display-inline="no-display-inline">Congress finds that—</text><paragraph id="id8b2c32ea9be54b919aebd34639c832c1"><enum>(1)</enum><text>meat and poultry slaughter and processing is a particularly dangerous occupation, with meat and poultry processing workers suffering injuries at measurably higher rates than workers in other private sector industries;</text></paragraph><paragraph id="idd3ffc718ed6045e5893dde5743e05b10"><enum>(2)</enum><text>meat and poultry processing workers face double the rate of amputations as the average worker in private industry, and injuries such as sprains, lacerations, and contusions are common among poultry workers;</text></paragraph><paragraph id="id1db3f116821c44fda3d11c8650afe571"><enum>(3)</enum><text>meat and poultry processing workers suffer from musculoskeletal injuries, such as carpal tunnel syndrome, <quote>trigger finger</quote>, tendinitis, rotator cuff injuries, lower back injuries, and chronic pain and numbness, in numbers that can exceed 50 percent of workers; </text></paragraph><paragraph commented="no" id="iddf6a72d76826426e98ea804a86e3a6b3"><enum>(4)</enum><text>higher line speeds in meat and poultry processing facilities is a recognized risk factor that leads to increased risk of both laceration and musculoskeletal injuries;</text></paragraph><paragraph commented="no" id="idebd90b816b6642129a127f0cf0549bf8"><enum>(5)</enum><text>meat and poultry processing work was and continues to be particularly dangerous during the Coronavirus Disease 2019 (COVID–19) pandemic due to, among other factors—</text><subparagraph commented="no" id="id33266451BE07498A8AA4F5E331372DB7"><enum>(A)</enum><text>the easily transmissible nature of the virus via aerosol and droplet;</text></subparagraph><subparagraph commented="no" id="idFBBBC192DF0C4885B061007354467567"><enum>(B)</enum><text>the close proximity of meat processing workers;</text></subparagraph><subparagraph commented="no" id="id162E4CDFFFCB4C9D9F1C6EF34147E5BF"><enum>(C)</enum><text>cold conditions inside meat processing facilities; and</text></subparagraph><subparagraph commented="no" id="id0A42946518884B1B8A8EF314A2798141"><enum>(D)</enum><text>the pace and physical rigor of meat and poultry processing work;</text></subparagraph></paragraph><paragraph id="idf11e019e99b244aaa8de06df6626156b"><enum>(6)</enum><text>during the COVID–19 pandemic, covered establishments have implemented policies and procedures that have—</text><subparagraph id="id4C989326D6EE4E1886AEEB705A437381"><enum>(A)</enum><text>increased workers’ risk of exposure to SARS–CoV–2;</text></subparagraph><subparagraph id="idF7DA10AA31D54153815D758ADADF8A1F"><enum>(B)</enum><text>prioritized processing rates over worker health and welfare; and </text></subparagraph><subparagraph id="idA81F071B727445B8B5AE96E1DCB1E9E3"><enum>(C)</enum><text>caused a disparate adverse impact on Asian, Black, and Latino workers in the meat and poultry processing industry;</text></subparagraph></paragraph><paragraph id="id4916a05988f64b59b0250a43ee479726"><enum>(7)</enum><text>enforcement of requirements of the Occupational Safety and Health Administration in the meat and poultry processing industry has been fundamentally inadequate, especially during the COVID–19 pandemic; and</text></paragraph><paragraph id="ide1483284222e44bd8d4e9e446b0ad0d3"><enum>(8)</enum><text>meat and poultry processing workers are subjected to exploitative conditions and abusive behavior by employers—</text><subparagraph id="id8D6EC37785544C588908249DF2AD03B7"><enum>(A)</enum><text>including—</text><clause id="id96a891da71c24d86b4282000e79486e8"><enum>(i)</enum><text>use of abusive and humiliating shouting by supervisors accusing workers of not working fast enough and harassing them to work <quote>faster</quote> and <quote>harder</quote>;</text></clause><clause id="idd825dcf5c6b247f99fa60a5385358449"><enum>(ii)</enum><text>use of sexualized language to harass women workers to work <quote>harder</quote> and <quote>faster</quote>;</text></clause><clause id="id093bac34e4f7443cb3ef1beb3ee53eea"><enum>(iii)</enum><text>patterns of direct sexual harassment and incidents of sexual assault; and</text></clause><clause id="id227f72c59ff54bdf8002ca24989464d1"><enum>(iv)</enum><text>little or no accountability or redress for emotional, sexualized, or psychological abuse due to—</text><subclause id="id8EE3946D2281402DA0A667869F7F7095"><enum>(I)</enum><text>weak enforcement of, and noncompliance with, discrimination protections; and</text></subclause><subclause id="idAE64170F1D5E47A1878763E59EA88158"><enum>(II)</enum><text>meat and poultry processing workers not reporting the abuse due to fear of receiving more abuse, having their employment terminated, or being reported to immigration enforcement; and</text></subclause></clause></subparagraph><subparagraph id="idE7B2109AEA8D438DA46B87C3FF593B20"><enum>(B)</enum><text>that lead to long-term psychological impacts, including—</text><clause id="id7b4b07dc2b2c486a99f8aad310cbb645"><enum>(i)</enum><text>increased feelings of anger and stress by workers pressured to work faster and more aggressively to slaughter animals on killing lines; and</text></clause><clause id="ideb2bf98557ac495e9a32103bff2ccc9e"><enum>(ii)</enum><text>episodes of panic and fear by workers who were required to continue working during COVID–19 outbreaks. </text></clause></subparagraph></paragraph></section><section commented="no" id="id34F4FF00D5A1475486DE15FEBAFBB8B3"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idf121d942817c4410a934ffbbfa4f2b8a"><enum>(1)</enum><header>Covered establishment</header><text>The term <term>covered establishment</term> means—</text><subparagraph id="idf48dd6bbcab249a080f5b84bd3766f28"><enum>(A)</enum><text>an official establishment (as defined in section 301.2 of title 9, Code of Federal Regulations (or successor regulations)) that is subject to inspection under the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id33a84b6b64f748e88c406eb0e748cc78"><enum>(B)</enum><text>an official establishment (as defined in section 381.1 of title 9, Code of Federal Regulations (or successor regulations)) that is subject to inspection under the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/451">21 U.S.C. 451 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="id6e82ae4ef7c74c6a93564ee9bef7691a"><enum>(2)</enum><header>Covered period</header><text>The term <term>covered period</term> means the period beginning on the date of enactment of this Act and ending on the date that is 90 days after the date on which the COVID–19 emergency is lifted.</text></paragraph><paragraph id="idc4bc118f74004604b788525659156009"><enum>(3)</enum><header>COVID–19 emergency</header><text>The term <term>COVID–19 emergency</term> means the public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) on January 31, 2020, with respect to COVID–19.</text></paragraph><paragraph id="idf4a1d14df9eb48858abc0c988d6149fb"><enum>(4)</enum><header>Employee; employer</header><text>Unless otherwise specified, the terms <term>employee</term> and <term>employer</term> have the meanings given those terms in section 3 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/652">29 U.S.C. 652</external-xref>). </text></paragraph></section><title id="id186eb5b13e6743099e65a2a7b09c4862"><enum>I</enum><header>Reforms to protect meat and poultry processing workers</header><subtitle id="id1CBC296CF408488A896BE2B53EE96F4C" style="OLC"><enum>A</enum><header>Department of Agriculture</header><section id="id3d31fdf3541c4d16ba311249bf07e055"><enum>101.</enum><header>Rule on increased line speeds at meat and poultry establishments</header><subsection id="id742961b8993345c692e3b82c2a4a8b03"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idF628AE2189374F3B9EBF6FF663154E8A"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Service.</text></paragraph><paragraph id="idA9824CD102CE463592B39D7801C618C9"><enum>(2)</enum><header>Assistant Secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of Labor for Occupational Safety and Health.</text></paragraph><paragraph id="idA00643F315B94A5BA79D03EC17732654"><enum>(3)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the National Institute for Occupational Safety and Health.</text></paragraph><paragraph id="idB5CAFDFA3EF24BF38A36A36BDF9BCCE5"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph><paragraph id="id8AEA31E0C3374A34BD47CB100BDDDBD7"><enum>(5)</enum><header>Service</header><text>The term <term>Service</term> means the Food Safety Inspection Service.</text></paragraph></subsection><subsection id="idf59ebe3be0d24fa9983f39c3041c2c14"><enum>(b)</enum><header>Rule on waivers</header><paragraph id="id683feae8a4c64c9395e589f2f5854dd3"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law (including regulations, including sections 303.1(h) and 381.3(b) of title 9, Code of Federal Regulations (or successor regulations)), the Secretary, acting through the Administrator, shall not issue a waiver relating to line speeds at a covered establishment or inspection staffing requirements for a covered establishment unless the covered establishment—</text><subparagraph id="id14ef3720b0104866a18970800da58347"><enum>(A)</enum><text>agrees to an inspection conducted by the Assistant Secretary or the Director for the purposes of the waiver; and</text></subparagraph><subparagraph id="idb51e6108abcb40d4ab4b30ce7ce408ce"><enum>(B)</enum><text>the Assistant Secretary or the Director certifies to the Secretary that any increases in line speed at the covered establishment would not have an adverse impact on worker safety.</text></subparagraph></paragraph><paragraph id="id363ADA998ABA4EA9B6C6E2727BEA775D"><enum>(2)</enum><header>Inspections</header><text>An inspection conducted by the Assistant Secretary or the Director under paragraph (1)(A) shall include—</text><subparagraph id="id0D681D5775DC4390834F5C22582730B7"><enum>(A)</enum><text>an ergonomic analysis of all jobs in the applicable covered establishment that may experience an increased work pace due to increasing the number of animals being slaughtered—</text><clause id="id314A4911501540FDA950418E30EB5D30"><enum>(i)</enum><text>per minute; and </text></clause><clause id="id8FDCC0F853204A72AAF56D408AF74C8C"><enum>(ii)</enum><text>per hour;</text></clause></subparagraph><subparagraph id="id2B7D17D947834CA6A1FE9CE91ADD5D07"><enum>(B)</enum><text>an assessment of the current rates of musculoskeletal disorders in the covered establishment; </text></subparagraph><subparagraph id="id79DD0AA968C94E80AD63B833AFAC61EE"><enum>(C)</enum><text>a review of current efforts at the covered establishment to mitigate those disorders, including a review of how medical personnel at the covered establishment manage those disorders; and </text></subparagraph><subparagraph id="id1EFC9B2083C444F5BD5D94B20E0FB38F"><enum>(D)</enum><text>a review of the impact of any proposed line speed increases on the pace of work for workers on the slaughter and production lines of the covered establishment (including the workers that package the meat).</text></subparagraph></paragraph><paragraph id="id362d47b224f047068c4c55267b1c92dc"><enum>(3)</enum><header>Limitation on authority over line speeds</header><text>None of the funds made available to the Secretary during the covered period may be used to develop, propose, finalize, issue, amend, or implement any policy, regulation, directive, constituent update, or any other agency program that would increase line speeds at covered establishments.</text></paragraph><paragraph id="id9cc0ca0d132447d2bb40bf22df6a320d"><enum>(4)</enum><header>Effect on State law</header><subparagraph id="id42686c726bbd417f9e782dc3a20ed39c"><enum>(A)</enum><header>In general</header><text>This subsection shall not preempt or limit any law or regulation of a State or a political subdivision of a State that—</text><clause id="id73aea13c09fb43cd89df49cd30f8c32b"><enum>(i)</enum><text>imposes requirements that are more protective of worker safety or animal welfare than the requirements of this subsection; or</text></clause><clause id="idd51c0510366241d89eb56d1c17719d22"><enum>(ii)</enum><text>creates penalties for conduct regulated by this subsection.</text></clause></subparagraph><subparagraph id="id7f7a949cbdc7468a8048234fd15abfd7"><enum>(B)</enum><header>Other laws</header><text>The requirements of this subsection are in addition to, and not in lieu of, any other laws protecting worker safety and animal welfare.</text></subparagraph></paragraph></subsection><subsection id="id936ddafdf0294bbea0b6ab79751c3642"><enum>(c)</enum><header>Transparency in rulemaking</header><text>With respect to each rulemaking proceeding initiated by the Administrator on or after the date of enactment of this Act, the Administrator shall comply with—</text><paragraph id="idD62ED5E8390A48BC9855B819FD505762"><enum>(1)</enum><text>the data quality guidelines of the Service, which state that the Service and the offices of the Service are held to a standard of transparency to ensure that the information shared by the Service is presented in an accurate, reliable, and unbiased manner; and</text></paragraph><paragraph id="idCFB761933CB54CB2B7AA0BDA638090A9"><enum>(2)</enum><text>Executive Order 13563 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note; relating to improving regulation and regulatory review), which requires Federal agencies to provide timely online access to relevant scientific information in an open format that can easily be searched and downloaded during a proposed rulemaking.</text></paragraph></subsection><subsection id="id42d357849b994020bddefc217d9eb7f0"><enum>(d)</enum><header>Evaluation of rulemaking and policies</header><text>In evaluating the impact of any future rulemaking or policy, the Secretary shall request that the Director conduct an evaluation of the rulemaking or policy that includes a review of—</text><paragraph id="idC891077D62404DD2BBDC6BEA9C4C2BD5"><enum>(1)</enum><text>current safety conditions and injuries and illnesses at the applicable covered establishments, including medical exams and medical histories;</text></paragraph><paragraph id="id68FB42456D474D2A8084459EF5B2F8A5"><enum>(2)</enum><text>whether the policy proposals will increase the pace of work for any employee at the applicable covered establishments; and </text></paragraph><paragraph id="id056138AE10EE4C06A87F0D9E6753C91D"><enum>(3)</enum><text>whether, and the extent to which, the policy proposals will impact worker safety.</text></paragraph></subsection><subsection id="idc88e2c17d87745649b2e48beeb006ef4"><enum>(e)</enum><header>Reports</header><paragraph id="idBC91ED39675F44798879534DB2FEB44B"><enum>(1)</enum><header>Report to Congress</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary, the Secretary of Labor, and the Secretary of Health and Human Services shall each submit to the Committee on Agriculture, Nutrition, and Forestry and the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Agriculture and the Committee on Education and Labor of the House of Representatives, a report that—</text><subparagraph id="idfda70c30c0224e98a0b9fe011f190582"><enum>(A)</enum><text>describes the actions taken by that Secretary to ensure worker, animal, and food safety during the COVID–19 emergency; and</text></subparagraph><subparagraph id="id27be50df1a234842bb327fd3067bce16"><enum>(B)</enum><text>includes an analysis of the issues described in paragraphs (1) through (12) of section 303(b).</text></subparagraph></paragraph><paragraph id="id326BFB027159466DB52A143FD518F94A"><enum>(2)</enum><header>Reports on implementation of rules</header><subparagraph id="idD9D232DC187B4DD1922E938375E3845B"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the implementation of any rule relating to line speeds at covered establishments, the Secretary shall submit to Congress a report on the impact of the rule on—</text><clause id="idADB95DB7F30C4EBBB7C3553EE0916872"><enum>(i)</enum><text> line speeds at covered establishments;</text></clause><clause id="idECA1361CFC304CDB9CB8D328011ABE2F"><enum>(ii)</enum><text>worker safety and health at covered establishments;</text></clause><clause id="id6F30D545EEED49D29807132A25295387"><enum>(iii)</enum><text>ergonomic aspects of jobs at covered establishments; and </text></clause><clause id="id57D71839174E460A968D378691E2FCD5"><enum>(iv)</enum><text>staffing levels that will ensure worker safety at covered establishments.</text></clause></subparagraph><subparagraph id="idB523BED33229436EB97D16C9B4FCB44D"><enum>(B)</enum><header>Requirement</header><text>A report under subparagraph (A) shall include—</text><clause id="idA90B8A5C3BB94CC98FD0B4748D10BB2C"><enum>(i)</enum><text>the results of a study carried out by an industrial engineer on every type of job at covered establishments impacted by the applicable rule;</text></clause><clause id="id2571C8C34CA0419A9FC911B7F06D73D7"><enum>(ii)</enum><text>a determination of the industrial engineer of the number of workers needed—</text><subclause id="idEAF49C1DE8E34AC98CEE2C308A8C43A9"><enum>(I)</enum><text>to do each job safely; and</text></subclause><subclause id="idC02B4E7BB6734A3BB2B10ADFBB9604C7"><enum>(II)</enum><text>to operate the covered establishment at different line speeds; and</text></subclause></clause><clause id="id5FE19A46A6C6444BBBE508C32FB3C50A"><enum>(iii)</enum><text>a job crewing report prepared by the industrial engineer.</text></clause></subparagraph></paragraph></subsection></section></subtitle><subtitle id="idBE3807CF52C947CC80C694C7D2ABDBA0" style="OLC"><enum>B</enum><header>Fair attendance policies</header><section id="id07f3257d274b46b497c99a95ec6073eb"><enum>111.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph commented="no" display-inline="no-display-inline" id="HD6C11C8193EF499B9DBAFE2AAD1463A7"><enum>(1)</enum><header display-inline="yes-display-inline">Employee</header><text display-inline="yes-display-inline">The term <term>employee</term> means an individual who is—</text><subparagraph commented="no" display-inline="no-display-inline" id="H38A19C6B001746F5869AB549DEC03322"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HA97EAFA15B2E4E28AE699B8FAF9C4BEB"><enum>(i)</enum><text display-inline="yes-display-inline">an employee, as defined in section 3(e) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(e)</external-xref>), who is not covered under subparagraph (E), including such an employee of the Library of Congress, except that a reference in such section to an employer shall be considered to be a reference to an employer described in clauses (i)(I) and (ii) of paragraph (2)(A); or</text></clause><clause commented="no" display-inline="no-display-inline" id="HAA207F349D484C4BA76F19D6C4E88AB8" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">an employee of the Government Accountability Office;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4917D5E7D52745F88509FD24BD8BF552"><enum>(B)</enum><text display-inline="yes-display-inline">a State employee described in section 304(a) of the Government Employee Rights Act of 1991 (42 U.S.C. 2000e–16c(a));</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H048DBA18240E470B953A5CAC82374884"><enum>(C)</enum><text display-inline="yes-display-inline">a covered employee, as defined in section 101 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1A23FBB3E1F64425B4974AB16E2AABB8"><enum>(D)</enum><text display-inline="yes-display-inline">a covered employee, as defined in section 411(c) of title 3, United States Code; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF15C74E2E9AC4BE28A6373FB84871444"><enum>(E)</enum><text display-inline="yes-display-inline">a Federal officer or employee covered under subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code (without regard to the limitation in section 6381(1)(B) of that title).