<official-title>To amend the Consolidated Farm and Rural Development Act to reform farm loans, to amend the Department of Agriculture Reorganization Act of 1994 to reform the National Appeals Division process, and for other purposes. </official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Credit for Farmers Act of 2023</short-title></quote>.</text></section> <section id="id5d4e407c5a054787ad9aacab8fc93441"><enum>2.</enum><header>Deferment of payments for borrowers of farm loans</header> <subsection id="id790b0c840a7a4f4ba6cae771e554d5ec"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="idb28f2a745746405dbef3db150de6b401"><enum>(1)</enum><header>Economically distressed farmer or rancher</header><text>The term <term>economically distressed farmer or rancher</term> means a farmer or rancher that is—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idb3263dbaad7f45c9af4df835ae4410d6"><enum>(A)</enum><text display-inline="yes-display-inline">delinquent, as described in the definition of the term <quote>delinquent borrower</quote> in section 761.2(b) of title 7, Code of Federal Regulations (or successor regulations); </text></subparagraph>
<subparagraph id="id8f4aefd6fac548818cfc1711a332e23e" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>financially distressed, as described in the definition of the term <quote>financially distressed borrower</quote> in section 761.2(b) of title 7, Code of Federal Regulations (or successor regulations); or</text></subparagraph> <subparagraph id="id4da9611fe5d3414b83eef8f9348670fc" commented="no"><enum>(C)</enum><text>a borrower of a direct farm loan who is unable to develop a feasible plan (as defined in section 761.2(b) of title 7, Code of Federal Regulations (or successor regulations)) for the current or next production cycle with current available rates and terms.</text></subparagraph></paragraph>
<paragraph id="id3b26d1a54ed54a4d9c0b8ecec7dd026e"><enum>(2)</enum><header>Eligible borrower</header><text>The term <term>eligible borrower</term> means a borrower that—</text> <subparagraph id="id70f0f5a107a14271a4a3042a2b692fa2"><enum>(A)</enum><text>is an economically distressed farmer or rancher; and</text></subparagraph>
<subparagraph id="idf3f8274d5117473e81a922fa85d4d9b8"><enum>(B)</enum><text>did not receive assistance under section 22006 of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (commonly known as the <quote>Inflation Reduction Act</quote>).</text></subparagraph></paragraph> <paragraph id="id874d2f5b129943e2bca5a0dcc7f43f3e"><enum>(3)</enum><header>Farm loan</header> <subparagraph id="ideb83163932ce43d58148697a4411bcae"><enum>(A)</enum><header>In general</header><text>The term <term>farm loan</term> means a direct or guaranteed—</text>
<clause id="id22fb7501db4f4aec9b41c795b3dc4aec"><enum>(i)</enum><text>farm ownership loan under subtitle A of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1922">7 U.S.C. 1922 et seq.</external-xref>);</text></clause> <clause id="id1ef6a298a85c4e0ebf3a0ce0a3883712"><enum>(ii)</enum><text>operating loan under subtitle B of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1941">7 U.S.C. 1941 et seq.</external-xref>); or</text></clause>
<clause id="id20f0cad3cf17480caf6d54d21d996ab9"><enum>(iii)</enum><text>emergency loan under subtitle C of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1961">7 U.S.C. 1961 et seq.</external-xref>).</text></clause></subparagraph> <subparagraph id="ide7d4f634b9504457ac8bb1473d8dce4d"><enum>(B)</enum><header>Inclusion</header><text>The term <term>farm loan</term> includes direct microloans of any type of loan described in clauses (i) through (iii) of subparagraph (A).</text></subparagraph></paragraph>
<paragraph id="id50e00ce422184c868efa2f87ab3fda71"><enum>(4)</enum><header>Historically underserved farmer or rancher</header><text>The term <term>historically underserved farmer or rancher</term> means—</text> <subparagraph id="id0daa861fa0c6425995a7265a7499e9b7"><enum>(A)</enum><text>a limited resource farmer or rancher, as determined by the Secretary;</text></subparagraph>
<subparagraph id="idb945df67198d45d590335ffe042198f4"><enum>(B)</enum><text>a socially disadvantaged farmer or rancher (as defined in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>));</text></subparagraph> <subparagraph id="idfc380a3748ae421cbad1bc4ba38472ad"><enum>(C)</enum><text>a beginning farmer or rancher (as defined in that section); and</text></subparagraph>
