which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require executive agencies and Federal courts to comply with address confidentiality programs, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H73025FCC72944BC29308007705E1E288"><section section-type="section-one" id="H2817053D2853415692F0865A8348AD1A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe at Home Act</short-title></quote>.</text></section><section id="H0E7C9FED430541149466FBC4D92409E2"><enum>2.</enum><header>Executive agency and Federal court compliance with State address confidentiality programs</header><subsection id="idE3861724274D4EF7A0DECB826BFD206F"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idE95506144BBA46B0B4AFB361A773F916"><enum>(1)</enum><header>Address confidentiality program</header><text display-inline="yes-display-inline">The term <term>address confidentiality program</term> means a program implemented pursuant to State law that—</text><subparagraph id="id774E886F94A34CFD8D7AD8373739C7C3"><enum>(A)</enum><text display-inline="yes-display-inline">provides a designated address;</text></subparagraph><subparagraph id="id222F0529746D4669A0924CAB1C52D6DC"><enum>(B)</enum><text display-inline="yes-display-inline">provides a mail-forwarding service; and</text></subparagraph><subparagraph id="idDFC139326D1C45ED80B23744F927B023"><enum>(C)</enum><text display-inline="yes-display-inline">is designated by a participant as the legal agent of the participant to receive service of process.</text></subparagraph></paragraph><paragraph id="id181DB7262CA04B9983E2E0E745DD3FB9"><enum>(2)</enum><header>Designated address</header><text display-inline="yes-display-inline">The term <term>designated address</term> means an address assigned by an address confidentiality program for a participant to use in lieu of the physical address of the participant.</text></paragraph><paragraph id="id79CB5EB55FFD4A749277E34F56101F01"><enum>(3)</enum><header>Executive agency</header><subparagraph id="id2814BA73010C43B8A98CBDDB4EBD7532"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>executive agency</term> has the meaning given the term <term>Executive agency</term> in section 105 of title 5, United States Code.</text></subparagraph><subparagraph id="idCB059588523B47D0817E27BBDF79E1AB"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">The term <term>executive agency </term> does not include the Census Bureau.</text></subparagraph></paragraph><paragraph id="idB5B6CED9571546CCBBA855D39641FEA8"><enum>(4)</enum><header>Participant</header><text display-inline="yes-display-inline">The term <term>participant</term> means an adult or minor who is enrolled in an address confidentiality program.</text></paragraph><paragraph id="idCD9BBE4D74634707A2D7FC3D33D057F3"><enum>(5)</enum><header>Physical address</header><text display-inline="yes-display-inline">The term <term>physical address</term> means the actual home, school, or employment address of a participant.</text></paragraph><paragraph id="idA31749C974634D77B407FCB8EA7ED696" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the States, the District of Columbia, each territory or possession of the United States, and each federally recognized Indian Tribe. </text></paragraph></subsection><subsection id="HC1D69815666142AAA81688622DF5AC54"><enum>(b)</enum><header>Acceptance of address confidentiality program</header><text display-inline="yes-display-inline">Each executive agency and Federal court shall accept, for any purpose for which an individual is required to provide an address to the agency or court, an address designated to that individual pursuant to an address confidentiality program.</text></subsection><subsection id="H2F6C93C1325E46AF994BAB7D7D7177A7"><enum>(c)</enum><header>Exemption from liability</header><text display-inline="yes-display-inline">A participant shall not be subject to Federal regulatory, civil, or criminal penalties for providing a designated address in lieu of the physical address of the participant to an executive agency or Federal court.</text></subsection><subsection id="H10F90A7D34ED4344B77BECC29931D8CF"><enum>(d)</enum><header>Regulatory compliance with address confidentiality programs</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, each executive agency shall review and, as necessary, modify existing regulations to comply with this Act.</text></subsection><subsection id="H9E3A8C444B584BCA880C008C9F660E85"><enum>(e)</enum><header>Compliance with address confidentiality program procedures and exemption from FOIA</header><paragraph id="id61D366627DCE4904998D07775F5EF125"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraphs (3) and (4), in the case of an executive agency or Federal court seeking to acquire the physical address of a participant, the agency or court shall comply with any applicable procedures of the applicable address confidentiality program for acquiring such address.