which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish name, image, and likeness rights for college athletes at institutions of higher education, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>College Athlete Economic Freedom Act</short-title></quote>.</text></section><section id="id8a1782c46f8549688488a87170da8216"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id8d5e35090a8541e78ac32742810eceee"><enum>(1)</enum><header>Athlete agent</header><text>The term <term>athlete agent</term> has the meaning given the term in section 2 of the Sports Agent Responsibility and Trust Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7801">15 U.S.C. 7801</external-xref>). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc26df71c15f543dd95bf5eb3f2c88b69"><enum>(2)</enum><header>Collective representative</header><text>The term <term>collective representative</term>—</text><subparagraph id="id773d9286100b4bb9b7b25135994a59be" commented="no"><enum>(A)</enum><text>means an individual or organization that represents a group of college athletes or prospective college athletes to negotiate contracts for the use of the names, images, or likenesses of such athletes or group of athletes; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id798be2cad8e24d0ab007053fc3da60c8"><enum>(B)</enum><text display-inline="yes-display-inline">includes—</text><clause commented="no" display-inline="no-display-inline" id="idef32f71bb8c44c6fb31f0b7493f6f0d9"><enum>(i)</enum><text display-inline="yes-display-inline">legal representatives;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7e9a8262d83944eabeb3a345a84b5007"><enum>(ii)</enum><text display-inline="yes-display-inline">athlete agents; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id45b16be06f634e72a038e175b90217d9"><enum>(iii)</enum><text display-inline="yes-display-inline">players' associations. </text></clause></subparagraph></paragraph><paragraph id="idf2c3c1bbcb8c43e0b71d83d339ac5318"><enum>(3)</enum><header>College athlete</header><text>The term <term>college athlete</term> means an individual who participates in or is eligible to participate in an intercollegiate sport for an institution of higher education.</text></paragraph><paragraph id="id476834a19d7e4a98a68aa9aff2b5d34a"><enum>(4)</enum><header>Compensation</header><text>The term <term>compensation</term> means any payment, remuneration, or benefit provided to a college athlete or prospective college athlete in exchange for the use of the name, image, or likeness of the college athlete or prospective college athlete.</text></paragraph><paragraph id="id60d4caec48b54cce8eeeb53c7950d366"><enum>(5)</enum><header>Grant-in-aid</header><text>The term <term>grant-in-aid</term> means a scholarship, grant, or other form of financial assistance that is provided by an institution of higher education to a college athlete for the college athlete’s undergraduate or graduate course of study. </text></paragraph><paragraph id="idff78d959856d41cda69eaa2935ca9643"><enum>(6)</enum><header>Image</header><text>The term <term>image</term>, with respect to a college athlete or prospective college athlete, means any photograph, video, or computer-generated representation that reasonably identifies the college athlete or prospective college athlete. </text></paragraph><paragraph id="id07e825056a5745d3b4af0716e262d664"><enum>(7)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>).</text></paragraph><paragraph id="idf1bc2cf9f549428c9e9ce2f6ac19bf17" commented="no"><enum>(8)</enum><header>Institutional name, image, and likeness collective</header><text>The term <term>institutional name, image, and likeness collective</term> means any entity that—</text><subparagraph id="id44d20071d4284c8889dd68ee4872038d" commented="no"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id70c19d0071464bf09884e4649c32ebd9"><enum>(i)</enum><text>is subject to the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>); or</text></clause><clause indent="up1" commented="no" display-inline="no-display-inline" id="id54439bc440074e23ba17857d446bffdf"><enum>(ii)</enum><text>is an organization not organized to carry on business for its own profit or the profit of its members; and</text></clause></subparagraph><subparagraph id="id52c2e9d2ce554126a6f1246dc1751cdc" commented="no"><enum>(B)</enum><text>supports the athletic interests of an institution of higher education or a limited group of institutions of higher education by—</text><clause id="id5bb12b041118445ba89efc1d4905e171" commented="no"><enum>(i)</enum><text>accepting contributions for the purpose of entering into or funding name, image, or likeness agreements with college athletes or prospective college athletes; or</text></clause><clause id="ida213b3538b8349949b969fca32b23f02" commented="no"><enum>(ii)</enum><text>arranging for college athletes to be paid by third parties for the commercial use of their names, images, or likenesses.