BILL</legis-type><official-title>To ensure transparent and competitive transportation fuel markets in order to protect consumers from unwarranted price increases. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transportation Fuel Market Transparency Act</short-title></quote>.</text></section><section id="id92A89E693A9B471A93DF038ADCE8474D"><enum>2.</enum><header>Amendments to the prohibitions on market manipulation and false information provisions of the Energy Independence and Security Act of 2007</header><subsection id="id8AC1430C42A04ACA83AD5FFC677E7099"><enum>(a)</enum><header>Application to transportation fuel</header><text>Subtitle B of title VIII of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17301">42 U.S.C. 17301 et seq.</external-xref>) is amended—</text><paragraph id="id107BBE4FC6054C79915AD0B56F3FFFCB"><enum>(1)</enum><text>in section 811, by striking <quote>gasoline or petroleum distillates</quote> and inserting <quote>or transportation fuel</quote>;</text></paragraph><paragraph id="idC7CE1046EBFE44328D9176E58E512737"><enum>(2)</enum><text>in section 812—</text><subparagraph id="id97D306E9B2C24645A04015C524DED87B"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>gasoline or petroleum distillates</quote> and inserting <quote>or transportation fuel</quote>; and</text></subparagraph><subparagraph id="idBF63EE8F66F4422F9FD7CF2C6CCB06E2"><enum>(B)</enum><text>in paragraph (3), by striking <quote>, gasoline, or petroleum distillates</quote> and inserting <quote>or transportation fuel</quote>; and</text></subparagraph></paragraph><paragraph id="id755FFC554A6743089381E6764F84C6B1"><enum>(3)</enum><text>by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDB925E9A154C43A884BE86F0EA424059"><section id="id068419328BF440C28A2890E92654FC7E"><enum>816.</enum><header>Definition of transportation fuel</header><text display-inline="no-display-inline">In this subtitle, the term <quote>transportation fuel</quote> includes gasoline, distillate fuels (including heating oil), jet fuel, aviation gasoline, and biofuel (including ethanol, biomass-based diesel and distillates, and renewable blending components).</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id89EBA1DE5C53417083AF88283BEFE653"><enum>(b)</enum><header>Prohibition on false information</header><text>Section 812 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17302">42 U.S.C. 17302</external-xref>) is amended—</text><paragraph id="id9FD0CDA2D1684260A59BC3A4516BC94E"><enum>(1)</enum><text>in the matter preceding paragraph (1)—</text><subparagraph id="id74E8FDB4C5484FF095157F90C4E97EDC"><enum>(A)</enum><text>by striking <quote>wholesale</quote> and inserting <quote>supply of, operational actions related to, output related to, or wholesale</quote>; and</text></subparagraph><subparagraph id="idf4063d2f570847a288f68df41df4dec4"><enum>(B)</enum><text>by striking <quote>to a Federal department or agency</quote>;</text></subparagraph></paragraph><paragraph id="id485213FFF1254FBAA3449D22F5E60089"><enum>(2)</enum><text>in paragraph (1), by adding <quote>and</quote> at the end;</text></paragraph><paragraph id="id709F6EF1E58845358E11F2B65959327D"><enum>(3)</enum><text>by striking paragraph (2) and redesignating paragraph (3), as amended by subsection (a), as paragraph (2); and</text></paragraph><paragraph id="id3FD36C739BA64A1583AC0AAA8B410683"><enum>(4)</enum><text>in paragraph (2), as so redesignated, by striking <quote>the person intended the false or misleading data to affect data compiled by the department or agency</quote> and inserting <quote>the person intended the false or misleading information reported by the person to affect the analyses</quote>.</text></paragraph></subsection><subsection id="id1F5271A16FFF4F14B2E5B171CF7CB1D0"><enum>(c)</enum><header>Enforcement</header><text>Section 813(a) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17303">42 U.S.C. 17303(a)</external-xref>) is amended by striking <quote>This subtitle</quote> and inserting <quote>Except as otherwise provided in section 814, this subtitle</quote>.</text></subsection><subsection id="idAD9F3D1689DD468C95F71FB5CEDC895C"><enum>(d)</enum><header>Penalties</header><text>Section 814(b) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17304">42 U.S.C. 17304(b)</external-xref>) is amended by striking <quote>section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>)</quote> and inserting <quote>section 5(m)(1)(A) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(m)(1)(A)</external-xref>)</quote>.</text></subsection></section><section id="idE6A7040126C440DDAACE04A776136480"><enum>3.