<official-title>To amend the Food Security Act of 1985 to create permanent payments within the environmental quality incentives program for soil health practices and carbon sequestration monitoring, and for other purposes.</official-title>

<section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Healthy Soils Healthy Climate Act of 2023</short-title></quote>.</text></section> <section section-type="subsequent-section" id="idAE212C109C254DEF9FFB100865D116E0"><enum>2.</enum><header>Amendments to the Food Security Act of 1985</header> <subsection id="id36d0a1fa5fa84c7ab29bf1407ae2c675"><enum>(a)</enum><header>Increased payments for high-Priority practices</header><text>Section 1240B(d)(7)(A) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-2">16 U.S.C. 3839aa–2(d)(7)(A)</external-xref>) is amended—</text>
<paragraph id="idd3bd515ad9754332a986f2c68dd5a6b6"><enum>(1)</enum><text>in clause (iii), by striking <quote>or</quote> at the end;</text></paragraph> <paragraph id="id36962ad843ad413db6197a85289feaa6"><enum>(2)</enum><text>in clause (iv), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph>
<paragraph id="idda0230c6cf714b0caa638791f5bbac7f"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id101cb5cdf1584e78a237994bbc8349ac"> <clause id="id7d63b47ba50e4490ab468b2da1dc306d"><enum>(v)</enum><text>increases soil organic carbon levels.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="id144d352c0a954c56b6b459a736cf41c7"><enum>(b)</enum><header>Incentive payments for soil health practices and carbon sequestration monitoring</header>
<paragraph id="idfe46d91904024e73b77d49615c8817d8"><enum>(1)</enum><header>In general</header><text>Section 1240B of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-2">16 U.S.C. 3839aa–2</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id8971f6e7bce44e0ea6e6f44ffe0dfedc"> <subsection id="id15325357df7c499eaba22f1c588296c6"><enum>(k)</enum><header>Incentive payments for soil health practices and carbon sequestration monitoring</header> <paragraph id="iddca237710d7f4eba8e136abe692d487c"><enum>(1)</enum><header>Provision of payments</header><text>The Secretary shall provide incentive payments under this subsection to producers to adopt practices designed to increase soil organic carbon levels.</text></paragraph>
<paragraph id="id578a4a9330ff4bbaa9d650f319cd31e1"><enum>(2)</enum><header>Requirements</header><text>In providing the incentive payments under paragraph (1), the Secretary shall establish—</text> <subparagraph id="id715a6d5b2a804eae94b1e26c8109bd44"><enum>(A)</enum><text>payments to provide an incentive for the use of practices across a variety of geographic regions;</text></subparagraph>
<subparagraph id="id56d4026ea11b465292d628cfea363298"><enum>(B)</enum><text>regionally appropriate protocols for measuring soil organic carbon levels and soil microbiology levels before and after treatment under this subsection to measure gains in soil health as a result of the practices; and</text></subparagraph> <subparagraph id="id391f824c41b24877b48f442a1bfe6973"><enum>(C)</enum><text>protocols and record keeping standards for in-field sampling to ensure consistency and the development of new carbon and ecosystem services markets.</text></subparagraph></paragraph>
<paragraph id="id0FC45CAB85A247CF9C62D3F287F9AAFB"><enum>(3)</enum><header>Priority</header><text>In providing incentive payments under paragraph (1), the Secretary shall give priority to providing the payments to—</text> <subparagraph id="id06F2B418B73645CF93E0868B9A7CD9B6"><enum>(A)</enum><text>small producers, as determined by the Secretary;</text></subparagraph>
<subparagraph id="idF9C940D1BC2C4C5C8BE052976F257D2C"><enum>(B)</enum><text>producers in rural areas, as determined by the Secretary; and</text></subparagraph> <subparagraph id="id75182C446EEF493B80D62662022AC65C"><enum>(C)</enum><text>socially disadvantaged farmers, as determined by the Secretary.</text></subparagraph></paragraph>
<paragraph id="id2ba04840f1c74e0eb72a25de1f4edaca"><enum>(4)</enum><header>Study; report to Congress</header>
