Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food Security Act of 1985 to require the Secretary of Agriculture to establish the forest conservation easement program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Forest Conservation Easement Program Act of 2023</short-title></quote>.</text></section><section id="id72EE766AB86640E39ABAC62C09895838"><enum>2.</enum><header>Forest Conservation Easement Program</header><subsection id="id660AFAC832594645A0F986ADCDD7277C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3801">16 U.S.C. 3801 et seq.</external-xref>) is amended—</text><paragraph id="id1040D7A1D869462EA1B36F73D4B13EA1"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subtitle I (<external-xref legal-doc="usc" parsable-cite="usc/16/3871">16 U.S.C. 3871 et seq.</external-xref>) as subtitle J; and</text></paragraph><paragraph id="id219C5328BD954077A5AA953545A52CFD"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subtitle H (<external-xref legal-doc="usc" parsable-cite="usc/16/3865">16 U.S.C. 3865 et seq.</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFD5F589F235A4C26890C96D7995259A1"><subtitle id="idB8EAE20ED905438FAD21D843252345BA" style="OLC"><enum>I<?LEXA-Enum I?></enum><header>Forest Conservation Easement Program</header><section id="iddb97f68a0ea74d8eb179d02d1b84f3df"><enum>1267.</enum><header>Establishment and purposes</header><subsection id="id0b21f93adf684aa7991e54b957b61ef0"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a forest conservation easement program for the conservation and restoration of eligible land and natural resources through the acquisition of conservation easements or other interests in land.</text></subsection><subsection id="id7f8e98fc519e4043acf5ae8b3cc72891"><enum>(b)</enum><header>Purposes</header><text>The purposes of the program are—</text><paragraph id="id4b69d97cb1454703ba6a122f934619fc"><enum>(1)</enum><text>to protect the viability and sustainability of forest land and related ecological and human conservation values of eligible land by limiting the negative impacts of non-forest land uses;</text></paragraph><paragraph id="id09640aa56cd24bd4aca53f0338a90b41"><enum>(2)</enum><text>to protect and enhance forest ecosystem and landscape functions and values;</text></paragraph><paragraph id="idd164daf9dbd64736a4009f6d158f47fc"><enum>(3)</enum><text>to promote the restoration, protection, and improvement of habitat of threatened and endangered species and other at-risk species;</text></paragraph><paragraph id="id64d39004cb99436a821033a5954ca265"><enum>(4)</enum><text>to maintain and enhance biodiversity;</text></paragraph><paragraph id="id156dcd14da1548d080f891a810b5bac6"><enum>(5)</enum><text>to enhance carbon sequestration;</text></paragraph><paragraph id="id689f2f51e8d94c39bd02aed7c362ae9f"><enum>(6)</enum><text>to protect and restore watersheds for water quality and quantity improvements;</text></paragraph><paragraph id="id06b54da5f9664b5583ad468f2f982682"><enum>(7)</enum><text>to prevent encroachment around military bases and installations; and</text></paragraph><paragraph id="id386fe443721046fabda1f468ee7dca33"><enum>(8)</enum><text>to carry out the purposes and functions of the healthy forests reserve program established under title V of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6571">16 U.S.C. 6571 et seq.</external-xref>), as in effect on the day before the date of enactment of this section.</text></paragraph></subsection></section><section id="id18b86a4fd2d944868ac9c0916b23f12d"><enum>1267A.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph commented="no" id="id75d850b49a944741b6127ddb5af5140d"><enum>(1)</enum><header>Beginning forest landowner</header><text>The term <term>beginning forest landowner</term> means a person that—</text><subparagraph commented="no" id="id96EA1195422B4FFF8F3690AA1F108478"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id9F55506E084D4173BF52CB098ADFB23C"><enum>(i)</enum><text>has not previously owned forest land; or</text></clause><clause commented="no" id="idAA24C09E1824433EB8655DAE75D6C4EA" indent="up1"><enum>(ii)</enum><text>has owned forest land for not more than 10 years; and</text></clause></subparagraph><subparagraph commented="no" id="id9a6425256ad94ab1bc1e7900065e0144"><enum>(B)</enum><text>meets such other criteria as the Secretary may establish. </text></subparagraph></paragraph><paragraph id="id2af76eac9c0e4116b05dfd32d86984ad"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="id0458de045caa42bd97eca73ccd58ec21"><enum>(A)</enum><text>an agency of State or local government or an Indian Tribe (including a land resource council established under State law); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H35E1624D23C64B25918C5D0711A10A5C"><enum>(B)</enum><text display-inline="yes-display-inline">an organization that is—</text><clause commented="no" display-inline="no-display-inline" id="HE429375801D64BEB903CAA8A55FDF366"><enum>(i)</enum><text>organized for, and at all times since the formation of the organization has been operated principally for, 1 or more of the conservation purposes specified in clause (i), (ii), (iii), or (iv) of <external-xref legal-doc="usc" parsable-cite="usc/26/170">section 170(h)(4)(A)</external-xref> of the Internal Revenue Code of 1986;</text></clause><clause commented="no" display-inline="no-display-inline" id="H6C4FD4F0A1014C489C43094DF71B27E7"><enum>(ii)</enum><text>an organization described in section 501(c)(3) of that Code that is exempt from taxation under section 501(a) of that Code; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H41FA9461F0154C93A9107C793D8768F6"><enum>(iii)</enum><text>described in—</text><subclause id="HD59356A437D5497E8B615DF234AEB128"><enum>(I)</enum><text>paragraph (1) or (2) of section 509(a) of that Code; or</text></subclause><subclause id="HA537C5BB75714D4E93A64D46BEEEB9A8"><enum>(II)</enum><text>section 509(a)(3) of that Code and is controlled by an organization described in section 509(a)(2) of that Code.</text></subclause></clause></subparagraph></paragraph><paragraph id="idde0704960e394918995844fdf91c1f4a"><enum>(3)</enum><header>Eligible land</header><text>The term <term>eligible land</term> means private land (which shall include land owned by any organization described in paragraph (2)(B) and land owned by any other private entity, without any eligibility requirement in addition to the eligibility requirements established by this subtitle) or Tribal land—</text><subparagraph id="id307974CE1EF347549E1AD8EBB2B88098"><enum>(A)</enum><text>that is—</text><clause id="id13643CB77A7547D38272A5FADC1B66D6"><enum>(i)</enum><text>forest land; or </text></clause><clause id="id8A5D7218DFB64E16B6C81FE5F90B071F"><enum>(ii)</enum><text>being restored to forest land; </text></clause></subparagraph><subparagraph id="idca87a02465ef4d1facd6f23b182b1a38"><enum>(B)</enum><text>in the case of a forest land easement—</text><clause id="idfd77cb2266ae42c9ba53b15616367be5"><enum>(i)</enum><text>that is subject to a pending offer for purchase of a forest land easement from an eligible entity; and</text></clause><clause id="id490bb27c07684978aa131eb186dff406"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id39155e3a7b7f441a91466c416caeec80"><enum>(I)</enum><text>the enrollment of which would protect forest uses and related conservation values by conserving land; or</text></subclause><subclause id="idd18c228b988d4f70827e8b783d980fe3" indent="up1"><enum>(II)</enum><text>the protection of which will further a State or local policy consistent with the purposes of the program; and</text></subclause></clause></subparagraph><subparagraph id="ida3e58c98db2a4904b294b86001471cb1"><enum>(C)</enum><text>in the case of a forest reserve easement, the enrollment of which will maintain, restore, enhance, or otherwise measurably—</text><clause id="id388e0366279e430b99fbed9ebfd5de5e"><enum>(i)</enum><text>increase the likelihood of recovery of a species that is listed as endangered or threatened under section 4 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533</external-xref>); or</text></clause><clause id="id1b5f013f9a0245d9a3aa4ea237fdf229"><enum>(ii)</enum><text>improve the well-being of a species that is—</text><subclause commented="no" id="idedf26aae35384126924ddbbc0bf1566a"><enum>(I)</enum><text>not listed as endangered or threatened under that section; and</text></subclause><subclause commented="no" id="idc9501a0a5f014bcf90e6b2452bc7dada"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id0F6B757770C046199803F242EC9F4304"><enum>(aa)</enum><text>a candidate for that listing, a State-listed species, or a special concern species; or</text></item><item commented="no" id="id9E3BBF900D904A029FB78BB049A12FB2" indent="up1"><enum>(bb)</enum><text>designated as a species of greatest conservation need by a State wildlife action plan.