<congress display="yes">118th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 2685</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To make data and internal guidance on excess personal property publicly available, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section id="idb8e8e61c-6a26-4ec5-a2a4-12e94e837b18" section-type="section-one" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reuse Excess Property Act</short-title></quote>.</text></section><section id="id5122b2ee-649a-45d3-8fb7-2ae31ceebde2" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Reporting on excess personal property</header><subsection commented="no" display-inline="no-display-inline" id="ida5448dbd-6e80-4fb8-b24e-3e4bc684964c" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/5">chapter 5</external-xref> of title 40, United States Code, is amended—</text><paragraph id="idb44bb532294744449e79c14d8d47a186" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in section 529—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9f9ab8893857432e85fec3acd245c4d2" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a), in the matter preceding paragraph (1), by inserting <quote>and the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives</quote> after <quote>Administrator of General Services</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide8330c0ad50f42c58e7ae92f7b97b11d" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf3956b02-b4ca-4b3b-837f-fb4dde457c22" changed="not-changed"><subsection commented="no" display-inline="no-display-inline" id="idd9441af7-a1a5-4057-8c68-b65a34c42efc" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Compilation of data</header><text display-inline="yes-display-inline">Not later than 180 days following the close of a fiscal year, the Administrator shall compile the data in the reports submitted under subsection (a) and submit to the Committee on Homeland Security Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives and publish on a centralized online website a publicly available report, which shall include—</text><paragraph commented="no" display-inline="no-display-inline" id="id4905c618-5f52-484c-b1dd-aa53fba02f93" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">the complete data provided in each report in a user-friendly format; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide0b94e72-5463-4f5c-afe4-d844d64ad1c6" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">a summary of the findings of each report, including the aggregate dollar amount of personal property determined to be no longer required for the purpose of the appropriation used to make the purchase; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8e1ac2ff-2ea1-4e48-8195-aa8fbdce0056" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">any other recommendations from the Administrator.</text></paragraph></subsection><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idca0a7118-37dd-40a7-bf48-f1203375a0a0" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 529 the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idb9b10217-f52a-4aad-9643-f6f364f241a6" changed="not-changed"><section id="ida912ab56-db0e-4ff9-af36-7bdab167a90b" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>530.</enum><header display-inline="yes-display-inline">Internal guidance on excess personal property</header><subsection commented="no" display-inline="no-display-inline" id="ide1e81dc5-4977-42c3-b0b8-9208c429b603" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Initial report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section, each executive agency shall submit to the Administrator of General Services and make publicly available on the website of the executive agency the internal guidance of the executive agency on considering using excess personal property to meet the needs of the executive agency, which shall include—</text><paragraph id="id464918fa-abb6-48d5-acd3-e15e0f42e903" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">a requirement to consider excess personal property before buying new;</text></paragraph><paragraph id="id6f5cad67-1bfd-49d1-a0f1-e87552c678ab" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">when it is practicable to check for and obtain excess personal property;</text></paragraph><paragraph id="id13c97dec-e9b6-421f-935f-8d18449f5708" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">how to evaluate the suitability of excess personal property for use; and</text></paragraph><paragraph id="ideb0f6666-8a69-4181-8f56-d28fb9df9ab9" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">defined roles and responsibilities relevant to considering the use of excess personal property, including the designation of an employee as responsible for searching through available excess personal property for items that meet the needs of the executive agency.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6b0f6de9-c09f-450a-93b7-61fef8a75e08" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Updates</header><text display-inline="yes-display-inline">Each executive agency shall submit to the Administrator of General Services and update on the website of the executive agency any changes to the internal guidance submitted and made available under subsection (a).</text></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc48a5c18-a98a-47a4-a111-bafd3fd67ad5" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Report on interagency working group</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator of General Services shall publish a publicly available report on a centralized online website that includes a summary of findings from the interagency working group on the acquisition of personal property that was first convened in February 2023 on ways to improve the use of excess personal property.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idf4d2af8f-9cac-4734-b20b-72ee6acd0165" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Technical and conforming amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/5">chapter 5</external-xref> of title 40, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/40/529">section 529</external-xref> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id71eaef95-fd11-4083-a990-dfa34b211540" changed="not-changed"><toc changed="not-changed"><toc-entry level="section" bold="off" changed="not-changed">530. Internal guidance on excess personal property.</toc-entry></toc><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection id="id96e47624aa2b4929a3cf6d1367bc6012" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">GAO report</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives a report that evaluates the frequency with which executive agencies (as defined in section 102 of title 40, United States Code) acquire personal property that was made, produced, or manufactured by any entity, including any corporation, that is organized under the laws of, is headquartered in, or has its principal place of business in the People’s Republic of China, including any Special Administrative Region.</text></subsection><subsection id="id961a323759ea400e8239401fb72e4643" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">Effective the date that is 5 years after the date of enactment of this Act, <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/5">chapter 5</external-xref> of title 40, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id28b37bef96e24fe98f0e9c147a2d6806" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">in section 529—</text><subparagraph commented="no" display-inline="no-display-inline" id="idC644BCD14A234BB3B333B3B67C503ECC" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a), in the matter preceding paragraph (1), by striking <quote>and the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives</quote>; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3c419dc81bb14101b5cde5601ac68cd8" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">by striking subsection (c);</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd5e4b09c6b9e4b4295c482d23e7450cc" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">by striking section 530; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id63a3f4bf9be347cb96ea71b182eb6d8e" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">in the table of sections, by striking the item relating to section 530. </text></paragraph></subsection><subsection id="id2063662f2d164a5c98a7137928186b15" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">No additional funds</header><text display-inline="yes-display-inline">No additional funds are authorized to be appropriated for the purpose of carrying out this Act or the amendments made by this Act.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20231218" chamber="Senate">Passed the Senate December 18, 2023.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
