which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide increased financial assistance for farmers’ markets and farmers’ market nutrition programs, to increase local agricultural production through food bank in-house production and local farmer contracting, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H3ADE68F7652F4874A3800C95A12F6F07"><section section-type="section-one" id="H16608C41B297430D878B04E8A78961C8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as <quote><short-title>Farmers’ Market and Food Bank Local Revitalization Act of 2023</short-title></quote>.</text></section><section id="H1C1A8A21F47C42FC976E1359F7298E5F"><enum>2.</enum><header>Findings and purposes</header><subsection id="HAD2AEFABFE7F40048D700BCE5FA66BC9"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="H74EAB8D8BA8D4DAE821BDA3F272551F0"><enum>(1)</enum><text>food insecurity, epidemic levels of obesity, hypertension, diabetes, and youth osteoporosis are caused by improper nutrition yielded by a lack of nutritious, reliable, and locally available healthy food options;</text></paragraph><paragraph id="H1FEA90104C9D45FDA757787E4164FBE0"><enum>(2)</enum><text>the American Diabetes Association estimated a 41-percent increase in costs of diagnosed diabetes, from a cost of $174,000,000,000 in 2007 to a cost of $245,000,000,000 in 2012, with 62 percent of those costs coming from senior health programs such as Medicare and Medicaid;</text></paragraph><paragraph id="H1E88BBFFF13C49DF9FC58C6F73CD980A"><enum>(3)</enum><text>since sequestration in 2008, there has been no funding increase for the senior farmers’ market nutrition program under section 4402 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/3007">7 U.S.C. 3007</external-xref>);</text></paragraph><paragraph id="HBCF9943FED184246A11053C353FBF99B"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id0c8525a2bd4f407fac347f0ee55b56ab"><enum>(A)</enum><text>from 2008 to 2020, the moderate at-home food cost for a family of 2 individuals aged 51 to 70 years old increased by an average of $70 per month; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfbc957b622014674b527b4c98f736ca2" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">funding for the seniors farmers’ market nutrition program has not kept pace with that inflation;</text></subparagraph></paragraph><paragraph id="id4f2543ff75954d1892134036be50e974"><enum>(5)</enum><text>according to the Department of Agriculture, the seniors farmers’ market nutrition program is experiencing, across all participating States, territories, and Indian Tribes—</text><subparagraph commented="no" display-inline="no-display-inline" id="id62412f45916b47a285a604d0b3d78eb5"><enum>(A)</enum><text display-inline="yes-display-inline">a total program funding backlog of $20,065,021; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7e267be785684b94a41daa3d2aff1260"><enum>(B)</enum><text display-inline="yes-display-inline">a seasonal benefit funding backlog of $16,120,741;</text></subparagraph></paragraph><paragraph id="H88B29644D3BC4A13938FA571859995C7"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id4fb422f0708c4defb37983abd8d35b51"><enum>(A)</enum><text>approximately 1 in 10 United States senior citizens, or approximately 5,146,000 individuals, are forced to live well below the Federal poverty level; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc77e118c2f7d4dbaa8fade129e510a39" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the seniors farmers’ market nutrition program is only able to reach about 725,000 of those individuals due to inadequate funding;</text></subparagraph></paragraph><paragraph id="idcd4a4d674c18437797223c5cb82b0270"><enum>(7)</enum><text>since sequestration in 2008, funding for the women, infants, and children farmers’ market nutrition program under section 17(m) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(m)</external-xref>) has decreased by more than $6,000,000, with no subsequent increase to previous levels;</text></paragraph><paragraph id="H90E54F5EEF874F08BF79343A2580E955"><enum>(8)</enum><text display-inline="yes-display-inline"> the women, infants, and children farmers’ market nutrition program is a vital safeguard for the nearly 1 in 7 children who will be—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide38a1c581e6d4a3aa4efa2f5dce62e98"><enum>(A)</enum><text display-inline="yes-display-inline">born into poverty in the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1fb7c4848bbf47968f8fcd4affc4e400"><enum>(B)</enum><text display-inline="yes-display-inline">at nutritional risk;</text></subparagraph></paragraph><paragraph id="HAC4029F5ED9343079F81F1A368C658A7"><enum>(9)</enum><text display-inline="yes-display-inline">according to the Department of Agriculture, the women, infants, and children farmers’ market nutrition program has a total program and seasonal benefit funding backlog of $6,198,432 across all participating States, territories, and Indian Tribes;</text></paragraph><paragraph id="H3733C3DB532B4B8CB0FEA35EBE11ECB2"><enum>(10)</enum><text>in