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6E5EAA6E933048F0814D832AC4D40D9C"><enum>(2)</enum><header display-inline="yes-display-inline">Employer</header><subparagraph commented="no" display-inline="no-display-inline" id="HEC94BB2F8DD74B198DDD1E9E0AB512C2"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>employer</term> means a person who is—</text><clause commented="no" display-inline="no-display-inline" id="H72890FB99EBE4F9296B7DCE59587DC15"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H83D59E73E52845D0BFD689BC02988740"><enum>(I)</enum><text display-inline="yes-display-inline">a covered employer, as defined in subparagraph (B), who is not covered under any other subclause of this clause;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H3E388A84385C4371A07169301C00C991" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">an entity employing a State employee described in section 304(a) of the Government Employee Rights Act of 1991;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HA7898BDB823E4595A3AD65E2066AA52D" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">an employing office, as defined in section 101 of the Congressional Accountability Act of 1995;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H5DAA6AFB939C42EA8E39CA8EFB9A3789" indent="up1"><enum>(IV)</enum><text display-inline="yes-display-inline">an employing office, as defined in section 411(c) of title 3, United States Code; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HF1978330E6764FADBC665BBBF1024C40" indent="up1"><enum>(V)</enum><text display-inline="yes-display-inline">an employing agency covered under subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HB102D12882234077878B96B3B8AFF7E2"><enum>(ii)</enum><text display-inline="yes-display-inline">engaged in commerce (including government), or an industry or activity affecting commerce (including government), as defined in subparagraph (B)(iii).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE30D8BC11F2743DF9377E3CEFC6C32BF"><enum>(B)</enum><header display-inline="yes-display-inline">Covered employer</header><clause commented="no" display-inline="no-display-inline" id="H3AA789D12B75409EB11980873FAAE811"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In subparagraph (A)(i)(I), the term <term>covered employer</term>—</text><subclause commented="no" display-inline="no-display-inline" id="HF9A3107240174D6A8215BF3435ED6A37"><enum>(I)</enum><text display-inline="yes-display-inline">means any person engaged in commerce or in any industry or activity affecting commerce who employs 15 or more employees for each working day during each of 20 or more calendar workweeks in the current or preceding year;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HEE7293C4B9B842929E49B4405B486D3D"><enum>(II)</enum><text display-inline="yes-display-inline">includes—</text><item commented="no" display-inline="no-display-inline" id="HE780A2B85BCF4C4D99C1084AEB4C9E6D"><enum>(aa)</enum><text display-inline="yes-display-inline">any person who acts, directly or indirectly, in the interest of an employer to any of the employees of such employer; and</text></item><item commented="no" display-inline="no-display-inline" id="HEE1253EF36A94377A79C07AA4B9AB167"><enum>(bb)</enum><text display-inline="yes-display-inline">any successor in interest of an employer;</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="HA060AB8274DF49CBA842898B5DD1FD49"><enum>(III)</enum><text display-inline="yes-display-inline">includes any public agency, as defined in section 3(x) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(x)</external-xref>); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H2592049C77CD48AAA00AC3A4B143F39F"><enum>(IV)</enum><text display-inline="yes-display-inline">includes the Government Accountability Office and the Library of Congress.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H2AFC24933B154A51998D6D71AB83ACD4"><enum>(ii)</enum><header display-inline="yes-display-inline">Public agency</header><text display-inline="yes-display-inline">For purposes of clause (i)(III), a public agency shall be considered to be a person engaged in commerce or in an industry or activity affecting commerce.</text></clause><clause commented="no" display-inline="no-display-inline" id="HF2727E480A5B490088219C0F0D76FF9E"><enum>(iii)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">For purposes of this subparagraph:</text><subclause commented="no" display-inline="no-display-inline" id="H55DBD164583045209727B4A2AC6407CC"><enum>(I)</enum><header display-inline="yes-display-inline">Commerce</header><text display-inline="yes-display-inline">The terms <term>commerce</term> and <term>industry or activity affecting commerce</term> mean any activity, business, or industry in commerce or in which a labor dispute would hinder or obstruct commerce or the free flow of commerce, and include commerce and any industry affecting commerce, as defined in paragraphs (1) and (3) of section 501 of the Labor Management Relations Act, 1947 (<external-xref legal-doc="usc" parsable-cite="usc/29/142">29 U.S.C. 142</external-xref>).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H8A65FD935AF54374B09CBF5C8DD0DD58"><enum>(II)</enum><header display-inline="yes-display-inline">Employee</header><text display-inline="yes-display-inline">The term <term>employee</term> has the meaning given such term in section 3(e) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(e)</external-xref>).</text></subclause></clause></subparagraph><subparagraph id="H42F50C8A6B114A70A382E631A06815AD" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Predecessors</header><text display-inline="yes-display-inline">Any reference in this paragraph to an employer shall include a reference to any predecessor of such employer. </text></subparagraph></paragraph><paragraph id="id22C4F483761342769C31A856F2A33345"><enum>(3)</enum><header>Legally protected leave</header><text>The term <term>legally protected leave</term>, when used with respect to an employee, means leave that is protected under a Federal, State, or local law applicable to the employee.</text></paragraph><paragraph id="id0ece38b9135f4e719f4af50149e3b4d8"><enum>(4)</enum><header>No fault attendance policy</header><text>The term <term>no fault attendance policy</term> means a policy or pattern and practice maintained by an employer under which employees face consequences for any absence, tardy, or early departure through the assessment of points (also referred to as <quote>demerits</quote> or <quote>occurrences</quote>) or deductions from an allotted bank of time, and those points or deductions subject the employee to progressive disciplinary action, which may include failure to receive a promotion, loss of pay, or termination. </text></paragraph><paragraph id="id3ee788e99c194e0cb86c46c2daee1a47" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Person</header><text>The term <term>person</term> has the meaning given such term in section 701(a) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e(a)</external-xref>).</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id1F0E6C155B73489990FAC1FAB05DB4BE"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor, acting through the Administrator of the Wage and Hour Division.</text></paragraph></section><section id="id17f77b1c246540dc91af717c2295c50f"><enum>112.</enum><header>Requirements for employers relating to no fault attendance policies or attendance systems</header><subsection id="id8510380496784689B8CA2314D72F45AB"><enum>(a)</enum><header>Requirements for no fault attendance policy</header><text display-inline="yes-display-inline">It shall be considered an unlawful employment practice for an employer to maintain a no fault attendance policy, unless the employer complies with the following:</text><paragraph id="id47324411846f4664ab9936e76f6fe24e"><enum>(1)</enum><text>The no fault attendance policy shall be distributed in writing—</text><subparagraph id="id1C83F30FA58D4ADD88B02BC17034826F"><enum>(A)</enum><text>not later than 90 days after the date of enactment of this Act, to all employees employed by the employer as of that date of distribution; and</text></subparagraph><subparagraph id="idB8DF10DDF9C34C549890D0ACB9510459"><enum>(B)</enum><text>with respect to each employee hired by the employer after such date of enactment, upon the commencement of the employee's employment.</text></subparagraph></paragraph><paragraph id="idE682B10024EB4D129CDE12F802ED6C9C"><enum>(2)</enum><text>If any changes are made to the no fault attendance policy, the no fault attendance policy shall be distributed in writing to all employees by not later than 30 days after the date of the changes. </text></paragraph><paragraph id="idcd1647cfcb6545c1a38d082317e1dcfd"><enum>(3)</enum><text>The employer shall provide employees with a means of accessing the no fault attendance policy at any physical workplace and outside of a physical workplace.</text></paragraph><paragraph id="id2db1867298af4321a03fd2d98e0066ca"><enum>(4)</enum><text>The no fault attendance policy shall explicitly state that employees will not face disciplinary action or other adverse consequences, which may include the assessment of points or a deduction from an allotted bank of time, for legally protected leave. </text></paragraph><paragraph id="ide8587258b51a4a1f85a5e9f61bbc2e6d"><enum>(5)</enum><text>The no fault attendance policy shall specifically reference and provide a reasonable amount of detail about all Federal, State, and local laws applicable to the employees that provide legally protected leave, including the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>), the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2601">29 U.S.C. 2601 et seq.</external-xref>), and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">chapter 43</external-xref> of title 38, United States Code.</text></paragraph><paragraph id="idc76a0938120e4c00906a7e073feebe39"><enum>(6)</enum><text>The no fault attendance policy shall identify a process for employees to complete each of the following:</text><subparagraph id="ida4b3ad41edb04987bf292037163cbd0c"><enum>(A)</enum><text>Report that an absence is for legally protected leave.</text></subparagraph><subparagraph id="idee7797af894143d397b2483f7dc74230"><enum>(B)</enum><text>Provide medical documentation, if it is required under the no fault attendance policy in order to avoid disciplinary action or other adverse consequences for legally protected leave.</text></subparagraph><subparagraph id="id2c501c8c869541c69b360fb3e5df41d5"><enum>(C)</enum><text>Seek removal of points that an employee believes were wrongly assessed, or the restoration of time that an employee believes was wrongly deducted for legally protected leave.</text></subparagraph><subparagraph id="idd310796591cf4849bdbc71defed1d7d2"><enum>(D)</enum><text>Delay the reporting of an absence in unforeseen or emergency circumstances without incurring additional points or discipline.</text></subparagraph></paragraph></subsection><subsection id="id641c74180c394769855a8e7ee97c110b"><enum>(b)</enum><header>Requirements for attendance systems</header><text>It shall be an unlawful employment practice for an employer to maintain any attendance system policy, or pattern and practice, that discourages employees from exercising, or attempting to exercise, any right to legally protected leave.</text></subsection><subsection id="idB3B2FF978BE54902B2E3680C317FB2A5"><enum>(c)</enum><header>Additional prohibitions</header><paragraph commented="no" display-inline="no-display-inline" id="HBCC89D3D64014724B461E11640279911"><enum>(1)</enum><header display-inline="yes-display-inline">Interference with rights</header><subparagraph commented="no" display-inline="no-display-inline" id="H7C2E0C1CFF354755AC20E4E3EC147188"><enum>(A)</enum><header display-inline="yes-display-inline">Exercise of rights</header><text display-inline="yes-display-inline">It shall be an unlawful employment practice for any employer to interfere with, restrain, or deny the exercise of, or the attempt to exercise, any right provided under this subtitle, including—</text><clause commented="no" display-inline="no-display-inline" id="H79B4F9F9B60C494EA59A452B7CE197A8"><enum>(i)</enum><text display-inline="yes-display-inline">discharging or discriminating against (including retaliating against) any individual for exercising, or attempting to exercise, any right provided under this subtitle; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H319F7F2339AB46DEA2610C238FC0B6ED"><enum>(ii)</enum><text display-inline="yes-display-inline">using the taking of legally protected leave as a negative factor in an employment action, such as hiring, promotion, reducing hours or number of shifts, or a disciplinary action.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H11B97313C45C46A88319D19B7D374595"><enum>(B)</enum><header display-inline="yes-display-inline">Discrimination</header><text display-inline="yes-display-inline">It shall be an unlawful employment practice for any employer to discharge or in any other manner discriminate against (including retaliating against) any individual for opposing any practice made unlawful by this subtitle.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H69A48DF16DA2418DAFACEC7E6A7F28DC"><enum>(2)</enum><header display-inline="yes-display-inline">Interference with proceedings or inquiries</header><text display-inline="yes-display-inline">It shall be an unlawful employment practice for any person to discharge or in any other manner discriminate against (including retaliating against) any individual because such individual—</text><subparagraph commented="no" display-inline="no-display-inline" id="H060426F5F0794D719FF48345F78726E1"><enum>(A)</enum><text display-inline="yes-display-inline">has filed an action, or has instituted or caused to be instituted any proceeding, under or related to this subtitle;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H20FE53B60EC94EDD91845F30644BCB1E"><enum>(B)</enum><text display-inline="yes-display-inline">has given, or is about to give, any information in connection with any inquiry or proceeding relating to any right provided under this subtitle; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6FC9B569D4E44DAFAF8CCAB504EC75DC"><enum>(C)</enum><text display-inline="yes-display-inline">has testified, or is about to testify, in any inquiry or proceeding relating to any right provided under this subtitle.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H896C74EBBF5D42B6A61B7640996B5F9F"><enum>113.</enum><header display-inline="yes-display-inline">Enforcement authority</header><subsection commented="no" display-inline="no-display-inline" id="H0A0A65E64779424BAB2A62FE9164535C"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><paragraph commented="no" display-inline="no-display-inline" id="H1BED8391E9B34978BDF8C3D2ABE5CD67"><enum>(1)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this subsection—</text><subparagraph commented="no" display-inline="no-display-inline" id="H386AB913EAA44D85AECF3E7B7C996676"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>employee</term> means an employee described in subparagraph (A) or (B) of section 111(1); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF62CD2E771CF4FAE9ED18A51A5CEDEB7"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>employer</term> means an employer described in clauses (i)(I) and (ii) of section 111(2)(A) or clauses (i)(II) and (ii) of such section; and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idE9A6C04911F641C4BEEDB2D1707F7EE3"><enum>(C)</enum><text>the term <term>other individual affected</term> does not include an individual covered under subsection (b), (c), or (d).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC05CDA7BE980476396A6AEB5DC30D50E"><enum>(2)</enum><header display-inline="yes-display-inline">Investigative authority</header><subparagraph commented="no" display-inline="no-display-inline" id="H7E4A5FCA0FBD4C908415EF11DBA76353"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To ensure compliance with the provisions of this subtitle, or any regulation or order issued under this subtitle, the Secretary shall have the investigative authority provided under section 11(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/211">29 U.S.C. 211(a)</external-xref>), with respect to employers, employees, and other individuals affected.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC5FB77E857A345E0B666B1F2550ABB6E"><enum>(B)</enum><header display-inline="yes-display-inline">Subpoena authority</header><text display-inline="yes-display-inline">For the purposes of any investigation provided for in this paragraph, the Secretary shall have the subpoena authority provided for under section 9 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/209">29 U.S.C. 209</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0A5F9F75D4CC49C5BF70B4DBFFA97147"><enum>(3)</enum><header display-inline="yes-display-inline">Civil action by employees or other individuals affected</header><subparagraph commented="no" display-inline="no-display-inline" id="HC85AC543E20B4FAD867B090CC95284CD"><enum>(A)</enum><header display-inline="yes-display-inline">Right of action</header><text display-inline="yes-display-inline">An action to recover the damages or equitable relief prescribed in subparagraph (B) may be maintained against any employer in any Federal or State court of competent jurisdiction by one or more employees or other individuals affected or their representative for and on behalf of—</text><clause commented="no" display-inline="no-display-inline" id="HD23409A7802F450E8DB0B3179F5EB662"><enum>(i)</enum><text display-inline="yes-display-inline">the employees or individuals; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H39DA68EEBFD9455B8208D02F62A051FE"><enum>(ii)</enum><text display-inline="yes-display-inline">the employees or individuals and others similarly situated.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAEAD0456F4AF4E75BA9C9A9896511C9B"><enum>(B)</enum><header display-inline="yes-display-inline">Liability</header><text display-inline="yes-display-inline">Any employer who violates section 112 shall be liable to any employee or other individual affected—</text><clause commented="no" display-inline="no-display-inline" id="H3BCAF6B9A41B4135960A33CDD674FA3B"><enum>(i)</enum><text display-inline="yes-display-inline">for damages equal to—</text><subclause commented="no" display-inline="no-display-inline" id="H13E68CED1D4B4975A6A865DA8B5B1E74"><enum>(I)</enum><text display-inline="yes-display-inline">the amount of—</text><item commented="no" display-inline="no-display-inline" id="HBCF1721FC8C944A6A0C29997DA5C1BA7"><enum>(aa)</enum><text display-inline="yes-display-inline">any wages, salary, employment benefits, or other compensation denied or lost by reason of the violation; or</text></item><item commented="no" display-inline="no-display-inline" id="HE1C6B18B6B494813B8942F17379305CE"><enum>(bb)</enum><text display-inline="yes-display-inline">in a case in which wages, salary, employment benefits, or other compensation have not been denied or lost, any actual monetary losses sustained as a direct result of the violation up to a sum equal to 56 hours of wages or salary for the employee or individual;</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H9662AC14F62B4BAA8994845C0780977A"><enum>(II)</enum><text display-inline="yes-display-inline">the interest on the amount described in subclause (I) calculated at the prevailing rate; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HA235928740944B8AAAD2FB8E0A3C3854"><enum>(III)</enum><text display-inline="yes-display-inline">an additional amount as liquidated damages; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H83690DEBDAAE4A7A9092A3AC4EA19938"><enum>(ii)</enum><text display-inline="yes-display-inline">for such equitable relief as may be appropriate, including employment, reinstatement, and promotion.