which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Research Facilities Act and the Agricultural Research, Extension, and Education Reform Act of 1998 to address deferred maintenance at agricultural research facilities, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Augmenting Research and Educational Sites to Ensure Agriculture Remains Cutting-Edge and Helpful Act</short-title></quote> or the <quote><short-title>AG RESEARCH Act</short-title></quote>.</text></section><section id="id37E35E2718624AE89CF47173E691A8DB"><enum>2.</enum><header>Agricultural research facilities</header><subsection id="id1D69137A2DDE4AA393D95DE841145C5D"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="id73f06a1ee8e3404bab152c30b775cc31"><enum>(1)</enum><text>in 2019, agriculture and related industries—</text><subparagraph id="idE58974E244A84B9D824733277A99A20B"><enum>(A)</enum><text>contributed $1,109,000,000,000 to the gross domestic product of the United States (5.2 percent of the total gross domestic product of the United States); and</text></subparagraph><subparagraph id="id46DDB27F401D4F4BA18136CA93B750EB"><enum>(B)</enum><text>provided 22,200,000 jobs domestically (10.9 percent of total employment in the United States);</text></subparagraph></paragraph><paragraph id="id102323acd46c46e4b6cdcdfaa8051c6c"><enum>(2)</enum><text>the National Institute of Food and Agriculture provides more than $1,700,000,000 in research funding each year to schools of agriculture;</text></paragraph><paragraph id="id032469e434d44b4780e4cfc6e99fc533"><enum>(3)</enum><text>a study published in 2015 found that deferred maintenance needs at 91 schools of agriculture across the United States totaled $8,400,000,000, with a total replacement cost of $29,000,000,000; </text></paragraph><paragraph id="id22ad548c9fd64126899f49104cc2415d"><enum>(4)</enum><text>a study published in 2021 found that deferred maintenance needs at schools of agriculture across the United States had increased to $11,500,000,000, with a total replacement cost of $38,100,000,000; and</text></paragraph><paragraph id="id023daaefcc234baebce0ef8f93817a83"><enum>(5)</enum><text>infrastructure investments must be made at schools of agriculture to ensure that United States agricultural research remains globally competitive.</text></paragraph></subsection><subsection id="id02C62C6D71544953A6906B313F17A29D"><enum>(b)</enum><header>Evaluation of proposals</header><text>Section 3(d) of the Research Facilities Act (<external-xref legal-doc="usc" parsable-cite="usc/7/390a">7 U.S.C. 390a(d)</external-xref>) is amended—</text><paragraph id="id24D6E07F21904C7EA3E5A434EBB19B34"><enum>(1)</enum><text>by redesignating paragraphs (1) and (2) as paragraphs (2) and (3), respectively; and</text></paragraph><paragraph id="idCD82BDA612664782AE5E101A6C8A7EEF"><enum>(2)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF3FFEA96F2BA49EC86E3145D795163B8"><paragraph id="id52EE6B0DC0AB4D24861890E6A83F6EA4"><enum>(1)</enum><text>review the proposal in consultation with representatives of National Institute of Food and Agriculture peer review panels;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idEF46DCD3B9744809A44E4BC46298E58E"><enum>(c)</enum><header>Grants for agricultural research facilities</header><text>Section 4 of the Research Facilities Act (<external-xref legal-doc="usc" parsable-cite="usc/7/390b">7 U.S.C. 390b</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id33345336BCCC42B0AD9D60B33E43DBB5"><section id="id06864517AE9D48CF86ED8E509CF6DD91"><enum>4.</enum><header>Grants for agricultural research facilities</header><subsection id="idE69F9DBD2CC14D2C82C8DD1B743DF9E7"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to assist agricultural research facilities in efforts to alter or repair those facilities or equipment of the facilities necessary for conducting agricultural research.