which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify minimum altitudes for go-arounds, inspection passes, practice approaches, and qualified instrument approaches, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id500d2eafca3a4ccda4de7ec4016c1645"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Backcountry Aviation Protection Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id0c3943969c924312a988104ef0aea957"><enum>2.</enum><header display-inline="yes-display-inline">Clarifying minimum altitudes for go-arounds, inspection passes, practice approaches, and qualified instrument approaches</header><subsection id="ide3918a90b1eb451fa03d82ae886e4613"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall revise section 91.119 of title 14, Code of Federal Regulations, to allow a properly qualified pilot operating an aircraft to conduct a go-around, an inspection pass, a practice approach, or a qualified instrument approach without regard to the minimum altitudes set forth in such section. </text></subsection><subsection id="id61d6cddeca244c2486e6b4e904d8b502"><enum>(b)</enum><header>Prohibition on FAA enforcement actions</header><text>Beginning on the date that is 1 year after the date of enactment of this Act, the Administrator may not take an enforcement action against a person under section 91.119 of title 14, Code of Federal Regulations, related to a go-around, inspection pass, or practice approach unless the Administrator has published final regulations in the Federal Register as required by subsection (a).</text></subsection><subsection id="id810ff7af3bea4a888899feca1e843665"><enum>(c)</enum><header>Burden of proof</header><text>In an enforcement action for a violation of section 91.119 of title 14, Code of Federal Regulations, the burden of proof shall be upon the Administrator to prove each element of the offense and the inapplicability of each exception to the offense, including takeoff, landing, go-around, inspection pass, practice approach, or qualified instrument approach maneuvers. </text></subsection><subsection id="id776ecc86f09642639dd1688de3733818"><enum>(d)</enum><header>Savings clause</header><text>Nothing in this Act shall impose a requirement on a person to complete a go-around, inspection pass, or practice approach before a landing.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id0b709406016f4bafb15b6fadbd0fe868"><enum>(e)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="ida7fa32e66dad416fa31b15cccb88ce02"><enum>(1)</enum><header>Administrator</header><text>The term <quote>Administrator</quote> means the Administrator of the Federal Aviation Administration.</text></paragraph><paragraph id="idD8E84D4838E345C8A43B4A21C52C21BC"><enum>(2)</enum><header>Go-around</header><text>The term <term>go-around</term>—</text><subparagraph id="id3FF93CC90C6A48EEB85FBA48E77516C8"><enum>(A)</enum><text>means an aborted landing which occurs at any point prior to the aircraft coming to a complete stop at a potential landing site; and</text></subparagraph><subparagraph id="idCF39E113B5BD4181BCAF4633212209B2"><enum>(B)</enum><text>includes a maneuver—</text><clause id="id9FDB1A52D17240689F1DD7F870B0614F"><enum>(i)</enum><text>for flight safety purposes; or</text></clause><clause id="id4F41F373573F40168E101F48E91531A0"><enum>(ii)</enum><text>to practice or instruct the appropriate procedures for an aborted landing.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8bf05ea9d00f4affbe792feb394ce9ee"><enum>(3)</enum><header>IFR conditions; instrument approach procedure</header><text>The terms <quote>IFR conditions</quote>, and <quote>instrument approach procedure</quote> have the meaning given those terms in section 1.1 of title 14, Code of Federal Regulations.</text></paragraph><paragraph id="idE82E257BF5EE498EAFFBA87AE1924A4F"><enum>(4)</enum><header>Inspection pass</header><text>The term <term>inspection pass</term> means a maneuver conducted to evaluate, at a low altitude, whether a potential landing site is suitable for takeoff and landing.</text></paragraph><paragraph id="idE4C00EA37DE04C26985F370A1C3B0B03"><enum>(5)</enum><header>Potential landing site</header><text>The term <term>potential landing site</term> includes any place on the surface of land or water where—</text><subparagraph id="id53F3672AA3674453A01DE2FFBEC11A67"><enum>(A)</enum><text>the takeoff or landing of an aircraft is not prohibited; and</text></subparagraph><subparagraph id="id42C67E8EDAFE4C51A3997CC62DBC8019"><enum>(B)</enum><text>the person operating the aircraft believes that it is possible a landing and subsequent takeoff could safely occur in the area such that it is objectively reasonable to evaluate the area at a low altitude.</text></subparagraph></paragraph><paragraph id="id115CC85DB00B4C289CE5D39489F52586"><enum>(6)</enum><header>Practice approach</header><text>The term <term>practice approach</term> means a maneuver conducted with or without the intent to land for the purpose of practicing—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9A8EB35B5AD74369B87D20C75CC86649"><enum>(A)</enum><text display-inline="yes-display-inline">an instrument approach procedure in conditions other than IFR conditions, provided that the pilot complies with—</text><clause id="id11D0A269D0DE4C679887547EC3D1F84F"><enum>(i)</enum><text>the published instrument approach procedure; or</text></clause><clause id="idB863D08B1D554FAEB75CD2B3368B15F3"><enum>(ii)</enum><text>a clearance or instruction issued by air traffic control; or</text></clause></subparagraph><subparagraph id="id32AE364FA76D4343B6B53D5C008D1C08"><enum>(B)</enum><text>a simulated engine failure or emergency descent. </text></subparagraph></paragraph><paragraph id="id51B56465BD054A8497A2948235E3CECE"><enum>(7)</enum><header>Qualified instrument approach</header><text>The term <term>qualified instrument approach</term> means an instrument approach procedure under actual IFR conditions in which the pilot complies with—</text><subparagraph commented="no" display-inline="no-display-inline" id="idBB0EE29221F04FDEBBA63260B41E353E"><enum>(A)</enum><text>the published instrument approach procedure; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDF4981546A5F4D4CA0E690915B79D9F3"><enum>(B)</enum><text>a clearance or instruction issued by air traffic control.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