</enum><header>Transportation fuel monitoring and enforcement within the Federal Trade Commission</header><subsection id="id8f29f4cfcad34ce0903751d307f0ea8d"><enum>(a)</enum><header>Establishment of the transportation fuel monitoring and enforcement unit</header><paragraph id="id14d0f498bc0944cea4e74b72cfe5b045"><enum>(1)</enum><header>In general</header><text>The Commission shall establish within the Commission the Transportation Fuel Monitoring and Enforcement Unit (in this section referred to as the <quote>Unit</quote>).</text></paragraph><paragraph id="id29a12a867ad840dc9f85b821ed84ea89"><enum>(2)</enum><header>Duties of the unit</header><subparagraph id="id89e1d5d6ddf24099a4ebb52f4d723c7a"><enum>(A)</enum><header>Primary responsibility</header><text>The primary responsibility of the Unit shall be to assist the Commission in protecting the public interest by continuously and comprehensively collecting, monitoring, and analyzing crude oil and transportation fuel market data in order to—</text><clause id="ide0f6f22d04a24f8bbfc2e1fef2cf9456"><enum>(i)</enum><text>support transparent and competitive market practices;</text></clause><clause id="id4b8c4517fedb4ebe96cc123fff073572"><enum>(ii)</enum><text>identify any market manipulation, reporting of false information, use of market power to disadvantage consumers, or other unfair method of competition; and</text></clause><clause id="iddd19fca07011463d904e32c7e45bc61b"><enum>(iii)</enum><text>facilitate enforcement of penalties against persons in violation of relevant statutory prohibitions.</text></clause></subparagraph><subparagraph id="id788c7877faaa4ccaa67e29191f1ab61f"><enum>(B)</enum><header>Specific duties</header><text>In order to carry out the responsibility under subparagraph (A), the Unit shall assist the Commission in carrying out the following duties:</text><clause id="idc740bc23423d449f858b5d4b7dfdc38c"><enum>(i)</enum><text>Receiving, compiling, and analyzing relevant buying and selling activity in order to identify and investigate anomalous market trends and potential market manipulation.</text></clause><clause id="idc99804ca68e547a4953f1744822ed768"><enum>(ii)</enum><text>Gathering evidence of wrongdoing against any person in violation of the statutory prohibitions on market manipulation and false information established in, and consistent with, subtitle B of title VIII of the Energy Independence and Security Act of 2007, as amended by section 2, or any other applicable provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45 et seq.</external-xref>).</text></clause><clause id="id8a4201d2df2b40458b5da23e0a40dcfa"><enum>(iii)</enum><text>Obtaining a data-sharing agreement with the Energy Information Administration that includes the data collected in accordance with section 205(n) of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7135">42 U.S.C. 7135</external-xref>), as amended by section 4.</text></clause><clause id="id353465749b3e4439af397aaad7d8092e"><enum>(iv)</enum><text>Obtaining data-sharing agreements with the Commodities Futures Trading Commission, the Federal Energy Regulatory Commission, and as necessary and practicable, State energy offices or commissions, and relevant public and private data sources that will allow the Commission to receive and archive information on—</text><subclause id="id1827a60173064f659758ae02ce49d437"><enum>(I)</enum><text>crude oil and transportation fuel buying and selling activity;</text></subclause><subclause id="idbb1a91b35dfa4efd9263af2b56a19d5d"><enum>(II)</enum><text>individual physical and financial market positions of market participants regarding crude oil and transportation fuel;</text></subclause><subclause id="ida44a8578c3f24ff6a3cd82b75961373a"><enum>(III)</enum><text>refinery output, capacity, and inventory levels of crude oil and transportation fuel;</text></subclause><subclause id="id538d0b235068489bb96a41f6b436c179"><enum>(IV)</enum><text>imports and exports of crude oil and transportation fuel within regions and at levels that could impact prices faced by consumers;</text></subclause><subclause id="id600f642b65f242799bc9cda9f27d9246"><enum>(V)</enum><text>public announcements by energy companies of planned pricing or output decisions regarding crude oil and transportation fuel; and</text></subclause><subclause id="ide0a50099512d4149bdad03b17cdf0e55"><enum>(VI)</enum><text>other relevant market information that will facilitate the gathering of evidence described in clause (ii), including sufficient market information necessary to monitor for cross-market manipulations that may include multiple financial and physical market positions.