which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Immigration and Nationality Act to provide for the reallocation of unused waivers of the foreign residency requirement for certain J visa holders.</official-title></form><legis-body><section id="idad867fbf2edc4860b3b9955c538c7aa9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Directing Our Country’s Transfer Of Residency Slots</short-title></quote> or the <quote><short-title>DOCTORS Act</short-title></quote>. </text></section><section commented="no" display-inline="no-display-inline" id="id745cef2d17674c2589aa62b993efe243" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Reallocation of unused waivers of the foreign residency requirement for certain J visa holders</header><text display-inline="no-display-inline">Section 214(<italic>l</italic>) of the Immigration and Nationality Act (8 U.S.C. 1184(<italic>l</italic>)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB4AC84760EE540D2AA8C75B61302CA7D"><paragraph id="idbe549599d88947c4837d0db2ad5d3891"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="iddb58b46d12e8427cbcaf7d02fe126e79"><enum>(A)</enum><text display-inline="yes-display-inline">Beginning on September 30, 2025, and every September 30 thereafter, each State agency that received a waiver under section 212(e) during the fiscal year that ends on that date shall report to the Secretary of State the total number of such waivers that the State agency did not use during such fiscal year. </text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id9d9f8aad9a5e467fa76d2c4b69b24c4a"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id2b1b4845de5f4df1b63ef1f7875c4473"><enum>(i)</enum><text>For fiscal year 2025, and each fiscal year thereafter, the Secretary of State shall—</text><subclause indent="up1" commented="no" display-inline="no-display-inline" id="id795fd7e31eba482e9eb78150d7e41477"><enum>(I)</enum><text display-inline="yes-display-inline">calculate the total number of unused waivers reported by all State agencies under subparagraph (A); and</text></subclause><subclause indent="up1" commented="no" display-inline="no-display-inline" id="id525c27ec24a14d0e9d736a68c0954f4d"><enum>(II)</enum><text display-inline="yes-display-inline">subject to clauses (ii) and (iii), reallocate such waivers for equal distribution among eligible State agencies for use during the subsequent fiscal year as waivers subject to paragraph (1)(D)(ii) (referred to in this paragraph as <quote>supplemental waivers</quote>).</text></subclause></clause><clause indent="up1" commented="no" display-inline="no-display-inline" id="idaf326cee0f324a9d8ff03cf701740c91"><enum>(ii)</enum><text>The total number of supplemental waivers that may be reallocated for use during a subsequent fiscal year shall be the number that is one-third of the difference between—</text><subclause commented="no" display-inline="no-display-inline" id="idf8333874816c4999bf29b76c6e544e08"><enum>(I)</enum><text display-inline="yes-display-inline">the total number of waivers under section 212(e) available for the fiscal year; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide6e94f4c6cce4480afc394be28f17684"><enum>(II)</enum><text display-inline="yes-display-inline">the total number of waivers under section 212(e) distributed during such fiscal year.</text></subclause></clause></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id0c2ab887d869462ab138b13ffa5ec942"><enum>(C)</enum><text>In reallocating waivers under subparagraph (B), on January 1, 2025, and every January 1 thereafter, the Secretary of State shall inform each eligible State agency of—</text><clause commented="no" display-inline="no-display-inline" id="id88dbd8e7e3dc488b9c425d5f3e661edd"><enum>(i)</enum><text display-inline="yes-display-inline">the number of supplemental waivers available to the State agency for the subsequent fiscal year; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id59692119003e4f9699dd4772d53da1ac"><enum>(ii)</enum><text display-inline="yes-display-inline">the manner in which the supplemental waivers will be distributed.</text></clause></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="iddb98737ea51c47c291080bc5d869a59c"><enum>(D)</enum><text display-inline="yes-display-inline">Ten percent of supplemental waivers distributed in a fiscal year shall be used to support positions in 1 or more facilities that serve patients who reside in medically underserved communities (as defined in section 799B of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/295p">42 U.S.C. 295p</external-xref>)).</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id42f26b0ff6bd4c65b4b26e2f1893e71e"><enum>(E)</enum><text display-inline="yes-display-inline">In this paragraph, the term <term>eligible State agency</term> means a State agency that, in the preceding fiscal year, used not fewer than 30 waivers under section 212(e).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
