which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to improve matters relating to medical examinations for veterans disability compensation, and for other purposes.</official-title></form><legis-body><section id="id0b766428044941518814bf514552c473" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medical Disability Exam Improvement Act of 2023</short-title></quote>.</text></section><section id="id5bd0d7fc6d2d4154ad43cacd12c5700e" section-type="subsequent-section"><enum>2.</enum><header>Modification of eligibility requirements for medical nexus examinations for toxic exposure risk activities</header><text display-inline="no-display-inline">Section 1168(a)(1) of title 38, United States Code, is amended—</text><paragraph id="id7769d54236c24b198d665b795ab0462d"><enum>(1)</enum><text>by striking <quote>with evidence of a disability and evidence of participation in a toxic exposure risk activity</quote> and inserting <quote>and expresses that such claim is associated with a toxic exposure risk activity</quote>; and</text></paragraph><paragraph id="ida49818fada0a4baab5fc3186a1e774b5"><enum>(2)</enum><text>by striking <quote>and such evidence</quote> and inserting <quote>and evidence of record before the Secretary</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="ide4e0f35c22d44c57be574540f21d03e6"><enum>3.</enum><header>Specification of accounts for certain expenses relating to medical examinations for veterans disability compensation claims under laws administered by Secretary of Veterans Affairs</header><text display-inline="no-display-inline">Section 5103A(d) of title 38, United States Code, is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id246266AD5ABF49D2AA506A0AD23BE070"><paragraph id="idffecd43823654a69864e5b4a4189332d" indent="up1"><enum>(3)</enum><text>Expenses of carrying out a medical examination or obtaining a medical opinion under paragraph (1), including payment for travel and incidental expenses under the terms and conditions set forth by section 111 of this title for the examination or medical opinion, shall be reimbursed to the accounts available for the general operating expenses of the Veterans Benefits Administration and information technology systems from amounts available to the Secretary for payment of compensation and pensions.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id2bdf29c2ce6b442a9d94a0ca70298f47"><enum>4.</enum><header>Study on improvements to Department of Veterans Affairs covered medical disability examinations in rural areas</header><subsection id="id4A973AFF88E24978A7434B90F68F2920"><enum>(a)</enum><header>Study required</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall complete a study on access by rural veterans to covered medical disability examinations.</text></subsection><subsection id="idCA6F9E6DE80342ADA611FCD386F96980"><enum>(b)</enum><header>Elements</header><paragraph id="id0FB7B4A8D41D4883BA8BF1BA155EACB5"><enum>(1)</enum><header>In general</header><text>The study conducted under subsection (a) shall include the following:</text><subparagraph id="idbcbbe0bad24944da9e9270b707983d4c"><enum>(A)</enum><text>A comparison of the average number of days to complete covered medical disability examinations for rural veterans compared to a national non-rural average time to complete a covered medical disability examinations, by either contractors or employees of the Department.</text></subparagraph><subparagraph id="id24E6A38B105B49FA9D39B9934EA35759"><enum>(B)</enum><text>A root cause analysis of differences identified pursuant to subparagraph (A).</text></subparagraph><subparagraph id="idEA3957810DE948C089D40306F2D07F28"><enum>(C)</enum><text>The plan of the Secretary for the following year to improve access described in subsection (a), which shall include a plan for the pursuit of a commercial or industry-standard solution or technology that could enable rural or housebound veterans to receive examinations without traveling long distances.</text></subparagraph></paragraph><paragraph id="id5b5afe0992f94632ae91dce1a7395c97"><enum>(2)</enum><header>National non-rural average defined</header><text>For purposes of paragraph (1)(A), the term <term>national non-rural average</term> means the national average of all periods in the previous calendar year—</text><subparagraph id="id73938e2ed57046da91637735247acfde"><enum>(A)</enum><text>beginning on the date on which a contractor or employee of the Department received a request from the Secretary to conduct a covered medical disability examination for a veteran who is not a rural veteran; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id98cceb0d70b04ab0aecb81edd8c5ce35"><enum>(B)</enum><text>ending on the date on which the examination was completed. </text></subparagraph></paragraph></subsection><subsection id="idd59aee0f2b18409da74e653086d1c822"><enum>(c)</enum><header>Report on study</header><text>Not later than one year after the date of the enactment of this Act, the Secretary shall submit to the Committee on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report on the findings of the Secretary with respect to the study completed under subsection (a).