</text></clause></subparagraph></paragraph><paragraph id="id021d168934c44a24817b600502f4a027"><enum>(9)</enum><header>Intercollegiate athletic association</header><text>The term <term>intercollegiate athletic association</term> means any association, conference, or other group or organization that—</text><subparagraph id="id150594e5d15e45d9a9be35a6039ad4fc"><enum>(A)</enum><text>exercises authority over intercollegiate athletics and the recruitment of college athletes or prospective college athletes; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd42984355bdd4bcd9d68b0b7f37b3125"><enum>(B)</enum><text>is engaged in interstate commerce or in any industry or activity affecting interstate commerce. </text></subparagraph></paragraph><paragraph id="id35222d2b76944e3c937ef479a6438398"><enum>(10)</enum><header>International college athlete</header><text>The term <term>international college athlete</term> means an alien (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)) lawfully present in the United States in the status of a nonimmigrant described in subparagraph (F)(ii) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) who participates in or is eligible to participate in an intercollegiate sport for an institution of higher education. </text></paragraph><paragraph id="id0748968fae8041a488048c9a3a230d7d"><enum>(11)</enum><header>Likeness</header><text>The term <term>likeness</term>, with respect to a college athlete or prospective college athlete, means the uniquely identifiable voice, catch phrase, or any other mark that when used in a context that reasonably identifies the college athlete or prospective college athlete. </text></paragraph><paragraph id="id19dafaacb1d54c4cb7cccc32a9012cea"><enum>(12)</enum><header>Name</header><text>The term <term>name</term>, with respect to a college athlete or prospective college athlete, means the first or last name, or a nickname, of the college athlete or prospective college athlete when used in a context that reasonably identifies the college athlete or prospective college athlete. </text></paragraph><paragraph id="id027f3915eed941cbaa0382849a67f70e"><enum>(13)</enum><header>Prospective college athlete</header><text>The term <term>prospective college athlete</term> means an individual who—</text><subparagraph id="id12ADA71CBE5A45B5916C130EEF4CA7D5"><enum>(A)</enum><text>has not enrolled at an institution of higher education; and</text></subparagraph><subparagraph id="id6D182445702343F5A5B88E9F4677ADD0"><enum>(B)</enum><text>may be recruited by an institution of higher education.</text></subparagraph></paragraph><paragraph id="id47460455f8da4a93b55a65a00e494b7c"><enum>(14)</enum><header>Third party</header><text>The term <term>third party</term> means an individual or entity other than an institution of higher education or an intercollegiate athletic association.</text></paragraph></section><section id="id870546e7b38d46ee9939e5d55ce8efaf"><enum>3.</enum><header>Athlete rights to market name, image, and likeness</header><subsection id="idf0b8d4593b5444b18fa1808b7013a2ea"><enum>(a)</enum><header>Right To market use of name, image, and likeness</header><paragraph id="id873bbd8b46884b0cae39bd96c53aeb01"><enum>(1)</enum><header>In general</header><text>An institution of higher education or intercollegiate athletic association may not enact or enforce any rule, requirement, standard, or other limitation that prevents college athletes or prospective college athletes, individually or as a group, from marketing the use of their names, images, or likenesses.</text></paragraph><paragraph id="id2b140012e02b4fb4a2cbbc6d0a783262"><enum>(2)</enum><header>Collusion</header><text display-inline="yes-display-inline">An institution of higher education may not coordinate with any other institution of higher education or third party to impose a limitation on the amount of payment offered to a college athlete, prospective college athlete, or group of college athletes or prospective college athletes under a contract for the use of the name, image, or likeness of the college athlete, prospective college athlete, or group of college athletes or prospective college athletes, unless such a limitation is the result of negotiations with a collective representative. </text></paragraph><paragraph id="id15da7ee9a75a440ead8627c2745d2c1a"><enum>(3)</enum><header>Right