business concerns identified in subsection (g)(2).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfecb1fe7a22c4746872f0d4edc1ea30c"><enum>(g)</enum><header>Aligning OSDBU and PCR Collaboration Regarding Bundled or Consolidated Contracts</header><text display-inline="yes-display-inline">Section 15 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644</external-xref>) is amended—</text><paragraph id="idfed63126e0fd44f18a78ca2669494665"><enum>(1)</enum><text>in subsection (k)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2376b2c088914bc99e866fb1c180f058"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (5)—</text><clause commented="no" display-inline="no-display-inline" id="ida85f2ece3c794a5a8a75de9b94da01de"><enum>(i)</enum><text>by inserting <quote>or consolidation</quote> after <quote>bundling</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="iddc46327f912b4ff9a676138c27da94a6"><enum>(ii)</enum><text>by inserting <quote>procurement center representative,</quote> after <quote>work with the</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="id78a735654d694300bc67a4f3c55940db"><enum>(iii)</enum><text>by inserting a comma after <quote>acquisition officials</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idb1dfe6627b974978a8ac756d0bbe46c3"><enum>(iv)</enum><text>by inserting <quote>or consolidated</quote> after <quote>bundled</quote>;</text></clause></subparagraph><subparagraph id="idada15d307ff54a4cb39f78bd8c5ac3c9"><enum>(B)</enum><text>in paragraph (8), in the matter preceding subparagraph (A), by inserting <quote>, as required under subsection (l)(4)</quote> after <quote>procurement center representative,</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5774ff37bbe74e97bf39d9232c8859fb"><enum>(C)</enum><text>in paragraph (17)—</text><clause commented="no" display-inline="no-display-inline" id="id7526ad4f3e69452c906f1b1061370771"><enum>(i)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7b03cee27995455c9ad71c9fddbd28ab"><enum>(ii)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (C) as subparagraph (D); and</text></clause><clause commented="no" for competition; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id41c1e0bd66d243528c6de69f247cebef"><enum>(2)</enum><text>in subsection (l)(2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide76cfc3e5f3f4d5699bb6dacc57fa0d7"><enum>(A)</enum><text>by moving subparagraph (A) 2 ems to the right;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id715584b163ea4da8ab7f28685fc0579a"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (H), (I), (J), and (K) as subparagraphs (I), (J), (K), and (L), respectively; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc4e822f386d341ad87dec07e99c9d3c5"><enum>(C)</enum><text>by inserting after subparagraph (G) the following:</text><quoted-block id="id2BEC33E6D60643F6866CD8DBFF7D900B" display-inline="no-display-inline" style="OLC"><subparagraph id="id4fe6ba1842c34d53b16d38a195154038"><enum>(H)</enum><text>consult with the Director of the Office of Small and Disadvantaged Business Utilization of that agency and appropriate agency personnel with regard to—</text><clause commented="no" display-inline="no-display-inline" id="id495a1b2163064024a955afc20ff37a0c"><enum>(i)</enum><text display-inline="yes-display-inline">proposed solicitations involving significant bundling or consolidation of contract requirements as described in subsection (k)(5); and </text></clause><clause id="id933e4daa17134f8eaa2e8e858834a4b8" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">notices by small business concerns of undue restrictions on the ability of the small business concern to compete for the award due to significant bundling or consolidation of contract requirements, as described in subsection (k)(17);</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd7e7e648e0f547ba93a648925919eea0"><enum>(D)</enum><text>in subparagraph (K), as so redesignated, by adding <quote>and</quote> at the end.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