</text></subsection><subsection id="id365F801103B649B18DCC99A5B53E5C0B" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Annual report on plans</header><text>Not later than two years after the date of the enactment of this Act and not less frequently than once each year thereafter, the Secretary shall submit to the Committee on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report evaluating the conduct of the plans of the Secretary to improve access described in subsection (a) and a new or revised plan for such improvement in the following year.</text></subsection></section><section id="id8fb86b0b0e594d9388e111ba4289dbdf"><enum>5.</enum><header>Improvements to training for processing medical disability examinations</header><subsection id="id38caa9094b704144a3b10515acbdcfb2"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall require additional training for employees of the Department of Veterans Affairs who order or review covered medical disability examinations.</text></subsection><subsection id="id802ff80eae004e2b9a49a696ae17800d"><enum>(b)</enum><header>Training requirements</header><text>The training required under subsection (a) shall include the following:</text><paragraph id="id153c92392ff740d0885bc36780246cb1"><enum>(1)</enum><text>Instruction on how to assess whether a covered medical disability examination is adequate for purposes of adjudicating the particular claim for a benefit under chapter 11 or 15 of title 38, United States Code, for which the examination was ordered by the Department.</text></paragraph><paragraph id="id69b9473a15bf4d3db492c19550e45f47"><enum>(2)</enum><text>Instruction on how to assess whether a covered medical disability examination is necessary for purposes of adjudicating the particular claim for a benefit under chapter 11 or 15 of title 38, United States Code, for which the examination was ordered by the Department.</text></paragraph><paragraph id="id059d57cb34f649b784e7f2c5af159c8b"><enum>(3)</enum><text>Review of relevant statutes, judicial decisions, regulations, and policies of the Department regarding covered medical disability examinations, including, at a minimum—</text><subparagraph id="id7A8E701CA76F4F38A7051881A58F06CB"><enum>(A)</enum><text>the duty to assist;</text></subparagraph><subparagraph id="ided8c1c2ef5bb4eba9d671e600a87c473"><enum>(B)</enum><text>the relevance of causation compared to other evidentiary standards in covered medical disability examinations;</text></subparagraph><subparagraph id="id46bd6cdf034d4b43b0c2458e7d7819f1"><enum>(C)</enum><text>the required elements of a covered medical disability examination, with an emphasis on the requirement for reasoned analysis to support medical opinions; and</text></subparagraph><subparagraph id="id24363d918ab8487384d3ece6fd6ca3e1"><enum>(D)</enum><text>the relevance of a lack of a statutory or regulatory presumption of service-connection in covered medical disability examinations. </text></subparagraph></paragraph></subsection><subsection id="id31e99073ff094bcbae4ed09083ee2a3c"><enum>(c)</enum><header>Frequency</header><text>The Secretary shall ensure that each employee of the Department who orders or uses a covered medical disability examination to evaluate a claim for a benefit under chapter 11 or 15 of title 38, United States Code, completes training that incorporates the requirements of subsection (b) not less frequently than once each year. </text></subsection><subsection id="idF5ED47FD05C44AADA96CC1245134F55A"><enum>(d)</enum><header>Modification of reports</header><paragraph id="id2FCF7FE212344CB486A313482AD1EE6E" commented="no"><enum>(1)</enum><header>Board of Veterans' Appeals</header><text>Section 7101(d)(2) of title 38, United States Code, is amended—</text><subparagraph commented="no" id="id839B337D4ABE4ABD910D27C7633A13BF"><enum>(A)</enum><text>in subparagraph (F), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph commented="no" id="id78AFA7683FA14BE0A66AE86B7E7F70AA"><enum>(B)</enum><text>in subparagraph (G), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" id="id120FD195F27143E497A33E4CF7E9BF6F"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida915c4cdc9cd4510bec374b33abc651d"><subparagraph id="id833155e9f0d24cab9373105bb3f91bce" commented="no" indent="up1"><enum>(H)</enum><text>a summary of recurring issues that the Chairman believes could be resolved by better training for employees of the Department, increased oversight, or clarification from either the Department or Congress.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id18BAEAA5E5D64B9BAEFCD40FF40B7AB1" commented="no"><enum>(2)</enum><header>United States Court of Appeals for Veterans Claims</header><text>Section 7288(b) of title 38, United States Code, is amended by adding at the end the following new paragraph: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id26bb1b0ca757466ea7130c7b4dce748e"><paragraph id="idadb15b7455f249d9809ffc791c3de554" commented="no"><enum>(16)</enum><text>A summary of recurring issues that the chief judge of the Court believes could be resolved by better training for employees of the Department, increased oversight, or clarification from either the Department or Congress.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id18a19a31c83a4fe48cb685ddb6193d1c"><enum>(e)</enum><header>Definition of covered medical disability examination</header><text display-inline="yes-display-inline">In this section, the term <term>covered medical disability examination</term> means a medical examination or medical opinion that the Secretary determines necessary for the purposes of adjudicating a benefit under chapter 11 or 15 of title 38, United States Code, regardless of whether conducted by an employee or a contractor of the Department.