to collective representation</header><text>An institution of higher education or intercollegiate athletic association may not enact or enforce any rule, requirement, standard, or other limitation, or engage in conduct that prevents college athletes from forming or recognizing, or interferes with such formation or recognition of, a collective representative—</text><subparagraph commented="no" display-inline="no-display-inline" id="id036bf22052ea4edb9984209342f12bf9"><enum>(A)</enum><text display-inline="yes-display-inline">to facilitate contracts for the use of the name, image, or likeness of college athletes, or group licensing agreements; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6170fb5fc6814e3b9f48a99ffa3b301c"><enum>(B)</enum><text display-inline="yes-display-inline">to provide representation for college athletes.</text></subparagraph></paragraph><paragraph id="idd9f5b62397ca4b00bd87dde861605a41"><enum>(4)</enum><header>Group licensing</header><subparagraph commented="no" display-inline="no-display-inline" id="id213c59bf04054b0bbe0f452001d44c78"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An institution of higher education or intercollegiate athletic association may not use the name, image, or likeness of any group of college athletes for any type of promotion, including a media rights agreement, unless the institution of higher education or intercollegiate athletic association obtains a license from the group for that purpose.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2337625fd55a4d819087255bd16bf416"><enum>(B)</enum><header>Notification</header><text>An institution of higher education or intercollegiate athletic association seeking a license described in subparagraph (A) shall notify the group of college athletes concerned with respect to—</text><clause commented="no" display-inline="no-display-inline" id="id62359a8d34ea4b45a7cd4fbc0d0fc411"><enum>(i)</enum><text display-inline="yes-display-inline">the manner in which the name, image, or likeness of the group will be used under the license; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id63f9610a5b1d4038a8d3287c3f83602c"><enum>(ii)</enum><text>the amount of revenue the institution of higher education or intercollegiate athletic association will receive in connection with any type of promotion, including a media rights agreement and any other revenue source, based on the use of the name, image, or likeness of the group. </text></clause></subparagraph></paragraph><paragraph id="id769f4fc95d5244d5bcfe7a03d63d5c83"><enum>(5)</enum><header>Grants-in-aid</header><text>Receipt of compensation for the use of the name, image, or likeness of a college athlete or prospective college athlete shall not adversely affect—</text><subparagraph id="id4dc9d73b02334da58cf41c9860126295"><enum>(A)</enum><text>the eligibility or opportunity of a college athlete or prospective college athlete to apply for a grant-in-aid; or</text></subparagraph><subparagraph id="id3c9901d06ecf48e5b17cb0d38dd422f4"><enum>(B)</enum><text>the amount, duration, or renewal of the grant-in-aid of a college athlete or prospective college athlete.</text></subparagraph></paragraph></subsection><subsection id="ide1293c35b666427c885d2d5dd0d501ba"><enum>(b)</enum><header>Equitable institutional support</header><paragraph commented="no" display-inline="no-display-inline" id="id0c69f7e1d60d49569a74dff4b3f9d138"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An institution of higher education, an intercollegiate athletic association, or a party affiliated with an institution of higher education or an intercollegiate athletic association that provides direct or indirect support to college athletes with respect to the marketing of their names, images, or likenesses shall make such support available and accessible to all college athletes in the applicable athletic program, regardless of gender, race, or participating sport.