which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reauthorize certain provisions of the Prioritizing Resources and Organization for Intellectual Property Act of 2008, to create a new grant program to fund legal aid programs to assist small businesses to protect intellectual property, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American IP Defense and Enforcement Advancement Act</short-title></quote> or the <quote><short-title>American IDEA Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id805917ce22364447825f3e10417df78b"><enum>2.</enum><header>Amendments</header><text display-inline="no-display-inline">The Prioritizing Resources and Organization for Intellectual Property Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/403">Public Law 110–403</external-xref>; 122 Stat. 4265) is amended—</text><paragraph id="id39786c11929d4e7aa95411e98030e6ff"><enum>(1)</enum><text>in section 3 (<external-xref legal-doc="usc" parsable-cite="usc/15/8101">15 U.S.C. 8101</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7999e83b5c284103a0df5302ac57e497"><enum>(A)</enum><text display-inline="yes-display-inline">in the section heading, by striking <quote><header-in-text style="OLC" level="section">Definition</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="section">Definitions</header-in-text></quote>;</text></subparagraph><subparagraph id="id2ceee32e25c445308b280b9737434ed1"><enum>(B)</enum><text>by redesignating paragraphs (1), (2), and (3) as subparagraphs (A), (B), and (C), respectively, and adjusting the margins accordingly;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idac5c82a2ca9e42a5af99364a1f3a1e8c"><enum>(C)</enum><text>by moving the undesignated matter following subparagraph (C) (as so redesignated) 2 ems to the right;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id12a6dccfe19c4b418e727ce5a22d7d28"><enum>(D)</enum><text>in the undesignated matter following subparagraph (C) (as so redesignated), by striking <quote>paragraph (1), (2), or (3)</quote> and inserting <quote>subparagraph (A), (B), or (C)</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5c688f2f8bcf4640be069ed41c60d34e"><enum>(E)</enum><text>by striking <quote>In this Act, the term <quote>United States person</quote> means—</quote> and inserting the following: “In this Act:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCCC32AA4D9F246129FFD278D401FFF0F"><paragraph commented="no" display-inline="no-display-inline" id="id07e1d1af7934480f9fa186766918ae82"><enum>(1)</enum><header>Priority watch list country</header><text display-inline="yes-display-inline">The term <term>priority watch list country</term> means a country on the priority watch list (as defined in section 182(g)(3) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2242">19 U.S.C. 2242(g)(3)</external-xref>) (commonly known as the <quote>Special 301 Priority Watch List</quote>). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc9159be498a94b65b052e3ca92787587"><enum>(2)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="ideed396a86d7146138aa30ee5f59f5a58"><enum>(F)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA09067182EA24AB1BFDDCF62C6427679"><paragraph commented="no" display-inline="no-display-inline" id="ide1a8c121d422461fbd63e360f914cedc"><enum>(3)</enum><header>Watch list country</header><text>The term <term>watch list country</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idba7ea534198c4e79aff1f42169f064a4"><enum>(A)</enum><text display-inline="yes-display-inline">means a country identified by the United States Trade Representative pursuant to section 182(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2242">19 U.S.C. 2242(a)</external-xref>); and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddba6c1821f704753ab8d58818a130e23"><enum>(B)</enum><text display-inline="yes-display-inline">includes a priority watch list country.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf99d4047f5df45558f204dc71447d6de"><enum>(2)</enum><text display-inline="yes-display-inline">in section 303(a) (<external-xref legal-doc="usc" parsable-cite="usc/15/8113">15 U.S.C. 8113(a)</external-xref>)—</text><subparagraph id="id2a03376dd8ed40b5be0fb4238e6c5d33"><enum>(A)</enum><text>by redesignating paragraph (6) as paragraph (7); and</text></subparagraph><subparagraph id="id8aa2b768d80e4817b21f1b7397ebb1f2"><enum>(B)</enum><text>by inserting after paragraph (5) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCE9390CF70A34913A37E40201380BDA6"><paragraph id="id96d3ee290fa84cffbfff20c0fb2478a7"><enum>(6)</enum><text>Preventing unlawful taking or use of intellectual property from corporations and universities located in the United States, particularly by entities or individuals located in a priority watch list country.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9d3c186ee16a4dfab1b434ec6168a4d9"><enum>(3)</enum><text>in section 304(b) (<external-xref legal-doc="usc" parsable-cite="usc/15/8114">15 U.S.C. 8114(b)</external-xref>), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD3DD40FF215A4677A9930F77A6F9679A"><paragraph commented="no" display-inline="no-display-inline" id="idd9b1fc46aa104e71a4ebcd62c7cc5f7b"><enum>(12)</enum><text>Strategies to prevent unlawful taking or use of intellectual property by entities or individuals located in priority watch list countries.