<subparagraph id="idbc03e37a5ca64a64aeb757d5c7d1af3e"><enum>(D)</enum><text>a veteran farmer or rancher (as defined in that section).</text></subparagraph></paragraph> <paragraph id="id416e20f5f6524f008204417f8cd67361"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection>
<subsection id="idea6ce76492e14f1e8a12a4438a091ab7"><enum>(b)</enum><header>Deferment of payments on direct farm loans</header><text>The Secretary shall—</text> <paragraph id="idb9e2675af60242b3bedd5433420abcfa"><enum>(1)</enum><text>defer payments of principal and interest due on direct farm loans by eligible borrowers during the 2-year period beginning on the date of enactment of this Act; and</text></paragraph>
<paragraph id="id1d303086b47443bca0dc6af741c984cd"><enum>(2)</enum><text>extend the date required for repayment of direct farm loans by eligible borrowers subject to deferment under paragraph (1) by not less than 2 years after the end of the period described in that paragraph.</text></paragraph></subsection> <subsection id="id5b6ebfa093b4415eb8d3c0dc8158d93c"><enum>(c)</enum><header>Zero percent interest</header><text>The Secretary shall modify each direct farm loan of an eligible borrower that is outstanding as of the date of enactment of this Act such that the interest rate on the farm loan is zero percent during the 2-year period beginning on that date of enactment.</text></subsection>
<subsection id="id11e7c286fca94f37bbcc8aa8b47728da"><enum>(d)</enum><header>Waiver of guaranteed farm loan fees for historically underserved farmers and ranchers</header><text>The Secretary shall require lenders of guaranteed farm loans to historically underserved farmers or ranchers to waive borrower fees on those loans during the period—</text> <paragraph id="id37bd9f20563a4b26b2092328a24948d9"><enum>(1)</enum><text>beginning on the date of enactment of this Act; and</text></paragraph>
<paragraph id="idaf4e37851c194bccbed0d295a5c389f7"><enum>(2)</enum><text>ending not earlier than 2 years after that date of enactment.</text></paragraph></subsection></section> <section id="id8007cdcc87bd4ec08e13fa765845b799"><enum>3.</enum><header>Farm loan reform</header> <subsection id="id1ec2ecb85ac44326b8ec94962e2edc5a"><enum>(a)</enum><header>In general</header><text>Subtitle D of the Consolidated Farm and Rural Development Act is amended by inserting after section 374 (<external-xref legal-doc="usc" parsable-cite="usc/7/2008i">7 U.S.C. 2008i</external-xref>) the following:</text>

<section id="id9974c547f7954ec687fc49dcdb0b1c08"><enum>375.</enum><header>Farm loan reform</header>
<subsection id="idabcc70ebd4f04acf81f4f1f87302bf01"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="ide4a80bfc39e6474f9f2960d6caa44053"><enum>(1)</enum><header>Adverse decision</header><text>The term <term>adverse decision</term> has the meaning given the term in section 271 of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6991">7 U.S.C. 6991</external-xref>).</text></paragraph>
<paragraph id="id4761ecb486424588a91144c159493bd2"><enum>(2)</enum><header>Farm loan</header><text>The term <term>farm loan</term> means a loan administered by the Farm Service Agency under subtitle A or B.</text></paragraph> <paragraph id="idc42465a697104a2e85bf76700bd980ed"><enum>(3)</enum><header>Principal residence</header><text>The term <term>principal residence</term> means the principal residence of a borrower of a farm loan, including adjoining land of not more than 10 acres.</text></paragraph></subsection>
<subsection id="idb9e0542e4a34402897d0b22afab1df9d"><enum>(b)</enum><header>Determination letters and adverse decisions</header>
<paragraph id="iddc04698d18794601b17195157f26295f"><enum>(1)</enum><header>In general</header><text>In the case of any adverse decision relating to a farm loan, a Farm Service Agency program benefit, or the noninsured crop disaster assistance program established by section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>), the Secretary shall include in a determination letter provided to the applicant, to the maximum extent practicable—</text> <subparagraph id="idcda79103f52c409d92e62588cf419fd6"><enum>(A)</enum><text>a description of each reason known, or that reasonably should have been known, to the Secretary for that adverse decision;</text></subparagraph>
<subparagraph id="id444dd3a3722e430f9f5f62d89dcb9978"><enum>(B)</enum><text>a reference to each regulation, and Farm Loan Program handbook instruction, with the maximum practicable specificity, that forms the basis for each reason described in subparagraph (A); and</text></subparagraph> <subparagraph id="idfc67e2e1c9c1471c9fbb9c4741667a77"><enum>(C)</enum><text>instructions for accessing the Electronic Code of Federal Regulations and Farm Loan Program handbook instructions online.</text></subparagraph></paragraph>