</text></item></subclause></clause></subparagraph></paragraph><paragraph id="id764881bd13c8443aa3ce2c3fd01077f7"><enum>(4)</enum><header>Forest land easement</header><text>The term <term>forest land easement</term> means an easement or other interest in eligible land that—</text><subparagraph id="id8c98cadf27b142fca988e5cb2820c6ba"><enum>(A)</enum><text>is conveyed to an eligible entity for the purpose of protecting natural resources and the forest nature of the eligible land; and</text></subparagraph><subparagraph id="ida586b9cf5d654f29aa993d475abf9abc"><enum>(B)</enum><text>permits the landowner the right to continue working forest production and related uses.</text></subparagraph></paragraph><paragraph id="idce54d9b427bc408eb35e50f292a34355"><enum>(5)</enum><header>Forest reserve easement</header><text>The term <term>forest reserve easement</term> means an easement or other interest in eligible land that—</text><subparagraph id="idb4e8b84aa77d4f2bb886089942965dad"><enum>(A)</enum><text>is conveyed to the Secretary for the purpose of protecting natural resources and the forest nature of the eligible land; and</text></subparagraph><subparagraph id="id4b8b459ed34946318e59e4965e8f2265"><enum>(B)</enum><text>permits the landowner the right to continue working forest production and related uses consistent with the applicable forest reserve easement plan developed under section 1267C(c)(1)(A).</text></subparagraph></paragraph><paragraph id="idf1983b32801349b4b4ebf3eec9ad1899"><enum>(6)</enum><header>Program</header><text>The term <term>program</term> means the forest conservation easement program established under this subtitle.</text></paragraph><paragraph id="id67620414b78c4befbc916de9940a53c9"><enum>(7)</enum><header>Socially disadvantaged forest landowner</header><text>The term <term>socially disadvantaged forest landowner</term> means a forest landowner who is a member of a socially disadvantaged group (as defined in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>)).</text></paragraph><paragraph id="idf86d6e2df9c644f58fc9b04be21bb5cc"><enum>(8)</enum><header>Veteran forest landowner</header><text>The term <term>veteran forest landowner</term> means a forest landowner who—</text><subparagraph id="idD121787AFA5540AFB6DACE0A3C7CB14D"><enum>(A)</enum><text>has served in the Armed Forces (as defined in section 101 of title 38, United States Code); and</text></subparagraph><subparagraph id="idfba1397cfb684eafa73536105fdad846"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id0595029B3FD443A98A0E3643FC264627"><enum>(i)</enum><text>has not previously owned forest land;</text></clause><clause id="id9102805dfddf498a8878f47f000020f7" indent="up1"><enum>(ii)</enum><text>has owned forest land for not more than 10 years; or</text></clause><clause id="id8c4d94c2ee754eb5aa7b62e92dd69417" indent="up1"><enum>(iii)</enum><text>is a veteran (as defined in that section) who has first obtained status as a veteran (as so defined) during the most recent 10-year period.</text></clause></subparagraph></paragraph></section><section id="id3473ed8672ad41bd958662b19dc71627"><enum>1267B.</enum><header>Forest land easements</header><subsection id="id8e476fa2fc114d099db82993c9839842"><enum>(a)</enum><header>Availability of assistance</header><text>The Secretary shall facilitate and provide funding for—</text><paragraph id="idc1993a4cce6e4d59b2be52753bcf131c"><enum>(1)</enum><text>the purchase by eligible entities of forest land easements in eligible land;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd76951b92f1c42c7aae21be643441b8a"><enum>(2)</enum><text display-inline="yes-display-inline">the development of voluntary forest management plans under subsection (b)(4)(F); and</text></paragraph><paragraph id="id5864c2411c71454c8dc7b1484e1039e6"><enum>(3)</enum><text>technical assistance to implement this section.</text></paragraph></subsection><subsection id="id5b64a73bfb784dc9baa7930d696e79ee"><enum>(b)</enum><header>Cost-Share assistance</header><paragraph id="idd2d99320ee444e22bb92a5db385c2bfc"><enum>(1)</enum><header>In general</header><text>The Secretary shall protect the forest use and related conservation values of eligible land through cost-share assistance to eligible entities for purchasing forest land easements.</text></paragraph><paragraph id="id4c8db442466b4470bc85658236aaa01e"><enum>(2)</enum><header>Scope of assistance available</header><subparagraph id="idd30d9e649a4740a3b0931cb1207f796b"><enum>(A)</enum><header>Federal share</header><text>Except as provided in subparagraph (C), an agreement described in paragraph (4) shall provide for a Federal share of 50 percent of the fair market value of the forest land easement.</text></subparagraph><subparagraph id="id759D683A587A422E82FC74BEE97815F3"><enum>(B)</enum><header>Determination of fair market value</header><text>The fair market value of a forest land easement shall be determined by the Secretary using—</text><clause id="id39785b50e0204b45a2e2f00314b8cea5"><enum>(i)</enum><text>the Uniform Standards of Professional Appraisal Practice;</text></clause><clause id="idf4d53e1284d24298ba9a5cb718cd178f"><enum>(ii)</enum><text>an areawide market analysis or survey; or</text></clause><clause id="id754232cd27934197ae7f1b5013e27d7b"><enum>(iii)</enum><text>another industry-approved method.</text></clause></subparagraph><subparagraph id="id1041fd06ef82477cb8690a615c679a51"><enum>(C)</enum><header>Exceptions</header><text>The Secretary may provide for a Federal share of not to exceed 75 percent of the fair market value of a forest land easement in the case of—</text><clause id="idD00B4A4C2B1E49CE8FA871AF4EF0E98C"><enum>(i)</enum><text>forests of special environmental significance, as determined by the Secretary; or</text></clause><clause id="id07d11f7902f8471ebe10fba0072fd4e7"><enum>(ii)</enum><text>eligible land owned by—</text><subclause id="idA79D77025AAA44D280C2E78449688BEB"><enum>(I)</enum><text>a beginning forest landowner;</text></subclause><subclause id="id6862C7D654244EDF92241B1565DCCB56"><enum>(II)</enum><text>a socially disadvantaged forest landowner;</text></subclause><subclause id="id495C70F8A5414A31A858A6F95689AE19"><enum>(III)</enum><text>a veteran forest landowner; or</text></subclause><subclause id="id300BDCF98CB845009FA4715510637997"><enum>(IV)</enum><text>a limited resource forest landowner, as defined by the Secretary.</text></subclause></clause></subparagraph><subparagraph id="iddc94b5c204664a33a55e74351f158694"><enum>(D)</enum><header>Non-Federal share</header><clause id="id15b081ca35a74e088dfa46c3f3ae9119"><enum>(i)</enum><header>In general</header><text>Under an agreement described in paragraph (4), the eligible entity shall provide a share that covers the difference between—</text><subclause id="id40CEC74FCB4D43F9A6BE3616398C6938"><enum>(I)</enum><text>the Federal share that is provided under this paragraph; and</text></subclause><subclause id="id28003F1DE296470D90EF38D06F9F73E4"><enum>(II)</enum><text>the fair market value of the forest land easement.</text></subclause></clause><clause id="id1b598787f9cd460e92c5eaa0debf53b6"><enum>(ii)</enum><header>Permissible forms</header><text>The non-Federal share provided by an eligible entity under this subparagraph may comprise—</text><subclause id="idfc4207fb332a40da8b92dd8cc412ebae"><enum>(I)</enum><text>cash resources;</text></subclause><subclause id="id5d8b3557841a40fb90f1b8cc39b5446e"><enum>(II)</enum><text>a charitable donation or qualified conservation contribution (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/170">section 170(h)</external-xref> of the Internal Revenue Code of 1986) from the private forest landowner from which the forest land easement will be purchased;</text></subclause><subclause id="ida3f9f4b7b5244ec9b390908c39ce800c"><enum>(III)</enum><text>costs associated with securing a deed to the forest land easement, including the cost of appraisal, survey, inspection, and title; and</text></subclause><subclause id="id6321587bf8904eefba25dc779c5755a0"><enum>(IV)</enum><text>other costs, as determined by the Secretary.</text></subclause></clause></subparagraph></paragraph><paragraph id="id887ea064361f47f79b09db6df4b24369"><enum>(3)</enum><header>Evaluation and ranking of applications</header><subparagraph id="idd91575fa6b28419c87faa6bc5902a590"><enum>(A)</enum><header>Criteria</header><text>The Secretary shall establish evaluation and ranking criteria to maximize the benefit of Federal investment under the program.