</text></paragraph><paragraph id="idd1a7d371a97e45c4a15aab13659da257"><enum>(2)</enum><header>Institutional name, image, and likeness collectives</header><text>Each institutional name, image, and likeness collective—</text><subparagraph id="ide611bbf212f7472fa1d719180d97ed64"><enum>(A)</enum><text>shall—</text><clause id="ide327d327e3844750b7760574fac7a9a0"><enum>(i)</enum><text>for purposes of paragraph (1), be considered to be affiliated with each institution of higher education the athletic interests of which the collective supports;</text></clause><clause id="idf82bdf93a651496c976df7a68fc3fbaa"><enum>(ii)</enum><text>register with the Federal Trade Commission as an institutional name, image, and likeness collective, including by identifying the institutions of higher education with which the collective affiliates;</text></clause><clause id="id7bef1d9f61ff44608e5a3cbe598317d4"><enum>(iii)</enum><text>maintain, with respect to college athletes enrolled at each affiliated institution of higher education—</text><subclause id="id26abf4325971442a88be8f27517c64fb"><enum>(I)</enum><text>the number of name, image, or likeness agreements facilitated by the collective, disaggregated by gender, race, and participating sport;</text></subclause><subclause id="idfec8ff0b2aae4df7b016e1f0397c7ed4"><enum>(II)</enum><text>the total monetary value of name, image, or likeness agreements facilitated by the collective, disaggregated by gender, race, and participating sport; and</text></subclause><subclause id="idbe1da53f48a6423b8743dec8a27839a7"><enum>(III)</enum><text>the number of college athletes and prospective college athletes assisted by the collective, disaggregated by gender, race, and participating sport; and</text></subclause></clause><clause id="id824e4d7e3a18469d8eae443d6ea24d1a"><enum>(iv)</enum><text>not later than September 1 each year, submit to the Federal Trade Commission a report containing, for the period beginning on July 1 of the preceding year and ending on June 30 of the year in which the report is submitted, the information described in subclauses (I) through (III) of clause (iii); and</text></clause></subparagraph><subparagraph id="id703067fabc8441e3897826de7ca68c7e"><enum>(B)</enum><text>shall not discriminate, on the basis of gender, race, or participating sport, in the facilitation of name, image, or likeness agreements for college athletes in the athletic program of, or prospective college athletes for, any particular institution of higher education. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id30b23d66f2374c29921a717409d830bb"><enum>(3)</enum><header>Determinations under title IX</header><text>For purposes of determinations about discrimination on the basis of sex under title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>), the support of an institution of higher education or intercollegiate athletic association related to athletes’ names, images, or likenesses shall be considered, including how an institution of higher education or intercollegiate athletic association promotes sports predominantly comprised of women relative to men. </text></paragraph></subsection><subsection id="id553450bc7f5c4837b1cf4badeeededa1"><enum>(c)</enum><header>Right to representation</header><paragraph id="id84057ab148bf44a098a1e5fc38709892"><enum>(1)</enum><header>Ability for college athletes to retain representation</header><text>An institution of higher education or intercollegiate athletic association may not prevent a college athlete or prospective college athlete from fully participating in intercollegiate athletics based on the college athlete or prospective college athlete having obtained professional representation with respect to a contract or legal matter, including—</text><subparagraph id="idc70e0d8df7d34133931ba0ac55509f75"><enum>(A)</enum><text>representation provided by an athlete agent, financial advisor, or collective representative; and</text></subparagraph><subparagraph id="idc70c8dff2abf4514ad7fb78858cd0683"><enum>(B)</enum><text>legal representation provided by an attorney.</text></subparagraph></paragraph><paragraph id="idec3c11ca5ed24d9e9f85fa9b92e0a195"><enum>(2)</enum><header>Prohibitions on the regulation of representation</header><text>An institution of higher education or intercollegiate athletic association may not regulate the legal, financial, or agency representation of college athletes and prospective college athletes with respect to the marketing of their names, images, or likenesses, including the certification of such legal, financial, or agency representation.</text></paragraph></subsection><subsection id="id3be6fff5b8cc4cdbbf3eacbba1e5acba"><enum>(d)</enum><header>Prohibition on waiver</header><paragraph commented="no" display-inline="no-display-inline" id="id1f059834a54f4455afdcc79c7a47b28d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), a college athlete, prospective college athlete, institution of higher education, intercollegiate athletic association, or any other person may not enter into any agreement or a legal settlement that waives or permits noncompliance with this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48de772980f142e89b890782682c0d84"><enum>(2)</enum><header>Exception</header><text>An institution of higher education or intercollegiate athletic association may restrict the commercial use of the name, image, or likeness of college athletes if such a restriction is part of a collective bargaining agreement between the institution of higher education or intercollegiate athletic association and college athletes.