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEF3D9ACEFDC841758A794AE7116F8BB6"><enum>(C)</enum><header display-inline="yes-display-inline">Fees and costs</header><text display-inline="yes-display-inline">The court in an action under this paragraph shall, in addition to any judgment awarded to the plaintiff, allow a reasonable attorney’s fee, reasonable expert witness fees, and other costs of the action to be paid by the defendant.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H88BD6555009645ADADA624388895A248"><enum>(4)</enum><header display-inline="yes-display-inline">Action by the Secretary</header><subparagraph commented="no" display-inline="no-display-inline" id="HDE9882AC34BB4727903BE276AE5B887E"><enum>(A)</enum><header display-inline="yes-display-inline">Administrative action</header><text display-inline="yes-display-inline">The Secretary shall receive, investigate, and attempt to resolve complaints of violations of section 112 with respect to employers, employees, and other individuals affected in the same manner that the Secretary receives, investigates, and attempts to resolve complaints of violations of sections 6 and 7 of the Fair Labor Standards Act of 1938 (29 U.S.C. 206 and 207).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCA911ED6234D45FEA2D71A19A29818D0"><enum>(B)</enum><header display-inline="yes-display-inline">Civil action</header><text display-inline="yes-display-inline">The Secretary may bring an action in any court of competent jurisdiction to recover the damages described in paragraph (3)(B)(i).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAEFCCD3A8D414178937992073E66B723"><enum>(C)</enum><header display-inline="yes-display-inline">Sums recovered</header><text display-inline="yes-display-inline">Any sums recovered by the Secretary pursuant to subparagraph (B) shall be held in a special deposit account and shall be paid, on order of the Secretary, directly to each employee or other individual affected. Any such sums not paid to an employee or other individual affected because of inability to do so within a period of 3 years shall be deposited into the Treasury of the United States as miscellaneous receipts.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6EFB5D1901C948F98C04BA5AB47A6096"><enum>(5)</enum><header display-inline="yes-display-inline">Limitation</header><subparagraph commented="no" display-inline="no-display-inline" id="H312FCBBCA98D4F1FAD163FE83794D1BC"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), an action may be brought under paragraph (3), (4), or (6) not later than 2 years after the date of the last event constituting the alleged violation for which the action is brought.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H90D6AAC1F05A4E9CB18A5C40AACB078D"><enum>(B)</enum><header display-inline="yes-display-inline">Willful violation</header><text display-inline="yes-display-inline">In the case of an action brought for a willful violation of section 112, such action may be brought not later than 3 years after of the last event constituting the alleged violation for which such action is brought.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2648D78CECBF4EE2A8137677170BEE24"><enum>(C)</enum><header display-inline="yes-display-inline">Commencement</header><text display-inline="yes-display-inline">In determining when an action is commenced under paragraph (3), (4), or (6) for the purposes of this paragraph, it shall be considered to be commenced on the date when the complaint is filed.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCC2FFD1BDC8A40C8A304417CE6A1BB5C"><enum>(6)</enum><header display-inline="yes-display-inline">Action for injunction by Secretary</header><text display-inline="yes-display-inline">The district courts of the United States shall have jurisdiction, for cause shown, in an action brought by the Secretary—</text><subparagraph commented="no" display-inline="no-display-inline" id="H22AA4DE6176949069C87C5428B433AAF"><enum>(A)</enum><text display-inline="yes-display-inline">to restrain violations of section 112, including the restraint of any withholding of payment of wages, salary, employment benefits, or other compensation, plus interest, found by the court to be due to employees or individuals eligible under this subtitle; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H458B989E26E74B348315C1D01FF71857"><enum>(B)</enum><text display-inline="yes-display-inline">to award such other equitable relief as may be appropriate, including employment, reinstatement, and promotion.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0A8CA51FECC846D08BDDACE1B68782CC"><enum>(7)</enum><header display-inline="yes-display-inline">Solicitor of Labor</header><text display-inline="yes-display-inline">The Solicitor of Labor may appear for and represent the Secretary on any litigation brought under paragraph (4) or (6).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9BF8AD8C78E44BFD877714A94073B7F8"><enum>(8)</enum><header display-inline="yes-display-inline">Government Accountability Office and Library of Congress</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this subsection, in the case of the Government Accountability Office and the Library of Congress, the authority of the Secretary of Labor under this subsection shall be exercised respectively by the Comptroller General of the United States and the Librarian of Congress.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8405466C379E42DABFFD658D8B76E110"><enum>(b)</enum><header display-inline="yes-display-inline">Employees covered by Congressional Accountability Act of 1995</header><text display-inline="yes-display-inline">The powers, remedies, and procedures provided in the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301 et seq.</external-xref>) to the Board (as defined in section 101 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>)), or any person, alleging a violation of section 202(a)(1) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1312">2 U.S.C. 1312(a)(1)</external-xref>) shall be the powers, remedies, and procedures this subtitle provides to that Board, or any person, alleging an unlawful employment practice in violation of this subtitle against an employee described in section 111(1)(C) or other individual affected by an employer described in clauses (i)(III) and (ii) of section 111(2)(A). </text></subsection><subsection commented="no" display-inline="no-display-inline" id="H2D86D8F93A89442C8CE14A9F8F11109F"><enum>(c)</enum><header display-inline="yes-display-inline">Employees covered by chapter <enum-in-header>5</enum-in-header> of title <enum-in-header>3</enum-in-header>, United States Code</header><text display-inline="yes-display-inline">The powers, remedies, and procedures provided in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/3/5">chapter 5</external-xref> of title 3, United States Code, to the President, the Merit Systems Protection Board, or any person, alleging a violation of section 412(a)(1) of that title, shall be the powers, remedies, and procedures this subtitle provides to the President, that Board, or any person, respectively, alleging an unlawful employment practice in violation of this subtitle against an employee described in section 111(1)(D) or other individual affected by an employer described in clauses (i)(IV) and (ii) of section 111(2)(A). </text></subsection><subsection commented="no" display-inline="no-display-inline" id="H37E613C9827E4F8AAE89C7A2A52564D4"><enum>(d)</enum><header display-inline="yes-display-inline">Employees covered by chapter <enum-in-header>63 </enum-in-header>of title <enum-in-header>5,</enum-in-header> United States Code</header><text display-inline="yes-display-inline">The powers, remedies, and procedures provided in title 5, United States Code, to an employing agency, provided in chapter 12 of that title to the Merit Systems Protection Board, or provided in that title to any person, alleging a violation of chapter 63 of that title, shall be the powers, remedies, and procedures this subtitle provides to that agency, that Board, or any person, respectively, alleging an unlawful employment practice in violation of this subtitle against an employee described in section 111(1)(E) or other individual affected by an employer described in clauses (i)(V) and (ii) of section 111(2)(A). </text></subsection></section><section id="id1db1c1a729da4f2abe2f586934729818"><enum>114.</enum><header>Regulations</header><subsection commented="no" display-inline="no-display-inline" id="H89D3853B2CDE451A8B0988859E1DAE41"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><paragraph commented="no" display-inline="no-display-inline" id="H44FBD443B7B64EC2937B546DCA3DB86F"><enum>(1)</enum><header display-inline="yes-display-inline">Authority</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), not later than 180 days after the date of enactment of this Act, the Secretary, in coordination with the Equal Employment Opportunity Commission and the heads of other relevant Federal agencies, shall prescribe such regulations as are necessary to carry out this subtitle with respect to employees described in subparagraph (A) or (B) of section 111(1) and other individuals affected by employers described in clauses (i)(I) and (ii) of section 111(2)(A) or clauses (i)(II) and (ii) of such section. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H925D6F30A34645BA8F92BC53CBB6E2D0"><enum>(2)</enum><header display-inline="yes-display-inline">Government Accountability Office; Library of Congress</header><text display-inline="yes-display-inline">The Comptroller General of the United States and the Librarian of Congress shall prescribe the regulations with respect to employees of the Government Accountability Office and the Library of Congress, respectively, and other individuals affected by the Comptroller General of the United States and the Librarian of Congress, respectively.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H71B902E6108B4F31A2B03E918F052AA5"><enum>(b)</enum><header display-inline="yes-display-inline">Employees covered by Congressional Accountability Act of 1995</header><paragraph commented="no" display-inline="no-display-inline" id="H22A221A8853E47419BE96585369E6CBA"><enum>(1)</enum><header display-inline="yes-display-inline">Authority</header><text display-inline="yes-display-inline">Not later than 90 days after the Secretary prescribes regulations under subsection (a), the Board of Directors of the Office of Compliance shall prescribe (in accordance with section 304 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1384">2 U.S.C. 1384</external-xref>)) such regulations as are necessary to carry out this subtitle with respect to employees described in section 111(1)(C) and other individuals affected by employers described in clauses (i)(III) and (ii) of section 111(2)(A).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H84ACBB5B95FF4750ACC56FE3EA4DF979"><enum>(2)</enum><header display-inline="yes-display-inline">Agency regulations</header><text display-inline="yes-display-inline">The regulations prescribed under paragraph (1) shall be the same as substantive regulations promulgated by the Secretary to carry out this subtitle except insofar as the Board may determine, for good cause shown and stated together with the regulations prescribed under paragraph (1), that a modification of such regulations would be more effective for the implementation of the rights and protections involved under this section.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H47FD906A24E54C189BE5DB703BFC8764"><enum>(c)</enum><header display-inline="yes-display-inline">Employees covered by chapter <enum-in-header>5</enum-in-header> of title <enum-in-header>3</enum-in-header>, United States Code</header><paragraph commented="no" display-inline="no-display-inline" id="HD2B9768BAC594A2B981AA7F5233AFBDD"><enum>(1)</enum><header display-inline="yes-display-inline">Authority</header><text display-inline="yes-display-inline">Not later than 90 days after the Secretary prescribes regulations under subsection (a), the President (or the designee of the President) shall prescribe such regulations as are necessary to carry out this subtitle with respect to employees described in section 111(1)(D) and other individuals affected by employers described in clauses (i)(IV) and (ii) of section 111(2)(A).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3CA816E207B34DB18B5D8779FC36E0CF"><enum>(2)</enum><header display-inline="yes-display-inline">Agency regulations</header><text display-inline="yes-display-inline">The regulations prescribed under paragraph (1) shall be the same as substantive regulations promulgated by the Secretary to carry out this subtitle except insofar as the President (or designee) may determine, for good cause shown and stated together with the regulations prescribed under paragraph (1), that a modification of such regulations would be more effective for the implementation of the rights and protections involved under this section.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB3AAA843D98A43EB9C69630CA7274359"><enum>(d)</enum><header display-inline="yes-display-inline">Employees covered by chapter <enum-in-header>63</enum-in-header> of title <enum-in-header>5</enum-in-header>, United States Code</header><paragraph commented="no" display-inline="no-display-inline" id="H7734F674FEB24011B2D65C75DFE2EE81"><enum>(1)</enum><header display-inline="yes-display-inline">Authority</header><text display-inline="yes-display-inline">Not later than 90 days after the Secretary prescribes regulations under subsection (a), the Director of the Office of Personnel Management shall prescribe such regulations as are necessary to carry out this subtitle with respect to employees described in section 111(1)(E) and other individuals affected by employers described in clauses (i)(V) and (ii) of section 111(2)(A).</text></paragraph><paragraph id="HB728135E26D64205801807B01617967D" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Agency regulations</header><text display-inline="yes-display-inline">The regulations prescribed under paragraph (1) shall be the same as substantive regulations promulgated by the Secretary to carry out this subtitle except insofar as the Director may determine, for good cause shown and stated together with the regulations prescribed under paragraph (1), that a modification of such regulations would be more effective for the implementation of the rights and protections involved under this section. </text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="id385B06E5291D4ECAAF804508D8CD09BD"><enum>(e)</enum><header>Requirements for all regulations</header><text>All regulations prescribed under this section shall—</text><paragraph display-inline="no-display-inline" commented="no" id="idAE5FA3B886BC4A049D9A6FEB9098D19A"><enum>(1)</enum><text>be issued in an accessible format in accordance with subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code; and</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id0600E19DB4764189AE92B80C7132B616"><enum>(2)</enum><text>provide an example of a model no fault attendance policy that conforms to the requirements of this subtitle.</text></paragraph></subsection></section><section id="idAF208324CA4040ECA9F2E435EC2E1EF2"><enum>115.</enum><header>Relationship to other laws</header><text display-inline="no-display-inline">Nothing in this subtitle shall be construed to invalidate or limit the powers, remedies, and procedures under any Federal law or law of any State or political subdivision of any State or jurisdiction that provide leave rights, whether paid or unpaid (such as sick time, family or medical leave, and time off as an accommodation).</text></section><section id="idbb4407464c8b4fea8d85637e799c1c57"><enum>116.</enum><header>Waiver of State immunity</header><text display-inline="no-display-inline">A State shall not be immune under the 11th Amendment to the Constitution of the United States from an action in a Federal or State court of competent jurisdiction for a violation of this subtitle. In any action against a State for a violation of this subtitle, remedies (including remedies both at law and in equity) are available for such a violation to the same extent as such remedies are available for such a violation in an action against any public or private entity other than a State. </text></section><section id="id0fc650fa7eeb48cdb21140ac7c3deded" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>117.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this subtitle or the application of that provision to particular persons or circumstances is held invalid or found to be unconstitutional, the remainder of this subtitle and the application of that provision to other persons or circumstances shall not be affected. </text></section></subtitle><subtitle id="id2E548634E1F748C985A18225423263D7" style="OLC"><enum>C</enum><header>Occupational Safety and Health Administration Reforms</header><section id="id3919cb5231c34a7c8be436277a6450e0"><enum>121.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title, the terms <term>Secretary</term> and <term>State</term> have the meanings given such terms in section 3 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/652">29 U.S.C. 652</external-xref>).</text></section><section id="id35446b21532f4adaabbae41d95b89e11"><enum>122.</enum><header>Ensuring compliance with employee rights to use toilet facilities at covered establishments</header><subsection id="id42868bf3ffd24a3c82b97fd104c3e0b3"><enum>(a)</enum><header>In general</header><text>During any inspection of a covered establishment conducted pursuant to section 8 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/657">29 U.S.C. 657</external-xref>), the Secretary shall verify that the employer of employees working at such establishment is in compliance with the occupational safety and health standard set forth in section 1910.141 of title 29, Code of Federal Regulations, as in effect on the day before the date of enactment of this Act, for employers to provide prompt access for employees to visit and use toilet facilities, including such standard as interpreted by the memorandum for regional administrators and State designees regarding <quote>Interpretation of 29 CFR. 1910.141(c)(1): Toilet Facilities</quote> issued by the Occupational Safety and Health Administration on April 6, 1998.