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5ee8502ee178414b85ce0d037ea839a8"><enum>(4)</enum><text>in section 401(b) (<external-xref legal-doc="usc" parsable-cite="usc/34/30103">34 U.S.C. 30103(b)</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb0425c202cea428dacfa6dee77908e8f"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>‘IP–TIC grants’</quote> and inserting <quote><quote>Intellectual Property Enforcement Program grants</quote> or <quote>IPEP grants</quote></quote>; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf7eb9dcd0af54b4da0b47241dcbb3c5d"><enum>(B)</enum><text>in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="ide7a956b36f9f49fc8c75aefa0c4391c5"><enum>(i)</enum><text>in the heading, by striking <quote><header-in-text style="OLC" level="paragraph">IP–TIC</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">Intellectual Property Enforcement Program</header-in-text></quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9b330307185d453bb52a886636901b70"><enum>(ii)</enum><text>in the matter preceding subparagraph (A), by striking <quote>IP–TIC</quote> and inserting <quote>IPEP</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idaac791d438144e48813a403a575dac55"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF5B8B6C8A5694AB4A00E24369073F17C"><subparagraph commented="no" display-inline="no-display-inline" id="id2e36f80f95cb4b5d8726300681fb78e7"><enum>(G)</enum><text>Facilitate coordination between State and local law enforcement officers and prosecutors and Federal law enforcement agencies in the enforcement of Federal criminal intellectual property laws.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id31ad0e76a5b34a89abe9b2289111c73a"><enum>(C)</enum><text>in paragraph (2)—</text><clause commented="no" display-inline="no-display-inline" id="idefcdf4a2b6d14700a9ea461cee0a5d1a"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>IP–TIC</quote> and inserting <quote>IPEP</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ided5c01287e454d8cbf3c9e720badee02"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>(<external-xref legal-doc="usc" parsable-cite="usc/42/3750">42 U.S.C. 3750 et seq.</external-xref>)</quote> and inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151 et seq.</external-xref>)</quote>;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id035abd4142614837b487a04405e77ef0"><enum>(D)</enum><text>by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB9462FC242BD43DABF8256591B4FC0F0"><paragraph commented="no" display-inline="no-display-inline" id="id9cee65d4fcad4aff907c536e7a6fd552"><enum>(3)</enum><header>Matching funds</header><subparagraph commented="no" display-inline="no-display-inline" id="idb8adc7516e92460d91e44c22985c2f94"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Federal share of an IPEP grant may not exceed—</text><clause commented="no" display-inline="no-display-inline" id="ida32fe149e01f43ff9458c0141467cc0e"><enum>(i)</enum><text display-inline="yes-display-inline">except as provided in clause (ii), 50 percent of the costs of the program or proposal funded by the IPEP grant; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idd0d319e1ca2c4ae28c067c1a4a9f4d96"><enum>(ii)</enum><text>60 percent of the costs of the program or proposal funded by the IPEP grant in the case of a program or proposal that includes a focus on investigating and prosecuting intellectual property violations that involve—</text><subclause commented="no" display-inline="no-display-inline" id="id5b22a8aa97d54c01a53e7a609bd1c127"><enum>(I)</enum><text display-inline="yes-display-inline">individuals or entities located in a watch list country;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id57923adcc9124a0791c63861539624ca"><enum>(II)</enum><text>individuals or entities operating under the direction or influence of individuals or entities located in a watch list country; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9a03e81291924eefaf05ab97b4bf62c9"><enum>(III)</enum><text>the import of products or components from a watch list country.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3e4d49850d3043679859cee42abe2bde"><enum>(B)</enum><header>Other violations</header><text display-inline="yes-display-inline">The recipient of an IPEP grant with a Federal share described in subparagraph (A)(ii) may use the grant to investigate or prosecute an intellectual property violation that involves individuals, entities, products, or components not described in subclause (I), (II), or (III) (as applicable) of that subparagraph if the recipient discovered the intellectual property violation during the course of investigating or prosecuting an intellectual property violation that involves an individual, entity, product, or component described in one of those subclauses.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide9c355cc182b42d6956799882ef9ac05"><enum>(E)</enum><text>in paragraph (4)(A), by inserting <quote>and 2024 through 2029</quote> after <quote>2009 through 2013</quote>; and</text></subparagraph></paragraph><paragraph id="ide147be4ea82d4072a4c304c8799fb336"><enum>(5)</enum><text>in section 402(a)(4)(A) (<external-xref legal-doc="usc" parsable-cite="usc/34/30104">34 U.S.C. 30104(a)(4)(A)</external-xref>), by inserting <quote>, including crimes perpetrated by entities located in priority watch list countries</quote> after <quote>intellectual property crimes</quote>.</text></paragraph></section><section id="id003fca8a906040d9bd5f41afba01b44e"><enum>3.</enum><header>GAO study on protection of intellectual property of manufacturers from priority watch list countries</header><subsection id="idcc0e97f77a6d4105b326d3aa5c395fde"><enum>(a)</enum><header>Study</header><text>The Comptroller General of the United States shall study how the Federal Government could better protect the intellectual property of manufacturers from priority watch list countries, as defined in section 3 of the Prioritizing Resources and Organization for Intellectual Property Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/15/8101">15 U.S.C. 8101</external-xref>) (as amended by section 2).