<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 2569</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230727">July 27, 2023</action-date><action-desc><sponsor name-id="S287">Mr. Cornyn</sponsor> (for himself, <cosponsor name-id="S337">Mr. Coons</cosponsor>, <cosponsor name-id="S374">Mr. Cotton</cosponsor>, <cosponsor name-id="S311">Ms. Klobuchar</cosponsor>, and <cosponsor name-id="S373">Mr. Cassidy</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Controlled Substances Act to clarify that the possession, sale, purchase, importation, exportation, or transportation of drug testing equipment that tests for the presence of fentanyl or xylazine is not unlawful.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6BDA335073C94478B7B0368BF598F443"><section section-type="section-one" id="H7D85E7ADC62A441E9B0EB59A6E4E915D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fentanyl Safe Testing and Overdose Prevention Act</short-title></quote>.</text></section><section id="idebde201ef00749be8fc790d06f844ea6"><enum>2.</enum><header>Clarification</header><text display-inline="no-display-inline">Section 422 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/863">21 U.S.C. 863</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD112A59367554BCA922D340474777A88"><subsection commented="no" display-inline="no-display-inline" id="idf53b8c7858ad4fd392be65092562a114"><enum>(g)</enum><header>Clarification</header><text display-inline="yes-display-inline">This section does not apply to the possession, sale, purchase, importation, exportation, or transportation of equipment for which the intended use is to indicate the presence of fentanyl or xylazine in a compound.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