</text></subsection><subsection id="id92285e18520444c798d8d482ae010b10" commented="no"><enum>(b)</enum><header>Requirements</header><text>In carrying out subsection (a), the Secretary shall verify that the employer described in such subsection—</text><paragraph id="ide397e8bceafb488bb2ca630ffd515a87"><enum>(1)</enum><text>allows employees to leave their work locations to use a toilet facility when needed and without punishment;</text></paragraph><paragraph id="id964a828e05b941dfa14e9b935e46dc01"><enum>(2)</enum><text>provides an adequate number of toilet facilities for the size of the workforce to prevent long lines;</text></paragraph><paragraph id="ida7a76c1490124ecfa249e3e74305cbd9"><enum>(3)</enum><text>avoids imposing unreasonable restrictions including waiting lists on the use of toilet facilities; </text></paragraph><paragraph id="ida0e0a0a2b8004b0e8392300421076173" commented="no"><enum>(4)</enum><text>ensures that restrictions, such as locking doors or requiring employees to sign out a key, do not cause extended delays in access to toilet facilities; and</text></paragraph><paragraph id="id184cba98464b4c409d3394bbaf47fd4d"><enum>(5)</enum><text>compensates each employee for breaks for using toilet facilities at the regular rate of pay of the employee in accordance with section 785.18 of title 29, Code of Federal Regulations, as in effect on the day before the date of enactment of this Act, and any other applicable Federal, State, or local law. </text></paragraph></subsection></section><section id="id154440297fd74a00844a588be1b96e1f"><enum>123.</enum><header>Occupational safety and health standards to protect employees in covered establishments</header><subsection id="id94870887517240168949f7672de4af1c"><enum>(a)</enum><header>Standard for protecting employees from occupational risk factors causing musculoskeletal disorders</header><paragraph id="id4612f5f0db014207b999f2c6a5787c98"><enum>(1)</enum><header>Proposed standard</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall, pursuant to section 6 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/655">29 U.S.C. 655</external-xref>), publish in the Federal Register a proposed standard for ergonomic program management for covered establishments. Such proposed standard shall include requirements for—</text><subparagraph id="id5a4ed861c8444d94b492b60a5c7e99f4"><enum>(A)</enum><text>hazard identification and ergonomic job evaluations, including requirements for employee and authorized employee representative participation in such identification;</text></subparagraph><subparagraph id="idb0cc568d5f254d0f83edeeb34694eedb"><enum>(B)</enum><text>hazard control, which such requirements rely on the principles of the hierarchy of controls and which may include measures such as rest breaks, equipment and workstation redesign, work pace reductions, or job rotation to less forceful or repetitive jobs;</text></subparagraph><subparagraph id="id3f807a466cc2474aafd0ec1beda43a7e"><enum>(C)</enum><text>training for employees regarding employer activities, occupational risk factors, and training on controls and recognition of symptoms of musculoskeletal disorders; and</text></subparagraph><subparagraph id="id70d3b16bfbff44c1b932d325ed40b173"><enum>(D)</enum><text>medical management that includes—</text><clause id="id1bb2e58d2fa44f83aba555026d01415d"><enum>(i)</enum><text>encouraging early reporting of musculoskeletal disorder symptoms;</text></clause><clause id="idada94a8289d64ffe8e3f986478d259f4"><enum>(ii)</enum><text>first aid delivered by those operating under State licensing requirements; and</text></clause><clause id="id522013f2be574c48b07584cfe7c27c8d"><enum>(iii)</enum><text>systematic evaluation and early referral for medical attention.</text></clause></subparagraph></paragraph><paragraph id="ide710448540f84d1087a8d1b929065f13"><enum>(2)</enum><header>Final standard</header><text>Not later than 30 months after the date of enactment this Act, the Secretary shall, pursuant to section 6 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/655">29 U.S.C. 655</external-xref>), publish in the Federal Register a final standard based on the proposed standard under paragraph (1).</text></paragraph></subsection><subsection id="id093d3072533a4e2da11e9220661125c1"><enum>(b)</enum><header>Standard for protecting employees from delays in medical treatment referrals following injuries or illnesses</header><paragraph id="id8bda5b5ce285424ab8e9969706aa8fcf"><enum>(1)</enum><header>Proposed standard</header><text>Not later than 3 months after the date of enactment of this Act, the Secretary shall, pursuant to section 6 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/655">29 U.S.C. 655</external-xref>), publish in the Federal Register a proposed standard requiring that all employers with employees working at a covered establishment who, in accordance with the standard promulgated under section 1910.151 of title 29, Code of Federal Regulations, as in effect on the day before the date of enactment of this Act, are required to have a person readily available at the establishment who is adequately trained to render first aid, shall ensure that such person—</text><subparagraph id="id19fae219f43a45a68cfda5d66aa26887"><enum>(A)</enum><text>without delay, refers any such employee who reports an injury or illness that requires further medical treatment to an appropriate medical professional of the employee’s choice for such treatment; </text></subparagraph><subparagraph id="id1fa865a300ea493f93a0f4d49499f3f9" commented="no"><enum>(B)</enum><text>provides for occupational medicine consultation services through a physician who is board certified in occupational medicine, which services shall include—</text><clause commented="no" id="id36EC99DB2DDA47E9BC186AD4A1D5DB6A"><enum>(i)</enum><text>regular review of any health and safety program, medical management program, or ergonomics program of the employer;</text></clause><clause commented="no" id="id648BAD7FE34046F99A79DABBF749BC43"><enum>(ii)</enum><text>review of any work-related injury or illness of an employee;</text></clause><clause commented="no" id="id21A8E51CF1A94D53BF2DABEB483C0E4A"><enum>(iii)</enum><text>providing onsite health services for treatment of such injury or illness; and </text></clause><clause commented="no" id="id5950711167444A69B7CA16E0A06B0BCD"><enum>(iv)</enum><text>consultation referral to a local health care provider for treating such injury or illness; and</text></clause></subparagraph><subparagraph id="ida1db93ae5eb842b6bd3df16aa09b0981"><enum>(C)</enum><text>complies with the licensing requirements for licensed practical nurses or registered nurses in the State in which the establishment is located.</text></subparagraph></paragraph><paragraph id="idb1e51065a2b54a3fbd3711a0c02b3f69"><enum>(2)</enum><header>Final standard</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall, pursuant to section 6 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/655">29 U.S.C. 655</external-xref>), publish in the Federal Register a final standard based on the proposed standard under paragraph (1).</text></paragraph></subsection><subsection id="id46ba52e0dcc542ed90b94e5ca2d11402"><enum>(c)</enum><header>Standard for protecting employees from airborne contagions</header><paragraph id="idd3c6163e5952484cb9b343a5b4ec7c2a"><enum>(1)</enum><header>Emergency temporary standard for COVID–19</header><text>In consideration of the grave danger presented by COVID–19 and the need to strengthen protections for workers at covered establishments, notwithstanding the provisions of law and the Executive orders listed in paragraph (4), not later than 7 days after the date of enactment of this Act, the Secretary of Labor shall promulgate an emergency temporary standard to protect all employees, contractors, and temporary workers at covered establishments from occupational exposure to SARS–CoV–2.</text></paragraph><paragraph id="id9bf71fb0df854780b0b5ddf472244fb9"><enum>(2)</enum><header>Extension of standard</header><text>Notwithstanding paragraphs (2) and (3) of section 6(c) of the Occupational Safety and Health Act of 1970 (29 <external-xref legal-doc="usc" parsable-cite="usc/8/655">8 U.S.C. 655(c)</external-xref>), the emergency temporary standard promulgated under this subsection shall be in effect until the date on which the final standard promulgated under paragraph (5) is in effect.</text></paragraph><paragraph id="idec20bfbdd552434db74d95e7e6c176a3"><enum>(3)</enum><header>State plan adoption</header><text>With respect to a State with a State plan that has been approved by the Secretary of Labor under section 18 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/667">29 U.S.C. 667</external-xref>), not later than 14 days after the date of enactment of this Act, such State shall promulgate an emergency temporary standard that is at least as effective in protecting employees, contractors, and temporary workers at covered establishments from occupational exposure to SARS–CoV–2 as the emergency temporary standard promulgated under this subsection.</text></paragraph><paragraph id="id6a629318194e48c1900fd37856a76caa"><enum>(4)</enum><header>Inapplicable provisions of law and executive order</header><text>The provisions of law and the Executive orders listed in this paragraph are as follows:</text><subparagraph id="id0c2566ac79384f5eab4bec8784abfc39"><enum>(A)</enum><text>The requirements of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/6">chapter 6</external-xref> of title 5, United States Code (commonly referred to as the <quote>Regulatory Flexibility Act</quote>).</text></subparagraph><subparagraph id="id6418706c49bf440c82fc76df005d8b93"><enum>(B)</enum><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly referred to as the <quote>Paperwork Reduction Act</quote>).</text></subparagraph><subparagraph id="idf52351daebbe4c9eab7426169c367e43"><enum>(C)</enum><text>The Unfunded Mandates Reform Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1501">2 U.S.C. 1501 et seq.</external-xref>).</text></subparagraph><subparagraph id="id98ad0ace65344062b1b129e722d14410"><enum>(D)</enum><text>Executive Order 12866 (58 Fed. Reg. 190; relating to regulatory planning and review), as amended.</text></subparagraph><subparagraph id="id58967ba2b775484f8e5515f96e31ef22"><enum>(E)</enum><text>Executive Order 13771 (82 Fed. Reg. 9339, relating to reducing regulation and controlling regulatory costs).</text></subparagraph></paragraph><paragraph id="idae4cb2ab9f244913bc5e5b8d11b5067b"><enum>(5)</enum><header>Final standard</header><text>Not later than 24 months after the date of enactment of this Act, the Secretary of Labor shall, pursuant to section 6 of the Occupational Safety and Health Act (<external-xref legal-doc="usc" parsable-cite="usc/29/655">29 U.S.C. 655</external-xref>), promulgate a final standard—</text><subparagraph id="id419a09aac89c445880b8a172401dc109"><enum>(A)</enum><text>to protect employees, contractors, and temporary workers at covered establishments from occupational exposure to infectious pathogens, including airborne and novel pathogens; and</text></subparagraph><subparagraph id="id812ae494ec564eccb11ebf0eb5009276"><enum>(B)</enum><text>that shall be effective and enforceable in the same manner and to the same extent as a standard promulgated under section 6(b) of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/655">29 U.S.C. 655(b)</external-xref>).</text></subparagraph></paragraph><paragraph id="id83ff045f641b49eab84ce198218f3cb2"><enum>(6)</enum><header>Consultation</header><text>In developing the standards under this subsection, the Secretary shall consult with—</text><subparagraph id="id3224806fc2ad4c03a292f5d5e632f278"><enum>(A)</enum><text>the Director of the Centers for Disease Control and Prevention;</text></subparagraph><subparagraph id="id88cdfcfe3ce144e49d80d5c04ed62432"><enum>(B)</enum><text>the Director of the National Institute for Occupational Safety and Health; and</text></subparagraph><subparagraph id="idd55fd9012ed4402793bd1abe7cd263c2"><enum>(C)</enum><text>the professional associations and representatives of the employees, contractors, and temporary workers at covered establishments.</text></subparagraph></paragraph><paragraph id="idafa14926bed54b2c869cbba74334a9e0"><enum>(7)</enum><header>Requirements</header><text>Each standard promulgated under this subsection shall include—</text><subparagraph id="id47e6071be75247efbbe6c05b66fc4cd3"><enum>(A)</enum><text>a requirement that the covered establishments—</text><clause id="idb94a1702071d4d8c9eb744790f8997b7"><enum>(i)</enum><text>develop and implement a comprehensive infectious disease exposure control plan, with the input and involvement of employees or, where applicable, the representatives of employees, as appropriate, to address the risk of occupational exposure;</text></clause><clause id="id4a35a0ea0037493e9de3231bbe3a4ca2"><enum>(ii)</enum><text>record and report each work-related COVID–19 infection and death, as set forth in part 1904 of title 29, Code of Federal Regulations (as in effect on the date of enactment of this Act), and section 129 of this Act; and</text></clause><clause id="id3ed99e972c344a7db715f61bff1c428e"><enum>(iii)</enum><text>reduce meat and poultry processing rates to achieve social distancing and implement applicable requirements sufficient to protect worker health with an adequate margin of safety;</text></clause></subparagraph><subparagraph id="id8538167a9d2d4cfe9c37c7b8609dacd2"><enum>(B)</enum><text>no less protection for novel pathogens than precautions mandated by standards adopted by a State plan that has been approved by the Secretary under section 18 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/667">29 U.S.C. 667</external-xref>); and</text></subparagraph><subparagraph id="iddbca63bae0094523b5397d6428d3f2f1"><enum>(C)</enum><text>the incorporation, as appropriate, of—</text><clause id="id52348af849d84c5f97475ec3e65b1dee"><enum>(i)</enum><text>guidelines issued by the Centers for Disease Control and Prevention, the National Institute for Occupational Safety and Health, and the Occupational Safety and Health Administration, which are designed to prevent the transmission of infectious agents in health care or other occupational settings; and</text></clause><clause id="id2dba59e864b5421dab95d13a173716da"><enum>(ii)</enum><text>relevant scientific research on airborne and novel pathogens.</text></clause></subparagraph></paragraph><paragraph id="idee8f4baa720f42b2940233bec3e4bb3d"><enum>(8)</enum><header>Enforcement</header><text>This subsection shall be enforced in the same manner and to the same extent as any standard promulgated under section 6(b) of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/655">29 U.S.C. 655(b)</external-xref>). </text></paragraph></subsection></section><section id="idd1290fa363fa422e96b600209d637d80"><enum>124.</enum><header>Permanent regional emphasis inspection program; expanding inspections</header><subsection id="id93476c7d0871488e93d567eec0327423"><enum>(a)</enum><header>Regional emphasis inspection program</header><paragraph id="id1bd9addd610646dea745862cc4c1f1db"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this Act, the Secretary shall, pursuant to section 8 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/657">29 U.S.C. 657</external-xref>), implement a regional emphasis inspection program for covered establishments in every State of the United States in which a covered establishment is located. Such program shall cover—</text><subparagraph id="id5C5A9A6C8C374D3D87D22616AE0355E0" commented="no"><enum>(A)</enum><text>amputation hazards;</text></subparagraph><subparagraph id="idFD57B29E234646FBBFCD9F9AB4A53AEF" commented="no"><enum>(B)</enum><text>ergonomics;</text></subparagraph><subparagraph id="id61E73A55D5DE4382822445D97B8FC6AB" commented="no"><enum>(C)</enum><text>hazards related to line speeds;</text></subparagraph><subparagraph id="id013F3ED3D8DC45AEAB84D9BFAAA947A8" commented="no"><enum>(D)</enum><text>bathroom breaks;</text></subparagraph><subparagraph id="idDD1688DA3A554D3B943808335355E631" commented="no"><enum>(E)</enum><text>use of chemicals such as peracetic acid (antimicrobials); and</text></subparagraph><subparagraph id="id80859A1D246C4B548C52BE07E45A2FD0" commented="no"><enum>(F)</enum><text>working conditions in high and low temperatures.</text></subparagraph></paragraph><paragraph id="idae0b34d4cd8b4bdfab446208f17f56ed"><enum>(2)</enum><header>State plans</header><text>Not later than 30 days after the date of enactment of this Act, a State with a State plan that has been approved by the Secretary under section 18 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/667">29 U.S.C. 667</external-xref>) shall adopt in each region within the State in which a covered establishment is located a regional emphasis inspection program that is at least as effective as the program under paragraph (1).</text></paragraph></subsection><subsection id="id607d10b8d73e43d4bee55f97f86814d7"><enum>(b)</enum><header>Expanding inspections when information presents possible additional dangers</header><paragraph id="id1bea4ae605f64da7b12761f101dc2f70"><enum>(1)</enum><header>In general</header><text>In the case the Secretary conducts a physical inspection of a covered establishment pursuant to section 8 of such Act in response to a referral, complaint, or fatality, and the Secretary, during such inspection makes a determination under paragraph (2), the Secretary shall expand such inspection to all areas of the establishment.</text></paragraph><paragraph id="id2c5269a4d1ad4bd3b1cd6f37c35b4991"><enum>(2)</enum><header>Determination</header><text>A determination described in this paragraph is either of the following:</text><subparagraph id="id8df614fc869c451fb2dc6313b0c47b20"><enum>(A)</enum><text>A determination, following a review of records of work-related injuries and illnesses maintained in accordance with such section 8, that a work-related injury or illness may be related to a workplace danger that may threaten physical harm.</text></subparagraph><subparagraph id="idf6755c060e9042208878da04b1d3e37b"><enum>(B)</enum><text>A determination, upon interviews with employees, that a workplace danger may threaten physical harm.</text></subparagraph></paragraph></subsection></section><section id="id839AF67C882E4CA0AB8A7E91CB5FFCE5"><enum>125.</enum><header>Representatives during physical inspections</header><subsection id="idd5c593a1fc044d17b7fe70bbe98565e3"><enum>(a)</enum><header>Proposed rule</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall, under section 8(e) of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/657">29 U.S.C. 657(e)</external-xref>), publish in the Federal Register a regulation providing that during a physical inspection of a covered establishment under such section—</text><paragraph id="idCC4424A14BAB4A45A7139DA3D31B28C6"><enum>(1)</enum><text display-inline="yes-display-inline">the representative authorized by employees to be given the opportunity to accompany the Secretary during the inspection as described in such section shall not be required to be an employee of the employer;</text></paragraph><paragraph id="id48046CDC41364E62A22574AD507046EF"><enum>(2)</enum><text display-inline="yes-display-inline">where there is no representative authorized by employees as described in paragraph (1), the employees may designate a person affiliated with a worker-based community organization to serve as such representative; and</text></paragraph><paragraph id="idaef26357055048c195d80c8dd174f107"><enum>(3)</enum><text>the inspector may arrange for interviews with employees off-site upon the request of the representative or designated person.</text></paragraph></subsection><subsection id="id560831488D4A4C679B75CEF71C2CB970"><enum>(b)</enum><header>Final rule</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Secretary shall publish in the Federal Register a final rule for the proposed rule under subsection (a).</text></subsection></section><section id="id034e839881714414bbac7e1fef03f7f1"><enum>126.