</text></subsection><subsection id="ideb6d6c16eeca469d96513c32ac2318d8"><enum>(b)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, the Comptroller General shall submit to Congress a report on the results of the study required under subsection (a). </text></subsection></section><section id="id5bd4fb3a20af477dbfe7ac8a72881bde"><enum>4.</enum><header>GAO study on diplomatic opportunities for intellectual property enforcement and capacity building for watch list countries</header><subsection commented="no" display-inline="no-display-inline" id="id9fdff6dc4870402d9a40c6aff20e11b0"><enum>(a)</enum><header display-inline="yes-display-inline">Study</header><text>The Comptroller General of the United States shall study whether the Federal Government could use diplomatic and trade channels to—</text><paragraph id="iddca2ae3eabff4325bc933a7673335196"><enum>(1)</enum><text>improve the capacity of a watch list country, as defined in section 3 of the Prioritizing Resources and Organization for Intellectual Property Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/15/8101">15 U.S.C. 8101</external-xref>) (as amended by section 2), to adequately and effectively protect the intellectual property rights of individuals, universities, and entities located in a watch list country or in the United States; and</text></paragraph><paragraph id="ide2df10089f1545bb8c4ae9bd05b24cc3"><enum>(2)</enum><text>recover from a priority watch list country, as defined in section 3 of the Prioritizing Resources and Organization for Intellectual Property Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/15/8101">15 U.S.C. 8101</external-xref>) (as amended by section 2), any unrecouped financial losses suffered by individuals, universities, and entities located primarily in the United States resulting from the unlawful use of intellectual property by a priority watch list country or an individual or entity operating under the direction or influence of the priority watch list country, if the losses were suffered due to a denial of adequate and effective protection of intellectual property rights by the priority watch list country.</text></paragraph></subsection><subsection id="idc6cb3d548b81496b970ed8eaa8e5baf5"><enum>(b)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, the Comptroller General shall submit to Congress a report on the results of the study required under subsection (a). </text></subsection></section><section commented="no" display-inline="no-display-inline" id="id4acfffcfe81f4493b622bd2f2090dcf7"><enum>5.</enum><header>Intellectual property protection legal aid</header><subsection commented="no" display-inline="no-display-inline" id="id2f0e7793c1b94119a5b19e70c7b3ce09"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id901ff869dc2642aebd83ef96a3186669"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id15484ef56ba84ce693b570f973bbde19"><enum>(A)</enum><text display-inline="yes-display-inline">a law school that is accredited by the American Bar Association; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfccf9a26d15346b180687326d71e9dce"><enum>(B)</enum><text display-inline="yes-display-inline">the bar association of a State;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf21b8d598a7d4974b60551ecc7c66855"><enum>(C)</enum><text>a legal services organization; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id43c914a86d114e90a614fd7d606f2b84"><enum>(D)</enum><text>a nonprofit organization or State agency, in partnership with an entity described in subparagraph (A), (B), or (C).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddbb95e7ba7144991964ff20cd6719cf9"><enum>(2)</enum><header>Low-revenue small business</header><text>The term <term>low-revenue small business</term> means a small business with an estimated annual revenue of not more than $150,000.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd3ecbce766394a23a2d1c2a7bde25b0d"><enum>(3)</enum><header display-inline="yes-display-inline">Small business</header><text display-inline="yes-display-inline">The term <term>small business</term> means a small business concern, as that term is defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8984fafd9af540659636cf091f31ee9d"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means a State, the District of Columbia, the Commonwealth of Puerto Rico, and any territory or possession of the United States. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7944dab8a1114403a311a407a98c733f"><enum>(b)</enum><header display-inline="yes-display-inline">Grant program</header><text display-inline="yes-display-inline">From amounts made available to carry out this section, the Attorney General shall make grants to eligible entities to fund—</text><paragraph commented="no" display-inline="no-display-inline" id="idcbebce95abb34f77a34c6bb7fa259ec2"><enum>(1)</enum><text display-inline="yes-display-inline">legal aid programs to provide no-cost or low-cost legal advice and services to low-revenue small businesses relating to the protection and enforcement of intellectual property rights; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd77d2eaf2f22437d92d5e8dd0b37f0f7"><enum>(2)</enum><text display-inline="yes-display-inline">the development and delivery of training programs and materials for small businesses relating to the protection and enforcement of intellectual property rights.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf300959fd67c44cb82d968acbf4fd3e9"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated such sums as may be necessary to carry out this section.</text></subsection></section></legis-body></bill>
