which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish standards for trauma kits purchased using funds provided under the Edward Byrne Memorial Justice Assistance Grant Program.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Law Enforcement Sustaining Aid and Vital Emergency Resources Act</short-title></quote> or the <quote><short-title>American Law Enforcement SAVER Act</short-title></quote>.</text></section><section id="id38D8635D75234891B12A50E39046ABF1"><enum>2.</enum><header>Trauma kit standards</header><text display-inline="no-display-inline">Section 521 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10202">34 U.S.C. 10202</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id05DF6EBA80A743AC8D6729B0A43F697C"><subsection id="idd07e05ca2c5b409ebe36deb714eef3f9"><enum>(d)</enum><header>Trauma kits</header><paragraph id="iddada5adfe491433181bed888bdc3d05b"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>trauma kit</term> means a first aid response kit that—</text><subparagraph id="id3f8320f3576d4659889ca7a3673ab30d"><enum>(A)</enum><text>includes, at a minimum, a bleeding control kit that can be used for controlling life-threatening hemorrhage, which shall include—</text><clause id="idc1d114875fff4e20b858c28956d98e16"><enum>(i)</enum><text>a tourniquet recommended by the Committee on Tactical Combat Casualty Care;</text></clause><clause id="id1e0cfcbae37f41438bf2014da069f81f"><enum>(ii)</enum><text>a bleeding control bandage;</text></clause><clause id="id34c7c4493e434eac91b653a60d1f06f4"><enum>(iii)</enum><text>a pair of nonlatex protective gloves and a pen-type marker;</text></clause><clause id="id437f1fef8fe146a19f9e29fe5abd972e"><enum>(iv)</enum><text>a pair of blunt-ended scissors;</text></clause><clause id="id1632ba1fa8a844549dc54d81461e7095"><enum>(v)</enum><text>instructional documents developed—</text><subclause commented="no" display-inline="no-display-inline" id="idfe8c43160838473cb0615612da574dae"><enum>(I)</enum><text display-inline="yes-display-inline">under the STOP THE BLEED national awareness campaign of the Department of Homeland Security, or any successor thereto;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb42d84d37e12407389595f71fcb1a05e"><enum>(II)</enum><text display-inline="yes-display-inline">by the American College of Surgeons Committee on Trauma;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida0d79d299dc04fc5870b3653998a6d79"><enum>(III)</enum><text display-inline="yes-display-inline">by the American Red Cross; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idaad534294b6c462dab34327bcc414c3d"><enum>(IV)</enum><text display-inline="yes-display-inline">by any partner of the Department of Defense; and</text></subclause></clause><clause id="id9368f35c82c74c2bb405d8f487de44a3"><enum>(vi)</enum><text>a bag or other container adequately designed to hold the contents of the kit; and </text></clause></subparagraph><subparagraph id="id5a200dcf9b3849dda0e44e348d08a87e"><enum>(B)</enum><text>may include any additional trauma kit supplies that—</text><clause id="id52b5c0c6d68344979ff582e40d7c65fe"><enum>(i)</enum><text>are approved by a State, local, or Tribal law enforcement agency or first responders;</text></clause><clause id="id81e9b1f24c1e4a618f2522ebbb8848e1"><enum>(ii)</enum><text>can adequately treat a traumatic injury; and</text></clause><clause id="idb417e983beac483089b16555381dfc01"><enum>(iii)</enum><text>can be stored in a readily available kit.</text></clause></subparagraph></paragraph><paragraph id="ida0b8295ef5c84083a0f80a1147066219"><enum>(2)</enum><header>Requirement for trauma kits</header><subparagraph id="iddd2f67dcda7e4c648a0944080e267862"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, a grantee may only purchase a trauma kit using funds made available under this part if the trauma kit meets the performance standards established by the Director of the Bureau of Justice Assistance under paragraph (3)(A).</text></subparagraph><subparagraph id="id02c3032af4d04399a3dea320926180b2"><enum>(B)</enum><header>Authority to separately acquire</header><text>Nothing in subparagraph (A) shall prohibit a grantee from separately acquiring the components of a trauma kit and assembling complete trauma kits that meet the performance standards.</text></subparagraph></paragraph><paragraph id="id605ab8ef3f6a465bbed960ef78f7a0f7"><enum>(3)</enum><header>Performance standards and optional agency best practices</header><text>Not later than 180 days after the date of enactment of this subsection, the Director of the Bureau of Justice Assistance, in consultation with organizations representing trauma surgeons, emergency medical response professionals, emergency physicians, and other medical professionals, relevant law enforcement agencies of States and units of local government, professional law enforcement organizations, local law enforcement labor or representative organizations, and law enforcement trade associations, shall—</text><subparagraph id="id9c4af77ad43e47f09b195e9c05a29327"><enum>(A)</enum><text>develop and publish performance standards for trauma kits that are eligible for purchase using funds made available under this part; and</text></subparagraph><subparagraph id="id87236782f8d34cb29826ed3613c2b2ff"><enum>(B)</enum><text>develop and publish optional best practices for law enforcement agencies regarding—</text><clause id="id39229c82b15f432b86bb758f4bdc889b"><enum>(i)</enum><text>training law enforcement officers in the use of trauma kits;</text></clause><clause id="id2a8ff74d58294014987e823acb5b4468"><enum>(ii)</enum><text>the deployment and maintenance of trauma kits in law enforcement vehicles; and</text></clause><clause id="id17ca2309bcf444c885202bd94a2cb330"><enum>(iii)</enum><text>the deployment, location, and maintenance of trauma kits in law enforcement agency or other government facilities.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