<paragraph id="idc5ff866b2f3743b898bbb5112a70fa7e"><enum>(2)</enum><header>Effect of failure to state reasons</header><text>If the Secretary issues any adverse decision relating to an application for a farm loan, a Farm Service Agency program benefit, or the noninsured crop disaster assistance program established by section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>) and does not include in a determination letter provided to the applicant a reason known to the Secretary for that adverse decision, the Secretary may not subsequently issue an adverse decision to that applicant on the basis of the same reason, unless the circumstances of the applicant have substantially changed since the issuance of the prior adverse decision.</text></paragraph></subsection> <subsection id="id94796a59244b4ed3975175b5934d084b"><enum>(c)</enum><header>Collateralization</header> <paragraph id="id513922974651484595c7515bfdc4c016"><enum>(1)</enum><header>Origination</header><text>The Secretary may only secure a direct farm loan with a principal residence if the total value of other assets available to secure the farm loan does not provide adequate security (as defined in section 761.2(b) of title 7, Code of Federal Regulations (or successor regulations)) for the loan.</text></paragraph>
<paragraph id="id550027efe95f43afb27471afae3288e6"><enum>(2)</enum><header>Partial release of principal residence security</header><text>In the case of a farm loan secured in part by a principal residence, the Secretary shall initiate a partial release of the principal residence as security in accordance with subpart H of part 765 of title 7, Code of Federal Regulations (or successor regulations), without any action required by the borrower, when the total value of other assets securing the farm loan is equal to 100 percent of the remaining loan amount.</text></paragraph> <paragraph id="id5f0cd874fd754db6a0daa2ca1a0e2309"><enum>(3)</enum><header>Loan servicing</header> <subparagraph id="id711f5bcff63847fbbbbc03ced4958e49"><enum>(A)</enum><header>In general</header><text>In the case of a farm loan borrower who is delinquent prior to restructuring the farm loan, the borrower shall execute and provide to the Secretary a lien on assets necessary to achieve not more than 100 percent collateralization of the loan value.</text></subparagraph>
<subparagraph id="id60a4ef6499b94f8d84a51698517f1e9c"><enum>(B)</enum><header>Best lien</header><text>Except as provided in section 764.106 of title 7, Code of Federal Regulations (or successor regulations), the Secretary shall take the best lien obtainable on assets described in subparagraph (A), subject to the condition that a primary residence shall be the last option available to the Secretary to achieve 100 percent collateralization of the loan value.</text></subparagraph></paragraph> <paragraph id="id634248afcb4040dd97698fa5a2ba49b2"><enum>(4)</enum><header>Prohibition on additional security</header><text>The Secretary may not secure a direct farm loan with any property that provides security in excess of the amount of security value equal to the loan amount.</text></paragraph></subsection>
<subsection id="id0f7dacbb873a4c76bee2b0524d9c993b"><enum>(d)</enum><header>Eligibility requirements</header><text>The Secretary shall not impose any limitation relating to the number of years in which a farm loan may be closed by a borrower.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="id4d35b0486b004057b75d949c2d6cad5b"><enum>(b)</enum><header>Refinancing of debt with farm loans</header> <paragraph id="id2766a5412d6042c589618433ae235814"><enum>(1)</enum><header>Purposes of farm ownership loans</header><text>Section 303(a)(1) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1923">7 U.S.C. 1923(a)(1)</external-xref>) is amended by striking subparagraph (E) and inserting the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="id4163670da12f47db8823b7bf516217ed">
<subparagraph id="idd0d6f0741a7b41dabc55d107b50dbc12"><enum>(E)</enum><text>refinancing indebtedness.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="id2a4518aa92af47149c9ab99859c84069"><enum>(2)</enum><header>Purposes of operating loans</header><text>Section 312(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1942">7 U.S.C. 1942(a)</external-xref>) is amended by striking paragraph (9) and inserting the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="id7af7384f2a5642dc91527b8884bb5ee4">
