which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize certain aliens seeking asylum to be employed in the United States while their applications are being adjudicated.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6EEC771847EB491AA2672F4B4365FB57"><section section-type="section-one" id="H906187F08E5F4EE489CE8D8992D80896"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Asylum Seeker Work Authorization Act of 2023</short-title></quote>.</text></section><section id="H5954A4800DAA467B90F2B054E03E5017"><enum>2.</enum><header>Employment authorization for aliens seeking asylum</header><text display-inline="no-display-inline">Section 208(d)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(d)(2)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HCB3E5B8ABDFC4DA6BEBE0A1AC9F5C759"><paragraph id="H8F465DBD4CBC422B9653A3D6255E1CD4"><enum>(2)</enum><header>Employment authorization</header><subparagraph commented="no" display-inline="no-display-inline" id="IDD341F2F9D33A4E80B84B17434B860C85"><enum>(A)</enum><header display-inline="yes-display-inline">Employment eligibility</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B)—</text><clause commented="no" display-inline="no-display-inline" id="idE2E7D5125A37473CAE8090A4C5E549C4"><enum>(i)</enum><text display-inline="yes-display-inline">an applicant for asylum is not entitled to employment authorization, but such authorization may be provided under regulation by the Secretary of Homeland Security; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id2E0CB8EB16D44FF0B9669A82CFB82197"><enum>(ii)</enum><text display-inline="yes-display-inline">an applicant who is not otherwise eligible for employment authorization shall not be granted such authorization before the date that is 180 days after the date on which the applicant files an application for asylum.</text></clause></subparagraph><subparagraph id="HF890523B6F1E4B25B2766496346C261F"><enum>(B)</enum><header>Expedited employment eligibility</header><clause id="idCB5426BEC7034CF38B9D671CFEB20152"><enum>(i)</enum><header>In general</header><text>The Secretary of Homeland Security shall authorize employment for an applicant for asylum—</text><subclause id="id7BDE72873EC344D3BB9DAB11331AEB25"><enum>(I)</enum><text>who—</text><item id="id7F90DC1B8A5D4218A0CF7295248F2AA4"><enum>(aa)</enum><text>has been continuously physically present in the United States since the date of the enactment of the <short-title>Asylum Seeker Work Authorization Act of 2023</short-title>; or</text></item><item id="id0D620E212F364B6CB5F5FFD7BDF1AF1C"><enum>(bb)</enum><text>entered the United States at a designated port of entry (as such term is used in section 411(e)(3)(A) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/211">6 U.S.C. 211(e)(3)(A)</external-xref>));</text></item></subclause><subclause id="idB20F84593A4048B3AA1BD02159D3A514"><enum>(II)</enum><text>who is not in detention;</text></subclause><subclause id="id8390A0AE52B74A4FBFE59656247A93D3"><enum>(III)</enum><text>whose application for asylum has not been determined frivolous; and</text></subclause><subclause id="id1D6D6BF4158B496597F9EB13EB86CD09"><enum>(IV)</enum><text>with respect to whom the procedures required under paragraph (5)(A)(i) have been completed.</text></subclause></clause><clause id="HB69C54B744034921B9FE2F7E75D007B3"><enum>(ii)</enum><header>Application</header><text>The Secretary may not grant employment authorization under this subparagraph to an applicant for asylum who is not otherwise eligible for employment authorization before the date that is 30 days after the date on which the applicant filed an application for asylum.</text></clause></subparagraph><subparagraph id="H0A124E50213F4F9E9E1E48DD860B5EB2"><enum>(C)</enum><header>Term</header><text>Employment authorization under this paragraph—</text><clause id="H60CD575F6C5D47A9A3E69448C321A601"><enum>(i)</enum><text>shall be for an initial period of 2 years; and</text></clause><clause id="H03EB929195C5496295030D006D25B337"><enum>(ii)</enum><text>shall be renewable for additional 2-year periods while the applicant’s asylum claim is being adjudicated, including while the claim is under administrative or judicial review.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