</text></subclause></clause><clause id="idecf32531c6dd4591b92bc43122d3b66e"><enum>(v)</enum><text>Any other information determined appropriate by the Commission to carry out the responsibility under subparagraph (A). </text></clause></subparagraph></paragraph></subsection><subsection id="id6A987CD0E3DB42BDA7A4CA9215F6E17C"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idEEFDCEF0F8DF469881FF00F217FA631B"><enum>(1)</enum><header>Commission</header><text>Other than in subsection (a)(2)(B)(iv), the term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="id2122691756434560a49227e0165cf198"><enum>(2)</enum><header>Transportation fuel</header><text>The term <term>transportation fuel</term> includes gasoline, distillate fuels (including heating oil), jet fuel, aviation gasoline, and biofuel (including ethanol, biomass-based diesel and distillates, and renewable blending components).</text></paragraph></subsection><subsection id="id369cfaff1bd44a4c86b071ca066b3c7e"><enum>(c)</enum><header>Regulations</header><text>Not later than 90 days after the date of enactment of this Act, the Commission shall promulgate regulations to carry out this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id6ec9f72b211940ffa7584d5348feac4c"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Commission such sums as may be necessary for each of fiscal years 2023 through 2028 to carry out this section. </text></subsection></section><section id="idd984d4168d25443eb4e6cdf28258f66d"><enum>4.</enum><header>Transportation fuel market transparency</header><text display-inline="no-display-inline">Section 205 of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7135">42 U.S.C. 7135</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0f33168c0eda4cb9b402c443bdbc0580"><subsection id="id289e37c923b64da28886747ed3aa09b5"><enum>(n)</enum><header>Transportation fuel market transparency</header><paragraph id="id01472966e10c4faab41530203aa33daa"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id747A73092F294F86B53578223AD14ECD"><enum>(A)</enum><header>Energy company</header><text>The term <term>energy company</term> means a person (as defined in section 11(e) of the Energy Supply and Environmental Coordination Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/796">15 U.S.C. 796(e)</external-xref>)) that—</text><clause id="id70cd9001513a40d6810175eeaa07a8c0"><enum>(i)</enum><text>owns or controls commercial amounts of crude oil or transportation fuel; or</text></clause><clause id="ida0ab5b0db18a4e4394691a23cb5f7f27"><enum>(ii)</enum><text>is engaged in—</text><subclause id="idc0f73c7476224b41b595ac0ea0fdd2da"><enum>(I)</enum><text>exploration for, or development of, crude oil;</text></subclause><subclause id="id8024c4c24c6c47ec93a760c03964be70"><enum>(II)</enum><text>extraction of crude oil;</text></subclause><subclause id="ide9a666d9cf454c6182b95365014d9afd"><enum>(III)</enum><text>refining or otherwise processing crude oil or transportation fuel;</text></subclause><subclause id="id1c4645f8f3f643ec8fe01e8e7e5b25ec"><enum>(IV)</enum><text>commercial storage of crude oil or transportation fuel;</text></subclause><subclause id="idfd00b13237904fa58ac7e59b6b35638b"><enum>(V)</enum><text>transportation by any means of commercial amounts of crude oil or transportation fuel; or</text></subclause><subclause id="idfa67b2a86a7e4f8c97b6d5726571921b"><enum>(VI)</enum><text>wholesale or retail distribution of crude oil or transportation fuel.</text></subclause></clause></subparagraph><subparagraph id="id61e5982e296e49a78b381cb4433cb420"><enum>(B)</enum><header>Transportation fuel</header><text>The term <term>transportation fuel</term> means—</text><clause id="idDDE34E2A867943C79D1599CBEC8DD9EA"><enum>(i)</enum><text>gasoline;</text></clause><clause id="id17E168961FAB4B4FB94ABDB8F9038B0E"><enum>(ii)</enum><text>distillate fuels, including heating oil;</text></clause><clause id="idDA8FC11DD137461084E2844D6D5A7947"><enum>(iii)</enum><text>jet fuel;</text></clause><clause id="id418FEAB5E9F746E3BD5FCF603197DDBC"><enum>(iv)</enum><text>aviation gasoline; and </text></clause><clause id="idCFC0049DCBCD4E92AD3D8D155A84B5AD"><enum>(v)</enum><text>biofuel, including ethanol, biomass-based diesel and distillates, and renewable blending components.</text></clause></subparagraph></paragraph><paragraph id="idf7955b54ba27493f941f17b306d5c65a"><enum>(2)</enum><header>Purpose</header><text>The purpose of this subsection is to collect data necessary to facilitate transparent and competitive transportation fuel markets, determine adherence to relevant international sanctions, and protect consumers.</text></paragraph><paragraph id="id164885b8bfcc48249e5741b1872a9cb3"><enum>(3)</enum><header>Surveys</header><subparagraph id="idBB7FB4F980BB4A86B77259A72D8C327F"><enum>(A)</enum><header>In general</header><text>The Administrator shall conduct surveys of energy companies to collect detailed and timely information on United States crude oil and transportation fuel markets.