<paragraph id="id2d3fb9cda9214b3183c9dee9b50f973a"><enum>(9)</enum><text>refinancing the indebtedness of a borrower; or</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="id81f9004154df4398929e3307b0da8923"><enum>(c)</enum><header>Removal of eligibility restriction based on previous debt write-Down or other loss</header><text>Section 373 of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2008h">7 U.S.C. 2008h</external-xref>) is amended—</text>
<paragraph id="ide8b1c7de3da3431780c8067a1f6a813b"><enum>(1)</enum><text>in subsection (b)(2)(A)—</text> <subparagraph id="idb4e4101f76664215a52258d6f7e20733"><enum>(A)</enum><text>by striking clause (i);</text></subparagraph>
<subparagraph id="idef87593ce8c9429cac6d829601f812de"><enum>(B)</enum><text>in clause (ii), by striking <quote>chapters 11, 12, or 13 of Title 11 of the</quote> and inserting <quote>chapter 11, 12, or 13 of title 11,</quote>; and</text></subparagraph> <subparagraph id="idc4a06d0ee0814658ac440143d3c69737"><enum>(C)</enum><text>by redesignating clauses (ii) and (iii) as clauses (i) and (ii), respectively; and</text></subparagraph></paragraph>
<paragraph id="ided367dd2339f4c859d624d676db29471"><enum>(2)</enum><text>by striking subsection (c) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id45a12f55be7242b1bf7fc68963187b81"> <subsection id="idf875efeaff974205947450834f1ba35e"><enum>(c)</enum><header>Prohibition on eligibility restriction based on debt write-Down or other loss</header><text>The Secretary shall not restrict the eligibility of a borrower for a farm ownership or operating loan under subtitle A or B based on a previous debt write-down or other loss to the Secretary.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="id3c8acb18c69c41e9adac1b4b21d1aff2"><enum>(d)</enum><header>Equitable relief</header><text>Section 366 of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2008a">7 U.S.C. 2008a</external-xref>) is amended—</text> <paragraph id="ida9c75ed7149a4fe0a27ee6657639f7b9"><enum>(1)</enum><text>in subsection (a)—</text>
<subparagraph id="id0c30092c929041c3942ab184d9fe1e83"><enum>(A)</enum><text>in paragraph (1), by striking <quote>(1) received</quote> and inserting <quote>(1)(A) received</quote>;</text></subparagraph> <subparagraph id="id7a398fb817514f62bf6e6b5ba61c4ef9"><enum>(B)</enum><text>in paragraph (2)—</text>
<clause id="idc5fc1171a58a455fa15646355e7f2ad6"><enum>(i)</enum><text>by striking the period at the end and inserting <quote>; or</quote>; and</text></clause> <clause id="id1fe27140af8a44b8a71497fdd5909b8b"><enum>(ii)</enum><text>by striking <quote>(2) the Secretary</quote> and inserting <quote>(B) the Secretary</quote>; and</text></clause></subparagraph>
<subparagraph id="id569a9c2766a14e789aab97d4d6ae9e20"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id77bc382e7ffc4f5baa4f1099e5bcc04f"> <paragraph id="id2feec140f63e4513ad77722c33807d64"><enum>(2)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="id4f467dbe9c194e19aa48d6eb1d98280f"><enum>(A)</enum><text>received a benefit under any other program administered by an agency (as defined in section 271 of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6991">7 U.S.C. 6991</external-xref>)); and</text></subparagraph>
<subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="idfc80744acf1d4547bfa0bc426201679a"><enum>(B)</enum><text>the Secretary determines is not in compliance with the requirements of the provisions of law that authorize that program.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="id221ce9d98d4c45dc8fb0264752d82b15"><enum>(2)</enum><text>in subsection (b)(2), by inserting <quote>, including having made management or financial decisions for the farming or ranching operation of the farmer or rancher that were detrimental due to the erroneous nature of an official communication from the Department of Agriculture, regardless of whether a financial benefit was received or only promised</quote> before the period at the end;</text></paragraph>
<paragraph id="ida0fe32de4a1143cb8b5e305ca4052b6a"><enum>(3)</enum><text>in subsection (c)(1), by striking <quote>(a)(2)</quote> and inserting <quote>(a)(1)(B)</quote>;</text></paragraph> <paragraph id="idb7f186657b294ae68ba8e63344044729"><enum>(4)</enum><text>in subsection (e), by striking <quote>section</quote> in the matter preceding paragraph (1) and all that follows through <quote>shall not be</quote> in paragraph (2) and inserting <quote>section shall be</quote>; and</text></paragraph>