</text></subparagraph><subparagraph id="ide40e43b7f93843adb6fec3842b2b6849"><enum>(B)</enum><header>Priority</header><text>In evaluating applications under the program, the Secretary shall give priority to an application for the purchase of a forest land easement that, as determined by the Secretary—</text><clause id="idf8df5676194744cc861e94888f904723"><enum>(i)</enum><text>maintains the viability of working forest land; and</text></clause><clause id="id55dd9be6d34945ffad18b41223c4a005"><enum>(ii)</enum><text>includes a forest management plan developed for the eligible land, which may comprise a plan described in any of subclauses (I) through (IV) of paragraph (4)(F)(ii).</text></clause></subparagraph><subparagraph id="id4ee2360c166f40fb84a9d08a01a3390f"><enum>(C)</enum><header>Considerations</header><text>In establishing the criteria under subparagraph (A), the Secretary shall emphasize support for—</text><clause id="id3a9d076c020e4668a9fd67895da38dd1"><enum>(i)</enum><text>protecting forest uses and related conservation values of the eligible land;</text></clause><clause id="id97032961707d4f879ae96a191b2570f9"><enum>(ii)</enum><text>reducing fragmentation; and </text></clause><clause id="id9a426a3439b146b49341b78c071ce5a5"><enum>(iii)</enum><text>maximizing the areas protected from conversion to non-forest uses.</text></clause></subparagraph><subparagraph id="idcf4460fc58d649d0ad9ca5e45b4772c0"><enum>(D)</enum><header>Accounting for geographic differences</header><text>The Secretary may adjust the criteria established under subparagraph (A) to account for geographic differences, if the adjustments—</text><clause id="id66fdc2057bfe4671860a51bb42fbc177"><enum>(i)</enum><text>meet the purposes of the program; and</text></clause><clause id="idaf35caf2c877490492b3ff0f87832448"><enum>(ii)</enum><text>continue to maximize the benefit of the Federal investment under the program.</text></clause></subparagraph><subparagraph id="id3dd8fbbb1dbb4ce3b5cb6ddefffd77df"><enum>(E)</enum><header>Bidding down</header><text>If the Secretary determines that 2 or more applications for cost-share assistance are comparable in achieving the purpose of the program, the Secretary shall not assign a higher priority to any of those applications solely on the basis of lesser cost to the program.</text></subparagraph></paragraph><paragraph id="idd3f0000464a8409db1a99063e8ee0828"><enum>(4)</enum><header>Agreements with eligible entities</header><subparagraph id="id826e6584144e4eb98103db82d5177481"><enum>(A)</enum><header>In general</header><text>The Secretary shall enter into agreements with eligible entities to stipulate the terms and conditions under which the eligible entity is permitted to use cost-share assistance provided under this section.</text></subparagraph><subparagraph id="id3b1a488708a14ed6920b5d68e4f36190"><enum>(B)</enum><header>Length of agreements</header><clause id="id4F3011D0C13B45E8AA977FFCDD5D4590"><enum>(i)</enum><header>In general</header><text>An agreement under subparagraph (A) shall be for a term that is—</text><subclause id="id9d5047fa789341498c36803906e261ad"><enum>(I)</enum><text>in the case of an eligible entity certified under paragraph (5), not less than 5 years; and</text></subclause><subclause id="idcd1cdd7cb2964ac8bc84fbe4b87cf008"><enum>(II)</enum><text>in the case of any other eligible entity, not less than 3, but not more than 5, years, unless the Secretary determines that an extension of time is justified. </text></subclause></clause><clause id="id1A707C36974449C5865F298ACECF486C"><enum>(ii)</enum><header>Expediting closings</header><text>The Secretary is encouraged to expedite closing on forest land easements, as practicable.</text></clause></subparagraph><subparagraph id="id8bfc0b49ee9444e7a3ec9595d4d6f4af"><enum>(C)</enum><header>Minimum terms and conditions</header><text>An eligible entity shall be authorized to use its own terms and conditions for forest land easements so long as the Secretary determines such terms and conditions—</text><clause id="idf31584a82c6d4af69b2c78519f00fda9"><enum>(i)</enum><text>are consistent with—</text><subclause id="id3F26D340CFA64C8B8467043443B7B880"><enum>(I)</enum><text>the purposes of the program; and </text></subclause><subclause id="idEC2838943F974EB8B41161346612B9DB"><enum>(II)</enum><text>the forestry activities to be conducted on the eligible land;</text></subclause></clause><clause id="id12464548df9d415f9b01199865c3f75b"><enum>(ii)</enum><text>permit effective enforcement of the conservation purposes of the forest land easements; and</text></clause><clause id="id2655968f24e4435082f4f92f79e65595"><enum>(iii)</enum><text>include a right of enforcement for the Secretary that—</text><subclause id="idede8938c246745c7ba48f505f330f299"><enum>(I)</enum><text>may be used only if the terms and conditions of the forest land easement are not enforced by the eligible entity; and</text></subclause><subclause id="id197ced2aa06641399fa504ae3c4af1d9"><enum>(II)</enum><text>does not extend to a right of inspection unless—</text><item id="id17b153f51bb548d282b335edf29b69a9"><enum>(aa)</enum><subitem commented="no" display-inline="yes-display-inline" id="id9e1414a8335b4dfda6b2a8833dd654a3"><enum>(AA)</enum><text>the holder of the forest land easement fails to provide monitoring reports in a timely manner; or</text></subitem><subitem id="id03b70aa2b3c64d39a3b5d95e8b5eee3d" indent="up1"><enum>(BB)</enum><text>the Secretary has a reasonable and articulable belief that the terms and conditions of the forest land easement have been violated; and</text></subitem></item><item id="ida53b54fb467341c89576a214e3c59dac"><enum>(bb)</enum><text>prior to the inspection, the Secretary notifies the eligible entity and the landowner of the inspection and provides a reasonable opportunity for the eligible entity and the landowner to participate in the inspection; and</text></item></subclause></clause><clause id="id3245499bacbe4a96af118dd4ef7e2b8f"><enum>(iv)</enum><text>include a limit on the impervious surfaces to be allowed that is consistent with the forestry activities to be conducted.</text></clause></subparagraph><subparagraph id="idd35bdb57d7b843f58a9ee58d1ece5894"><enum>(D)</enum><header>Additional permitted terms and conditions</header><text>An eligible entity may include terms and conditions for a forest land easement that—</text><clause id="id3fa5667281464415b2dceb801653ab5c"><enum>(i)</enum><text>are intended to keep the eligible land subject to the forest land easement in active forest management, as determined by the Secretary;</text></clause><clause id="idab0c20a06a484a56977ff2253a621829"><enum>(ii)</enum><text>allow subsurface mineral development on the eligible land subject to the forest land easement and in accordance with applicable State law if, as determined by the Secretary—</text><subclause id="id61fd705c278e41f08c35b789699f3db8"><enum>(I)</enum><text>the subsurface mineral development—</text><item id="id50cc5402e6914a088b141b6d500ec980"><enum>(aa)</enum><text>has a limited and localized impact;</text></item><item id="id68ad2363cf2b41ddab9b53d24926af08"><enum>(bb)</enum><text>does not harm the forest use and conservation values of the eligible land subject to the forest land easement;</text></item><item id="idc6433791d7734e4a9157564a9a4ef911"><enum>(cc)</enum><text>does not materially alter or affect the existing topography;</text></item><item id="id1970ed4db2d94e7cb5ed79da8f63471e"><enum>(dd)</enum><text>complies with a subsurface mineral development plan that—</text><subitem id="idc8f1a927e312495b80f3c61bd9b79a1a"><enum>(AA)</enum><text>includes a plan for the remediation of impacts to the forest use and conservation values of the eligible land subject to the forest land easement; and</text></subitem><subitem id="id25fb392596eb4c99bbfe324281c39823"><enum>(BB)</enum><text>is approved by the Secretary prior to the initiation of mineral development activity;</text></subitem></item><item id="id8a9df23ec6a845ed8b316eba1cbaf050"><enum>(ee)</enum><text>is not accomplished by any surface mining method;</text></item><item id="id17f0f2c5355d4de48f8958fde7f04f02"><enum>(ff)</enum><text>is within the impervious surface limits of the forest land easement under subparagraph (C)(iv); and</text></item><item id="id5161648159a64a13a9f82bf16d007644"><enum>(gg)</enum><text>uses practices and technologies that minimize the duration and intensity of impacts to the forest use and conservation values of the eligible land subject to the forest land easement; and</text></item></subclause><subclause id="id25a9d6b17e94407db666ac4a6a84172f"><enum>(II)</enum><text>each area impacted by the subsurface mineral development is reclaimed and restored by the holder of the mineral rights at cessation of operation; and</text></subclause></clause><clause id="idc8248d3834454ce292453f3e904022c3"><enum>(iii)</enum><text>include other relevant activities relating to the forest land easement, as determined by the Secretary.