</text></subparagraph><subparagraph id="id4440c5eca8024a30b375497ffbd2d81e"><enum>(B)</enum><header>Exemption</header><text>The Administrator shall exempt an energy company from participating in the surveys conducted under subparagraph (A) if the energy company has a de minimis market presence or impact, as determined by the Administrator. </text></subparagraph></paragraph><paragraph id="id495758c34ad146188600a685524441b8"><enum>(4)</enum><header>Data collected</header><subparagraph id="idf61e442151274111b14f84df94c6e7db"><enum>(A)</enum><header>In general</header><text>The surveys conducted under paragraph (3) shall collect information on a national, regional, State, and energy company basis.</text></subparagraph><subparagraph id="id56ca0289ec1d45099aed9fbde3c0a02a"><enum>(B)</enum><header>Information</header><text>The surveys conducted under paragraph (3) shall collect the following information with respect to crude oil and transportation fuel, as applicable:</text><clause id="ida97ddb98c5464866927101dac2bc4fc6"><enum>(i)</enum><text>The quantity of crude oil and transportation fuel imported and exported.</text></clause><clause id="id0d8b2c27658d4deb93b2cdd8d27a5e5f"><enum>(ii)</enum><text>The quantity of crude oil and transportation fuel refined, stored, and transported.</text></clause><clause id="ideb5a6020e38a42368afa0ac96b9aaf58"><enum>(iii)</enum><text>The quantity of crude oil and transportation fuel entering final retail and commercial commerce.</text></clause><clause id="idbd2fa6f846f84020940712128f671dab"><enum>(iv)</enum><text>The quantity of crude oil and transportation fuel purchased and sold at any upstream point between energy companies, including off-exchange bilateral sales and sales between subsidiaries of the same energy company.</text></clause><clause id="ide2b65681e30d4e5e852daf16151578f0"><enum>(v)</enum><text>Market price data for the transactions described in clauses (i) through (iv).</text></clause><clause id="id37b25cd8cb3c4eafba6319936e4f6bf6"><enum>(vi)</enum><text>Submissions to relevant price reporting entities.</text></clause><clause id="id893eba556c2140b6a513597643f8dfe2"><enum>(vii)</enum><text>Any other such data, analyses, or evaluations that the Administrator determines is necessary to achieve the purpose described in paragraph (2).</text></clause></subparagraph><subparagraph id="id76a8f71f7c89430ea73a50cbd8b083a4"><enum>(C)</enum><header>Origin of fuel</header><text>In obtaining the information described in subparagraph (B), the Administrator shall, to the maximum extent practicable, track and publish the country of original production of crude oil and transportation fuel that may have been resold, refined, blended, stored, or otherwise been exchanged or sold before being imported or exported into the United States.</text></subparagraph><subparagraph id="id470808fad11c427f9b9a68147658b29a"><enum>(D)</enum><header>Other sources</header><text>The Administrator may, when practicable and determined reliable by the Administrator, obtain information described in subparagraph (B) from private price publishers and providers of trade processing services.</text></subparagraph></paragraph><paragraph id="idab325eb919ba4b0ba3174ea0285071ae"><enum>(5)</enum><header>Minimizing reporting burdens</header><text>The Administrator shall seek to minimize any burdens on energy companies in reporting information to the Administrator, including by automating data submission practices for data collected under the surveys conducted under paragraph (3). </text></paragraph><paragraph id="id7702ce020c774c77a58d0e5266d282e6"><enum>(6)</enum><header>Public distribution</header><subparagraph id="id72f3f1f23f5a4c10803c3e46450adcf6"><enum>(A)</enum><header>In general</header><text>To the maximum extent practicable, subject to this paragraph, the Administrator shall consistently and promptly make publicly available analyses of the results of the data collected pursuant to this subsection in a form and manner easily adaptable for public use and machine analysis.</text></subparagraph><subparagraph id="id16fd94d1f84841a1908bc90f9893e35a"><enum>(B)</enum><header>Geographical specificity</header><text>Analyses published under subparagraph (A)—</text><clause id="id189b13b6ba1b4ffd8f8b9cb60557d512"><enum>(i)</enum><text>shall be geographically specific enough to provide meaningful differentiation between fuel markets; and</text></clause><clause id="id49d66b42fcfa4766b737f49b0d140e34"><enum>(ii)</enum><text>shall not organize geographical data in the form of Petroleum Administration for Defense Districts or other geographic aggregations lacking sufficient resolution to ascertain regionally specific market trends or disparities.