<paragraph id="id22b30ff824e94907ab7ab3b78001ce4c"><enum>(5)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id7309c59fa914471e9dcbee928b3af714"> <subsection id="id99cd83c5bffc4dce8fceb795a61198c9" commented="no"><enum>(f)</enum><header>Authority of National Appeals Division Administrative Judges</header> <paragraph commented="no" display-inline="no-display-inline" id="id1c9211842965437a97ad54d61d77427e"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An Administrative Judge of the National Appeals Division may provide equitable relief under this section.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ide5cc491958f64643bc6a3b5e1763e4e0"><enum>(2)</enum><header>Review</header><text>The Secretary may review a decision of an Administrative Judge to grant equitable relief pursuant to paragraph (1).</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="id8b41f7097511449bb71ebda37a53c9eb"><enum>(g)</enum><header>Cases in which an applicant is eligible</header> <paragraph id="id84bf18009537463793bf54acdfc4519e"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text>
<subparagraph id="id8612e13deb724a4995dc6e579d252c84"><enum>(A)</enum><header>Adverse decision</header><text>The term <term>adverse decision</term> has the meaning given the term in section 271 of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6991">7 U.S.C. 6991</external-xref>).</text></subparagraph> <subparagraph id="id085ea1ab328c47e69ab93a5557d203ee"><enum>(B)</enum><header>Applicant</header><text>The term <term>applicant</term> means a person who submitted to the Farm Service Agency an application for—</text>
<clause commented="no" display-inline="no-display-inline" id="id2c2573c41f8f47ec9d610d0770471da7"><enum>(i)</enum><text display-inline="yes-display-inline">a direct farm ownership, operating, or emergency loan under this title;</text></clause> <clause commented="no" display-inline="no-display-inline" id="ide8a4d3135f654f4abd3b5e5942e42c1f"><enum>(ii)</enum><text display-inline="yes-display-inline">a Farm Service Agency program benefit; or </text></clause>
<clause commented="no" display-inline="no-display-inline" id="id516d231fcd3e4be9a9c8b6c64c3dde5b"><enum>(iii)</enum><text display-inline="yes-display-inline">the noninsured crop disaster assistance program established by section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>).</text></clause></subparagraph></paragraph> <paragraph id="id34624b739d9a4d4a8afc1d0af46fa48e"><enum>(2)</enum><header>Denial based on feasibility</header> <subparagraph id="id5e702517e4ec445b9a500bd701126b65"><enum>(A)</enum><header>In general</header><text>A loan applicant shall be eligible for equitable relief under this section if—</text>
<clause id="idffc1eab2b2a34836bc2622ee40aff926"><enum>(i)</enum><text>the National Appeals Division determines that the Farm Service Agency was in error in denying the loan, benefit, or payment based on feasibility;</text></clause> <clause id="id43da3beebdf74816b97ec9772276beec"><enum>(ii)</enum><text>the National Appeals Division has confirmed the accuracy of the projected income and projected expenses described in the original application submitted by the applicant; and</text></clause>
<clause id="id20669fc4217c46ea8ecefd914b8c3e9c"><enum>(iii)</enum><text>the original application submitted by the applicant is no longer feasible due to the delay caused by the erroneous denial by the Farm Service Agency and the length of the appeals process.</text></clause></subparagraph> <subparagraph id="id37cb6001ba2c4e9c9bf425163785c7c9"><enum>(B)</enum><header>Amount</header><text>The amount of equitable relief under subparagraph (A) shall be the amount equal to the difference between—</text>
<clause id="id5cd2f495f5d04a7aa939ac62c0c3d702"><enum>(i)</enum><text>the projected income described in the application; and</text></clause> <clause id="id6da6e0e4831e4bb8b163d3dfa087c679"><enum>(ii)</enum><text>the projected expenses described in the application.</text></clause></subparagraph></paragraph>
<paragraph id="id2e3869fed73f4acaa2e56719cd8b8bf5"><enum>(3)</enum><header>Denial based on eligibility</header><text>A loan applicant shall be eligible for equitable relief under this section if—</text> <subparagraph id="id8780966f795d44648de7ac18f6a7265b"><enum>(A)</enum><text>feasibility was not listed as a reason for an adverse decision in the determination letter provided to the applicant;</text></subparagraph>
<subparagraph id="id874f1a29d6c14abaa1ca8545f73a98e9"><enum>(B)</enum><text>eligibility was listed as a reason for an adverse decision in the determination letter provided to the applicant;</text></subparagraph> <subparagraph id="id6183e90f4917416ca3e2183797c7376e"><enum>(C)</enum><text>the National Appeals Division determines that the Farm Service Agency was in error in denying the loan based on eligibility; and</text></subparagraph>