</text></paragraph></subsection></section><section id="ide49b749c700c482a89a9657330a0d4df"><enum>4.</enum><header>Grants for analyzing name, image, likeness, and athletic reputation monetization</header><subsection id="id81ed2c502489432fb29d6dc7e4ffd8d9"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="ida827df369e62419d8a377eafa7ae0ff9"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="idc4c4c97241de449a8976a17f17221741"><enum>(A)</enum><text>a business in the United States;</text></subparagraph><subparagraph id="id3d17629434564f37adad42d8f33dd626"><enum>(B)</enum><text>a public or private education and research organization in the United States; or</text></subparagraph><subparagraph id="ided8c3e2a02b14472a222505b1b2637c8"><enum>(C)</enum><text>a consortium of entities described in subparagraph (A) or (B).</text></subparagraph></paragraph><paragraph id="id2dc551edff7547f5ab25890717a578c0"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph></subsection><subsection id="id462e4a92218d4d0b938ecca46fc35600"><enum>(b)</enum><header>Grants authorized</header><text>Not less frequently than annually, the Secretary may award a grant to, or enter into a contract or a cooperative agreement with, an eligible entity for the purpose of conducting a market analysis of the monetization of the rights granted to college athletes and prospective college athletes under this Act during the 1-year period preceding the date on which the analysis is completed.</text></subsection><subsection id="id9f6371008e93418a9ffb453c664e3feb"><enum>(c)</enum><header>Requirements</header><text>An eligible entity that receives a grant or enters into a contract or cooperative agreement to conduct an analysis under subsection (b) shall—</text><paragraph id="idfe8940e064e74bec9e3f375ac72d5112"><enum>(1)</enum><text>make the analysis and information relating to the analysis available to the public, including—</text><subparagraph id="idb9cca6aa977c429887b617092969c4bf"><enum>(A)</enum><text>the surveys and interviews conducted by the eligible entity during the course of the analysis; and</text></subparagraph><subparagraph id="idecd98c29616c45d290280b03b02fbbab"><enum>(B)</enum><text>estimates of the compensation received by college athletes and prospective college athletes during the 1-year period preceding the date of on which the analysis is completed as a result of the monetization of the names, images, or likenesses of such college athletes and prospective college athletes, disaggregated by—</text><clause id="id857fcf288cd345d3a49f82cb50182f59"><enum>(i)</enum><text>gender;</text></clause><clause id="id247a3b253b5943d2920a933af661b27c"><enum>(ii)</enum><text>race; and</text></clause><clause id="id2715b76370184d76ba7a87dbf65aad44"><enum>(iii)</enum><text>sport; and</text></clause></subparagraph></paragraph><paragraph id="id7fdc170150b64f959d487d155f8901e4"><enum>(2)</enum><text>provide recommendations to the Secretary to address any disparity among estimates based on the factors described in clauses (i), (ii), and (iii) of paragraph (1)(B).</text></paragraph></subsection><subsection id="id0ba483c6b85944b5b8b30a290c44d8ae"><enum>(d)</enum><header>Public availability of recommendations</header><text>The Secretary shall make available to the public any recommendations received under subsection (c)(2).</text></subsection><subsection id="id355dc21e62994663a0d4807fcafe2058"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary such sums as may be necessary to carry out this section. </text></subsection></section><section id="idf0c9d4426dd04c8dbce875ef4d21ddcb"><enum>5.</enum><header>International college athletes</header><subsection id="ida2d3251df90245eda7908caddfdefb7f" commented="no"><enum>(a)</enum><header>Eligibility for F visas</header><text>Section 101(a)(15)(F) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(F)</external-xref>) is amended by—</text><paragraph commented="no" display-inline="no-display-inline" id="idc4a4a152b6a74d80898edba3466a9ebb"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(i) an alien having</quote> and inserting <quote>(i)(I) an alien having</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf1f98ea04c1e4eb1a4d7a1d3350c992c"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating clauses (ii) and (iii) as subclauses (II) and (III), respectively; </text></paragraph><paragraph