</text></clause></subparagraph><subparagraph id="idd6a6063d7bdd4012b5966e12ac9974e2"><enum>(C)</enum><header>Nondisclosure</header><text>Any analysis published under subparagraph (A) shall not disclose matters exempted from mandatory disclosure under section 552(b) of title 5, United States Code.</text></subparagraph></paragraph><paragraph id="idcda6452eea2445ac894d015cabae4d7e"><enum>(7)</enum><header>Data-sharing agreements</header><subparagraph id="id73107a2260044edab57ba8311cfbbba6"><enum>(A)</enum><header>Federal Trade Commission</header><text>Notwithstanding subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Confidential Information Protection and Statistical Efficiency Act of 2018</quote>), not later than 1 year after the date of enactment of this subsection, the Administrator shall enter into a data-sharing agreement with the Federal Trade Commission that shall allow any information collected pursuant to this subsection to be requested by and transferred to the Federal Trade Commission without limitation or delay.</text></subparagraph><subparagraph id="idc9a25e52f18b43bdac30c7e7d60671f5"><enum>(B)</enum><header>Other Federal agencies</header><text>The Administrator may enter into data-sharing agreements with other Federal agencies that have energy-related policy decision-making responsibilities, including the Commodity Futures Trading Commission, the Federal Energy Regulatory Commission, and the Securities and Exchange Commission.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block><quoted-block style="OLC" display-inline="no-display-inline" id="ida01979412f4a436eb2b946c6b74a0205"><paragraph id="id282bd5b76f13410297c3f295f91ac53e"><enum>(9)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Administrator to carry out this section such sums as are necessary for each of fiscal years 2023 through 2028.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id66CA2FEB1D61412F856D5E0749E74612" committee-id="SSCM00"><enum>5.</enum><header>Report on FTC enforcement actions based on the market manipulation and false information provisions of the Energy Independence and Security Act of 2007</header><subsection id="id1360BA5D4F1041DE85AC343C5FB69322" committee-id="SSCM00"><enum>(a)</enum><header>Report</header><text>Not later than 90 days after the date of enactment of this Act, the Federal Trade Commission (in this section referred to as the <term>Commission</term>) shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report regarding the enforcement actions of the Commission against prohibited market manipulation or false information under section 813 of the Energy Independence and Security Act of 2007 ( <external-xref legal-doc="usc" parsable-cite="usc/42/17303">42 U.S.C. 17303</external-xref>) during the calendar year commencing on January 1, 2022, and the preceding 5 calendar years.</text></subsection><subsection id="idFA2933763E3747DEAF8233572E0DADF8" committee-id="SSCM00"><enum>(b)</enum><header>Report contents</header><text>The report required under subsection (a) shall include, for each calendar year—</text><paragraph id="id66a2842684b040d8b9979b82436fbbcf" committee-id="SSCM00"><enum>(1)</enum><text>the number of enforcement actions initiated; and</text></paragraph><paragraph id="id0DDD26E82ADD4DBB86FE95E8DE7071D2" committee-id="SSCM00"><enum>(2)</enum><text>the number of enforcement actions completed, including—</text><subparagraph id="id9900EB0E250241B1A5DD8A68CC4608C2" committee-id="SSCM00"><enum>(A)</enum><text>the number of such actions that resulted in a violation of section 811 or 812 of the Energy Independence and Security Act of 2007 ( <external-xref legal-doc="usc" parsable-cite="usc/42/17301">42 U.S.C. 17301</external-xref>, 17302), including—</text><clause id="id24021936547D476691BF6E07E5E482C6" committee-id="SSCM00"><enum>(i)</enum><text>the average number of violations per enforcement action;</text></clause><clause id="idCFCE288A521B4D5299B3B7C0C2DFDCA5" committee-id="SSCM00"><enum>(ii)</enum><text>the average civil penalty assessed in each enforcement action; and</text></clause><clause id="id15B7754FA6C34E00B0D416B37B737D2F" committee-id="SSCM00"><enum>(iii)</enum><text>the aggregate civil penalties collected by the Commission during the calendar year; and</text></clause></subparagraph><subparagraph id="id93DCA5EE0697440F886CB36ABBC95401" committee-id="SSCM00"><enum>(B)</enum><text>the number of such actions that resulted in a finding of no violation of such section 811 or 812.</text></subparagraph></paragraph></subsection></section><section id="idBEC7FD6154F946E380E9D13C20013458"