<subparagraph id="id6d50e1b9c526448a85bdcf1c19b6f38d"><enum>(D)</enum><text>the original application submitted by the applicant is no longer feasible due to the delay caused by the erroneous denial by the Farm Service Agency and the length of the appeals process.</text></subparagraph></paragraph> <paragraph id="id193af02508384426b77cc2db888ba2bd"><enum>(4)</enum><header>Subsequently withdrawn adverse decision</header><text>An applicant shall be eligible for equitable relief under this section if—</text>
<subparagraph id="id89cc1a89f1ee425cbe333f2f0137a637"><enum>(A)</enum><text>the Farm Service Agency issued an adverse decision on an application that the Farm Service Agency subsequently withdrew; and</text></subparagraph> <subparagraph id="id530cce6b60954a498e7147bb1a89ce9e"><enum>(B)</enum><text>the original application submitted by the applicant is no longer feasible due to the delay caused by the adverse decision.</text></subparagraph></paragraph>
<paragraph id="id6bec0534ca934325b8e39d50f3e9e7a7"><enum>(5)</enum><header>Promised program benefits not received</header><text>An applicant shall be eligible for equitable relief under this section if—</text> <subparagraph id="id4d49a913069040798634098d1e58d62d"><enum>(A)</enum><text>the Farm Service Agency indicated in an official communication made after the date of enactment of this subsection that the applicant could expect the loan, benefit, or payment, and then reversed its decision; and</text></subparagraph>
<subparagraph id="id7549e23edc254858969624eef47d39aa"><enum>(B)</enum><text>the applicant acted in good faith.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="idff9b35b2ac844547b24f0193d4397d12"><enum>4.</enum><header>National appeals division reform</header> <subsection id="id0b40b7f4e0394f1496adab3055cae98d"><enum>(a)</enum><header>Burden of proof</header><text>Section 277(c)(4) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6997">7 U.S.C. 6997(c)(4)</external-xref>) is amended—</text>
<paragraph id="id69f7fccb312f4026a58a69f3033fcfe2"><enum>(1)</enum><text>by striking <quote>The appellant</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id9C79349AA8E94007AC4CB9CEC3574A39"> <subparagraph id="id2339b9392cf8491987f568126902507d"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the appellant</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="iddfc4e51d3efd4f9da9be0dc6e1d3df5a"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idbce201f617dd4426bae3a58d4725caf3"> <subparagraph id="id963c8d4af4724b0288bd8774c61e7734"><enum>(B)</enum><header>Appellants below income threshold</header> <clause id="idd2b7ec6186eb4d4780ce34e59467c58a"><enum>(i)</enum><header>In general</header><text>In the case of an appellant described in clause (ii), the agency shall bear the burden of proving by substantial evidence that the adverse decision of the agency was not erroneous.</text></clause>
<clause id="id4fef39fc9f344ab4aaee0384a63662dd"><enum>(ii)</enum><header>Appellants described</header><text>An appellant referred to in clause (i) is an appellant—</text> <subclause id="id8183b542334f42d7a41b78b0cae7f4f3"><enum>(I)</enum><text>the adjusted gross income of which for the previous year is not more than $300,000; or</text></subclause>
<subclause id="id3d81f27134954e00b10905d7c234439e"><enum>(II)</enum><text>the average annual adjusted gross income of which for the previous 5-year period is not more than $300,000.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="id6b20d33d36434f10943cf0dd3d73954a"><enum>(b)</enum><header>Implementation</header><text>Section 280 of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/7000">7 U.S.C. 7000</external-xref>) is amended—</text>
<paragraph id="id007d87ec321146b2afda909356498206"><enum>(1)</enum><text>by redesignating subsection (b) as subsection (c); and</text></paragraph> <paragraph id="id0cce0b0fa76b40988928bede20d42ed1"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text>

<subsection id="id436017250bd14e2dad1f4453ceff591e"><enum>(b)</enum><header>Requirement</header><text>In implementing a final determination in accordance with subsection (a), the head of an agency shall use the information used by the Division to make the final determination, without requiring additional information, except as otherwise provided in the decision letter relating to the final determination.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> </legis-body> </bill>