the United States, food banks provide meals to 1 in 7 individuals;</text></paragraph><paragraph id="HEFFA93A944E746928D2F1391018CBEE7"><enum>(11)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id6ecae874fffc4c63b36b7765ee3384bc"><enum>(A)</enum><text>many food banks share special relationships with local farmers, who often donate crops to food banks; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id951eed4334354b54ae084507a360727a" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the relationships described in subparagraph (A) allow for more efficient and sustainable procurement for food banks;</text></subparagraph></paragraph><paragraph id="id2e7143548f8947059952ab7a57c6138e"><enum>(12)</enum><text>assisting food banks to grow their own food will aid local procurement and allow food banks to serve as farming resources to their communities, especially to individuals who are food-insecure; and</text></paragraph><paragraph id="H4021E140A3FA42049E16B0C34795A874"><enum>(13)</enum><text>the Agriculture Improvement Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/334">Public Law 115–334</external-xref>; 132 Stat. 4490) (and amendments made by that Act) specifically required an examination of methods to incorporate local products to reduce food waste.</text></paragraph></subsection><subsection id="HA4D996DE3C6A4AFF84F023A0318EEBBD"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text><paragraph id="H41D5668FF9A04048AE6D4EE19C1AC2AB"><enum>(1)</enum><text display-inline="yes-display-inline">to increase and enhance funding for farmers’ market nutrition programs—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7b2fff265b674c83a2e48da77dc221c2"><enum>(A)</enum><text display-inline="yes-display-inline">to support seniors and food-insecure families; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id58001421f8644ac096f8c175d2821fe2"><enum>(B)</enum><text display-inline="yes-display-inline">to increase market capacity for local farmers;</text></subparagraph></paragraph><paragraph id="H1A1C99C7C5454DB581010514452815F5"><enum>(2)</enum><text>to provide funding assistance for the expansion and construction of farmers’ markets in rural and urban food desert areas; and</text></paragraph><paragraph id="H1AD4D60AB26C492188269C8F91ED92A6"><enum>(3)</enum><text>to increase local food production through—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0d424464e4ab4b5fa63a1b00c3b4157c"><enum>(A)</enum><text display-inline="yes-display-inline">encouraging partnerships of food banks and local farmers; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd8e911edef9144dda39b8c0a22e9e442"><enum>(B)</enum><text display-inline="yes-display-inline">the provision of funding to food banks to grow necessary produce through traditional or controlled environmental agriculture farming methods.</text></subparagraph></paragraph></subsection></section><section id="HA9081FA9896B459BA1D38F360D417071"><enum>3.</enum><header>Authorization for seniors farmers’ market nutrition program</header><text display-inline="no-display-inline">Section 4402(a) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/3007">7 U.S.C. 3007(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id00a052fd701546529e80325e9d5cff24"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>2023</quote> and inserting <quote>2028</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id49c4c9067cd44fbcba647de033047ae0"><enum>(2)</enum><text>by striking <quote>Of the funds of the Commodity Credit Corporation, the Secretary of Agriculture</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id45D0EA548B9D4AB19E2F3325C3AB483C"><paragraph commented="no" display-inline="no-display-inline" id="idba43a7d65b1846f9a4d3f88b7d513234"><enum>(1)</enum><header>Commodity Credit Corporation</header><text>Of the funds of the Commodity Credit Corporation, the Secretary of Agriculture (referred to in this section as the <term>Secretary</term>)</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1d23ac7968494369be778fb740937b08"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1BA2E57337B04531A25D992678590A08"><paragraph commented="no" display-inline="no-display-inline" id="H0DF6FB01B96F4F11A3A3F5D9B3B4AB9D"><enum>(2)</enum><header>Authorization of appropriations</header><subparagraph commented="no" id="H8A45E1C1273B4A25BF292852BE06E23D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to the amounts made available under paragraph (1), there are authorized to be appropriated to the Secretary, for the purposes described in subparagraph (B)—</text><clause commented="no" id="HE431337B25884DE09DA194994E4FAB78"><enum>(i)</enum><text>for fiscal year 2024, such sums as are necessary to ensure that not less than $60,000,000 is available under this paragraph and paragraph (1);</text></clause><clause commented="no" id="HBB7DC28E38DF445A88B05BD58F160CA6"><enum>(ii)</enum><text>for fiscal year 2025, such sums as are necessary to ensure that not less than $70,000,000 is available under this paragraph and paragraph (1); and</text></clause><clause commented="no" id="H125486560C12415794FA2CECF1E3DDF2"><enum>(iii)</enum><text>for each of fiscal years 2026 through 2028, such sums as are necessary to ensure that not less than $100,000,000 is available under this paragraph and paragraph (1).