</text></subsection></section><section id="idf80389d516be4c619c97b05985a90cc8"><enum>6.</enum><header>Review and priority processing of claims with inadequate or unnecessary examinations</header><subsection id="idf3472c1ff79d49078f5a255c297028da"><enum>(a)</enum><header>Review</header><text>Not later than 1 year after the date of the enactment of this Act and not less frequently than once every calendar month thereafter, the Secretary of Veterans Affairs shall review a statistically significant sample of all covered medical disability examinations completed during the previous calendar month.</text></subsection><subsection id="id0c4e8c7cc7b6465f9b5b4bdc077f6d9d"><enum>(b)</enum><header>Further sample requirements</header><text>Under each review required by subsection (a), the Secretary shall ensure the review includes—</text><paragraph id="idb06ad705ebb94731a8c95266a29cfe42"><enum>(1)</enum><text>a statistically significant sample of covered medical disability examinations completed by employees of the Department of Veterans Affairs; and</text></paragraph><paragraph id="id7f201f77701f4a439177b24252e7fa56"><enum>(2)</enum><text>a statistically significant sample of covered medical disability examinations completed by each contractor that provides such examinations for the Department.</text></paragraph></subsection><subsection id="idf4e3b4425aaa44aa92a5785374f7445d"><enum>(c)</enum><header>Analysis</header><text>Under each review required by subsection (a), the Secretary shall analyze—</text><paragraph id="ided32b662f93b44a285d2cbb4bd1b4f89"><enum>(1)</enum><text>the sample specified in subsection (b)(1) and identify the percentage of examinations that were adequate for purposes of adjudicating the particular claim for a benefit under chapter 11 or 15 of title 38, United States Code, for which the examination was ordered by the Department;</text></paragraph><paragraph id="id00316c6ec86f4c758213e6efd31a4ab7"><enum>(2)</enum><text>the sample specified in subsection (b)(2) and identify the percentage of examinations that were adequate for purposes of adjudicating the particular claim for a benefit under chapter 11 or 15 of title 38, United States Code, for which the examination was ordered by the Department; and</text></paragraph><paragraph id="id2602ca3d760844289c5533e626e60082"><enum>(3)</enum><text>the overall sample specified in subsection (a) and identify the percentage of examinations that were necessary for purposes of adjudicating the particular claim for a benefit under chapter 11 or 15 of title 38, United States Code, for which the examination was ordered by the Department.</text></paragraph></subsection><subsection id="id0aa318852aa8479bb2ffd411f12f35b1"><enum>(d)</enum><header>Priority processing</header><text>If during a review under subsection (a) the Secretary finds any covered medical disability examination to be not adequate or not necessary for adjudicating a claim of a claimant, the Secretary may provide such claimant—</text><paragraph id="iddc5269523c594bf6a31b3406f3a98093"><enum>(1)</enum><text>another examination on a priority basis; and</text></paragraph><paragraph id="id0fec7d35653a401da8791a8e946d9602"><enum>(2)</enum><text>priority processing for the entirety of impacted claim.</text></paragraph></subsection><subsection id="id3885610556b0426d99a081643abdf30b"><enum>(e)</enum><header>Covered medical disability examination defined</header><text>In this section, the term <term>covered medical disability examination</term> means a medical examination or medical opinion that the Secretary determines necessary for the purposes of adjudicating a benefit under chapter 11 or 15 of title 38, United States Code, regardless of whether conducted by an employee or a contractor of the Department.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id890f45be58ed43699f8d4ba52b950762"><enum>7.</enum><header>Mechanism for contractors conducting disability examinations under certain Department of Veterans Affairs pilot program to transmit medical evidence introduced by claimants during examinations</header><text display-inline="no-display-inline">Section 504 of the Veterans' Benefits Improvements Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/275">Public Law 104–275</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/5101">38 U.S.C. 5101</external-xref> note) is amended—</text><paragraph id="idd7ceec99d6534bfb8533762071ce5285"><enum>(1)</enum><text>by redesignating subsections (d) and (e) as subsection (e) and (f), respectively; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc0871bc66efd40eb872675ca1c147ddf"><enum>(2)</enum><text>by inserting after subsection (c) the following new subsection (d):</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0678b26784ea47e996eb8d2f2cb6ed32"><subsection id="idb1cfede8f32c44f898d6dc1a07dafc33"><enum>(d)</enum><header>Mechanism for transmittal of evidence introduced by applicants during examinations</header><text>The Secretary shall establish a mechanism whereby a health care professional can transmit to the Secretary, evidence introduced by the applicant during a medical examination or in conjunction with such examination.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