id="idb3344005b6774f9890fbc2c2a15e1c3f"><enum>(3)</enum><text>by striking the semicolon and inserting <quote>; or</quote>; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9c3a81037fe74ad092b85d7e0f2c5909"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3D6F575C8F0445E7A8CEEC3EA760B199"><clause commented="no" display-inline="no-display-inline" id="id4f44e4f5014642b881a6f865fca8ac98" indent="up2"><enum>(ii)</enum><text display-inline="yes-display-inline">an alien having a residence in a foreign country which he has no intention of abandoning, who is a bona fide college athlete (as defined in section 2 of the <short-title>College Athlete Economic Freedom Act</short-title>) qualified to pursue a full course of study and who seeks to enter the United States temporarily and for the purpose of pursuing a course of study at an established college, university, or other academic institution while also participating in intercollegiate athletics, which institution or place of study shall have agreed to report to the Secretary of Homeland Security the termination of attendance of each nonimmigrant student, and if any such institution of learning or place of study fails to make reports promptly the approval shall be withdrawn;</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id238b2a443ac74d6d8763c0297b54d15d"><enum>(b)</enum><header>Name, image, and likeness activities by international college athletes</header><text>Section 212(a)(5)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(5)(A)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBC4971E481D74A158270F00DA3A198C1"><clause commented="no" display-inline="no-display-inline" id="id2358c2a39f4248fba609aef7d8a066ae"><enum>(v)</enum><header>International college athletes</header><text display-inline="yes-display-inline">Notwithstanding clause (i), an alien who seeks admission to the United States to compete in intercollegiate athletics as an international college athlete nonimmigrant described in subparagraph (F)(ii) of section 101(a)(15) shall not be inadmissible for having participated or engaged in activities described in section 3 of the <short-title>College Athlete Economic Freedom Act</short-title> (relating to the marketing of the name, image, or likeness, of the alien), individually or as a member of a group of athletes, and such activities shall not constitute a violation of or failure to maintain such nonimmigrant status.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id12d7ac5edbb9477fb8fd7654ecc1b928"><enum>(c)</enum><header>Employment authorization for name, image, and likeness activity</header><text>Section 214 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0454061BCCE744069669274C9A8CCF7A"><subsection commented="no" display-inline="no-display-inline" id="id88e779a2a51d48ab92e06aac983aa80e"><enum>(s)</enum><header>International college athletes</header><text display-inline="yes-display-inline"> In the case of an international college athlete nonimmigrant described in section 101(a)(15)(F)(ii) who participates in intercollegiate athletics, the Secretary of Homeland Security shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id34f7051fc45848ab9d11809f08af47bd"><enum>(1)</enum><text display-inline="yes-display-inline">authorize the alien, incident to status, to engage in employment activities described in section 3 of the <short-title>College Athlete Economic Freedom Act</short-title> (relating to the marketing of the nonimmigrant's name, image, or likeness of the nonimmigrant), individually or as a member of a group of athletes, in the United States during the period of authorized admission; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide48a2704b9244b4f9fee7e4e4bcfb446"><enum>(2)</enum><text display-inline="yes-display-inline">provide the international college athlete nonimmigrant with an <quote>employment authorized</quote> endorsement or other appropriate document signifying authorization of employment.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id974bfcdb24884cc8bb36a94a1c5de1d6"><enum>(d)</enum><header>Employee status of college athletes</header><text>In the event that any Federal or State court of competent jurisdiction or any government agency declares college athletes to be employees of an institution of higher education or intercollegiate athletic association—</text><paragraph commented="no" display-inline="no-display-inline" id="idcf20f5c7715a426d8e6cab6f442ed173"><enum>(1)</enum><text display-inline="yes-display-inline">participation in intercollegiate athletics shall not violate or be considered to be a violation of or a failure to maintain nonimmigrant status described in subparagraph (F)(ii) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaf3b46463201481b83eaae31c7cbfc31"><enum>(2)</enum><text display-inline="yes-display-inline">international college athletes admitted to the United States pursuant to visas issued under that subparagraph may be paid for their participation in college athletics in the same manner as other college athletes are paid.