which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a commission on long-term care.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id81A38217FD9245BB98597819FB5868DD"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Our Seniors Act</short-title></quote>.</text></section><section id="id03B92D219DDA444D954B9FAEE1A7EE8D"><enum>2.</enum><header>Commission on Long-Term Care</header><subsection id="id9B8EB1084EE649E587D248E2E74DBDAB"><enum>(a)</enum><header>In general</header><text>There is established a commission to be known as the Commission on Long-Term Care (referred to in this section as the <term>Commission</term>).</text></subsection><subsection id="id58A8EE09F2764BE884275A4B8DD5FCA3"><enum>(b)</enum><header>Membership</header><paragraph id="idECEE131F72DE434DBC4A82DB6E1FEE99"><enum>(1)</enum><header>Composition</header><subparagraph id="idA237FAB0C644451DB6F8B3D68363F2D1"><enum>(A)</enum><header>Members</header><text>The Commission shall be composed of 12 members, of whom—</text><clause display-inline="no-display-inline" id="HDDE1F31EAD3B48F482780653487BAD8F"><enum>(i)</enum><text display-inline="yes-display-inline">6 shall be appointed by the President;</text></clause><clause id="H4104BDDBE5BA422BB04223318D9A2A56"><enum>(ii)</enum><text>2 shall be appointed by the Speaker of the House of Representatives;</text></clause><clause id="H99B89E114FE14794BC81D6636FE94FB4"><enum>(iii)</enum><text>1 shall be appointed by the minority leader of the House of Representatives;</text></clause><clause id="H59C5A040A82B4D9BB6D7F17FCE65277A"><enum>(iv)</enum><text>2 shall be appointed by the majority leader of the Senate; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H1C52BC7AC50444F68BF416967443EAA9"><enum>(v)</enum><text>1 shall be appointed by the minority leader of the Senate. </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5167FCC5787648D08ED2A6717595B122"><enum>(B)</enum><header>Qualifications</header><text>Each member appointed under subparagraph (A) shall have experience in one or more of the following areas:</text><clause id="id8594d89c08024bbab9fdafb507aa3846"><enum>(i)</enum><text>Palliative care.</text></clause><clause id="idf6c8a8ad1637462ab4c5f21f98ec5899"><enum>(ii)</enum><text>Hospice care.</text></clause><clause commented="no" display-inline="no-display-inline" id="id1667f8f6f86949a3bcb1d9ab072fbd03"><enum>(iii)</enum><text display-inline="yes-display-inline">Home and community-based services delivery.</text></clause><clause id="id0be962fdde3a4297b3cdd680d06f59d4"><enum>(iv)</enum><text>Labor and workforce development.</text></clause><clause id="id0c6071d445c54a2c8173da6083011a66"><enum>(v)</enum><text>Aging and geriatrics.</text></clause><clause id="ide801a0ef13ed4fa9a54c7e5f89651127"><enum>(vi)</enum><text>Advocating for the disability community.</text></clause><clause id="id533cb1508a94408bb3209f5d25a37f4b"><enum>(vii)</enum><text>Long-term care insurance.</text></clause><clause id="id6335f52bfe7e4a759f55854917ef0855"><enum>(viii)</enum><text>Advocating for patients and caregivers.</text></clause></subparagraph><subparagraph id="H1A5120BA98F242018CC86D382FE44352"><enum>(C)</enum><header>Diversity of qualifications</header><clause id="id12A627D0EF924DC19357C44BE87F559D"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In making appointments to the Commission under subparagraph (A), the President and the congressional leaders shall make every effort to select individuals whose qualifications are not already represented by other members of the Commission.</text></clause><clause id="id58491ABD8E714472BB6610CDA0FB2ADE"><enum>(ii)</enum><header>Representation of all qualification areas</header><text>If no member of the Commission has experience in an area identified in subparagraph (B), the Secretary of Health and Human Services shall appoint an agency detailee or stakeholder representative who has experience in such area to be present for all meetings of the Commission.</text></clause></subparagraph></paragraph><paragraph id="id4BB585CB7E0E46568358BDC2B9C9F9C1"><enum>(2)</enum><header>Date of appointments</header><text>The appointments of the members of the Commission shall be made not later than 90 days after the date of enactment of this Act.</text></paragraph><paragraph id="H06AA1F3B3ACB4D56ACE4CCC34EDAAB22"><enum>(3)</enum><header>Member terms; vacancies</header><subparagraph id="idFCA45EA113D64B17AA101A567452E101"><enum>(A)</enum><header>Member terms</header><text>Members shall be appointed to the Commission for terms of 6 years (in the case of members appointed by the President) and 4 years (in the case of all other members). There shall be no limitation on the number of terms a member may be appointed for.