Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Secretary of Defense to conduct detection, monitoring, and other operations in cyberspace to counter Mexican transnational criminal organizations that are engaged in certain activities that cross the southern border of the United States, and for other purposes.</official-title></form><legis-body><section id="id7d50146ce9ad473ba261129dbe4e1f40" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Countering Mexican Transnational Criminal Organizations in Cyberspace Act of 2023</short-title></quote>.</text></section><section id="id4675e27d02cf48fc825fb7012cf1707b"><enum>2.</enum><header>Authority for countering illegal trafficking by Mexican transnational criminal organizations in cyberspace</header><subsection id="id9e5d95602a0041828726092506b790ac"><enum>(a)</enum><header>Authority</header><paragraph id="id064c296248fd4f5f9d541f9cf6d2fbcc"><enum>(1)</enum><header>In general</header><text>In accordance with sections 124 and 394 of title 10, United States Code, the Secretary of Defense may, in coordination with other relevant Federal departments and agencies and in consultation with the Government of Mexico as appropriate, conduct detection, monitoring, and other operations in cyberspace to counter Mexican transnational criminal organizations that are engaged in any of the following activities that cross the southern border of the United States:</text><subparagraph commented="no" display-inline="no-display-inline" id="idd2211bc76668403d9600437c5f3d47ca"><enum>(A)</enum><text display-inline="yes-display-inline">Smuggling of illegal drugs, controlled substances, or precursors thereof.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id24a26b20443a4a20a2f778ceba1e97b1"><enum>(B)</enum><text display-inline="yes-display-inline">Human trafficking.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddbc8dfe426164e58909e6c303b004565"><enum>(C)</enum><text display-inline="yes-display-inline">Weapons trafficking.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id68608ef8ab814776a65cc24d8e4dce59"><enum>(D)</enum><text display-inline="yes-display-inline">Other illegal activities.</text></subparagraph></paragraph><paragraph id="id57dd8997df4342de914dfcd344a2b278"><enum>(2)</enum><header>Certain entities</header><text>The authority provided by paragraph (1) may be used to counter Mexican transnational criminal organizations, including entities cited in the most recent National Drug Threat Assessment published by the United States Drug Enforcement Administration, that are engaged in the activities described in (1).</text></paragraph></subsection><subsection id="ide60d9c5695eb4ab2a76738b5be5e0c68"><enum>(b)</enum><header>Cyber strategy for countering illegal trafficking by transnational criminal organizations affecting the security of United States southern border</header><paragraph id="idde26988f944243439fe9ee2c840bab45"><enum>(1)</enum><header>Strategy required</header><text>Not later than 60 days after the date of the enactment of this Act, the Secretary shall, in consultation with the National Cyber Director and the heads of such other Federal departments and agencies as the Secretary considers appropriate, submit to the appropriate congressional committees a strategy for conducting operations in cyberspace under subsection (a).</text></paragraph><paragraph id="ide7c9576e60884330a4490c89cda230e3"><enum>(2)</enum><header>Elements</header><text>The strategy submitted pursuant to paragraph (1) shall include the following:</text><subparagraph id="id7def5a94048f44bda131735c7e947fc4"><enum>(A)</enum><text>A description of the cyberspace presence and activities, including any information operations, of the entities described under subsection (a)(2) pose to the national security of the United States.</text></subparagraph><subparagraph id="id19f89cf43615484a950ec38aeaf21c56"><enum>(B)</enum><text>A description of any previous actions taken by the Department of Defense to conduct operations in cyberspace to counter illegal activities by transnational criminal organizations, and a description of those actions.</text></subparagraph><subparagraph id="id42a7bc1f271044f3bcfc6c9adfaa93cd"><enum>(C)</enum><text>An assessment of the financial, technological, and personnel resources that the Secretary can deploy to exercise the authority provided in subsection (a) to counter illegal trafficking by transnational criminal organizations.</text></subparagraph><subparagraph id="idf57d8a2eb7a2455ca2e29bda144e9a75"><enum>(D)</enum><text>Recommendations, if any, for additional authorities as may be required to enhance the exercise of the authority provided in subsection (a).</text></subparagraph><subparagraph id="idd1a6a54923b84e81ae2fe723d1d4743a"><enum>(E)</enum><text>A description of the extent to which the Secretary has worked, or intends to work, with the Government of Mexico, interagency partners, and the private sector to enable operations in cyberspace against illegal trafficking by transnational criminal organizations.</text></subparagraph><subparagraph id="idbf3fff9d90e642cbb73e0bde0601ecf2"><enum>(F)</enum><text>A description of the security cooperation programs in effect on the day before the date of the enactment of this Act that would enable the Secretary to cooperate with Mexican defense partners against illegal trafficking by transnational criminal organizations in cyberspace.</text></subparagraph><subparagraph id="id3ac950d8f0d049dfa4e00482dc1ea049"><enum>(G)</enum><text>An assessment of the potential risks associated with cooperating with Mexican counterparts against transnational criminal organizations in cyberspace and ways that those risks can be mitigated, including in cooperation with Mexican partners.</text></subparagraph><subparagraph id="idd8d496b04ab84bf1bcb282ef2cf90e2c"><enum>(H)</enum><text>A description of any cooperation agreements or initiatives in effect on the day before the date of the enactment of this Act with interagency partners and the government of Mexico to counter transnational criminal organizations in cyberspace.</text></subparagraph></paragraph></subsection><subsection id="idc011f9ad6a0140abb5d3f0d86aee37ec"><enum>(c)</enum><header>Quarterly monitoring briefing</header><text>The Secretary shall, on a quarterly basis in conjunction with the briefings required by section 484 of title 10, United States Code, provide to the appropriate congressional committees a briefing setting forth, for the preceding calendar quarter, the following:</text><paragraph id="idb0f042477a734e84a00e3e8f48bc4f0a"><enum>(1)</enum><text>Each country in which an operation was conducted under subsection (a).</text></paragraph><paragraph id="id497d894c38b24ff7aaf8c6ebce165011"><enum>(2)</enum><text>The purpose and nature of each operation set forth pursuant to paragraph (1).</text></paragraph><paragraph id="idbba1ccec34d54ebc835bca73c0a8d509"><enum>(3)</enum><text>The start date and end date or expected duration of each operation set forth pursuant to paragraph (1).</text></paragraph><paragraph id="id945f2578d1a94e57a57db07d14d14193"><enum>(4)</enum><text>The elements of the Department of Defense down to O–6 command level who conducted or are conducting the operations set forth pursuant to paragraph (1).</text></paragraph></subsection><subsection id="id4d7bd8d5255846a396bcebb5e7189296"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to supersede any standing prohibitions on collection of information on United States persons.</text></subsection></section></legis-body></bill>