<subparagraph id="iddcc68909fd60431ca09f9ff014dda38a"><enum>(A)</enum><header>Study</header><text>Not later than 2 years after the date of enactment of this subsection, and every 2 years thereafter, the Secretary shall conduct a study regarding changes in soil health and soil organic carbon levels as a result of the practices used under this subsection.</text></subparagraph> <subparagraph id="idbb133cc6e2184b9da5c7e83647e2bf7e"><enum>(B)</enum><header>Report to Congress</header><text>Not later than 2 years after the date of enactment of this subsection, and every 2 years thereafter, the Secretary shall submit to Congress a report describing and analyzing the results of the study conducted under subparagraph (A).</text></subparagraph>
<subparagraph id="id8c91e62c1ce6442ea977a1aa25c1b140"><enum>(C)</enum><header>Inclusion</header><text>The report under subparagraph (B) shall include an analysis of—</text> <clause id="id0ab32cbddfc74b5fb4ad40b9bd48a24d"><enum>(i)</enum><text>the effect of various practices on soil organic carbon levels;</text></clause>
<clause id="idbcccd739ac804ac5a094435f221dac6e"><enum>(ii)</enum><text>the extent to which the lessons learned in carrying out this subsection can be transferred to other geographic regions;</text></clause> <clause id="id257187be44234d6fb75ae790585d26d6"><enum>(iii)</enum><text>further data required to substantiate the connection between soil organic carbon levels and crop yield and resiliency, if applicable;</text></clause>
<clause id="idF8157272DCB7442FB61825A719FA59F0"><enum>(iv)</enum><text>the effect of multiple practices on soil organic carbon levels;</text></clause> <clause id="id66e8b744aafa42a5a04d0659ab80b32c"><enum>(v)</enum><text>potential barriers to data collection across a variety of geographic regions; and</text></clause>
<clause id="id000e04e3b48145308819731a4d038292"><enum>(vi)</enum><text>carbon permanence and loss of any sequestered carbon, based on weather, management, and other relevant factors, and the depth of sequestered carbon.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="id1c96aee11a08497c95c36e364cdce31b"><enum>(2)</enum><header>Funding</header><text>Section 1240B(f) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-2">16 U.S.C. 3839aa–2(f)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="id9c49bf6df3204da8a26358fa7db4c298"><enum>(3)</enum><header>Incentive payments for soil health practices and carbon sequestration monitoring</header><text>For each fiscal year for which funds are made available under section 1241(a)(3)(A), of the funds made available for payments under the program, $100,000,000 shall be used to provide incentive payments under subsection (k).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="id4647df5144b84bc7b5037b3bde9ca100"><enum>(c)</enum><header>Priority for soil health and carbon sequestration</header><text>Section 1240B of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-2">16 U.S.C. 3839aa–2</external-xref>) (as amended by subsection (b)(1)) is amended by adding at the end the following:</text>

<subsection id="idDED8A4C365E048F0A6BCB07ECAA31445"><enum>(l)</enum><header>Priority for soil health and carbon sequestration</header>
<paragraph id="id148f1a2c80ec47b6b6cc818f65e30156"><enum>(1)</enum><header>In general</header><text>To the maximum extent feasible, the Secretary shall manage the program to promote practices that enhance soil health and increase soil organic carbon levels.</text></paragraph> <paragraph id="id347f6ecad70c452e94cb5c53cba6bb62"><enum>(2)</enum><header>Soil health and carbon sequestration on eligible land</header><text>The Secretary shall—</text>