</enum><header>Enhanced protections from retaliation</header><subsection id="id7fbbbb0c9ab54b0dbdb98b11f7bcd99c"><enum>(a)</enum><header>Employee actions</header><text>Section 11(c)(1) of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/660">29 U.S.C. 660(c)(1)</external-xref>) is amended—</text><paragraph id="ide8312940e432414da3a942bd29d4ad58"><enum>(1)</enum><text>by striking <quote>discharge</quote> and all that follows through <quote>because such</quote> and inserting the following: “discharge or cause to be discharged, or in any other manner retaliate or discriminate against or cause to be retaliated or discriminated against, any employee because—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4bbcc94a782e4a5b89d59bace2ff3fee"><subparagraph id="id16b339cced44413a967087da8792f51b"><enum>(A)</enum><text>such</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id4ab6ba81fe4043ae8e2b6015d687b2cb"><enum>(2)</enum><text>by striking <quote>this Act or has</quote> and inserting the following: “this Act;</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8e6f24a723d341e6b4844bd84ebde472"><subparagraph id="id8de6df978ce947f198f5ca0e2080413d"><enum>(B)</enum><text>such employee has</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id288b3c0f86e349639f13f1bbd862bcfd"><enum>(3)</enum><text>by striking <quote>in any such proceeding or because of the exercise</quote> and inserting the following: “before Congress or in any Federal or State proceeding related to safety or health;</text><quoted-block style="OLC" display-inline="no-display-inline" id="id99278031b306410ca4b849d422f55f4a"><subparagraph id="id8ef59e627ca74146abc3fd9a4f554d8c"><enum>(C)</enum><text>such employee has refused to violate any provision of this Act; or</text></subparagraph><subparagraph id="id593b69abb8cd4e1cbc9ebd1c53f96499"><enum>(D)</enum><text>of the exercise</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="ida4baa9509677451d801766cc6cb4f9e3"><enum>(4)</enum><text>by inserting before the period at the end the following: <quote>, including the reporting of any injury, illness, or unsafe condition to the employer, agent of the employer, safety and health committee involved, or employee safety and health representative involved</quote>.</text></paragraph></subsection><subsection id="idd3438b4815234a86a5e1079e71732324"><enum>(b)</enum><header>Prohibition of retaliation; procedure</header><text>Section 11 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/660">29 U.S.C. 660</external-xref>) is amended—</text><paragraph id="id580DEAE7AC28404FA6F0032B6AB8A26C"><enum>(1)</enum><text>in subsection (c)—</text><subparagraph id="idF9CDFA6393744756A8EF1A15DF768F84"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="idA8DD3A9714BD474FB9EA47233E5C0E64"><enum>(i)</enum><text>by striking <quote>discharged or otherwise discriminated against by any person in violation of this subsection</quote> and inserting <quote>aggrieved by a violation of this subsection</quote>; and</text></clause><clause id="id728DC6E2B0CF419DB9095C85C0629FF9"><enum>(ii)</enum><text>by striking <quote>such discrimination</quote> and inserting <quote>such violation</quote>; and</text></clause></subparagraph><subparagraph id="idE5967B003BA74C4AAF80429F848ACE82"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id56499960DCBD4E9D96A9DDB44329E991"><paragraph id="id336B693519994FFD9344586777417B7E"><enum>(4)</enum><header>Exception for meat and poultry establishments</header><text>Paragraphs (2) and (3) shall not apply with respect to a complaint filed by an employee of an employer that is a covered establishment, as defined in section 3 of the <short-title>Protecting America's Meatpacking Workers Act</short-title>.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idC1E55B4EAC0C458699E99EA8E9DF2218"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id86C2C92A7A9F44889CBEC11A1C9DD1FD"><subsection id="id363AC7121914486EA754F03D6E9410C3"><enum>(d)</enum><header>Meat and poultry establishments</header><paragraph id="idB2D4299B102F45B5AE8BEAA1807E9605"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="idB0E1517E71E344C19DC51C9FF8CB52DE"><enum>(A)</enum><header>Complainant</header><text>The term <term>complainant</term> means a complainant who is a covered employee.</text></subparagraph><subparagraph id="idDA33F23266144CA2BAB5A2E48DA3ABA0"><enum>(B)</enum><header>Covered employee</header><text>The term <term>covered employee</term> means an employee of a covered employer.</text></subparagraph><subparagraph id="id3A5B7848024A4D038F8D8C7A693A10EE"><enum>(C)</enum><header>Covered employer</header><text>The term <term>covered employer</term> means an employer that is a covered establishment, as defined in section 3 of the <short-title>Protecting America's Meatpacking Workers Act</short-title>.</text></subparagraph><subparagraph id="id87EC608BF2304CBD83390E1F814DF002"><enum>(D)</enum><header>Respondent</header><text>The term <term>respondent</term> means a respondent who is a covered employer.</text></subparagraph></paragraph><paragraph id="id0B51FC9E9F51444A8ECDCC53CCE13098"><enum>(2)</enum><header>Reasonable apprehension</header><subparagraph id="id41C9E9FA1DAA42D4BE2295C6B4306ED5"><enum>(A)</enum><header>In general</header><text>No person shall discharge, or cause to be discharged, or in any other manner retaliate or discriminate against, or cause to be retaliated or discriminated against, a covered employee for refusing to perform the covered employee’s duties if the covered employee has a reasonable apprehension that performing such duties would result in serious injury to, or serious impairment of the health of, the covered employee or other covered employees.</text></subparagraph><subparagraph id="idD4A99EABC22841B19F4F80EC3A6A6195"><enum>(B)</enum><header>Circumstances</header><text>For purposes of subparagraph (A), the circumstances causing the covered employee’s reasonable apprehension described in such subparagraph shall be of such a nature that a reasonable person, under the circumstances confronting the covered employee, would conclude that performing the duties described in such subparagraph would have the result described in such subparagraph. </text></subparagraph><subparagraph id="id958CC171712144668E92C7C794DFE1EA"><enum>(C)</enum><header>Communication</header><text>In order to qualify for protection under this paragraph, the covered employee, when practicable, shall have communicated or attempted to communicate the safety or health concern to the covered employer and have not received from the covered employer a response reasonably calculated to allay such concern.</text></subparagraph></paragraph><paragraph id="id134a925246d442a2854a0e85b487d135"><enum>(3)</enum><header>Complaint</header><text>Any covered employee who believes that the covered employee has been discharged, disciplined, or otherwise retaliated or discriminated against by any person in violation of subsection (c)(1) or paragraph (2) of this subsection may seek relief for such violation by filing a complaint with the Secretary under paragraph (5).</text></paragraph><paragraph id="id37e16f5b406d4bbeae6a77ce79469738"><enum>(4)</enum><header>Statute of limitations</header><subparagraph id="idefbbdbae66ef4718bd86a1ffbd2de316"><enum>(A)</enum><header>In general</header><text>A covered employee may take the action permitted by paragraph (3) not later than 180 days after the later of—</text><clause id="id4bdc20dc4e174f9495540785eb6579af"><enum>(i)</enum><text>the date on which an alleged violation of subsection (c)(1) or paragraph (2) of this subsection occurs; or</text></clause><clause id="id0d7d66b68b2846e7812379941423b2ff"><enum>(ii)</enum><text>the date on which the covered employee knows or should reasonably have known that such alleged violation occurred.</text></clause></subparagraph><subparagraph id="id01f0385f14cc41b282648b4e2f28bf4c"><enum>(B)</enum><header>Repeat violation</header><text>Except in cases when the covered employee has been discharged, a violation of subsection (c)(1) or paragraph (2) of this subsection shall be considered to have occurred on the last date an alleged repeat violation occurred.</text></subparagraph></paragraph><paragraph id="id207c298ce89a48748e4934943b1b2fcf"><enum>(5)</enum><header>Investigation</header><subparagraph id="idca2aee0275564c27ada774d27578c531"><enum>(A)</enum><header>In general</header><text>A covered employee may, within the time period required under paragraph (4)(A), file a complaint with the Secretary alleging a violation of subsection (c)(1) or paragraph (2) of this subsection. If the complaint alleges a prima facie case, the Secretary shall conduct an investigation of the allegations in the complaint, which—</text><clause id="idd87ff63a04d84aeb82695b699bbcdd43"><enum>(i)</enum><text>shall include—</text><subclause id="id1f49da76f21a40c79ed8c2aa74e6a18b"><enum>(I)</enum><text>interviewing the complainant;</text></subclause><subclause id="idcf4919edecd04552b6ef1eda6eefb6f5"><enum>(II)</enum><text>providing the respondent an opportunity to—</text><item id="id0f9c34b3b3ab498190b95498e07727b3"><enum>(aa)</enum><text>submit to the Secretary a written response to the complaint; and</text></item><item id="id9a5537ed2b3e4f1fb768c19bf536d9d5"><enum>(bb)</enum><text>meet with the Secretary to present statements from witnesses or provide evidence; and</text></item></subclause><subclause id="id8fc9a80cb19148898991daf15e20d0c1"><enum>(III)</enum><text>providing the complainant an opportunity to—</text><item id="id995edd269317412fa2d7a684c4b4ab62"><enum>(aa)</enum><text>receive any statements or evidence provided to the Secretary;</text></item><item id="id02e5017676774fd581642a3e79a49c3e"><enum>(bb)</enum><text>meet with the Secretary; and</text></item><item id="id26bd676ca58e4680b5c84caeb334a30f"><enum>(cc)</enum><text>rebut any statements or evidence; and</text></item></subclause></clause><clause id="id22a2f0d06844456ba15585cb4db50625"><enum>(ii)</enum><text>may include issuing subpoenas for the purposes of such investigation.</text></clause></subparagraph><subparagraph id="id4f5e206d259040f7b90d68a94f801792"><enum>(B)</enum><header>Decision</header><text>Not later than 90 days after the filing of the complaint under this paragraph, the Secretary shall—</text><clause id="id2c31d601d8234058ad69d49edd75bb12"><enum>(i)</enum><text>determine whether reasonable cause exists to believe that a violation of subsection (c)(1) or paragraph (2) of this subsection has occurred; and</text></clause><clause id="id7cdad94cc2c7443d83998302ac0244e6"><enum>(ii)</enum><text>issue a decision granting or denying relief.</text></clause></subparagraph></paragraph><paragraph id="id7bd0d9722e5f47c0b017e25df2b7e397"><enum>(6)</enum><header>Preliminary order following investigation</header><text>If, after completion of an investigation under paragraph (5)(A), the Secretary finds reasonable cause to believe that a violation of subsection (c)(1) or paragraph (2) of this subsection has occurred, the Secretary shall issue a preliminary order providing relief authorized under paragraph (14) at the same time the Secretary issues a decision under paragraph (5)(B). If a de novo hearing is not requested within the time period required under paragraph (7)(A)(i), such preliminary order shall be deemed a final order of the Secretary and is not subject to judicial review.</text></paragraph><paragraph id="iddfaffea618a743d0bd2673e67f5858db"><enum>(7)</enum><header>Hearing</header><subparagraph id="ideb4b7d70a2044a38b9cf541e21c38f4b"><enum>(A)</enum><header>Request for hearing</header><clause id="id7df7632843ce433fad45bebf867e533c"><enum>(i)</enum><header>In general</header><text>A de novo hearing on the record before an administrative law judge may be requested—</text><subclause id="id0394ad054b214b4a872576c0a2e08ee1"><enum>(I)</enum><text>by the complainant or respondent within 30 days after receiving notification of a decision granting or denying relief issued under paragraph (5)(B) or a preliminary order under paragraph (6), respectively;</text></subclause><subclause id="idff5178ccc1eb4b4483805bce3db74f47"><enum>(II)</enum><text>by the complainant within 30 days after the date the complaint is dismissed without investigation by the Secretary under paragraph (5)(A); or</text></subclause><subclause id="id2da28a98b1564d8f9c082a2d254bdc44"><enum>(III)</enum><text>by the complainant within 120 days after the date of filing the complaint under paragraph (5), if the Secretary has not issued a decision under paragraph (5)(B).</text></subclause></clause><clause id="id528c2644fe5740909c38266947b7d20c"><enum>(ii)</enum><header>Reinstatement order</header><text>The request for a hearing shall not operate to stay any preliminary reinstatement order issued under paragraph (6).</text></clause></subparagraph><subparagraph id="id242fccdb313247e89cee5d39374bf0fd"><enum>(B)</enum><header>Procedures</header><clause id="idde3678d0937d4ec49ca9847e82fe2335"><enum>(i)</enum><header>In general</header><text>A hearing requested under this paragraph shall be conducted expeditiously and in accordance with rules established by the Secretary for hearings conducted by administrative law judges.</text></clause><clause id="idce239f2edb9f4293aa6033e0009cf756"><enum>(ii)</enum><header>Subpoenas; production of evidence</header><text>In conducting any such hearing, the administrative law judge may issue subpoenas. The respondent or complainant may request the issuance of subpoenas that require the deposition of, or the attendance and testimony of, witnesses and the production of any evidence (including any books, papers, documents, or recordings) relating to the matter under consideration.</text></clause><clause id="id7863c6db952a421cbb4bf3fa5ce11cca"><enum>(iii)</enum><header>Decision</header><text>The administrative law judge shall issue a decision not later than 90 days after the date on which a hearing was requested under this paragraph and promptly notify, in writing, the parties and the Secretary of such decision, including the findings of fact and conclusions of law. If the administrative law judge finds that a violation of subsection (c)(1) or paragraph (2) of this subsection has occurred, the judge shall issue an order for relief under paragraph (14). If review under paragraph (8) is not timely requested, such order shall be deemed a final order of the Secretary that is not subject to judicial review.</text></clause></subparagraph></paragraph><paragraph id="id4e15e1fa82114013bf07b190ca0fd3a7"><enum>(8)</enum><header>Administrative appeal</header><subparagraph id="id874d14ee675144f58cd1d1227062bfba"><enum>(A)</enum><header>In general</header><text>Not later than 30 days after the date of notification of a decision and order issued by an administrative law judge under paragraph (7), the complainant or respondent may file, with objections, an administrative appeal with an administrative review body designated by the Secretary (referred to in this paragraph as the <quote>review board</quote>).</text></subparagraph><subparagraph id="id9528946b28674bb489551b3ae20d8cec"><enum>(B)</enum><header>Standard of review</header><text>In reviewing the decision and order of the administrative law judge, the review board shall affirm the decision and order if it is determined that the factual findings set forth therein are supported by substantial evidence and the decision and order are made in accordance with applicable law.</text></subparagraph><subparagraph id="id7f7f5f77541b449cbc5c2a0959b197c7"><enum>(C)</enum><header>Decisions</header><text>If the review board grants an administrative appeal, the review board shall issue a final decision and order affirming or reversing, in whole or in part, the decision under review by not later than 90 days after receipt of the administrative appeal. If it is determined that a violation of subsection (c)(1) or paragraph (2) of this subsection has occurred, the review board shall issue a final decision and order providing relief authorized under paragraph (14). Such decision and order shall constitute final agency action with respect to the matter appealed.</text></subparagraph></paragraph><paragraph id="id59e7b724d4a542ab82e77439b11dd628"><enum>(9)</enum><header>Settlement in the administrative process</header><subparagraph id="id1d71a8c5ded94756a355ac8569f5d2cc"><enum>(A)</enum><header>In general</header><text>At any time before issuance of a final order, an investigation or proceeding under this subsection may be terminated on the basis of a settlement agreement entered into by the parties.</text></subparagraph><subparagraph id="ida63002deb0354c898cd6075cc83bd377"><enum>(B)</enum><header>Public policy considerations</header><text>Neither the Secretary, an administrative law judge, nor the review board conducting a hearing under this subsection shall accept a settlement that contains conditions conflicting with the rights protected under this Act or that are contrary to public policy, including a restriction on a complainant’s right to future employment with employers other than the specific covered employers named in a complaint.</text></subparagraph></paragraph><paragraph id="id049d40b2094b4ad4ba03288c3abadb12"><enum>(10)</enum><header>Inaction by the review board or administrative law judge</header><subparagraph id="id6cd67ab11f0749a8910ba6871e109881"><enum>(A)</enum><header>In general</header><text>The complainant may bring a de novo action described in subparagraph (B) if—</text><clause id="id4d29faf388c44de98e3f029e727f144d"><enum>(i)</enum><text>an administrative law judge has not issued a decision and order within the 90-day time period required under paragraph (7)(B)(iii); or</text></clause><clause id="id2c999cbc09824bebb39e0bc7c13baf1f"><enum>(ii)</enum><text>the review board has not issued a decision and order within the 90-day time period required under paragraph (8)(C).</text></clause></subparagraph><subparagraph id="id6dcc33716c204a3797f8843696dbe3f3"><enum>(B)</enum><header>De novo action</header><text>Such de novo action may be brought at law or equity in the United States district court for the district where a violation of subsection (c)(1) or paragraph (2) of this subsection allegedly occurred or where the complainant resided on the date of such alleged violation. The court shall have jurisdiction over such action without regard to the amount in controversy and to order appropriate relief under paragraph (14). Such action shall, at the request of either party to such action, be tried by the court with a jury.</text></subparagraph></paragraph><paragraph id="ide4f6df95dffe4a83ab141417fb6d7fd8"><enum>(11)</enum><header>Judicial review</header><subparagraph id="id42d890022ec6460ab3965400ac344d2b"><enum>(A)</enum><header>Timely appeal to the court of appeals</header><text>Any party adversely affected or aggrieved by a final decision and order issued under this subsection may obtain review of such decision and order in the United States Court of Appeals for the circuit where the violation, with respect to which such final decision and order was issued, allegedly occurred or where the complainant resided on the date of such alleged violation. To obtain such review, a party shall file a petition for review not later than 60 days after the final decision and order was issued. Such review shall conform to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code. The commencement of proceedings under this subparagraph shall not, unless ordered by the court, operate as a stay of the final decision and order.</text></subparagraph><subparagraph id="idc80eb42045534a6ab78ffef89c540e22"><enum>(B)</enum><header>Limitation on collateral attack</header><text>An order and decision with respect to which review may be obtained under subparagraph (A) shall not be subject to judicial review in any criminal or other civil proceeding.