</text></clause></subparagraph><subparagraph id="idd486023d9b70457e92f15e3ce66b6c50"><enum>(E)</enum><header>Substitution of qualified projects</header><text>An agreement under subparagraph (A) shall allow, upon mutual agreement of the parties, substitution of qualified projects that are identified at the time of the proposed substitution.</text></subparagraph><subparagraph id="id3d58fb7a82c14bc289e65a22f985bdbd"><enum>(F)</enum><header>Voluntary forest management plan</header><clause commented="no" display-inline="no-display-inline" id="idc9718ad7652341409560ecb39b1069b0"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">If eligible land does not have a forest management plan at the time of application for the program, prior to the acquisition of the forest land easement, the landowner shall develop, in partnership with the eligible entity, a voluntary forest management plan for the eligible land subject to the forest land easement.</text></clause><clause id="idc12e769855fb460f81f1ba633870c837"><enum>(ii)</enum><header>Sufficiency of other plans</header><text>A voluntary forest management plan described in clause (i) may comprise—</text><subclause id="id16ad9ecac79f49a98b923fec3ea2d1e6"><enum>(I)</enum><text>a forest stewardship plan described in section 5(f) of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2103a">16 U.S.C. 2103a(f)</external-xref>);</text></subclause><subclause id="idd488d9fb47e24b9fa8d45b421e9ba381"><enum>(II)</enum><text>another plan approved by the applicable State forester or State forestry agency;</text></subclause><subclause id="idd22e1f6efa184ccb9f7f166712b9644b"><enum>(III)</enum><text>a plan developed under a third-party certification system; or</text></subclause><subclause id="id902d11992a6947478ba5099f58391791"><enum>(IV)</enum><text>another plan determined appropriate by the Secretary.</text></subclause></clause><clause id="idcac7129a70a94da3b46a626dcbff8b20"><enum>(iii)</enum><header>Reimbursement</header><text>The Secretary may reimburse a landowner for the cost of the development of a voluntary forest management plan under clause (i).</text></clause></subparagraph><subparagraph id="idaad7df73547747d7831012bd49f8cf0c"><enum>(G)</enum><header>Effect of violation</header><text>If a violation of a term or condition of an agreement under subparagraph (A) occurs—</text><clause id="id3bd45c235969475ab019fe80d2b6ec0f"><enum>(i)</enum><text>the Secretary may terminate the agreement; and</text></clause><clause id="idbde9c95a864945229bd8bd6a46893d8b"><enum>(ii)</enum><text>the Secretary may require the eligible entity to refund all or part of any payments received by the eligible entity under the program, with interest on the payments as determined appropriate by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="id6d1c01cb7836434bb827e73d9e87df18"><enum>(5)</enum><header>Certification of eligible entities</header><subparagraph id="idB5E5277A74574151947493E3C66D74EA"><enum>(A)</enum><header>Certification process</header><text>The Secretary shall establish a process to create forest land easement acquisition and operational efficiencies, under which the Secretary shall—</text><clause id="id8bd72b63970a4cfd8298917b552059cd"><enum>(i)</enum><text>directly certify eligible entities that meet established criteria;</text></clause><clause id="id4938bdea461e4e76b20f3b1499ff53d4"><enum>(ii)</enum><text>enter into long-term agreements with certified eligible entities;</text></clause><clause id="id24573ce339da4e6f8d911181a688e83f"><enum>(iii)</enum><text>accept proposals for cost-share assistance for the purchase of forest land easements throughout the duration of such agreements; and</text></clause><clause id="idaed4b8063bca4992bb1021f15ff09724"><enum>(iv)</enum><text>allow a certified eligible entity to use and modify its own terms and conditions, notwithstanding subparagraphs (C) and (D) of paragraph (4).</text></clause></subparagraph><subparagraph id="id23825724beaf426d8194b69de4d1ca5c"><enum>(B)</enum><header>Certification criteria</header><text>To be certified under subparagraph (A)(i), an eligible entity shall demonstrate to the Secretary that the eligible entity—</text><clause id="id1cde9fb25a3f47529b80023a0c17bba1"><enum>(i)</enum><text>will maintain, at a minimum, for the duration of an agreement described in subparagraph (A)(ii)—</text><subclause id="id5a2e1188f1e148e1aa9845c006f01733"><enum>(I)</enum><text>a plan for administering forest land easements that is consistent with the purposes of the program;</text></subclause><subclause id="idf94ff5f6c6264b07a1bbeb0efc29b484"><enum>(II)</enum><text>the capacity and resources to monitor and enforce forest land easements; and</text></subclause><subclause id="id99ee1d4c7dd24646b1554b031f0d32e4"><enum>(III)</enum><text>policies and procedures to ensure—</text><item id="ida5e2ff2e93314ed19e015d960d75d86a"><enum>(aa)</enum><text>the long-term integrity of forest land easements;</text></item><item id="id6e20604547b94d1e838761651217473d"><enum>(bb)</enum><text>timely completion of acquisitions of forest land easements; and</text></item><item id="id405c7c8281e944ce8c215bf5d63db30a"><enum>(cc)</enum><text>timely and complete evaluation and reporting to the Secretary on the use of funds provided under the program;</text></item></subclause></clause><clause id="id59bf46387c21460fbaf3ffbba7bcc460"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id98148E61F66F41B0B7E25BF21EE98E71"><enum>(I)</enum><text>is an eligible entity that has been accredited by the Land Trust Accreditation Commission, or by an equivalent accrediting body, as determined by the Secretary, and has acquired not fewer than 5 forest land easements under the program or any other forest easement program;</text></subclause><subclause id="idb73d0695cb45499fa4483527bad32906" indent="up1"><enum>(II)</enum><text>is a State department of agriculture or other State agency with statutory authority for forest land protection that has acquired not fewer than 5 forest land easements under the program or any other forest easement program; or</text></subclause><subclause id="id1ce11c14e63d495eaa39cb23849f99af" indent="up1"><enum>(III)</enum><text>is an eligible entity not described in subclause (I) or (II) that has acquired not fewer than 10 forest land easements under the program or any other forest easement program; and</text></subclause></clause><clause id="idea2998e033fc474f804fcba5b0bb6051"><enum>(iii)</enum><text>has successfully met the responsibilities of the eligible entity under the applicable agreements with the Secretary, as determined by the Secretary, relating to forest land easements that the eligible entity has acquired as described in subclause (I), (II), or (III) of clause (ii).</text></clause></subparagraph><subparagraph id="id7a64649ded294c349893ec2f73296b4f"><enum>(C)</enum><header>Quality assurance</header><text>The Secretary shall establish an annual quality review process—</text><clause id="id9cec8022e4f94309a6301b38b02bbb63"><enum>(i)</enum><text>to review a minimum sample of forest land easements acquired by eligible entities certified under subparagraph (A)(i);</text></clause><clause id="idb87158dbf8964411bafd95d7dd8ab626"><enum>(ii)</enum><text>to ensure the integrity of the forest land easement acquisition process under subparagraph (A);</text></clause><clause id="id070968d10b994b3e836fab86f9ddaf55"><enum>(iii)</enum><text>to establish a nonpunitive process for corrective actions with respect to the processes described in subparagraph (A); and</text></clause><clause id="id26f1efbefb764754a991b034b480c7de"><enum>(iv)</enum><text>to provide for waiver of successive annual reviews based on demonstrated compliance with the requirements under this paragraph. </text></clause></subparagraph></paragraph></subsection><subsection id="id3646aeb9f30a408b8b9493ab870d295a"><enum>(c)</enum><header>Method of enrollment</header><text>The Secretary shall enroll eligible land under this section through the use of—</text><paragraph id="id15f136cc66fc41038d8bc612ac95e5a9"><enum>(1)</enum><text>permanent easements; or</text></paragraph><paragraph id="id96c182f06b77427eaecdb57c55d3833a"><enum>(2)</enum><text>easements for the maximum duration allowed under applicable State laws.</text></paragraph></subsection><subsection id="id63057d7d1bbb43b1aab5daa07bc57645"><enum>(d)</enum><header>Technical assistance</header><text>The Secretary may provide technical assistance, on request, to assist in compliance with the terms and conditions of forest land easements.</text></subsection></section><section id="id2254b0759ecc44f68d2897a7c391510a"><enum>1267C.</enum><header>Forest reserve easements</header><subsection id="id0fddf141114a4cd28f63824ab0f67471"><enum>(a)</enum><header>Availability of assistance</header><text>The Secretary shall provide assistance to owners of eligible land to restore, protect, and enhance eligible land through—</text><paragraph id="id5a272c59f230473aad044c1d6d90f233"><enum>(1)</enum><text>forest reserve easements and related forest reserve easement plans; and</text></paragraph><paragraph id="idc0e15524dc8d4da8ac161529ea735697"><enum>(2)</enum><text>technical assistance to implement this section.