</text></subparagraph><subparagraph commented="no" id="idA62575D8D19F4F23A2FD24EDF19DDBC3"><enum>(B)</enum><header>Vacancies</header><text>Any vacancy in the Commission shall not affect its powers, but shall be filled in the same manner as the original appointment. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA363758EE0AD4CF79684DF170FA99625"><enum>(4)</enum><header>Chairperson</header><text>The President shall select a Chairperson for the Commission from among its members. </text></paragraph></subsection><subsection id="H865B0E71E94349418C361DE87CD1D6AD"><enum>(c)</enum><header>Meetings</header><paragraph id="idCC40A8FD63084E3BB97278D87C463898"><enum>(1)</enum><header>Initial meeting</header><text>Not later than 60 days after the date on which a majority of the members of the Commission have been appointed, the Commission shall hold its first meeting.</text></paragraph><paragraph id="HC40A46FE2B8B45D7A5A9C9889A93ED48"><enum>(2)</enum><header>Meetings</header><text>The Commission shall meet at the call of the Chairperson.</text></paragraph><paragraph id="H60E06B87F8B442E88C5611798FA49D9D"><enum>(3)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum, but a lesser number of members may hold hearings.</text></paragraph></subsection><subsection commented="no" id="idACDA21EA05DE4F5EA4A4DDD46DC2D761"><enum>(d)</enum><header>Duties of the Commission</header><paragraph commented="no" id="id78ECE91002204913A3B6EE9763B8BFB1"><enum>(1)</enum><header>In general</header><text>The Commission shall not later than 1 year after the date of enactment of this Act, and on a yearly basis thereafter, submit policy recommendations to Congress, the President, appropriate Federal agencies, and the public with respect to the following:</text><subparagraph id="idc47333a0d7ae47549b6cf2ac5eb6e6cc"><enum>(A)</enum><text>Long-term care coverage for non-Medicaid eligible population.</text></subparagraph><subparagraph id="idbb9a54e3bff04451b5b820410c19c5b7"><enum>(B)</enum><text>Considerations for aging in place.</text></subparagraph><subparagraph id="idd37459eba2cd4e92917410c89e2c5eb7"><enum>(C)</enum><text>Financing options for long-term care for low and middle income individuals.</text></subparagraph><subparagraph id="id0c28fb78b00f4165a0a35126e746ea8b"><enum>(D)</enum><text>Caregiver supports and workforce stability and preparedness.</text></subparagraph><subparagraph id="id2ae194fa90a2453b971f9fbbc02c5b24"><enum>(E)</enum><text>Access to comprehensive care, including geriatric care as appropriate, coordination of medical and personal care needs, access to palliative care as needed, including both concurrently with curative treatment for serious illness or injury and as hospice end-of-life care.</text></subparagraph><subparagraph id="id6ce8d3f78a794072b6993b880cc15245"><enum>(F)</enum><text>Affordability of services.</text></subparagraph><subparagraph id="idc0285cd8219f40c3aebe57568a5d260b"><enum>(G)</enum><text>Considerations for children and non-senior adults with disabilities.</text></subparagraph><subparagraph id="iddae1ed663f9f4f9593666e004fac511e"><enum>(H)</enum><text>Support for adult children caring for aging parents, including through health benefits, tax credits, and other tax incentives for caregivers who are not able to claim their parents as dependents for tax purposes. </text></subparagraph><subparagraph id="id749d2846df1a4509b23a1e987723cfbe"><enum>(I)</enum><text>Integrating meals, access to basic services, wraparound community services.</text></subparagraph><subparagraph id="id47312a96c6d54411bc71fb806bde40a9"><enum>(J)</enum><text>Reducing hospitalization costs through increased access to home-based services, including with options through the Medicare and Medicaid programs.</text></subparagraph></paragraph><paragraph id="id0AD169777EEA4B0CBF200CEAC34F4CD8"><enum>(2)</enum><header>Interaction with outside groups</header><text>In developing the recommendations under paragraph (1), the Commission shall regularly consult with—</text><subparagraph id="idEB66016630804543B34219CADEA8EAFB"><enum>(A)</enum><text>a wide variety of stakeholder groups;</text></subparagraph><subparagraph id="id9B0392B11BC04C49B48370C9806222CB"><enum>(B)</enum><text>the Medicare Payment Advisory Commission and the Medicaid and CHIP Payment and Access Commission; and</text></subparagraph><subparagraph id="idD7F7B17BA76043C4BF7437DE848576A6"><enum>(C)</enum><text>State and county aging agencies.