<subparagraph id="id325f95e1e8cf4a7087a13cfe21d7607e"><enum>(A)</enum><text>develop ranking and scoring criteria under the program that prioritize soil health practices that score highest in soil carbon sequestration on eligible land; and</text></subparagraph> <subparagraph id="idd655477d37064e3cb5439cc7e67e270b"><enum>(B)</enum><text>develop a soil organic carbon conservation activity plan under the program to measure and monitor sequestration and mitigation improvement levels from the practices described in subparagraph (A), such as cover crops, crop rotation, and improved soil management.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="idf246d11edeea4366b971c6bc59fdd2d3"><enum>(d)</enum><header>Streamlining and coordination</header><text>Section 1240B of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-2">16 U.S.C. 3839aa–2</external-xref>) (as amended by subsection (c)) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id089D38509FBC46EC8A2B714927CA83A0"> <subsection id="id954d0a97fa854749878fd1662443f226"><enum>(m)</enum><header>Streamlining and coordination</header><text>To the maximum extent feasible, the Secretary shall provide for streamlined and coordinated procedures for the program and the conservation stewardship program under subchapter B, including applications, contracting, conservation planning, conservation practices, and related administrative procedures.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="id594b15943cb44203a42f9ec4cccff4f1"><enum>(e)</enum><header>On-Farm conservation innovation trials</header><text>Section 1240H(c) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-8">16 U.S.C. 3839aa–8(c)</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="id5f62e93ae3aa4ac38bc595eb3b7b343d"><enum>(1)</enum><text>in paragraph (2), in the matter preceding subparagraph (A), by striking <quote>2031</quote> and inserting <quote>2023, and $100,000,000 of the funds made available to carry out this subchapter for each of fiscal years 2024 through 2031</quote>; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idb99ddb55d39c47fcb153f51507e27132"><enum>(2)</enum><text>in paragraph (7), in the matter preceding subparagraph (A), by inserting <quote>including not less than 50 percent of the funds made available to carry out this subsection for each of fiscal years 2024 through 2031,</quote> after <quote>subsection,</quote>.</text></paragraph></subsection> <subsection commented="no" id="id93E82B5CAF434E268B4A6B39B917E4FC"><enum>(f)</enum><header>Soil health and carbon science research program at agriculture research stations</header><text>The Secretary of Agriculture shall establish a program—</text>
<paragraph commented="no" id="idD8422FC9C41E42AD80A7F59CB8A2E0C4"><enum>(1)</enum><text>to provide grants to land-grant colleges and universities to conduct research relating to soil health and carbon science, including—</text> <subparagraph id="id2b11159a8c1840e4b758b0d1c6a7e2f4"><enum>(A)</enum><text>the effect of various practices on soil organic carbon levels;</text></subparagraph>
<subparagraph id="id3125ea937d8e4c02bf804e9f84feb965"><enum>(B)</enum><text>the extent to which the lessons learned from the effects described in subparagraph (A) can be transferred to other geographic regions;</text></subparagraph> <subparagraph id="id876d2df5024146d0aa244b00ff6c169c"><enum>(C)</enum><text>the connection between soil organic carbon levels and crop yield and resiliency;</text></subparagraph>
<subparagraph id="ide2a9b6806aaa45b4b9b89ae7181cde1c"><enum>(D)</enum><text>the effect of multiple practices on soil organic carbon levels;</text></subparagraph> <subparagraph id="id0c568e0bc3cf4b56b616e94c37604d3d"><enum>(E)</enum><text>potential barriers to soil health and carbon data collection across a variety of geographic regions; and</text></subparagraph>
<subparagraph id="id1b78f37eaed441879e671f7e1e9a3cbc"><enum>(F)</enum><text>carbon permanence and loss of soil-sequestered carbon, based on weather, management, and other relevant factors, and the depth of sequestered carbon by different practices; and</text></subparagraph></paragraph> <paragraph commented="no" id="idAEE542C397C14C2289D94FE2A2BC8D4D"><enum>(2)</enum><text>to conduct research relating to soil health and carbon science at agriculture research stations of the Department of Agriculture.</text></paragraph></subsection></section>