</text></clause></subparagraph><subparagraph commented="no" id="H07A5E465184C4121BB989B97548C9152"><enum>(B)</enum><header>Benefit enhancement</header><text display-inline="yes-display-inline">The additional amounts made available under subparagraph (A) shall be used—</text><clause commented="no" id="HC2AB6CEE97BC4106B8D992D846AA8710"><enum>(i)</enum><text> to increase the income limit for seniors farmers’ market nutrition program eligibility to 200 percent of the Federal poverty guideline;</text></clause><clause commented="no" id="H7556E5F8E4284E8DA59E702155B2E11F"><enum>(ii)</enum><text>to increase the minimum individual benefit available under the seniors farmers’ market nutrition program to $35; and</text></clause><clause commented="no" id="H7F1D3BAC491048729D7C7C21B61DB364"><enum>(iii)</enum><text display-inline="yes-display-inline">to remove the maximum individual benefit limit under the seniors farmers’ market nutrition program.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section section-type="subsequent-section" id="H79FA7AB37571462F85932C94AEA6EA4B"><enum>4.</enum><header>Minimum individual benefit increase under WIC farmers’ market nutrition program</header><text display-inline="no-display-inline">Section 17(m) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(m)</external-xref>) is amended—</text><paragraph id="id0b68eabdc7ae4a30a8343188cc109bef"><enum>(1)</enum><text>in paragraph (4), by striking <quote>paragraph (6)</quote> each place it appears and inserting <quote>paragraph (7)</quote>;</text></paragraph><paragraph id="H58D8A5942DA34990AC9F13C98B701617"><enum>(2)</enum><text>in paragraph (5)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id384705bb837740a1b96596abf9d9203d"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>paragraph (3)</quote> each place it appears and inserting <quote>paragraph (4)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8779e98a42474cc5b42d089ed24da083"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (C)—</text><clause id="H8C467EB7B2674E1397C43148EB6FC7AD"><enum>(i)</enum><text>in clause (i), by striking <quote>$10</quote> and inserting <quote>$35</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1760df2e921c4d89bc56936c6c78ac61"><enum>(7)</enum><text>by striking <quote>(m)(1) Subject to</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1A0673E85F9241C4AADDEB84F81D39A1"><subsection id="idec2c1f75628644bb9b70f1cfeeee860b" commented="no" display-inline="no-display-inline"><enum>(m)</enum><header>Women, infants, and children farmers' market nutrition program</header><paragraph commented="no" display-inline="no-display-inline" id="id3932b14764cc4520ab4edb557589b887"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this subsection:</text><subparagraph id="ID10BB041FE6074F64B741C306173C9D7F"><enum>(A)</enum><header>Coupon</header><text>The term <term>coupon</term> means a coupon, voucher, or other negotiable financial instrument by which benefits provided under this section are transferred.</text></subparagraph><subparagraph id="ID93017AB703874D45A75304E12D9B3A1E"><enum>(B)</enum><header>Program</header><text>The term <term>program</term> means—</text><clause id="ID4E992457621E4E1F96833FA065AE14FF"><enum>(i)</enum><text>the State farmers' market coupon nutrition program authorized by this subsection (as in effect on September 30, 1991); and</text></clause><clause id="IDE6FFDD675ED84962815C312855F1B939"><enum>(ii)</enum><text>the farmers' market nutrition program authorized by this subsection.</text></clause></subparagraph><subparagraph id="ID3633A60D6EDF4D1990B69665E9912835"><enum>(C)</enum><header>Recipient</header><text>The term <term>recipient</term> means a person or household, as determined by the State, that is—</text><clause commented="no" display-inline="no-display-inline" id="idd549879d772e41a29ecdbbe25b904ed4"><enum>(i)</enum><text display-inline="yes-display-inline">chosen by a State to receive benefits under this subsection; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id3d535bfa7d3c426b8b36c1caca6cf0f5"><enum>(ii)</enum><text display-inline="yes-display-inline">included on a waiting list to receive those benefits.</text></clause></subparagraph><subparagraph id="ID4AC9FC0EEDF14FCEB766814C2CE18873"><enum>(D)</enum><header>State agency</header><text>The term <term>State agency</term> includes—</text><clause commented="no" display-inline="no-display-inline" id="id52f03e1041c94b88b2303951d79afc59"><enum>(i)</enum><text display-inline="yes-display-inline">a State department of agriculture; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id9dc939b5081544a19cc220705daebcc6"><enum>(ii)</enum><text display-inline="yes-display-inline">any other agency approved by the chief executive officer of the State.