</text></paragraph></subsection><subsection id="id806c57f1fa8f47498ad74c58b80a9b6c"><enum>(b)</enum><header>Easements</header><paragraph id="id77841882299b4aa9a25fdf513e6b6240"><enum>(1)</enum><header>Method of enrollment</header><subparagraph id="id766b7e30a6fd47f1a9bedb038705b5dc"><enum>(A)</enum><header>Authorized methods</header><text>The Secretary shall enroll eligible land under this section—</text><clause id="idBD9D3B69992F46A080208CF047BED97F"><enum>(i)</enum><text>through the use of—</text><subclause id="idd476f3429d63462ab57a3e831af9f80c"><enum>(I)</enum><text>permanent easements;</text></subclause><subclause id="id5597e11cef954ec993bf64a01924b434"><enum>(II)</enum><text>30-year easements; and</text></subclause><subclause id="idb6c5f24d4cb14f228bdce41c5883cf7b"><enum>(III)</enum><text>easements for the maximum duration allowed under applicable State laws; and</text></subclause></clause><clause commented="no" id="ida9a73f95e09b4e05a90b31030ff85665"><enum>(ii)</enum><text>in the case of Indian Tribes, in accordance with subparagraph (B).</text></clause></subparagraph><subparagraph id="id06356caa6c164574a5ca461f74f5598e"><enum>(B)</enum><header>Acreage owned by Indian Tribes</header><clause id="idc2c3ec0fc44e4b51a950a62fc563ffc6"><enum>(i)</enum><header>Definition of acreage owned by an Indian Tribe</header><text>In this subparagraph, the term <term>acreage owned by an Indian Tribe</term> means eligible land that is—</text><subclause id="id653ffe7b63a84ee7a84cd6a063f9eb7e"><enum>(I)</enum><text>land that is held in trust by the United States for Indian Tribes or individual Indians;</text></subclause><subclause id="id84d37bf81b164c47ab0e89bafe4e6656"><enum>(II)</enum><text>land, the title to which is held by Indian Tribes or individual Indians subject to Federal restrictions against alienation or encumbrance;</text></subclause><subclause id="id97d69ba9bb8c4f5a9b04f4280e5f4203"><enum>(III)</enum><text>land that is subject to rights of use, occupancy, and benefit of certain Indian Tribes;</text></subclause><subclause id="idcd003fae2de04a939061de74611b0ff1"><enum>(IV)</enum><text>land that is held in fee title by an Indian Tribe;</text></subclause><subclause id="id35adf51179024723b5c791ea64855b58"><enum>(V)</enum><text>land that is owned by a native corporation formed under—</text><item id="id013F771CB5704DABA984482391ACFBB8"><enum>(aa)</enum><text>section 17 of the Act of June 18, 1934 (commonly known as the <quote>Indian Reorganization Act</quote>) (48 Stat. 988, chapter 576; <external-xref legal-doc="usc" parsable-cite="usc/25/5124">25 U.S.C. 5124</external-xref>); or</text></item><item id="idC8753B4CC1224600A86AD2041B5E9080"><enum>(bb)</enum><text>section 8 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1607">43 U.S.C. 1607</external-xref>); or</text></item></subclause><subclause id="ide9f93cf6ad6044a5bb1f88be73fbc1f2"><enum>(VI)</enum><text>a combination of 1 or more types of land described in subclauses (I) through (V).</text></subclause></clause><clause id="idff1f88c2faad4f77871c49f44c1950af"><enum>(ii)</enum><header>Enrollment of acreage</header><text>In the case of acreage owned by an Indian Tribe, the Secretary may enroll acreage in a forest reserve easement through the use of—</text><subclause id="id6e7507157dd7440b9d531b5c635e9d37"><enum>(I)</enum><text>a 30-year contract (the compensation for which shall be equivalent to the compensation for a 30-year easement);</text></subclause><subclause id="id69bc0a5efe524c65b7ba86bdc804262b"><enum>(II)</enum><text>a permanent easement; or</text></subclause><subclause id="id4ac154e085214db09926b2bdb5b79387"><enum>(III)</enum><text>any combination of the methods described in subclauses (I) and (II).</text></subclause></clause></subparagraph><subparagraph id="idef66e3b252ff4aa083e7edcb5e7b8a37"><enum>(C)</enum><header>Limitation</header><text>Not more than 10 percent of amounts made available to carry out this section in a fiscal year may be used for 30-year easements under this section.</text></subparagraph></paragraph><paragraph id="id42524471d76e42f5bac6f8823666f0ae"><enum>(2)</enum><header>Evaluation and ranking of offers</header><subparagraph id="id92eeb96e855f4e1291dca8933765e132"><enum>(A)</enum><header>Criteria</header><text>The Secretary shall establish evaluation and ranking criteria for offers from landowners under this section to maximize the environmental benefits per dollar expended under the program.</text></subparagraph><subparagraph id="id04bfadd3bd4447c287f1ef37e7c422b6"><enum>(B)</enum><header>Priority</header><text>The Secretary shall give priority to the enrollment of eligible land under this section that provides the greatest conservation benefit to—</text><clause id="id6a3797cfbce240ffbbb5f7ff3c8009ff"><enum>(i)</enum><text>primarily, species listed as endangered or threatened under section 4 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533</external-xref>); and</text></clause><clause commented="no" id="id54b46dc785de4776a5321e0a456b36d9"><enum>(ii)</enum><text>secondarily, species that are— </text><subclause commented="no" id="id1E887F542ECD4AE8A963B7DFF5555E33"><enum>(I)</enum><text>not listed as endangered or threatened under that section; and</text></subclause><subclause commented="no" id="id4CCDD63ABB4A4D458F13B6E273A9150E"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="idA1411CCFA32B45AD886CBB25DA0AEF84"><enum>(aa)</enum><text>candidates for that listing, State-listed species, or special concern species; or</text></item><item commented="no" id="id090D8E8CF5E541E5AB7A83A9DAD1AF92" indent="up1"><enum>(bb)</enum><text>designated as species of greatest conservation need by a State wildlife action plan.</text></item></subclause></clause></subparagraph><subparagraph id="idbceb7f4f3bd445bf9a819a9c9c0dbadf"><enum>(C)</enum><header>Other considerations</header><text>The Secretary may give additional consideration to eligible land the enrollment under this section of which will—</text><clause id="idff90693efe32476daafcb5dad795cbd2"><enum>(i)</enum><text>improve biological diversity;</text></clause><clause id="id62d697de52b2475f88d95b06bfdb4463"><enum>(ii)</enum><text>restore native forest ecosystems;</text></clause><clause id="idab48491f274e46bf9eb365eec82cd717"><enum>(iii)</enum><text>conserve forest land that provides habitat for species described in subparagraph (B);</text></clause><clause id="id2899c1855419493faff8dfc1b05dd756"><enum>(iv)</enum><text>reduce fragmentation; and </text></clause><clause id="id2bc17ccbb058434381c214dbaa98fab5"><enum>(v)</enum><text>increase carbon sequestration.</text></clause></subparagraph></paragraph><paragraph id="idbdf4c242c6ee4df59aeb22a218425b23"><enum>(3)</enum><header>Terms and conditions of easements</header><subparagraph id="iddf20057458db427badc31928116b80db"><enum>(A)</enum><header>In general</header><text>A forest reserve easement shall include terms and conditions that—</text><clause id="idea820ad35b0e4e4691ea7423c82c104f"><enum>(i)</enum><text>are consistent with the purposes of the program and the forestry activities to be conducted on the eligible land;</text></clause><clause id="ide6afa14d3882472785d6eecf302f504b"><enum>(ii)</enum><text>are consistent with the management objectives of the owner of the eligible land, as determined appropriate by the Secretary and identified in the forest reserve easement plan developed under subsection (c)(1)(A);</text></clause><clause id="id62499009dbbd40a79cecd8792dac9b1c"><enum>(iii)</enum><text>permit effective enforcement of the conservation purposes of the forest reserve easements;</text></clause><clause id="id364b6e114d3945acb1a3ec4142b4a763"><enum>(iv)</enum><text>provide for the efficient and effective establishment or enhancement of forest ecosystem functions and values; and</text></clause><clause id="idc5ffd6dbd179483c8473590b7ceed6f1"><enum>(v)</enum><text>include such additional provisions as the Secretary determines are desirable to carry out the program or facilitate the practical administration of the program.</text></clause></subparagraph><subparagraph id="idf341169ff95743728fdb2cb95028f97b"><enum>(B)</enum><header>Adjustment of terms</header><text>To ensure the terms and conditions of a forest reserve easement are consistent with the management objectives of the owner of the eligible land and the purposes of the program, the Secretary may adjust the standard terms and conditions for any forest reserve easement prior to acquiring the forest reserve easement, as long as the adjustment does not conflict with this section.