</text></subparagraph></paragraph><paragraph id="H0BD7FD7270054932B23C079DD1E2388B"><enum>(3)</enum><header>Federal agency response</header><text display-inline="yes-display-inline">Not later than 6 months after the submission of a report required under paragraph (1), any Federal agency that is affected by a recommendation described in the report shall submit to Congress a report containing the response of the Federal agency to the recommendation and the plans of the Federal agency to address the recommendation. </text></paragraph></subsection><subsection commented="no" id="idF85E61F7057B42C7A7886B25791236FC"><enum>(e)</enum><header>Powers of the Commission</header><paragraph commented="no" id="id3F41BA0956F8430BACFFEF398ABF66A6"><enum>(1)</enum><header>In general</header><text>The Commission may hold such hearings, sit and act at such times and places, take such testimony, and receive such evidence as the Commission considers advisable to carry out this Act. The Commission shall have the authority to exercise these powers via video conference or other remote technology as it determines to be appropriate.</text></paragraph><paragraph id="H6374C4725E9F4290B0792B327533DB9F"><enum>(2)</enum><header>Information from federal agencies</header><text>The Commission may secure directly from any Federal department or agency such information as the Commission considers necessary to carry out this Act. Upon request of the Chairperson of the Commission, the head of such department or agency shall furnish such information to the Commission.</text></paragraph><paragraph id="H08457741247A46568138BD980FB46E65"><enum>(3)</enum><header>Postal services</header><text>The Commission may use the United States mails in the same manner and under the same conditions as other departments and agencies of the Federal Government.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF7C350B9CA504484900FE60630B15391"><enum>(4)</enum><header>Gifts</header><text>The Commission may accept, use, and dispose of gifts or donations of services or property so long as such gifts or donations are publicly disclosed. </text></paragraph></subsection><subsection id="HD40EE83FDE874FA2B40C1FE7129D394B"><enum>(f)</enum><header>Commission personnel matters</header><paragraph id="HE149CAF9AF5E4349886131E713A58CF0"><enum>(1)</enum><header>Travel expenses</header><text>The members of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Commission.</text></paragraph><paragraph id="HA41085E7D50F4F33B0AD8E998FAA3084"><enum>(2)</enum><header>Staff</header><subparagraph id="HFE381F222BB347D0B2E3CA7466926D3D"><enum>(A)</enum><header>In general</header><text>The Chairperson of the Commission may, without regard to the civil service laws and regulations, appoint and terminate an executive director and such other additional personnel as may be necessary to enable the Commission to perform its duties. The employment of an executive director shall be subject to confirmation by the Commission.</text></subparagraph><subparagraph id="H7E2EA17CD50F49B3B7ECB63FFDDA16B7"><enum>(B)</enum><header>Compensation</header><text>The Chairperson of the Commission may fix the compensation of the executive director and other personnel without regard to chapter 51 and subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, relating to classification of positions and General Schedule pay rates, except that the rate of pay for the executive director and other personnel may not exceed the rate payable for level V of the Executive Schedule under section 5316 of such title.</text></subparagraph></paragraph><paragraph id="H16F493C48F874C53AA533703C9F981C4"><enum>(3)</enum><header>Detail of government employees</header><text>At the discretion of the relevant agency, any Federal Government employee may be detailed to the Commission without reimbursement, and such detail shall be without interruption or loss of civil service status or privilege.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H35F77D62A5A748E187C1734AAFCEA8A6"><enum>(4)</enum><header>Procurement of temporary and intermittent services</header><text>The Chairperson of the Commission may procure temporary and intermittent services under section 3109(b) of title 5, United States Code, at rates for individuals that do not exceed the daily equivalent of the annual rate of basic pay prescribed for level V of the Executive Schedule under section 5316 of such title. </text></paragraph></subsection><subsection commented="no" id="idA6B5FF12930E464BA3061D4B90617F6B"><enum>(g)</enum><header>Termination of the Commission</header><text>The Commission shall terminate on the date that is 10 years after the date of enactment of this Act. </text></subsection></section><section commented="no" id="id97F41BD9C039402FB719C59E2E3ACC4E"><enum>3.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as are necessary to carry out this Act.</text></section></legis-body></bill>