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5ed41b9a4abb4bd59c71b939266880a2"><enum>(2)</enum><header>Grant program</header><text>Subject to</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section section-type="subsequent-section" id="HC1E201E2058548D9B7C300ACCAD0CEC6"><enum>5.</enum><header>Infrastructure funding for farmers’ markets</header><subsection id="HDDB433786B9B40668E2223ED3AB62CA2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Agriculture (referred to in this Act as the <term>Secretary</term>) shall make loans, loan guarantees, and grants to public agencies and nonprofit organizations for—</text><paragraph id="H064DEF13DF6D4C97864FF58D0DF2D3CA"><enum>(1)</enum><text>the construction of new farmers’ markets; or</text></paragraph><paragraph id="HC01F690A7417400E93E724F8DEF825C1"><enum>(2)</enum><text>the improvement or rehabilitation of existing farmers’ markets, including by adding or improving payment technologies used at those farmers’ markets.</text></paragraph></subsection><subsection id="H4A29FF35B3764F189B9B58ACFE02DA48"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">To be eligible to receive a loan, loan guarantee, or grant under this section with respect to a farmers’ market, a public agency or nonprofit organization shall demonstrate, to the satisfaction of the Secretary—</text><paragraph id="H7B6E92952ADF493E8BCDD2C45DDAEB4D"><enum>(1)</enum><text>financial need; and</text></paragraph><paragraph id="H0BE4F09A10884F2696FD7DC5C277FD63"><enum>(2)</enum><text>a commitment to reserving not less than 50 percent of the floor area of the farmers’ market for the sale of agricultural products that, as determined by the Secretary, are produced locally by—</text><subparagraph commented="no" display-inline="no-display-inline" id="id61a7119f85c64810b90489501729d732"><enum>(A)</enum><text display-inline="yes-display-inline">farmers, ranchers, or aquaculture, mariculture, or fisheries operators; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbc8074b09f1c46b685888bba546e43ba"><enum>(B)</enum><text display-inline="yes-display-inline">an association of farmers, ranchers, or aquaculture, mariculture, or fisheries operators.</text></subparagraph></paragraph></subsection><subsection id="H626F6F3DC1F44086AD79A068A90A9D69"><enum>(c)</enum><header>Cost sharing</header><paragraph id="HADEE5AAFA54C4847BEBD37E9CC87CFC8"><enum>(1)</enum><header>Grants</header><text display-inline="yes-display-inline">The amount of a grant provided under this section shall be not more than 25 percent of the cost of the activity for which the grant is provided.</text></paragraph><paragraph id="H3D91F9A74622446EA690399F2D903C8B"><enum>(2)</enum><header>Maximum amount</header><text display-inline="yes-display-inline">The combined amount of a grant or loan provided, and any loan guaranteed, for a public agency or nonprofit organization under this section shall not exceed 80 percent of the cost of the activity for which the grant or loan is provided, or the loan is guaranteed, as applicable.</text></paragraph></subsection><subsection id="H20914414B801466DADB650548C000918"><enum>(d)</enum><header>Interest rate</header><paragraph id="H0DA5EA364AD642A5B9061BA298C130ED"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A loan provided by the Secretary under this section shall bear interest at the rate equivalent to the rate of interest charged on United States Treasury securities of comparable maturity on the date on which the loan is approved. </text></paragraph><paragraph id="H1158B06ED360418491B9DD5639B17733"><enum>(2)</enum><header>Duration</header><text display-inline="yes-display-inline">The interest rate referred to in paragraph (1) with respect to a loan under this section shall remain in effect for the term of the loan.</text></paragraph></subsection><subsection id="H29927FEAAA1A489A8E6A1CE5FC84F376"><enum>(e)</enum><header>Funding</header><text display-inline="yes-display-inline">Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this section $50,000,000 for each of fiscal years 2024 through 2029.</text></subsection></section><section display-inline="no-display-inline" section-type="subsequent-section" id="H7F7B292EC73D40418D90934F9C45225A"><enum>6.</enum><header>Pilot program for food banks and local farmer contracting for local procurement</header><subsection id="HBB3DA23196E74340B146D84663ABA17C"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a pilot program under which the Secretary shall provide grants to food banks to voluntarily contract with farmers local to the food banks to grow produce for food bank programs to promote local procurement of produce.</text></subsection><subsection id="HE59AFE629E2A48F79050EB2B875FEE1D"><enum>(b)</enum><header>Methods</header><text display-inline="yes-display-inline">Under a contract described in subsection (a), a local farmer may grow produce through traditional or controlled environmental agriculture farming methods.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ida6d6d740bec8436e9f72647df28d4796"><enum>(c)</enum><header>Amount</header><text>The amount of a grant provided to a food bank under this section shall be $500,000.