</text></subparagraph></paragraph><paragraph id="idbf6fc16a83544b7e83f82f72fc46ae56"><enum>(4)</enum><header>Compensation</header><subparagraph id="idb09f812d9891463cbf32abd36a99cac1"><enum>(A)</enum><header>Permanent easements</header><text>In the case of eligible land enrolled in a permanent easement under this section, the Secretary shall pay the owner of the eligible land an amount equal to the difference between, as determined by the Secretary—</text><clause id="id659E86686EF84D0C8921BEC9235DDA77"><enum>(i)</enum><text>the fair market value of the eligible land before the enrollment in the permanent easement; and</text></clause><clause id="id50DA06E3C3534332AF135AB324F563E0"><enum>(ii)</enum><text>the fair market value of the eligible land as encumbered by the permanent easement.</text></clause></subparagraph><subparagraph id="id7a3f24ce1297492c835bea33d82c4224"><enum>(B)</enum><header>Other</header><text>The Secretary shall pay the owner of eligible land enrolled under this section in a 30-year contract, a 30-year easement, or an easement for the maximum duration allowed under applicable State laws not less than 50 percent, and not more than 75 percent, of the compensation that would be paid for a permanent easement in accordance with subparagraph (A).</text></subparagraph><subparagraph id="idBBDDC0365D3F4351849BCDDB3348082A"><enum>(C)</enum><header>Determination of fair market value</header><text>The Secretary shall determine the fair market value of eligible land for purposes of this paragraph using the Uniform Standards of Professional Appraisal Practice or another industry-approved method.</text></subparagraph></paragraph></subsection><subsection id="id70d1b510e779432a878dc0d61c36a9af"><enum>(c)</enum><header>Easement restoration and management</header><paragraph id="id1a63b89d73c4486885b6afe9e9b12d08"><enum>(1)</enum><header>Forest reserve easement plan</header><subparagraph id="id1f22e3a29f5c4006ba74b4afd133ec23"><enum>(A)</enum><header>In general</header><text>Land enrolled in a forest reserve easement shall be subject to a forest reserve easement plan, to be developed jointly by the landowner and the Secretary, that describes the activities to be carried out on the land, as are necessary to restore, maintain, and enhance habitat for species described in subsection (b)(2)(B), including—</text><clause id="id12c0210914c242ad90a3cb4e25bbc03f"><enum>(i)</enum><text>converting or restoring forest land to improve forest ecosystem functions and values;</text></clause><clause id="id57efca8fcbe14b1d853dc8c261ec3e93"><enum>(ii)</enum><text>enhancing or maintaining existing forest ecosystem functions and values;</text></clause><clause id="idfa5f3762aa3443c78cf986f5dc99a94b"><enum>(iii)</enum><text>restoring marginal farmland or degraded forest land to improve forest ecosystem functions and values; </text></clause><clause id="ida9f2bdd7cc364d4bbb8062a8b5e71a88"><enum>(iv)</enum><text>the conservation treatments and forest management practices that will achieve the conservation values and goals that are consistent with the program, as determined by the Secretary; or</text></clause><clause id="id2a1c1dd21175484cac238a3e41bd5b22"><enum>(v)</enum><text>any combination of the activities described in clauses (i) through (iv).</text></clause></subparagraph><subparagraph id="iddd7ca57691664f71882b502f946215c3"><enum>(B)</enum><header>Practices and measures</header><text>A forest reserve easement plan developed under subparagraph (A) shall require such practices and measures as are necessary to accomplish the activities described in subparagraph (A), which may include—</text><clause id="id287a71b235d84599bdf9b367fdb52e74"><enum>(i)</enum><text>land management and silviculture practices;</text></clause><clause id="ida78db509077d42ecb7b2af6e0140365a"><enum>(ii)</enum><text>vegetative treatments;</text></clause><clause id="idc0c553d1e2c749f09fa26889b2bbd989"><enum>(iii)</enum><text>structural practices and measures;</text></clause><clause id="id59fa93a621a54679afd72ae0433c8ce2"><enum>(iv)</enum><text>practices to increase carbon sequestration;</text></clause><clause id="id22086b89667944e28f6ddcedc7a10e51"><enum>(v)</enum><text>practices to improve biological diversity; and</text></clause><clause id="idb37b785bd6e7447685596a4bfcb206e8"><enum>(vi)</enum><text>other practices and measures, as determined by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="id24eff2930bab44f187f99d2042ac863a"><enum>(2)</enum><header>Financial assistance</header><subparagraph id="id2c78a858ce5a4c36bef9f8cb44abde52"><enum>(A)</enum><header>In general</header><text>The Secretary shall provide financial assistance to owners of eligible land to carry out the activities, practices, and measures described in the forest reserve easement plan developed for the eligible land under paragraph (1).</text></subparagraph><subparagraph id="id8025024013d549cca9ac5b1e601a4fe5"><enum>(B)</enum><header>Payments</header><text>With respect to financial assistance provided under subparagraph (A), the Secretary shall—</text><clause id="id95861365edb14cc09e3894be9f98500f"><enum>(i)</enum><text>in the case of a permanent easement, pay an amount that is not more than 100 percent of the eligible costs described in subparagraph (C), as determined by the Secretary; and</text></clause><clause id="id72b1c4fba72742eeaa0c0956f0bfb9ea"><enum>(ii)</enum><text>in the case of a 30-year contract, a 30-year easement, or an easement for the maximum duration allowed under applicable State laws, pay an amount that is not less than 50 percent, and not more than 75 percent, of the eligible costs described in subparagraph (C), as determined by the Secretary.</text></clause></subparagraph><subparagraph id="id07e61856d2aa4a90a8e254eaccdecc3e"><enum>(C)</enum><header>Eligible costs</header><text>Costs eligible for payments under this paragraph are the costs of activities, practices, and measures referred to in subparagraph (A) that are associated with the initial restoration or enhancement of the required habitat conditions for the applicable species.</text></subparagraph><subparagraph id="idad1bcac4629645fd95be957dcda8bd0f"><enum>(D)</enum><header>Timing of payments</header><text>Payments under this paragraph shall be made—</text><clause id="id511661a48e2a4a02816d99b14bab0a16"><enum>(i)</enum><text>only on a determination by the Secretary that an activity, practice, or measure described in subparagraph (C) has been established in compliance with appropriate standards and specifications; and</text></clause><clause id="id58e1fd91ef89487bb7fddf48e8797ac4"><enum>(ii)</enum><text>as soon as practicable after the obligation is incurred.</text></clause></subparagraph><subparagraph id="id59ba4c4092414a4c8d2d1ca16552d6c1"><enum>(E)</enum><header>Limitations</header><text>Cost-sharing payments made by the Secretary under this paragraph to a person or legal entity may not exceed $500,000 per easement or contract.</text></subparagraph><subparagraph id="idb948a6b9fb744c3a95970791f3e95421"><enum>(F)</enum><header>Participation in other programs</header><text>The Secretary shall not prohibit owners of eligible land enrolled in a forest reserve easement from being eligible for any other Department of Agriculture or other Federal program with respect to activities, practices, and measures not funded by payments under this paragraph. </text></subparagraph></paragraph></subsection><subsection id="id546cc0d98bd848029cd109be1b5fe822"><enum>(d)</enum><header>Technical assistance</header><paragraph id="idf737036014354b3e8ab8e6199f0ac126"><enum>(1)</enum><header>In general</header><text>The Secretary shall provide to owners of eligible land technical assistance to assist the owners in complying with the terms and conditions of a forest reserve easement.</text></paragraph><paragraph id="id89bd7ee271024846a936b0e5f2ede807"><enum>(2)</enum><header>Contracts or agreements</header><text>The Secretary may enter into 1 or more contracts with private entities or agreements with a State, nongovernmental organization, or Indian Tribe to provide technical assistance with the implementation of this section, including the enrollment, restoration, enhancement, or maintenance of a forest reserve easement, if the Secretary determines that the contract or agreement will advance the purposes of the program.</text></paragraph></subsection><subsection id="id04afafdc376e44fe877e25bc435c937c"><enum>(e)</enum><header>Protections and measures</header><paragraph id="id22f42d02e9bb46bc96e1964b462eff0c"><enum>(1)</enum><header>Protections</header><text>In the case of a landowner that enrolls eligible land in a forest reserve easement, and whose conservation activities result in a net conservation benefit for a species described in subsection (b)(2)(B), the Secretary shall make available to the landowner safe harbor or similar assurances and protection under—</text><subparagraph id="id226CE1581EC84AEEAE3BD0B30CD03B95"><enum>(A)</enum><text>section 7(b)(4) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536(b)(4)</external-xref>); or</text></subparagraph><subparagraph id="idE4C7516652504505B219A219785210E2"><enum>(B)</enum><text>section 10(a)(1) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1539">16 U.S.C. 1539(a)(1)</external-xref>).