</text></paragraph><paragraph id="id6D114AC8E09042268C24A86138077E40"><enum>(2)</enum><header>FOIA exemption</header><text display-inline="yes-display-inline">Upon acquiring a physical address under paragraph (1), the physical address—</text><subparagraph id="id17B8BB18F62549C0B801283BB6D0C040"><enum>(A)</enum><text display-inline="yes-display-inline">shall be considered confidential; and</text></subparagraph><subparagraph id="id7FB7DE7366614725A7955E090367797F"><enum>(B)</enum><text display-inline="yes-display-inline">shall be exempt from disclosure under section 552 of title 5, United States Code (commonly referred to as the <quote>Freedom of Information Act</quote>) for the purpose of subsection (b)(3) of that section.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3f3ea986e9c84b8ba058d41192147786"><enum>(3)</enum><header>Law enforcement exception</header><subparagraph commented="no" display-inline="no-display-inline" id="id155ce1a7362142fe8de0e3d42d41bc2a"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">When the physical address of a participant is relevant to a Federal criminal proceeding, a Federal court may order the disclosure of the physical address to relevant parties without regard to the procedures of the relevant address confidentiality program, including—</text><clause commented="no" display-inline="no-display-inline" id="id1c2d4f61100b43aaaf476d5b572678ee"><enum>(i)</enum><text display-inline="yes-display-inline">court officers and employees;</text></clause><clause commented="no" display-inline="no-display-inline" id="idf498bd9745b4460aa80055ed8464d0cc"><enum>(ii)</enum><text display-inline="yes-display-inline">supervision and probation officers;</text></clause><clause commented="no" display-inline="no-display-inline" id="id0e0dece2a62448c5a92fd0c822734d72"><enum>(iii)</enum><text display-inline="yes-display-inline">prosecutors;</text></clause><clause commented="no" display-inline="no-display-inline" id="idbf84e5576972443c870db160218220eb"><enum>(iv)</enum><text display-inline="yes-display-inline">law enforcement officers; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id29af454407734aa6a3cd47d853dd64db"><enum>(v)</enum><text display-inline="yes-display-inline">any other party determined relevant by the Federal court.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6c364998ba3f4d2f99150b2093771c0b"><enum>(B)</enum><header>Limitations</header><text display-inline="yes-display-inline">If a Federal court orders the disclosure of a physical address to a party under subparagraph (A), the party—</text><clause commented="no" display-inline="no-display-inline" id="id2c391022a1694cceb75d7505bab042db"><enum>(i)</enum><text display-inline="yes-display-inline">shall keep the physical address confidential; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idba1f4e2d8ff647a7be4c2a0e68f0d031"><enum>(ii)</enum><text display-inline="yes-display-inline">may only use the physical address for the purpose for which the Federal court orders the disclosure. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id16e898e19c6043f28afa6d39a9563673"><enum>(4)</enum><header display-inline="yes-display-inline">Administration exception</header><text>If an executive agency requires the physical address of a participant in order for the executive agency to carry out the requirements of Federal law, a Federal court may order the disclosure of the physical address to the executive agency if the head of the executive agency makes a written request to the relevant address confidentiality program that maintains the record specifying—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9bebe43c6fad46efba9a5fe53a85053a"><enum>(A)</enum><text display-inline="yes-display-inline">the particular portion of the record desired; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idab1e1dd25da64e97923a124e1a084bcc"><enum>(B)</enum><text display-inline="yes-display-inline">the activity for which the record is sought.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2e2656099f4d4cd682a1540c20343197"><enum>(5)</enum><header display-inline="yes-display-inline">Rule of construction</header><text>Nothing in this subsection shall be construed to require an executive agency to be subject to an audit performed by a State.</text></paragraph></subsection><subsection id="HF135211C877545528581F0F8E834C1C3"><enum>(f)</enum><header>Prompt notification upon termination from participation</header><text>If the participation of an individual in an address confidentiality program is terminated, that individual shall promptly notify each executive agency or Federal court that accepted a designated address under subsection (b).</text></subsection></section></legis-body></bill>