</text></paragraph></subsection><subsection id="id95398b8d99cd4a1da9e682f31c8f1397"><enum>(e)</enum><header>Evidence of employment eligibility</header><text>Endorsement of the Form I–20 (Certificate of Eligibility for Nonimmigrant Student Status) of an international college athlete by a designated school official for name, image, or likeness activities described in section 3 shall serve as evidence of eligibility for employment in the United States.</text></subsection></section><section id="idabea5bb20c8547c4b474f27f2b7da4cb"><enum>6.</enum><header>Enforcement provisions</header><subsection id="id522adda5fa61462abaf75f17e964ecf3"><enum>(a)</enum><header>Unfair or deceptive act or practice</header><paragraph id="id4497cdc6e6cf44a3b40ff4c13a0a3e35"><enum>(1)</enum><header>In general</header><text>A violation of section 3 shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="idd8ba335d2b4c4b45a2bd42e2d271ebf4"><enum>(2)</enum><header>Actions by the Commission</header><text>The Commission shall enforce section 3 in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></paragraph><paragraph id="id242ec3a13ceb4a18a526c0c4b231ff8a"><enum>(3)</enum><header>Enforcement related to nonprofit organizations</header><text>Notwithstanding section 4, 5(a)(2), or 6 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/44">15 U.S.C. 44</external-xref>, 45(a)(2), 46) or any jurisdictional limitation of the Federal Trade Commission, the Commission shall also enforce this Act and the regulations promulgated under this Act, in the same manner provided in paragraphs (1) and (2) of this subsection, with respect to organizations not organized to carry on business for their own profit or that of their members.</text></paragraph></subsection><subsection id="id6472e3930be34f949ebc30d8ec8dd14c"><enum>(b)</enum><header>Private right of action</header><paragraph id="ide05b3362591c4f6185a1dc1a00a597ed"><enum>(1)</enum><header>In general</header><text>An individual who is aggrieved by a violation of section 3 may bring a civil action in an appropriate Federal district court of competent jurisdiction.</text></paragraph><paragraph id="id2674189bc4fb460cb6ddb67ca9c7aa93"><enum>(2)</enum><header>Damages; costs and attorney’s fees</header><text>A court may award to a prevailing party in a civil action brought under paragraph (1)—</text><subparagraph id="id3fa423d21c9f439ab6c64eec047b4f66"><enum>(A)</enum><text>actual damages sustained by the party as a result of the violation that is the subject of the action; and</text></subparagraph><subparagraph id="id0601156373e24fcab702e8d92ee9dada"><enum>(B)</enum><text>the costs of the action and reasonable attorney’s fees.</text></subparagraph></paragraph></subsection><subsection id="id571ff2dc2a5f43c99d16a76727c1c2de"><enum>(c)</enum><header>Sherman Act</header><text>A violation of this Act shall be deemed to be a per se violation of the Sherman Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1">15 U.S.C. 1 et seq.</external-xref>) and subject to all remedies and rights afforded under that Act.</text></subsection></section><section id="idbd459a70c9344d6abdc102745b087842"><enum>7.</enum><header>State preemption</header><subsection id="iddd67a97d7aa248248082775d39b4e1fe"><enum>(a)</enum><header>In general</header><text>A State may not enforce a State law relating to the ability of college athletes to enter into contracts with third parties for the use of their names, images, or likenesses pursuant to this Act.</text></subsection><subsection id="id4dd31a0937a542b3bd4fd1e30cfc823d"><enum>(b)</enum><header>Exception for the certification of athlete agents</header><text>A State may enforce a State law or regulation relating to the certification of athlete agents under the Sports Agent Responsibility and Trust Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7801">15 U.S.C. 7801 et seq.</external-xref>).</text></subsection></section><section id="ide97fad7550444b66b0524b8b6ebac375"><enum>8.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall affect the treatment of qualified scholarships under <external-xref legal-doc="usc" parsable-cite="usc/26/117">section 117</external-xref> of the Internal Revenue Code of 1986.</text></section></legis-body></bill>