</text></subparagraph></paragraph><paragraph id="id5f2f016d0dca4fb580bf25fbd0dc886d"><enum>(2)</enum><header>Measures</header><text>If protection under paragraph (1) requires the taking of measures that are in addition to the measures covered by the applicable forest reserve easement plan agreed to under subsection (c)(1), the cost of the additional measures, and the cost of any permit, shall be considered part of the forest reserve easement plan for purposes of financial assistance under subsection (c)(2).</text></paragraph></subsection><subsection id="id6c72c9bce11b4a7fa6cd062e56e9064f"><enum>(f)</enum><header>Administration</header><paragraph id="idd6bcbec389514b8b897150da55b91e12"><enum>(1)</enum><header>Delegation of easement administration</header><subparagraph id="ide5d271ae8d72431f95fecace76966a59"><enum>(A)</enum><header>Federal and State agencies</header><text>The Secretary may delegate any of the management, monitoring, and enforcement responsibilities of the Secretary under this section to other Federal or State agencies that have the appropriate authority, expertise, and resources necessary to carry out those delegated responsibilities.</text></subparagraph><subparagraph id="id19F5C3792EDB4F278473EDC7CD064D20"><enum>(B)</enum><header>Conservation organizations</header><text>The Secretary may delegate any of the management responsibilities of the Secretary under this section to conservation organizations if the Secretary determines the organization has the appropriate expertise and resources necessary to carry out those delegated responsibilities.</text></subparagraph></paragraph><paragraph id="id21d99c37af7a43a88e531375acb80c22"><enum>(2)</enum><header>Involvement by other agencies and organizations</header><text>In carrying out this section, the Secretary may consult with—</text><subparagraph id="ida5828736a8ce44a18e0a296a654c9082"><enum>(A)</enum><text>private forest landowners;</text></subparagraph><subparagraph id="id10a5e60696684d03846073ae31a5286c"><enum>(B)</enum><text>other Federal agencies;</text></subparagraph><subparagraph id="idc4fa5befd96d4398bb3e2bdddc9401d5"><enum>(C)</enum><text>State forestry agencies;</text></subparagraph><subparagraph id="id28bc68bb9bea409487383f29b8e78d87"><enum>(D)</enum><text>State fish and wildlife agencies;</text></subparagraph><subparagraph id="id76b048bc4e514ffe843d2c87ef635b21"><enum>(E)</enum><text>State environmental quality agencies;</text></subparagraph><subparagraph id="id425e9ba6a7e24faeab27e065b13a0227"><enum>(F)</enum><text>other State conservation agencies; and</text></subparagraph><subparagraph id="id2c085a8a8157464d85d2275d55ba3d6b"><enum>(G)</enum><text>nonprofit conservation organizations.</text></subparagraph></paragraph></subsection></section><section id="id4c9532b79756418194bc21b809c123ad"><enum>1267D.</enum><header>Administration</header><subsection id="idfb7b5585a2e449b28399ad3bf4023b83"><enum>(a)</enum><header>Set aside for historically underserved landowners</header><paragraph id="id7d5ab291c52e411eb88e4f0a3837fc9e"><enum>(1)</enum><header>Allocation of funds</header><text>Of the amounts made available for each of fiscal years 2024 through 2028 to carry out the program, the Secretary shall use, to the maximum extent practicable, 10 percent to enroll in the program eligible land owned by—</text><subparagraph id="id1C10E694D82740278AA87E49FB69CA1B"><enum>(A)</enum><text>a beginning forest landowner;</text></subparagraph><subparagraph id="id423AD27F32904E2298A276EF8E2838B4"><enum>(B)</enum><text>a socially disadvantaged forest landowner;</text></subparagraph><subparagraph id="id8D8EF66C0A134EBB990E4476601EBC7F"><enum>(C)</enum><text>a veteran forest landowner; or</text></subparagraph><subparagraph id="idFB29A0C3203846C4BB0302CDCE3FBE71"><enum>(D)</enum><text>a limited resource forest landowner, as defined by the Secretary.</text></subparagraph></paragraph><paragraph id="id8cd6648a94c246b78367cedcfaead939"><enum>(2)</enum><header>Repooling of funds</header><text>In any fiscal year, amounts not obligated under paragraph (1) by a date determined by the Secretary shall be available for enrollment of any land eligible for enrollment under the program.</text></paragraph></subsection><subsection id="id58f752a19c34473b8c609e17676f9aeb"><enum>(b)</enum><header>Ineligible land</header><paragraph id="idAF73425396624139B2FDE734CD477472"><enum>(1)</enum><header>In general</header><text>The Secretary shall not use amounts made available to carry out the program for the purposes of acquiring an easement on—</text><subparagraph id="id4e53fd5f2d0e483ba9f8c903a7fa1457"><enum>(A)</enum><text>land owned by a Federal agency, other than acreage owned by an Indian Tribe (as defined in section 1267C(b)(1)(B)(i));</text></subparagraph><subparagraph id="idf4799d0b729942288b12fa95f923f353"><enum>(B)</enum><text>land owned in fee title by a State, including an agency or a subdivision of a State, or a unit of local government;</text></subparagraph><subparagraph id="id2ac71bc6acd44b639a8bd8265fa89cd7"><enum>(C)</enum><text>land subject to an easement or deed restriction that, as determined by the Secretary, provides similar protection as would be provided by enrollment in the program; or</text></subparagraph><subparagraph id="id92a9a833e31545b787244c6afd801921"><enum>(D)</enum><text>land the enrollment in the program of which would undermine the purposes of the program due to on-site or off-site conditions, such as risk of hazardous substances, permitted or existing rights of way, infrastructure development, or adjacent land uses.</text></subparagraph></paragraph><paragraph id="idFA93412622704D80ABCDEA36AE4F41DA"><enum>(2)</enum><header>Limitation</header><text>The Secretary shall not impose any limitation on the use of amounts made available to carry out the program for the purposes of acquiring an easement on any land not described in any of subparagraphs (A) through (D) of paragraph (1).</text></paragraph></subsection><subsection id="id1beb29ee4da747dba200ac4312760b59"><enum>(c)</enum><header>Subordination, exchange, modification, and termination</header><paragraph id="id9ea7b7ef94e041aaad4ba83d71228de6"><enum>(1)</enum><header>Subordination</header><text>The Secretary may subordinate any interest in eligible land, or portion of such an interest, administered by the Secretary (including for the purposes of utilities and energy transmission services) directly or on behalf of the Commodity Credit Corporation under the program if the Secretary determines that the subordination—</text><subparagraph id="idd82ead7196744192b659896aa14e94be"><enum>(A)</enum><text>increases conservation values or has a limited negative effect on conservation values;</text></subparagraph><subparagraph id="id2da01791ce1e4529a0ea388c82c3cfa3"><enum>(B)</enum><text>minimally affects the acreage subject to the interest in eligible land; and</text></subparagraph><subparagraph id="id2f35ca21242943e4adfa89b23d88a467"><enum>(C)</enum><text>is in the public interest or furthers the practical administration of the program.</text></subparagraph></paragraph><paragraph id="id547df9b6bc514d0a9d265cdab6cb6b8f"><enum>(2)</enum><header>Modification and exchange</header><subparagraph id="ida2459e331d9341fd8ead705f62abdb28"><enum>(A)</enum><header>Authority</header><text>The Secretary may approve a modification or exchange of any interest in eligible land, or portion of such an interest, administered by the Secretary, directly or on behalf of the Commodity Credit Corporation under the program if the Secretary determines that—</text><clause id="id62147be3c4ef46c1be3db775fcfa1e79"><enum>(i)</enum><text>no reasonable alternative exists and the effect on the interest in eligible land is avoided or minimized to the extent practicable; and</text></clause><clause id="idab9141e090a44eccbd1de978e693958f"><enum>(ii)</enum><text>the modification or exchange—</text><subclause id="ida4ac3f213211467d88d9b53b3c4748c6"><enum>(I)</enum><text>results in equal or increased conservation values;</text></subclause><subclause id="idf51ab506d9ef4f11bc95ad284d6896c9"><enum>(II)</enum><text>results in equal or greater economic value to the United States;</text></subclause><subclause id="id82974e2f05fe430995d1f82481934694"><enum>(III)</enum><text>is consistent with the original intent of the easement;</text></subclause><subclause id="id79218f5e4c2d4d949466c0f5426f476d"><enum>(IV)</enum><text>is consistent with the purposes of the program; and</text></subclause><subclause id="idb2e8fe2c9ef04d88a43a9ba160607975"><enum>(V)</enum><text>is in the public interest or furthers the practical administration of the program.