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id021abab5ef484cbca9171f244ef63023"><enum>(d)</enum><header display-inline="yes-display-inline">Distribution</header><paragraph commented="no" display-inline="no-display-inline" id="ide7ba22ee049244fa816bbae3ab6eb069"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the Secretary shall distribute grants under this section to 15 food banks, in accordance with the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="id37e452ec1e7c4b2f8b8121343c351d83"><enum>(A)</enum><header>ZIP Code</header><text>Of the 15 food banks that receive grants under this section—</text><clause commented="no" display-inline="no-display-inline" id="id277220dcd17b4faa8d184be0b9358e0c"><enum>(i)</enum><text display-inline="yes-display-inline">5 shall be located in urban ZIP Codes (as designated by the Bureau of the Census);</text></clause><clause commented="no" display-inline="no-display-inline" id="id727d3cadaaf34220b8aac66a7d9132b4"><enum>(ii)</enum><text display-inline="yes-display-inline">5 shall be located in suburban ZIP Codes (as designated by the Bureau of the Census); and</text></clause><clause id="idba274252099e4c72b80323f856bfd909" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>5 shall be located in rural ZIP Codes (as designated by the Bureau of the Census). </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide81791ecf3e648428efbc5fb00ef54f4"><enum>(B)</enum><header>Census Bureau region</header><text>Of the 15 food banks that receive grants under this section—</text><clause commented="no" display-inline="no-display-inline" id="id52fbab1bc5d84b9c91569e483968bb1e"><enum>(i)</enum><text>3 shall be located in the Northeast Region (as established by the Bureau of the Census);</text></clause><clause commented="no" display-inline="no-display-inline" id="id85ADBE1F4F5C4733A3731A105D20540A"><enum>(ii)</enum><text>3 shall be located in the Midwest Region (as established by the Bureau of the Census);</text></clause><clause commented="no" display-inline="no-display-inline" id="id8507F0CAA67F43EAB43334E73AD04EFC"><enum>(iii)</enum><text>3 shall be located in the South Region (as established by the Bureau of the Census);</text></clause><clause commented="no" display-inline="no-display-inline" id="idEADEE742009D410F86316F5DF301F2CC"><enum>(iv)</enum><text>3 shall be located in the West Region (as established by the Bureau of the Census); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id366e7041a5064989b7138baf47656228"><enum>(v)</enum><text>3 may be located in any region established by the Bureau of the Census, as the Secretary determines to be appropriate.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb0835c5025a04757a361778b682536a4"><enum>(2)</enum><header display-inline="yes-display-inline">Priority</header><text display-inline="yes-display-inline">A food bank that serves an economically depressed or food desert area, as determined by the Secretary, shall be given priority in the distribution of grants under this section. </text></paragraph></subsection><subsection id="HF0A424650CBE4419B0F80A011D96022C"><enum>(e)</enum><header>Funding</header><text display-inline="yes-display-inline">Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this section $7,500,000 for the period of fiscal years of 2024 and 2025.</text></subsection></section><section id="H1CE6579373E047AD9D5E4B6B54A1EC64"><enum>7.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than 180 days after the effective date of this Act, the Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate, the Special Committee on Aging of the Senate, and the Committees on Agriculture and Education and the Workforce of the House of Representatives a report that describes—</text><paragraph commented="no" display-inline="no-display-inline" id="id8e1306659b1246238dce380d7c3269a0"><enum>(1)</enum><text display-inline="yes-display-inline">the effect of this Act and the amendments made by this Act on—</text><subparagraph commented="no" display-inline="no-display-inline" id="id18c67ef395bd46ca91f9028d9dd5e3b7"><enum>(A)</enum><text display-inline="yes-display-inline">local procurement of food; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4bacd8907b004c8bad1c50c42b0494e3"><enum>(B)</enum><text display-inline="yes-display-inline">local farmers;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id47c2fc7a9ce4457482608c8bebbf0814"><enum>(2)</enum><text display-inline="yes-display-inline">the individuals and entities procuring food locally pursuant to this Act and the amendments made by this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id672cde37ce774c5ab0ba4ce1995e850c"><enum>(3)</enum><text display-inline="yes-display-inline">the communities involved in programs carried out under this Act and the amendments made by this Act.</text></paragraph></section><section id="H4FE97E2678104D64BA9843DCF25D3521"><enum>8.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, take effect on the date that is 120 days after the date of enactment of this Act.</text></section></legis-body></bill>