</text></subparagraph></paragraph><paragraph id="id54d18dbff63644f999e1960a654fb445"><enum>(12)</enum><header>Enforcement of order</header><text>If a respondent fails to comply with an order issued under this subsection, the Secretary or the complainant on whose behalf the order was issued may file a civil action for enforcement in the United States district court for the district in which the violation was found to occur to enforce such order. If both the Secretary and the complainant file such action, the action of the Secretary shall take precedence. The district court shall have jurisdiction to grant all appropriate relief described in paragraph (14).</text></paragraph><paragraph id="id0e317ea4189e4cf48c5f3f48d6b9580a"><enum>(13)</enum><header>Burdens of proof</header><subparagraph id="id8d8dbf12fa8b48fc874385df66180843"><enum>(A)</enum><header>Criteria for determination</header><text>In making a determination or adjudicating a complaint pursuant to this subsection, the Secretary, administrative law judge, review board, or a court may determine that a violation of subsection (c)(1) or paragraph (2) of this subsection has occurred only if the complainant demonstrates that any conduct described in subsection (c)(1) or paragraph (2) of this subsection with respect to the complainant was a contributing factor in the adverse action alleged in the complaint.</text></subparagraph><subparagraph id="ida54b01cbb7374e8da09586a782602720"><enum>(B)</enum><header>Prohibition</header><text>Notwithstanding subparagraph (A), a decision or order that is favorable to the complainant shall not be issued in any administrative or judicial action pursuant to this subsection if the respondent demonstrates by clear and convincing evidence that the respondent would have taken the same adverse action in the absence of such conduct.</text></subparagraph></paragraph><paragraph id="idf7ebad9ae199462b9b253e6c4e5d1810"><enum>(14)</enum><header>Relief</header><subparagraph id="id87b63c1dc318449096bffbc0e83ce531"><enum>(A)</enum><header>Order for relief</header><text>If the Secretary, administrative law judge, review board, or a court determines that a covered employer has violated subsection (c)(1) or paragraph (2) of this subsection, the Secretary, administrative law judge, review board, or court, respectively, shall have jurisdiction to order all appropriate relief, including injunctive relief, and compensatory and exemplary damages, including—</text><clause id="id1ca7baa3f9f74579bf4b04d5963982c6"><enum>(i)</enum><text>affirmative action to abate the violation;</text></clause><clause id="idcc21a5cc24d844aaa78e83156275b223"><enum>(ii)</enum><text>reinstatement without loss of position or seniority, and restoration of the terms, rights, conditions, and privileges associated with the complainant’s employment, including opportunities for promotions to positions with equivalent or better compensation for which the complainant is qualified;</text></clause><clause id="idfb4b7cc3fcdc4b63a7059f7e11bfbfaa"><enum>(iii)</enum><text>compensatory and consequential damages sufficient to make the complainant whole (including back pay, prejudgment interest, and other damages); and</text></clause><clause id="id65d56d3bd8f64e4ea18a9f8f35d48062"><enum>(iv)</enum><text>expungement of all warnings, reprimands, or derogatory references that have been placed in paper or electronic records or databases of any type relating to the actions by the complainant that gave rise to the unfavorable personnel action, and, at the complainant’s direction, transmission of a copy of the decision on the complaint to any person whom the complainant reasonably believes may have received such unfavorable information.</text></clause></subparagraph><subparagraph id="id7dec42a2d71844f2af72db5b8673c29f"><enum>(B)</enum><header>Attorneys’ fees and costs</header><text>If the Secretary or an administrative law judge, review board, or court grants an order for relief under subparagraph (A), the Secretary, administrative law judge, review board, or court, respectively, shall assess, at the request of the covered employee against the covered employer—</text><clause id="ided6257dad16144688a643099c0425bf1"><enum>(i)</enum><text>reasonable attorneys’ fees; and</text></clause><clause id="id282d8df8e498446fa0cbbae390734b53"><enum>(ii)</enum><text>costs (including expert witness fees) reasonably incurred, as determined by the Secretary, administrative law judge, review board, or court, respectively, in connection with bringing the complaint upon which the order was issued.</text></clause></subparagraph></paragraph><paragraph id="id18f220fc4b6d469aba50f08808954cbb"><enum>(15)</enum><header>Procedural rights</header><text>The rights and remedies provided for in this subsection may not be waived by any agreement, policy, form, or condition of employment, including by any pre-dispute arbitration agreement or collective bargaining agreement.</text></paragraph><paragraph id="id93f96a546a5a4c5483950145b1f5f0f1"><enum>(16)</enum><header>Savings</header><text>Nothing in this subsection shall be construed to diminish the rights, privileges, or remedies of any covered employee who exercises rights under any Federal or State law or common law, or under any collective bargaining agreement.</text></paragraph><paragraph id="idfb5f040df5a84811ba410131b6e3521f"><enum>(17)</enum><header>Election of venue</header><subparagraph id="idf5eecb00d29b44ca8d696a87f6973975"><enum>(A)</enum><header>In general</header><text>A covered employee of a covered employer who is located in a State that has a State plan approved under section 18 may file a complaint alleging a violation of subsection (c)(1) or paragraph (2) of this subsection by such employer with—</text><clause id="id4ddd52a559a94097b19cbe3e4633ed51"><enum>(i)</enum><text>the Secretary under paragraph (5); or</text></clause><clause id="idd2ea07fc57594c1ca7128001553d28fe"><enum>(ii)</enum><text>a State plan administrator in such State.</text></clause></subparagraph><subparagraph id="id4fc140f8e6da41a0a2f021d5a5fc54ca"><enum>(B)</enum><header>Referrals</header><text>If—</text><clause id="id097641934b71492cb5ca10e69cbfb1b4"><enum>(i)</enum><text>the Secretary receives a complaint pursuant to subparagraph (A)(i), the Secretary shall not refer such complaint to a State plan administrator for resolution; or</text></clause><clause id="id9c044dc1b99f4687b3ce9a9239022e6a"><enum>(ii)</enum><text>a State plan administrator receives a complaint pursuant to subparagraph (A)(ii), the State plan administrator shall not refer such complaint to the Secretary for resolution.</text></clause></subparagraph></paragraph><paragraph id="id4CE64BDA27404962972929A8597241CA"><enum>(18)</enum><header>Presumption of retaliation</header><text>The Secretary shall apply an unrebuttable presumption of retaliation in any complaint initiated under paragraph (5) in which the Secretary finds a covered employee suffers an adverse action within 90 days of the date on which the covered employee took any action protected under subsection (c)(1) or raised any reasonable apprehension under paragraph (2) of this subsection. </text></paragraph><paragraph id="idCC2A762CE3A64284A2005C6DF9CC1926"><enum>(19)</enum><header>Supplement and not supplant</header><text>The remedies provided for under this subsection supplement, and do not supplant, the private right of action under section 130 of the <short-title>Protecting America's Meatpacking Workers Act</short-title>.</text></paragraph><paragraph id="idA73ABA6B231C4229B279388D9222825C"><enum>(20)</enum><header>Definitions</header><text>For purposes of this subsection and subsection (c)—</text><subparagraph id="id546BCC6826DA44DBA9B5147EEC0E7C39"><enum>(A)</enum><text>the term <term>retaliate or discriminate against</term> includes reporting, or threatening to report, to a Federal, State, or local authority the suspected citizenship or immigration status of a covered employee, or of a family member of a covered employee, because the covered employee raises a concern about workplace health and safety practices or hazards; and</text></subparagraph><subparagraph id="id491BA88C1DD048DE86787E6BF410E17D"><enum>(B)</enum><text>the term <term>family member</term>, with respect to the family member of a covered employee, means an individual who—</text><clause id="id17D93529B22C4FF889D0F7B1756E7AB8"><enum>(i)</enum><text>is related to the covered employee by blood, adoption, marriage, or domestic partnership; and</text></clause><clause id="idAF42EE7BD9254857906FD6E081C94B44"><enum>(ii)</enum><text>is a significant other, parent, sibling, child, uncle, aunt, niece, nephew, cousin, grandparent, or grandchild of the covered employee.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idd8331f2b315242248b5dab23ab8b52cb"><enum>(c)</enum><header>Relation to enforcement</header><text>Section 17(j) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/666">29 U.S.C. 666(j)</external-xref>) is amended by inserting before the period the following: <quote>, including the history of violations under subsection (c) or (d) of section 11</quote>. </text></subsection></section><section id="idaafea492c7614bd8ab45394f3895514a"><enum>127.</enum><header>Regulations to restore a column on required records of work-related musculoskeletal disorders</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall issue a final rule regarding matters pertaining to the proposed rule issued by the Secretary on January 29, 2010, entitled <quote>Occupational Injury and Illness Recording and Reporting Requirements</quote> (75 Fed. Reg. 4728).</text></section><section id="id00ba7a9558f446849bbdfc353c0b7cec" commented="no"><enum>128.</enum><header>Funding for additional OSHA inspectors</header><text display-inline="no-display-inline">Out of any amounts in the Treasury not otherwise appropriated, there is appropriated $60,000,000 to the Secretary for each of fiscal years 2024 through 2029, to remain available until expended for—</text><paragraph commented="no" id="id2283542AA14346659FF849FFAEB31E49"><enum>(1)</enum><text display-inline="yes-display-inline">the hiring of additional inspectors to carry out inspections under section 8 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/657">29 U.S.C. 657</external-xref>); and</text></paragraph><paragraph commented="no" id="idB47E2307323E470683DC5B92A90025EF"><enum>(2)</enum><text display-inline="yes-display-inline">carrying out sections 6, 8, and 11 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/655">29 U.S.C. 655</external-xref>; 657; and 660), as amended by this Act.</text></paragraph></section><section id="idA318449CF39C4079A5F16B99AE53A6D5"><enum>129.</enum><header>OSHA reporting</header><subsection id="id8FD6AD83083B4FE2A1DB431DECA349A3"><enum>(a)</enum><header>Definition of pandemic</header><text>In this section, the term <term>pandemic</term> means a public health emergency declared under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) with respect to a pandemic. </text></subsection><subsection id="idb89394d0a46342e59d93b5220b25bead"><enum>(b)</enum><header>Reporting during a pandemic</header><paragraph id="id4233172784c44bfea009255d6553aea0"><enum>(1)</enum><header>Standardized reporting</header><subparagraph id="id1b007d8f7cb145bd9dee0957e5b25e73"><enum>(A)</enum><header>In general</header><text>The Secretary shall establish a standardized process for covered establishments to report, on a weekly basis during a pandemic, to the Secretary information regarding infections and deaths related to the pandemic. Such information shall include—</text><clause id="idb6b54ef86d864ca1be0ac99655889f11"><enum>(i)</enum><text>the number of employees on a weekly and cumulative basis that have contracted the disease resulting in the pandemic; </text></clause><clause id="id18b54c21a1664b6c81b7b28259f9f0d9"><enum>(ii)</enum><text>racial demographics of such employees; and</text></clause><clause id="idc27dc28867434658b2da46e9d1a1f372"><enum>(iii)</enum><text>the employment status of such employees.</text></clause></subparagraph><subparagraph id="id2ba2289f7e2f4af1aa6e46c36a05e2df"><enum>(B)</enum><header>Form and procedures</header><clause id="id4d63eab2c2d3429cbb224648dd7d9b04"><enum>(i)</enum><header>COVID–<enum-in-header>19</enum-in-header></header><text>Not later than 7 days after the date of enactment of this Act, the Secretary shall issue reporting procedures described in subparagraph (A), including forms for such procedures, for reporting the information described in such subparagraph during the pandemic with respect to COVID–19.</text></clause><clause id="ide146223666ac421cb7f08d76618828c6"><enum>(ii)</enum><header>Future pandemics</header><text>Not later than 1 year after the date of enactment of this Act, or 7 days following a declaration of a pandemic other than COVID–19, whichever is sooner, the Secretary shall issue reporting procedures described in subparagraph (A), including forms for such procedures, for pandemics other than COVID–19. </text></clause></subparagraph></paragraph><paragraph id="id52ce09954ad94dc3a962ed0e5c5f4a37"><enum>(2)</enum><header>Public availability</header><text>The Secretary shall make the information reported under paragraph (1) available to the public in a manner that facilitates public participation, including by making such information available on its website in a manner that maximizes public participation.</text></paragraph><paragraph id="id4319226dac814d8f843508a7c3ca00dd"><enum>(3)</enum><header>Privacy</header><text>A covered establishment, in reporting information to the Secretary under paragraph (1), may not claim confidential business information or patient privacy, except that such an establishment may withhold the names of workers, as a basis to withhold information.</text></paragraph></subsection><subsection id="id283dc7b93d6742a6aaf7acbc97a23ccd" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Disclosures to employees</header><text>A covered establishment shall disclose to each employee or individual providing work for the employer, including any individual providing such work through a contract or subcontract, all chemicals used at the worksite where the employee or individual provides such work. Such disclosure shall be provided to the employee or individual in the native language of the employee or individual. </text></subsection></section><section id="idab229279dc294bee9a1113077add9399"><enum>130.</enum><header>Private right of action</header><subsection id="id095ef5b9ff954d8e884547cc0a3bc571"><enum>(a)</enum><header>In general</header><text>Any person aggrieved by the failure of a covered establishment to comply with the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/651">29 U.S.C. 651 et seq.</external-xref>), including any regulation promulgated pursuant to such Act, or to comply with this subtitle may file suit in any district court of the United States having jurisdiction of the parties, without respect to the amount in controversy and without regard to the citizenship of the parties, or in any other court of competent jurisdiction.</text></subsection><subsection id="id55c38a9dd05d4b83afd3fa4e61f11d76"><enum>(b)</enum><header>Right of recovery</header><text>In an action brought by any aggrieved person pursuant to this section, the person may recover equitable and legal relief (including compensatory and punitive damages), attorney’s fees (including expert fees), and costs of the action.</text></subsection><subsection id="idf36083e4d0d145a68fc7a6232c104a62"><enum>(c)</enum><header>Action by the Secretary</header><text>Any administrative enforcement by the Secretary shall not preclude the relief afforded by this section or otherwise deprive a court of jurisdiction. </text></subsection></section><section id="id7e6d8d12d9d646b2af4fdfb9c623ed9a"><enum>131.</enum><header>Injunction proceedings</header><text display-inline="no-display-inline">Section 13 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/662">29 U.S.C. 662</external-xref>) is amended—</text><paragraph id="id1305F3C4937D4B60A95F3397D7F20265"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by adding at the end the following: <quote>Any employee (or the representative of such employee) at a place of employment subject to enforcement under this subsection may unconditionally intervene as a matter of right.</quote>; and</text></subparagraph><subparagraph id="id786F905F5BB149818146433A598E2C4A"><enum>(B)</enum><text>under which such employer and labor organization agree that—</text><clause id="id058BFFE72DA64C9B8D557591AE9C184A"><enum>(i)</enum><text>the employer will not—</text><subclause id="idFFD1092D15254BAABC1503CF967031B2"><enum>(I)</enum><text>hinder any effort of an employee to join a labor organization; or </text></subclause><subclause id="id10CC7CA6C7C144598D3494598DC69759"><enum>(II)</enum><text>take any action that directly or indirectly indicates or implies any opposition to an employee joining a labor organization;</text></subclause></clause><clause id="id3C2623844A4642BBB4D30879AB53C5F4"><enum>(ii)</enum><text>the labor organization agrees to refrain from picketing, work stoppages, or boycotts against the employer;</text></clause><clause id="id44807EE3A45E4C519BC20BF64F713C0F"><enum>(iii)</enum><text>the employer provides the labor organization with employee contact information, and facilitates or permits labor organization access to employees at the workplace, including facilitating or permitting the labor organization to meet with employees to discuss joining the labor organization; or</text></clause><clause id="ida46d1fa188ba4c619713b592966d43dc"><enum>(ii)</enum><text>any adjustment to the base for quality, grade, or other factors relating to the value of livestock or livestock products that are readily verifiable market factors and are outside the control of the packer.</text></clause></subparagraph></paragraph><paragraph id="idf42a2a5a5d8646308f661558b62e62f3"><enum>(16)</enum><header>Forward contract</header><text>The term <term>forward contract</term> means an oral or written contract for the purchase of livestock that provides for the delivery of the livestock to a packer at a date that is more than 7 days after the date on which the contract is entered into, without regard to whether the contract is for—</text><subparagraph id="id1a2ba4c2b8284640bcd013cb986bbac8"><enum>(A)</enum><text>a specified lot of livestock; or</text></subparagraph><subparagraph id="idb4ec7704f95b4e57ae77b0fe3a652586"><enum>(B)</enum><text>a specified number of livestock over a certain period of time.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id43807da83fbf4e67aaa27991449c05d8"><enum>205.</enum><header>Unlawful practices</header><subsection id="id31f37fe81506436195fef08b5b3c5361"><enum>(a)</enum><header>In general</header><text>Section 202 of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/192">7 U.S.C. 192</external-xref>), is amended—</text><paragraph id="idfd9b6daabe384bdfb3409d3cb69198c0"><enum>(1)</enum><text>by redesignating subsections (a) through (f) and (g) as paragraphs (1) through (6) and (10), respectively, and indenting appropriately;</text></paragraph><paragraph id="id9c5ec75f15fa4721a0ef803ba262fb14"><enum>(2)</enum><text>by striking the section designation and all that follows through <quote>It shall be</quote> in the matter preceding paragraph (1) (as so redesignated) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd449fa303b784addbe6f36782c9529f2"><section id="id3bd2b562b12c4e20a62fbd96adba1ffb"><enum>202.