</text></subclause></clause></subparagraph><subparagraph id="idb06047f8e217470e9697ee4729746296"><enum>(B)</enum><header>Limitation</header><text>In modifying or exchanging an interest in eligible land, or portion of such an interest, under this paragraph, the Secretary may not increase any payment to an eligible entity.</text></subparagraph></paragraph><paragraph id="idfe4e7fbce0474e488fd872910552e818"><enum>(3)</enum><header>Termination</header><text>The Secretary may approve a termination of any interest in eligible land, or portion of such an interest, administered by the Secretary, directly or on behalf of the Commodity Credit Corporation under the program if the Secretary determines that—</text><subparagraph id="ida235894fe87e47b18d1f555bb10eaaa4"><enum>(A)</enum><text>termination is in the interest of the Federal Government;</text></subparagraph><subparagraph id="idbf4c248e48f248de99b80b583e9514bf"><enum>(B)</enum><text>the United States will be fully compensated for—</text><clause id="id224c80a1948a48098c97b2a223e2eaa9"><enum>(i)</enum><text>the fair market value of the interest in eligible land;</text></clause><clause id="idd636341aa4f84f4ab74c118a2f71d362"><enum>(ii)</enum><text>any costs relating to the termination; and</text></clause><clause id="id50afc4d4af644fef83615a3a60335d08"><enum>(iii)</enum><text>any damages determined appropriate by the Secretary; and</text></clause></subparagraph><subparagraph id="id17f79f63eebd46c798cae82f17995126"><enum>(C)</enum><text>the termination will—</text><clause id="id16283bd646564d01b1d2d0a1c48f506c"><enum>(i)</enum><text>address a compelling public need for which there is no practicable alternative even with avoidance and minimization; and</text></clause><clause id="idd3511c1b195b40b98b7fecb1bd2f36ab"><enum>(ii)</enum><text>further the practical administration of the program.</text></clause></subparagraph></paragraph><paragraph id="id47f5c3ced3704eb7a62489751a93b531"><enum>(4)</enum><header>Consent</header><text>The Secretary shall obtain consent from the landowner and eligible entity, if applicable, for any subordination, exchange, modification, or termination of an interest in eligible land, or portion of such an interest, under this subsection.</text></paragraph><paragraph id="iddc6a301f9d78479aa765a167751819c0"><enum>(5)</enum><header>Notice</header><text>Not less than 90 days before taking any termination action described in paragraph (3), the Secretary shall provide written notice of that action to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate.</text></paragraph></subsection><subsection id="idc2034c93a21e4b509ae1e462f63d0962"><enum>(d)</enum><header>Land enrolled in other programs</header><text>In accordance with section 4(b) of the <short-title>Forest Conservation Easement Program Act of 2023</short-title>, land enrolled in the healthy forests reserve program established under title V of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6571">16 U.S.C. 6571 et seq.</external-xref>) on the day before the date of enactment of this section shall be considered enrolled in the program.</text></subsection><subsection id="idbb1145dcb964493d845488a282eeef2b"><enum>(e)</enum><header>Program eligibility</header><text>Sections 1001 through 1001F shall not apply to owners of eligible land for the purposes of determining eligibility for the program.</text></subsection><subsection id="id83ac37a62aa34a39b682fffb329d29e1"><enum>(f)</enum><header>Streamlined enrollment process</header><text>The Secretary shall provide for a streamlined application and enrollment process for determining the eligibility of forest landowners for the program.</text></subsection><subsection id="id76587e32bb1f4df0b4cdd2ee2554cecc"><enum>(g)</enum><header>Environmental services market</header><text>The Secretary may not prohibit through a contract, easement, or agreement under the program a participant in the program from participating in, and receiving compensation from, an environmental services market if 1 of the purposes of the environmental services market is the facilitation of additional conservation benefits that are consistent with the purposes of the program.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id3a2c2a1c4dce4932958cc131beaf687f"><enum>1267E.</enum><header>Funding</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this subtitle $100,000,000 for each of fiscal years 2024 through 2028.</text></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id1E9FC545B2A348709B99287589665BB5"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="idB80E476338214DEBA39F54880295DF1F"><enum>(1)</enum><text>Section 1201(a) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3801">16 U.S.C. 3801(a)</external-xref>) is amended, in the matter preceding paragraph (1), by striking <quote>subtitles A through I:</quote> and inserting <quote>subtitles A through J:</quote>.</text></paragraph><paragraph id="id3994F31DB07E41D7BBDC0F602864FF5C"><enum>(2)</enum><text>Section 1241(e)(1) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3841">16 U.S.C. 3841(e)(1)</external-xref>) is amended by striking <quote>subtitle I</quote> and inserting <quote>subtitle J</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE66C354980724EF4B8A7417C5E4D2E45"><enum>(3)</enum><text>Section 1244(d) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3844">16 U.S.C. 3844(d)</external-xref>) is amended by striking <quote>I.</quote> and inserting <quote>J.</quote>.</text></paragraph></subsection></section><section id="id1ebdded3c1e5472c886c335fcdd06adc"><enum>3.</enum><header>Healthy Forests Reserve Program</header><subsection id="id2e8ea53bf40e48999c6b4720bf25d783"><enum>(a)</enum><header>Repeal</header><text>Title V of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6571">16 U.S.C. 6571 et seq.</external-xref>) is repealed.</text></subsection><subsection id="id49d789a9e6814a078075080e4e827eb7"><enum>(b)</enum><header>Transitional provisions</header><paragraph id="id5c9afeac4b3341e388f0b4a0c7032960"><enum>(1)</enum><header>Effect on existing contracts, agreements, and easements</header><text>The repeal made by subsection (a) shall not affect the validity or terms of any contract, agreement, or easement entered into by the Secretary of Agriculture under title V of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6571">16 U.S.C. 6571 et seq.</external-xref>) before the date of enactment of this Act, or any payments required to be made in connection with the contract, agreement, or easement.</text></paragraph><paragraph id="id23882f7d3d234f90b396d6326f01d2de"><enum>(2)</enum><header>Funding</header><subparagraph id="idb5a2d90149c04d3a98cd7d18b81d822b"><enum>(A)</enum><header>Use of prior year funds</header><text>Notwithstanding the repeal made by subsection (a), any funds made available from the Commodity Credit Corporation to carry out the healthy forests reserve program established under title V of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6571">16 U.S.C. 6571 et seq.</external-xref>) (as in effect on the day before the date of enactment of this Act) shall be made available to carry out contracts, agreements, or easements referred to in paragraph (1) that were entered into prior to the date of enactment of this Act, subject to the condition that no such contract, agreement, or easement may be modified so as to increase the amount of any payment received.</text></subparagraph><subparagraph id="id7214716ba0fd47b9a23cf8a5edbe67f5"><enum>(B)</enum><header>Other</header><text>The Secretary of Agriculture may use funds made available to carry out the forest conservation easement program established under subtitle I of the Food Security Act of 1985 to continue to carry out contracts, agreements, or easements referred to in paragraph (1) using the provisions of law (including regulations) applicable to those contracts, agreements, and easements as in existence on the day before the date of enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="idE89A3989B0154B13B1CC5F32EA63EE4A"><enum>(c)</enum><header>Conforming amendments</header><paragraph id="idF05B2A63DE384293809C4F4BBC1E3835"><enum>(1)</enum><text>The table of contents in section 1(b) of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/148">Public Law 108–148</external-xref>; 117 Stat. 1887) is amended by striking the items relating to title V.</text></paragraph><paragraph id="idFE6952E6258E4E7AB155EB563DB979B9"><enum>(2)</enum><text>Section 1271A(1) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3871a">16 U.S.C.