</text></subsection><subsection id="id146462DA0FA746ABBA2E8F1CB83A6DE9"><enum>(b)</enum><header>Grant program</header><paragraph id="id97ED7DC8527D40CFB77BF22B904BF3FA"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish in the National Institute of Food and Agriculture a competitive grant program to provide to agricultural research facilities the Federal share of the cost of the construction, alteration, acquisition, modernization, renovation, or remodeling of—</text><subparagraph id="idB9B5D7AA14CE4746BC2A5E87F7C6CB63"><enum>(A)</enum><text>the agricultural research facilities; or</text></subparagraph><subparagraph id="id1EDB4C29D243453AA9DE2C2752DFE646"><enum>(B)</enum><text>equipment of the agricultural research facilities necessary for conducting agricultural research.</text></subparagraph></paragraph><paragraph id="id99A8A9AE773849C2B4F1A73945283F52"><enum>(2)</enum><header>Secretarial waiver</header><text>Notwithstanding section 3(c)(2)(A), the Secretary may provide that the Federal share described in paragraph (1) is up to 100 percent of the costs described in that paragraph on a case-by-case basis, as the Secretary determines to be appropriate.</text></paragraph></subsection><subsection id="id86B06358E628456797F891ABEC0534C9"><enum>(c)</enum><header>Requirements</header><paragraph id="id4E46DFAEF5CA40E69DA3CFA331EF7134"><enum>(1)</enum><header>Amount; terms and conditions</header><text>Grants awarded under this section shall be in such amounts and under such terms and conditions as the Secretary determines are necessary to carry out the purpose of this section.</text></paragraph><paragraph id="id18E188837E4447ABB740543E76AD9AF5"><enum>(2)</enum><header>Equitable distribution</header><text>To the maximum extent practicable, grants shall be awarded under this section to ensure—</text><subparagraph id="id030FD2B802794419A5059F4C8DA777E6"><enum>(A)</enum><text>an equitable geographic distribution of funds;</text></subparagraph><subparagraph id="id9677ADCCB2E3454F9E64696549B28847"><enum>(B)</enum><text>an equitable distribution of funds to diverse institutions; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide0018cf2df97405c9602affb7dda7072"><enum>(C)</enum><text display-inline="yes-display-inline">an equitable distribution of funds to institutions with diverse areas of study within agricultural science; and</text></subparagraph><subparagraph id="id2F3FB772DAF047FCA8AFB12A6F665041"><enum>(D)</enum><text>an equitable distribution of funds to agricultural research facilities of various sizes.</text></subparagraph></paragraph><paragraph id="idD83C5971B2E045959C11A3C94D8D0D3E"><enum>(3)</enum><header>Limitation</header><text>Not greater than 20 percent of amounts made available to carry out this section shall be awarded to projects in any 1 State.</text></paragraph><paragraph id="idBD52C22C0539470593511DDD80206A0D"><enum>(4)</enum><header>Administration</header><text>In carrying out this section, the Secretary shall establish procedures for—</text><subparagraph id="idFC1BF53F70224EF58AFE5781F9D0470B"><enum>(A)</enum><text>the submission of proposals for competitive grants; and</text></subparagraph><subparagraph id="id36D861BB15ED4ACEB86F7918886F7BF5"><enum>(B)</enum><text>in consultation with representatives of National Institute of Food and Agriculture peer review panels, the review and selection of proposals submitted under subparagraph (A).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id50E4432D384B464E9AF9F7522338D08A"><enum>(d)</enum><header>Funding</header><text>Section 6 of the Research Facilities Act (<external-xref legal-doc="usc" parsable-cite="usc/7/390d">7 U.S.C. 390d</external-xref>) is amended—</text><paragraph id="id1284278E65AA4CAE93F6CCA0DCEB1A00"><enum>(1)</enum><text>by striking the section designation and heading and all that follows through the end of subsection (a) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE07FB24BF7E7483597E52DF4DC6EE140"><section id="idABF0CB6A32CC40FFB3E3453D64646D2D"><enum>6.