</enum><header>Unlawful acts</header><subsection id="id9952895506b94077a5e78f538821effe"><enum>(a)</enum><header>In general</header><text>It shall be</text></subsection></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id7d5d1a7b5f884f3b9e9efddc40ab98e2"><enum>(3)</enum><text>in subsection (a)—</text><subparagraph id="idce5b839a28f9498d97a20b98f0934b12"><enum>(A)</enum><text>in the matter preceding paragraph (1) (as so redesignated), by striking <quote>to:</quote> and inserting <quote>to do any of the following:</quote>;</text></subparagraph><subparagraph id="idcca20ac6f2784ff2899489076ea7d21c"><enum>(B)</enum><text>in each of paragraphs (1) through (6) (as so redesignated), by striking <quote>; and</text></clause><clause id="ida5d8d15509d74244a63bdac3b44014c9"><enum>(iii)</enum><text>by striking <quote>(3)</quote> and inserting <quote>(C)</quote>;</text></clause></subparagraph><subparagraph id="idd22996000ac04b21850d4333f5f4f883"><enum>(D)</enum><text>by inserting after paragraph (6) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id39709cf8187e4459831bd3c53d482835"><paragraph id="ida38431b43c5843e8a3906f909311ba08"><enum>(7)</enum><text>Use, in effectuating any sale of livestock, a forward contract that—</text><subparagraph id="id8b618a22b342467c9dda2659af383bc0"><enum>(A)</enum><text>does not contain a firm base price that may be equated to a fixed dollar amount on the date on which the forward contract is entered into;</text></subparagraph><subparagraph id="id5e17558832fa413cb679af2d577270a1"><enum>(B)</enum><text>is not offered for bid in an open, public manner under which—</text><clause id="id07c93f2124e74c4fa432b9c12ac091b3"><enum>(i)</enum><text>buyers and sellers have the opportunity to participate in the bid;</text></clause><clause id="idc16b233f2fe2464baf5ecce414b85509"><enum>(ii)</enum><text>more than 1 blind bid is solicited; and</text></clause><clause id="id680bdf20283c4776b88e7bd5e7bab0a3"><enum>(iii)</enum><text>buyers and sellers may witness bids that are made and accepted;</text></clause></subparagraph><subparagraph id="idab84553f78da49a7a20d1f5dfc40c38e"><enum>(C)</enum><text>is based on a formula price; or</text></subparagraph><subparagraph id="id37e3177c5aac42caa078730b43b9f782"><enum>(D)</enum><text>provides for the sale of livestock in a quantity in excess of—</text><clause id="ide7dff1e1f69f478dba33a92a1acc0c4b"><enum>(i)</enum><text>in the case of cattle, 40 cattle;</text></clause><clause id="idcf364573eafb44ab9cf087b70d570cc1"><enum>(ii)</enum><text>in the case of swine, 30 swine; and</text></clause><clause id="id3746990d641d403cb3308b041e2835ed"><enum>(iii)</enum><text>in the case of another type of livestock, a comparable quantity of that type of livestock, as determined by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="id1dd318359cb945b6aed82702dbfc5fef"><enum>(8)</enum><text>Own or feed livestock directly, through a subsidiary, or through an arrangement that gives a packer operational, managerial, or supervisory control over the livestock, or over the farming operation that produces the livestock, to such an extent that the producer of the livestock is not materially participating in the management of the operation with respect to the production of the livestock, except that this paragraph shall not apply to—</text><subparagraph id="idc08074e18a3d457587d78d1a38c87f1b"><enum>(A)</enum><text>an arrangement entered into not more than 7 business days before slaughter of the livestock by a packer, a person acting through the packer, or a person that directly or indirectly controls, or is controlled by or under common control with, the packer;</text></subparagraph><subparagraph id="id356b35cf157d45edb1c94113689e75c6"><enum>(B)</enum><text>a cooperative or entity owned by a cooperative, if a majority of the ownership interest in the cooperative is held by active cooperative members that—</text><clause id="id4a211ee51ccf432c9565edf29baaa53b"><enum>(i)</enum><text>own, feed, or control the livestock; and</text></clause><clause id="id0c6c4afb2d5546629d417797d65af36f"><enum>(ii)</enum><text>provide the livestock to the cooperative for slaughter;</text></clause></subparagraph><subparagraph id="id69f518a5141b4455a7c4cd9a365e0d67"><enum>(C)</enum><text>a packer that is not required to report to the Secretary on each reporting day (as defined in section 212 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635a">7 U.S.C. 1635a</external-xref>)) information on the price and quantity of livestock purchased by the packer; or</text></subparagraph><subparagraph id="idb67f60d1d3fb45c7b974121cf23bdfa4"><enum>(D)</enum><text>a packer that owns only 1 livestock processing plant.</text></subparagraph></paragraph><paragraph id="idf4fd2fd4b97446c681378742860d2c43"><enum>(9)</enum><text>Take any action that adversely affects or is likely to adversely affect competition, regardless of whether there is a business justification for the action.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id684a0a9348894bce9a924fd0488948e1"><enum>(E)</enum><text>in paragraph (10) (as so redesignated), by striking <quote>subdivision (a), (b), (c), (d), or (e)</quote> and inserting <quote>paragraphs (1) through (9)</quote>; and</text></subparagraph></paragraph><paragraph id="idd8315bf85dd145b4bae2afe31d922089"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc95aa1db9b8748998a337d399c817e3b"><subsection id="id093dc126828a41eebf9e9a25a2c59780"><enum>(b)</enum><header>Unfair, discriminatory, and deceptive practices and devices</header><text>Acts by a packer, swine contractor, or live poultry dealer that violate subsection (a)(1) include the following:</text><paragraph id="id1bbad3001bf5476dabeca59bdba8f213"><enum>(1)</enum><text>Refusal to provide, on the request of a livestock producer, swine production contract grower, or poultry grower with which the packer, swine contractor, or live poultry dealer has a marketing or delivery contract, the relevant statistical information and data used to determine the compensation paid to the livestock producer, swine production contract grower, or poultry grower, as applicable, under the contract, including—</text><subparagraph id="id2dc88ce80c6c4f5d82528427d01a23bf"><enum>(A)</enum><text>feed conversion rates by house, lot, or pen;</text></subparagraph><subparagraph id="id5dd83df0d7e0475eb677832fc2e7a48b"><enum>(B)</enum><text>feed analysis;</text></subparagraph><subparagraph id="idf2035a62352247bab99f62e526102605"><enum>(C)</enum><text>breeder history;</text></subparagraph><subparagraph id="id214c8c1aa76f4827aad36f68b58bfaf8"><enum>(D)</enum><text>quality grade;</text></subparagraph><subparagraph id="id60cb245d22d7456b8712dd17b2339a9b"><enum>(E)</enum><text>yield grade; and</text></subparagraph><subparagraph id="id376f3fa7aab2473ba4ad879b398d9d66"><enum>(F)</enum><text>delivery volume for any certified branding program (such as programs for Angus beef or certified grassfed or Berkshire pork).</text></subparagraph></paragraph><paragraph id="id25915bcf39a143ac9da4407881492f2d"><enum>(2)</enum><text>Conduct or action that limits or attempts to limit by contract the legal rights and remedies of a livestock producer, swine production contract grower, or poultry grower, including the right—</text><subparagraph id="id9c0721185ed94b58b9b839122b163822"><enum>(A)</enum><text>to a trial by jury, unless the livestock producer, swine production contract grower, or poultry grower, as applicable, is voluntarily bound by an arbitration provision in a contract;</text></subparagraph><subparagraph id="id98afe6c1683447e098729fe90517e286"><enum>(B)</enum><text>to pursue all damages available under applicable law; and</text></subparagraph><subparagraph id="idadbffa079b9a48409dbab15d3153c049"><enum>(C)</enum><text>to seek an award of attorneys’ fees, if available under applicable law.</text></subparagraph></paragraph><paragraph id="id37118636ee76459f88d470e597ad7a97"><enum>(3)</enum><text>Termination of a poultry growing arrangement or swine production contract with no basis other than an allegation that the poultry grower or swine production contract grower failed to comply with an applicable law, rule, or regulation.</text></paragraph><paragraph id="id56273de2b3924fddb4ac84c2c91dd72e"><enum>(4)</enum><text>A representation, omission, or practice that is likely to mislead a livestock producer, swine production contract grower, or poultry grower regarding a material condition or term in a contract or business transaction.</text></paragraph></subsection><subsection id="id6f988acc5dbd4571b0b5941b112b6399"><enum>(c)</enum><header>Undue or unreasonable preferences, advantages, prejudices, and disadvantages</header><paragraph id="idddfaf69c5f2d4ea5879e7b6d13c87b4f"><enum>(1)</enum><header>In general</header><text>Acts by a packer, swine contractor, or live poultry dealer that violate subsection (a)(2) include the following:</text><subparagraph id="id70bc33a8316b4d999d1e0a5bd67bbec6"><enum>(A)</enum><text>A retaliatory action (including coercion or intimidation) or the threat of retaliatory action—</text><clause id="id88216b941f454ba68c3d59051410843d"><enum>(i)</enum><text>in connection with the execution, termination, extension, or renewal of a contract or agreement with a livestock producer, swine production contract grower, or poultry grower aimed to discourage the exercise of the rights of the livestock producer, swine production contract grower, or poultry grower under this Act or any other law; and</text></clause><clause id="idbfb568deca014955bf49c471ca6d5bd3"><enum>(ii)</enum><text>in response to lawful communication (including as described in paragraph (2)), association, or assertion of rights by a livestock producer, swine production contract grower, or poultry grower.</text></clause></subparagraph><subparagraph id="id022dac89435e4b08a9dc6b5c4d1794cf"><enum>(B)</enum><text>Use of the tournament system for poultry as described in paragraph (3).</text></subparagraph></paragraph><paragraph id="idae19a2f0be55486eb5d5edeed54d9965"><enum>(2)</enum><header>Lawful communication described</header><text>A lawful communication referred to in paragraph (1)(A)(ii) includes—</text><subparagraph id="ide488bf69ed4c440c8b5a374ffed87ed1"><enum>(A)</enum><text>a communication with officials of a Federal agency or Members of Congress;</text></subparagraph><subparagraph id="id55813c2e8b7143789445addd047e8ee2"><enum>(B)</enum><text>any lawful disclosure that demonstrates a reasonable belief of a violation of this Act or any other law; and</text></subparagraph><subparagraph id="id890a5bc57f414ee48e8357d60443c0d0"><enum>(C)</enum><text>any other communication that assists in carrying out the purposes of this Act.</text></subparagraph></paragraph><paragraph id="id14e02c4bae824334b516ef4da0c693ca"><enum>(3)</enum><header>Use of tournament system for poultry</header><subparagraph id="id967a59a1d38443988881e1f545e3ef85"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), a live poultry dealer shall be in violation of subsection (a)(2) if the live poultry dealer determines the formula for calculating the pay of a poultry grower in a tournament group by comparing the performance of the birds of other poultry growers in the group using factors outside the control of the poultry grower and within the control of the live poultry dealer.</text></subparagraph><subparagraph id="id7273b12515c64aae8a424f0b0246ceba"><enum>(B)</enum><header>Exception</header><text>Under subparagraph (A), a live poultry dealer shall not be found in violation of subsection (a)(2) if the live poultry dealer demonstrates through clear and convincing evidence that the inputs and services described in subparagraph (C) that were used in the comparative evaluation were substantially the same in quality, quantity, and timing, as applicable, for all poultry growers in the tournament group.</text></subparagraph><subparagraph id="id872359c61807454081b9b1f948085bd0"><enum>(C)</enum><header>Inputs and services described</header><text>The inputs and services referred to in subparagraph (B) include, with respect to poultry growers in the same tournament group—</text><clause id="id2a10af20c5ed4a43b1b79b12757cc762"><enum>(i)</enum><text>the quantity, breed, sex, and age of chicks delivered to each poultry grower;</text></clause><clause id="id8df27ef8e700456ab40a7604e7382ce9"><enum>(ii)</enum><text>the breed and age of the breeder flock from which chicks are drawn for each poultry grower;</text></clause><clause id="idfe8890e1998f4a3384e53daabbaa9ad3"><enum>(iii)</enum><text>the quality, type (such as starter feed), and quantity of feed delivered to each poultry grower;</text></clause><clause id="idea220f5c4090498fb00b1dda49193df8"><enum>(iv)</enum><text>the quality of and access to medications for the birds of each poultry grower;</text></clause><clause id="idbe5e7b176ada4c66956b546b888994b8"><enum>(v)</enum><text>the number of birds in a flock delivered to each poultry grower;</text></clause><clause id="id55cf7d24a0da4d04a19b82e52937329a"><enum>(vi)</enum><text>the timing of the pick-up of birds for processing (including the age of the birds and the number of days that the birds are in the care of the poultry grower) for each poultry grower;</text></clause><clause id="id24ee98d2d4854c90907d53f80c513448"><enum>(vii)</enum><text>the death loss of birds during pick-up, transport, and time spent at the processing plant for each poultry grower;</text></clause><clause id="ide22cfa6de3464a038a516a3e8fb86465"><enum>(viii)</enum><text>condemnations of parts of birds due to actions in processing for each poultry grower;</text></clause><clause id="id3b91303d913a421db4e524a0ecfbf178"><enum>(ix)</enum><text>condemnations of whole birds due to the fault of the poultry grower;</text></clause><clause id="id44eb87eb28a243a8b2375fb902c6620c"><enum>(x)</enum><text>the death loss of birds due to the fault of the poultry grower;</text></clause><clause id="idc734548035044674903025c0243c1801"><enum>(xi)</enum><text>the stated reasons for the cause of the death losses and condemnations described in clauses (vii) through (x);</text></clause><clause id="id279f4406d49e42b0bc4b2993364281ea"><enum>(xii)</enum><text>the type and classification of each poultry grower; and</text></clause><clause id="id5b9528cdbc444ff0bb95b9ae11c81c4d"><enum>(xiii)</enum><text>any other input or service that may have an impact on feed conversion to weight gain efficiency or the life span of the birds of each poultry grower.</text></clause></subparagraph></paragraph></subsection><subsection id="id7ad6856c38da4e5fb2aa606363d986d1"><enum>(d)</enum><header>Harm to competition not required</header><text>In determining whether an act, device, or conduct is a violation under paragraph (1) or (2) of subsection (a), a finding that the act, device, or conduct adversely affected or is likely to adversely affect competition is not required.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id9e52c29779bb4d8abb278b1bb1b51da9"><enum>(b)</enum><header>Effective date</header><paragraph id="id544fd03568af462a976ffc0a6e433711"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), paragraph (8) of section 202(a) of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/192">7 U.S.C. 192</external-xref>) (as designated by subsection (a)(2)), shall take effect on the date of enactment of this Act.</text></paragraph><paragraph id="idf219cb6f6dc84a55a60265aabe7974fd"><enum>(2)</enum><header>Transition rules</header><text>In the case of a packer that, on the date of enactment of this Act, owns, feeds, or controls livestock intended for slaughter in violation of paragraph (8) of section 202(a) of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/192">7 U.S.C. 192</external-xref>) (as designated by subsection (a)(2)), that paragraph shall take effect—</text><subparagraph id="id2226eabddddb46d495624c2a92f9580b"><enum>(A)</enum><text>in the case of a packer of swine, beginning on the date that is 18 months after the date of enactment of this Act; and</text></subparagraph><subparagraph id="id2db6a3cfb9924db1a5769cb7c6b2ddad"><enum>(B)</enum><text>in the case of a packer of any other type of livestock, beginning not later than 180 days after the date of enactment of this Act, as determined by the Secretary.</text></subparagraph></paragraph></subsection></section><section id="id49a8635d8ac4491c83fd477e60c10a99"><enum>206.</enum><header>Spot market purchases of livestock by packers</header><text display-inline="no-display-inline">The Packers and Stockyards Act, 1921, is amended by inserting after section 202 (<external-xref legal-doc="usc" parsable-cite="usc/7/192">7 U.S.C. 192</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1db90517d0144b47a011aa4f7c56682a"><section id="id27a85bf8ff9b47cca4de67e21c53dac0"><enum>202A.</enum><header>Spot market purchases of livestock by packers</header><subsection id="id0cffbf1986454f2d83633776d49c50a2"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idaaaa500afa01441caa60ae8b04cc1983"><enum>(1)</enum><header>Covered packer</header><subparagraph id="id9977b2da221144f8af6abcc90e428f2e"><enum>(A)</enum><header>In general</header><text>The term <term>covered packer</term> means a packer that is required under subtitle B of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635">7 U.S.C. 1635 et seq.</external-xref>) to report to the Secretary each reporting day information on the price and quantity of livestock purchased by the packer.</text></subparagraph><subparagraph id="idd2c7a755b4394d4cbd4b6ebcc0643e22"><enum>(B)</enum><header>Exclusion</header><text>The term <term>covered packer</term> does not include a packer that owns only 1 livestock processing plant.</text></subparagraph></paragraph><paragraph id="id4f295d98cc9f4c7594a23f51b133841f"><enum>(2)</enum><header>Nonaffiliated producer</header><text>The term <term>nonaffiliated producer</term> means a producer of livestock—</text><subparagraph id="id475c268fc6da404cb7ba54c16df615fb"><enum>(A)</enum><text>that sells livestock to a packer;</text></subparagraph><subparagraph id="id02893c38eecb4a25bc0c284b0947d3c3"><enum>(B)</enum><text>that has less than 1 percent equity interest in the packer;</text></subparagraph><subparagraph id="id1902578070b84dc1bab3b706ae0203bf"><enum>(C)</enum><text>that has no officers, directors, employees, or owners that are officers, directors, employees, or owners of the packer;</text></subparagraph><subparagraph id="id433f748f5ca84af598a4cc256fbd7b60"><enum>(D)</enum><text>that has no fiduciary responsibility to the packer; and</text></subparagraph><subparagraph id="id5fc9c4f8fa7147b79405ca01f20e7ff4"><enum>(E)</enum><text>in which the packer has no equity interest.</text></subparagraph></paragraph><paragraph id="id1516a73585364d1cb173d79c5c6a3aae"><enum>(3)</enum><header>Spot market sale</header><subparagraph id="id4e39a70f80a54a2899d7102d239b3413"><enum>(A)</enum><header>In general</header><text>The term <term>spot market sale</term> means a purchase and sale of livestock by a packer from a producer—</text><clause id="idd4ad3f4727c3435db2ea49d8ad99bd2f"><enum>(i)</enum><text>under an agreement that specifies a firm base price that may be equated with a fixed dollar amount on the date the agreement is entered into;</text></clause><clause id="id6c7d60775a264be69d03fbc7586380db"><enum>(ii)</enum><text>under which the livestock are slaughtered not more than 7 days after the date on which the agreement is entered into; and</text></clause><clause id="id4ff266bf5ac542f8b922c12d3ffc3398"><enum>(iii)</enum><text>under circumstances in which a reasonable competitive bidding opportunity exists on the date on which the agreement is entered into.