which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To make data and internal guidance on excess personal property publicly available, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reuse Excess Property Act</short-title></quote>.</text></section><section id="id8dfac31110ca477a92e7ee4ee3fb5635"><enum>2.</enum><header>Reporting on excess personal property</header><subsection commented="no" display-inline="no-display-inline" id="id247955c4ee7749ba897022e7ea2bb973"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/5">chapter 5</external-xref> of title 40, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id8c176900881f48a2bf270f97f0d4be0d"><enum>(1)</enum><text>in section 529, by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id431ED8B63A1F4A429DB2D875E2ADC64C"><subsection commented="no" display-inline="no-display-inline" id="ida6740ddd1f554f1e93dc24164e497d8a"><enum>(c)</enum><header>Compilation of data</header><text>Not later than 180 days following the close of a fiscal year, the Administrator shall compile the data in the reports submitted under subsection (a) and publish a publicly available report on a centralized online website, which shall include—</text><paragraph commented="no" display-inline="no-display-inline" id="id9072d86fd11f4be3a36d936e4153957c"><enum>(1)</enum><text display-inline="yes-display-inline">the complete data provided in each report in a user-friendly format; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf7594a5362fb48c98cd3f8a5d8f807dc"><enum>(2)</enum><text>a summary of the findings of each report, including the aggregate dollar amount of personal property determined to be no longer required for the purpose of the appropriation used to make the purchase; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id844b27d713b4442c8fa2aea0c02f35fe"><enum>(3)</enum><text>any other recommendations from the Administrator.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id704946ddf90a466298c35b7c89d19783"><enum>(2)</enum><text>by inserting after section 529 the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id61E63CA263164D9AA46E3931755DDE9B"><section id="iddcd9aa177f304e338808982515f0f848"><enum>530.</enum><header>Internal guidance on excess personal property</header><subsection commented="no" display-inline="no-display-inline" id="idf734c68b27d047dfafc590486a6f5261"><enum>(a)</enum><header display-inline="yes-display-inline">Initial report</header><text>Not later than 180 days after the date of enactment of this section, each executive agency shall submit to the Administrator and make publicly available on the website of the executive agency the internal guidance of the executive agency on considering using excess personal property to meet the needs of the executive agency, which shall include—</text><paragraph id="id181D272F09C44E54A4216A7B2D95E54D"><enum>(1)</enum><text>a requirement to consider excess personal property before buying new;</text></paragraph><paragraph id="id07FF3F21A58A40659DE4EB227D98B12C"><enum>(2)</enum><text>when it is practicable to check for and obtain excess personal property;</text></paragraph><paragraph id="id783B270A425847E4BACE078C27A35ADF"><enum>(3)</enum><text>how to evaluate the suitability of excess personal property for use; and</text></paragraph><paragraph id="idDE0C0C1F411C4AF5B4736B945A48DF3C" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>defined roles and responsibilities relevant to considering the potential use of excess personal property, including the designation of an employee as responsible for searching through available excess personal property for items that meet the needs of the executive agency.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1f155bc4285344d09dd894b8c2710b9b"><enum>(b)</enum><header>Updates</header><text>Each executive agency shall submit to the Administrator and update on the website of the executive agency any changes to the internal guidance submitted and made available under subsection (a).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id98565ccab2ce46da9a86c0798603f50e"><enum>(b)</enum><header>Report on interagency working group</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator of General Services shall publish a publicly available report on a centralized online website that includes a summary of findings from the interagency working group on the acquisition of personal property that was first convened in February 2023 on ways to improve the use of excess personal property.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idbadee573579f4ffca3665c116440eae1"><enum>(c)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/5">chapter 5</external-xref> of title 40, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/40/529">section 529</external-xref> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id36663167AA5B42E0A44F404CA47FEBF7"><toc><toc-entry level="section" bold="off">530.