</enum><header>Funding and limitations on use of funds</header><subsection id="idE8B66FB984954BA2A9EB14A3443B1E3F"><enum>(a)</enum><header>Funding</header><paragraph commented="no" display-inline="no-display-inline" id="id56a707d2f5d648588af95b1c2eee223a"><enum>(1)</enum><header display-inline="yes-display-inline">Mandatory funding</header><subparagraph id="idB23A6E735C054F3B9204016DC3C00EA1"><enum>(A)</enum><header>In general</header><text>Subject to subsections (b) through (d), but notwithstanding any other provision of law, on October 1, 2023, and on each October 1 thereafter through October 1, 2027, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary to carry out section 4 $1,000,000,000, to remain available until expended.</text></subparagraph><subparagraph id="IDDDDB9AFAA4B2435EB9C6E3EA8D700BC2"><enum>(B)</enum><header>Receipt and acceptance</header><text>The Secretary shall be entitled to receive, shall accept, and shall use to carry out section 4 the funds transferred under paragraph (1), without further appropriation. <added-phrase reported-display-style="italic"></added-phrase></text></subparagraph></paragraph><paragraph id="id60F8A5888CFC4CE7B22515BB0B699B11"><enum>(2)</enum><header>Authorization of appropriations</header><text>In addition to amounts made available under paragraph (1), subject to subsections (b) through (d), there is authorized to be appropriated to the Secretary not more than $3,000,000,000 for each of fiscal years 2024 through 2028, to remain available until expended, for the study, plan, design, structure, and related costs of agricultural research facilities under this Act.</text></paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id76DB778327B740CAB0081A29FB5504F2"><enum>(2)</enum><text>in subsection (b), by inserting <quote>Federal</quote> before <quote>administration</quote>. </text></paragraph></subsection></section><section id="idD7C4CB272AD043928D2CA3A795F75E23"><enum>3.</enum><header>Agricultural research centers</header><subsection id="id32BB5E2A6B4C436EA7554B68FD84E553"><enum>(a)</enum><header>Finding</header><text>Congress finds that the Agricultural Research Service Capital Investment Strategy dated April 2012 indicates that research facilities of the Agricultural Research Services have more than $1,000,000,000 in deferred maintenance.</text></subsection><subsection id="id1A61350ECF7E483B80974FB0F9DC9D44"><enum>(b)</enum><header>Direct funding for deferred maintenance at ARS research facilities</header><text>Title IV of the Agricultural Research, Extension, and Education Reform Act of 1998 is amended by inserting before section 404 (<external-xref legal-doc="usc" parsable-cite="usc/7/7624">7 U.S.C. 7624</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6B3720E42DF94F938650D72E7589DE11"><section id="id8EDBDCAACB2D4D3D8CFF8DEEB14AB5C9"><enum>401.</enum><header>Direct funding for deferred maintenance at ARS research facilities</header><subsection id="id0FF887BCB6B24D5698AF717230421992"><enum>(a)</enum><header>In general</header><text>Using amounts made available under subsection (c), the Secretary shall provide direct payments to research facilities of the Agricultural Research Service for the purpose of addressing deferred maintenance.</text></subsection><subsection id="id9AC939D2E51C47A9848EA82303C04BD0"><enum>(b)</enum><header>Priority</header><text>In providing direct payments under subsection (a), the Secretary shall give priority to the most critical structures in accordance with the Agricultural Research Service Capital Investment Strategy dated April 2012.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id30F5B42A7F314FAAB08B2E2B77F5AC03"><enum>(c)</enum><header display-inline="yes-display-inline">Funding</header><paragraph id="idB4B5DDACEE204576AE8F708965F52560"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, on October 1, 2023, and on each October 1 thereafter through October 1, 2027, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary to carry out this section $200,000,000, to remain available until expended.</text></paragraph><paragraph id="id3D5DB84DC8AA46BABDF4989F6716CA33"><enum>(2)</enum><header>Receipt and acceptance</header><text>The Secretary shall be entitled to receive, shall accept, and shall use to carry out this section the funds transferred under paragraph (1), without further appropriation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