</text></clause></subparagraph><subparagraph id="idd30c3047a2d64ba7b4ed9af9b9139636"><enum>(B)</enum><header>Reasonable competitive bidding opportunity</header><text>For the purposes of subparagraph (A)(iii), a reasonable competitive bidding opportunity shall be considered to exist if—</text><clause id="idd7d3d9a686294df282579f29b46af6ca"><enum>(i)</enum><text>no written or oral agreement precludes the producer from soliciting or receiving bids from other packers; and</text></clause><clause id="idadedce322f4946dc9c2d05f18aa57896"><enum>(ii)</enum><text>no circumstance, custom, or practice exists that—</text><subclause id="id5ecfd84e06b84178a1f936eec8e1bc35"><enum>(I)</enum><text>establishes the existence of an implied contract (as determined in accordance with the Uniform Commercial Code); and</text></subclause><subclause id="id7c6adac4a42b4529a4e2c8fbb60aa73d"><enum>(II)</enum><text>precludes the producer from soliciting or receiving bids from other packers.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="idebb2fdc906a64658a912fa3d2cfcf78d"><enum>(b)</enum><header>General rule</header><text>Of the quantity of livestock that is slaughtered by a covered packer during each reporting day in each plant, the covered packer shall slaughter not less than the applicable percentage specified in subsection (c) of the quantity through spot market sales from nonaffiliated producers.</text></subsection><subsection id="idd7229b19292142cc8f9eb36035220cf1"><enum>(c)</enum><header>Applicable percentages</header><paragraph id="idcd585339c4854162b3a8e5e1a5fef094"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the applicable percentage shall be 50 percent.</text></paragraph><paragraph id="ida29f9da1d03b4a078035b5b0702e15b8"><enum>(2)</enum><header>Exceptions</header><text>In the case of a covered packer that reported to the Secretary in the 2018 annual report that more than 60 percent of the livestock of the covered packer were committed procurement livestock, the applicable percentage shall be the greater of—</text><subparagraph id="id088b0e6cec6f464787489192efa031af"><enum>(A)</enum><text>the difference between the percentage of committed procurement so reported and 100 percent; and</text></subparagraph><subparagraph id="idd367aa161d2140a0b338d9bc39efc3c3"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id7ebdcc1398d84485b9a2e66387c73dbf"><enum>(i)</enum><text>during each of calendar years 2020 and 2021, 20 percent;</text></clause><clause indent="up1" id="id9E06A5478E424E1895EE43154861E767"><enum>(ii)</enum><text>during each of calendar years 2022 and 2023, 30 percent; and</text></clause><clause indent="up1" id="id3923CDB7742841A98D8902628A36FE30"><enum>(iii)</enum><text>during calendar year 2024 and each calendar year thereafter, 50 percent.</text></clause></subparagraph></paragraph></subsection><subsection id="id66b7293911eb475e9cc71adc8551c1a7"><enum>(d)</enum><header>Nonpreemption</header><text>This section does not preempt any requirement of a State or political subdivision of a State that requires a covered packer to purchase on the spot market a greater percentage of the livestock purchased by the covered packer than is required under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id95e2c6737e5b4e52a60277cea40c1b7a"><enum>207.</enum><header>Investigation of live poultry dealers</header><subsection id="ida0de00cc63b04646a713b420ba8b4bfc"><enum>(a)</enum><header>Administrative enforcement authority over live poultry dealers</header><text>Sections 203, 204, and 205 of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/193">7 U.S.C. 193</external-xref>, 194, 195), are amended by inserting <quote>, live poultry dealer,</quote> after <quote>packer</quote> each place it appears.</text></subsection><subsection id="id1584f4433cc64648b60c42b2aff6a04b"><enum>(b)</enum><header>Authority To request temporary injunction or restraining order</header><text>Section 408(a) of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/228a">7 U.S.C. 228a(a)</external-xref>), is amended by inserting <quote>or poultry care</quote> after <quote>on account of poultry</quote>.</text></subsection><subsection id="id106651d53cb445f0981654a7ee61a7af"><enum>(c)</enum><header>Violations by live poultry dealers</header><text>Section 411 of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/228b-2">7 U.S.C. 228b–2</external-xref>), is amended—</text><paragraph id="idc2d6b287e05442a794f2b7b18b64466b"><enum>(1)</enum><text>in subsection (a), in the first sentence, by striking <quote>any provision of section 207 or section 410 of</quote>; and</text></subparagraph><subparagraph id="idb974f2ad1e5f4a1ea1653ab024c822d7"><enum>(B)</enum><text>by striking <quote>he</quote> and inserting <quote>the Secretary</quote>; and</text></subparagraph></paragraph><paragraph id="idb7214c38ca76467bbc35c2f29f7ce154"><enum>(4)</enum><text>in subsection (g), by striking <quote>his officers, directors, agents, and employees</quote> and inserting <quote>the officers, directors, agents, and employees of the packer, live poultry dealer, or swine packer</quote>.</text></paragraph></subsection></section></title><title id="idB729CB7AFDAC453CA8AF4A352AAEEDA7" style="OLC"><enum>III</enum><header>GAO reports</header><section id="id4753f508c75e4e40ad504cffcfc641c5"><enum>301.</enum><header>Review and report on fragility and national security in the food system</header><subsection id="id34b407f95b914bd3b15181d5d5025833"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Comptroller General of the United States shall carry out, and submit to Congress a report containing, a review of the fragility of the food system in the United States with respect to meat and poultry.</text></subsection><subsection id="idaae855e7258641308ecf96f47fe60ffd"><enum>(b)</enum><header>Requirements</header><text>The report under subsection (a) shall include information on, and an analysis of—</text><paragraph id="id164db286184244cf8ee735fd230106a8"><enum>(1)</enum><text>the reach of corporate consolidation and corporate control of the meat and poultry supply chain, including animal feed, inputs for animal feed, processing, and distribution;</text></paragraph><paragraph id="id9b6761879a9a4919bead283a9a790095"><enum>(2)</enum><text>the effects of corporate consolidation and corporate control of the meat and poultry supply chain on—</text><subparagraph id="idB61097C37C504C498A1EC77F4CAC88E6"><enum>(A)</enum><text>consumers, farmers, rural communities, and meat and poultry processing workers;</text></subparagraph><subparagraph id="id9678062B2A7B4CD98A3AE9525F85D4FA"><enum>(B)</enum><text>greenhouse gas emissions, climate change, and costs borne by communities to adapt to climate change;</text></subparagraph><subparagraph id="id63F33122B94B4CB2971A907AE353BC15"><enum>(C)</enum><text>water quality, soil quality, air quality, and biodiversity; and </text></subparagraph><subparagraph id="id39F9527C17C44B47B6CE74996C14B4FF"><enum>(D)</enum><text>politics and political lobbying;</text></subparagraph></paragraph><paragraph id="idc83afa0da6c6433c97ef26cf9140fa36"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idB1B16715FDBA418DB86F4DF076F96E4F"><enum>(A)</enum><text>the extent to which Department of Agriculture rules and regulations designed for large covered establishments are applied to small- and medium-sized covered establishments; and </text></subparagraph><subparagraph id="idF87A7711228F475A85E35BBF25D592B2" indent="up1"><enum>(B)</enum><text>the need for the Secretary of Agriculture to adapt rules and regulations to benefit small- and medium-sized covered establishments;</text></subparagraph></paragraph><paragraph id="ida7f7cde4dbd045e3bf4608c26378ffa9"><enum>(4)</enum><text>the effects of the COVID–19 pandemic on meat and poultry exports, meat and poultry cold storage inventories, processing rates of meat and poultry, and the net profits earned by owners of covered establishments;</text></paragraph><paragraph id="id65736e0090c04c2593379ba9b4d281a7"><enum>(5)</enum><text>the effect of the COVID–19 pandemic on meat and poultry prices paid—</text><subparagraph id="id68C616F6E1EC404090103F22DD102BFD"><enum>(A)</enum><text>to farmers; and </text></subparagraph><subparagraph id="id21EA342B1DEF491E8295A0BD09DB744B"><enum>(B)</enum><text>by consumers;</text></subparagraph></paragraph><paragraph id="ida7b8bfbd8e41475dae7b6e5a1659e53b"><enum>(6)</enum><text>Federal support for the corporations that control the largest percentage of the meat and poultry industry through contracts, procurement, subsidies, and other mechanisms;</text></paragraph><paragraph id="id4b84e3dbbfca42f4b5b35f56f02a1c35"><enum>(7)</enum><text>the risk of disruption caused by corporate consolidation among covered establishments, including an analysis of food supply chain issues resulting from the COVID–19 pandemic; and</text></paragraph><paragraph id="ideb086e52953141f3b549619f1dfb8266"><enum>(8)</enum><text>the extent to which breaking up the meat packing oligopoly would increase food system resiliency for the next pandemic.</text></paragraph></subsection></section><section id="idEBC8107BA37E4029916EF3AA1038C493"><enum>302.</enum><header>Review and report on racial and ethnic disparities in meat and poultry processing</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Comptroller General of the United States shall carry out, and submit to Congress, a report on racial and ethnic disparities in the meat and poultry processing sector. Such report shall contain a review of each of the following:</text><paragraph id="idde4a1fac0e7e400b8ca892ab3298aa64"><enum>(1)</enum><text>The impacts of working in covered establishments to individuals working at such establishments who are employees, temporary workers, incarcerated workers, noncitizen workers admitted to the United States as nonimmigrants described in section 101(a)(15)(H)(ii)(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(ii)(b)</external-xref>) or as refugees under section 207 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>), or noncitizen workers who are not lawfully present in the United States. Such review shall include a review of—</text><subparagraph id="id24df7f27460041b09fbc845754205107"><enum>(A)</enum><text>workplace injuries, including repetitive musculoskeletal injuries, of such individuals;</text></subparagraph><subparagraph id="id553b0ef600184f1d9d9c69cc68a8a36b"><enum>(B)</enum><text>psychological and mental health conditions of such individuals; </text></subparagraph><subparagraph id="id776199a72c61416cb12242bfdbc9a460"><enum>(C)</enum><text>exposure of such individuals to chemicals or other potential carcinogens and reproductive toxins;</text></subparagraph><subparagraph id="idaccb82b5e1d840e5a218b9899d95e719"><enum>(D)</enum><text>any physical or mental abuse, including sexual harassment, of such individuals by co-workers or managers; </text></subparagraph><subparagraph id="id3FC79B0B27034AC086482C213A13399A"><enum>(E)</enum><text> the risk of exposure to SARS–CoV–2 for such individuals; </text></subparagraph><subparagraph id="id2DC930EFE3A24A12B817F4C0A5CC7CFD"><enum>(F)</enum><text>the extent to which such individuals are unable to seek appropriate relief for workplace injuries, abuse, and protection from exposure to SARS–CoV–2 during the COVID–19 emergency for fear of retaliation; and</text></subparagraph><subparagraph id="id80A8998573F4483D88A94F886E9039C5"><enum>(G)</enum><text>COVID–19 deaths and illnesses of such individuals, including the short- and long-term effects of COVID–19 for such individuals.</text></subparagraph></paragraph><paragraph id="idf52b7a3d90964069833fbd340e04f8c4"><enum>(2)</enum><text>The racial demographics and use of temporary workers to outsource the responsibility of covered establishments to provide a safe workplace.</text></paragraph><paragraph id="id3fb4863397404638970da99b2f52b7fa"><enum>(3)</enum><text>The racial demographics and use of incarcerated workers in covered establishments, including—</text><subparagraph id="id0f8cc3b40f484503aac3ec373cb8dbff"><enum>(A)</enum><text>the extent to which such workers have a choice in working at covered establishments;</text></subparagraph><subparagraph id="ide6bfab6e65354deca34074ed83dbcbd4"><enum>(B)</enum><text>the use of such workers to outsource the responsibility of covered establishments to provide a safe workplace;</text></subparagraph><subparagraph id="ida4e04a24d227414690aaae8577d1c95f"><enum>(C)</enum><text>the use of such workers to outsource the responsibility of covered establishments to provide fair compensation; and</text></subparagraph><subparagraph id="id75afc99c32194207bd71930a1181ae3d"><enum>(D)</enum><text>the use of such workers by covered establishments to externalize employee cost.</text></subparagraph></paragraph><paragraph id="id2237cd6236454ea8b1cc9aa71e339f34"><enum>(4)</enum><text>The racial demographics and use of noncitizen workers admitted to the United States as nonimmigrants described in section 101(a)(15)(H)(ii)(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(ii)(b)</external-xref>) or as refugees under section 207 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>) at covered establishments, including—</text><subparagraph id="idf438d28ef7ea481faa504bad10b86baf"><enum>(A)</enum><text>the extent to which predatory practices, such as limiting the ability of such workers to choose and move between competing organizations, are utilized by covered establishments with respect to such workers;</text></subparagraph><subparagraph id="id91506805b5fb4476871d60a526293168"><enum>(B)</enum><text>the extent to which such workers are unable to speak out for fear of retaliation; and</text></subparagraph><subparagraph id="id3a539629a38446dbbe5c0c1db3331be0"><enum>(C)</enum><text>the extent to which there is full transparency about the nature of employment of such workers prior to being hired.</text></subparagraph></paragraph><paragraph id="idd35e1ff9a0ca472f8c7b825fb5b9f7df"><enum>(5)</enum><text>The racial demographics and use of noncitizen workers who are not lawfully present in the United States at covered establishments, including—</text><subparagraph id="ida99d8e1ee14e4da88215a685c3089614"><enum>(A)</enum><text>the extent to which such workers are unable to speak out for fear of retaliation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6343f90089024c1899afdcebd090608c"><enum>(B)</enum><text>whether any collusion between Federal immigration offices and covered establishments have the effect of intimidating and silencing such workers. </text></subparagraph></paragraph></section><section id="id9182d3c274be470486d4c8095f0b44e1"><enum>303.</enum><header>GAO report on line speeds</header><subsection id="id9fc81dafcf83443893afd0a7b6dcbe08"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the end of the covered period, the Comptroller General of the United States shall carry out, and submit to Congress a report containing, a review of the actions taken by the Secretary, the Secretary of Labor, and the Secretary of Health and Human Services in response to the COVID–19 pandemic to determine the effectiveness of those actions in protecting animal, food, and worker safety.</text></subsection><subsection id="id784c7b8b338d45c68417ead6be7ecebc"><enum>(b)</enum><header>Contents</header><text>The review carried out under subsection (a) shall include information on, and an analysis of, with respect to covered establishments—</text><paragraph id="id92f3c438361f4c68b914a0c393328ef6"><enum>(1)</enum><text>all policies and regulations relating to inspection of those establishments that have been implemented by the Secretary, the Secretary of Labor, and the Secretary of Health and Human Services during the COVID–19 emergency and the covered period;</text></paragraph><paragraph id="id19fb46e38ef440328f1b507b3058a2d7"><enum>(2)</enum><text>the pandemic emergency preparedness plans of those establishments;</text></paragraph><paragraph id="iddb7bd5009f6443daaf21ca0a1b9305b4"><enum>(3)</enum><text>the extent to which those establishments have implemented guidance and recommendations to space workers 6 feet apart on production lines and in break rooms, locker rooms, and all other workspaces;</text></paragraph><paragraph id="id1c3f980c85fa4c4eb9f39e316827ba9e"><enum>(4)</enum><text>the extent to which those establishments maintain policies and procedures that discourage workers from reporting exposure, seeking treatment, or remaining in isolation, including—</text><subparagraph id="id7E816F2AD38A41A3B65072B97BE6D8D7"><enum>(A)</enum><text>bonus or work incentive programs; and </text></subparagraph><subparagraph id="idDF07BAFE7BF7411AA4FF800ED874D1AE"><enum>(B)</enum><text>sick leave that does not cover the full pay of a worker;</text></subparagraph></paragraph><paragraph id="id8416630c5b6c418ab7c3d4e57c26b7e5"><enum>(5)</enum><text>the extent to which those establishments provide communications and training about COVID–19 in a language and at a literacy level workers understand;</text></paragraph><paragraph id="id3b2f5200a66849e49adf4ff888a9950f"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idCD3A76C9C68B4C08BC9FD05A249868EF"><enum>(A)</enum><text>the quantity and quality of face masks and personal protective equipment, such as face shields and respirators, made available to workers at those establishments;</text></subparagraph><subparagraph id="id235C573C5FDA4FE48790277A0F1C73BE" indent="up1"><enum>(B)</enum><text>whether the face masks and personal protective equipment are provided to the workers free of charge; and</text></subparagraph><subparagraph indent="up1" id="idBC3CFAA5D2864EC1B8E8F0523A0B301A"><enum>(C)</enum><text>usage of the face masks and personal protective equipment by the workers;</text></subparagraph></paragraph><paragraph id="idbd28dcec54de423fb58560076c58aa93"><enum>(7)</enum><text>any guidance provided to inspectors of those establishments by the Secretary, the Secretary of Labor, or the Secretary of Health and Human Services during the COVID–19 emergency;</text></paragraph><paragraph id="id7cebd9e5b764464cb741731516e066a9"><enum>(8)</enum><text>actions taken by the Secretary, the Secretary of Labor, and the Secretary of Health and Human Services to protect workers, animals, and food at establishments that have reported cases of COVID–19;</text></paragraph><paragraph id="id335b889b7af64c4592a9c48f0efc1478"><enum>(9)</enum><text>all humane handling reports issued, and enforcement actions taken, by the Secretary during the COVID–19 emergency pursuant to—</text><subparagraph id="ide466e600408e450db1e3a8280fe71ac1"><enum>(A)</enum><text>Public Law 85–765 (commonly known as the <quote>Humane Methods of Slaughter Act of 1958</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/7/1901">7 U.S.C. 1901 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id4347f5d7723b4fc2ba0c551aa3914af2"><enum>(B)</enum><text>good commercial practices regulations promulgated under the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/451">21 U.S.C. 451 et seq.</external-xref>);</text></subparagraph></paragraph><paragraph id="id8cb3ab59af2f433f956d3fa5fbe5e71c"><enum>(10)</enum><text>the impact of faster line speeds on the ability of those establishments to maintain protections for workers;</text></paragraph><paragraph id="id27ef0316af5b49b5b2449d6e934b5d64"><enum>(11)</enum><text>any instance of interference by a Federal agency with the contents of any report of findings based on a review of a covered establishment experiencing an outbreak of COVID–19 conducted by personnel of the Centers for Disease Control and Prevention; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6205165792af465389fedcad0e7f1300"><enum>(12)</enum><text>any instance of interference by a Federal agency with the recommended actions of a State or local health department to close a covered facility experiencing COVID–19-related deaths and disease. </text></paragraph></subsection></section></title></legis-body></bill>
