Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Natural Gas Act to bolster fairness and transparency in the consideration of interstate natural gas pipeline permits, to provide for greater public input opportunities in the natural gas pipeline permitting process, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pipeline Fairness, Transparency, and Responsible Development Act of 2023</short-title></quote>.</text></section><section id="idDD91AFD5144244F9A05C5D72D17D5609"><enum>2.</enum><header>Notice to affected landowners</header><subsection id="id7199FA902B5E4A5EA6C319C004AB48F4"><enum>(a)</enum><header>Initial notice</header><text display-inline="yes-display-inline">Section 7(d) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f(d)</external-xref>) is amended—</text><paragraph id="id5D335CD693D2424B84871658BE78D962"><enum>(1)</enum><text>by striking the subsection designation and all that follows through <quote>Application for certificates</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC769ED4186A54089ACAE87FB64E33856"><subsection id="idD99AE597F57541DABDF7D2DD5963B18A"><enum>(d)</enum><header>Application for certificate of public convenience and necessity</header><paragraph id="id2EEAA24CA4EF49D3B3C4BDC3B4BE80CF"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), an application for a certificate</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idF5748229E656435CA678F507353517B0"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5600C74A551F41A1BB98A5A117057129"><paragraph id="id50D44F7D4E8A475680CB9637FF100637"><enum>(2)</enum><header>Requirements</header><subparagraph id="id2BA2A02BF6EE45D98891464DAD04116D"><enum>(A)</enum><header>Application</header><text>An application for a certificate of public convenience and necessity under paragraph (1) shall include—</text><clause id="idAE68AF4CA77743FB9A8ADC24C5F1B282"><enum>(i)</enum><text>the name and address of each interested party on whom the Commission or the applicant is required to serve notice of the application under that paragraph; and</text></clause><clause id="id79E8489BEB994DFCA90D93103B6BC8B7"><enum>(ii)</enum><text>a copy of the notice proposed to be served on each interested party under that paragraph.</text></clause></subparagraph><subparagraph id="id5E5E02370D734B93A583F1B8B44227CC"><enum>(B)</enum><header>Notice</header><clause id="idE2DA3438A0E64AB1B29DE9786E2CA938"><enum>(i)</enum><header>In general</header><text>A notice served on an interested party under paragraph (1) shall include the following:</text><subclause id="id2469482CFFD746C7AA778987D2B167F3"><enum>(I)</enum><text>A description of the proceeding before the Commission relating to the application for a certificate of public convenience and necessity, which shall include the following statement:</text><continuation-text continuation-text-level="subclause">“‘If the applicant ([name of applicant]) wants to build the pipeline on property that you own, and the Commission issues the requested certificate of public convenience and necessity, then the applicant will have the right, subject to paying just compensation, to take your property for its project.’. </continuation-text></subclause><subclause id="id4E708BAAD0E841C2A035964830A18C8D"><enum>(II)</enum><text>Complete instructions on how the interested party can move to intervene in the proceeding described in the notice, including instructions on how to intervene—</text><item id="id39A6968B8DB24C9792BC1FB7786EF018"><enum>(aa)</enum><text>electronically; and</text></item><item id="id8902C7DD75D0425E9B7E3B4B746763DB"><enum>(bb)</enum><text>through a paper filing.</text></item></subclause><subclause id="id86F9E5F904214F929D353D99263025C2"><enum>(III)</enum><text>A clear statement of the contents required to be included in a motion to intervene in the proceeding described in the notice.</text></subclause><subclause id="idBF0F8C7D1B0B40CA985345ADB9C293C5"><enum>(IV)</enum><text>The deadline for the interested party to move to intervene in the proceeding described in the notice.</text></subclause><subclause id="id37B5CA44FF524AF396B4EE81ECBAAA5E"><enum>(V)</enum><text>A section, separated from the remaining text of the notice and clearly displayed in bold print, informing the interested party that—</text><item id="id3849427E18E8485E89F8B2BFC2FC8F13"><enum>(aa)</enum><text>in order to preserve the right to seek judicial review of a decision by the Commission relating to the certificate of public convenience and necessity, the interested party must intervene in the proceeding described in the notice; and</text></item><item id="id8AD6325F8B14462AA59CA757A059C0DB"><enum>(bb)</enum><text>intervention in the proceeding described in the notice is the only way to preserve the right to judicial review described in item (aa).</text></item></subclause></clause><clause id="idD25B192665814021A3085DB8393AC539"><enum>(ii)</enum><header>Review</header><text>The Commission shall—</text><subclause id="id408344A13761402690163D17AE862F66"><enum>(I)</enum><text>review each notice submitted to the Commission under subparagraph (A)(ii) to determine whether the notice meets the requirements described in clause (i); and</text></subclause><subclause id="id483CD1174F6C4094ABA3D16F4A960BB6"><enum>(II)</enum><text>approve the notice only if the notice meets—</text><item id="idD084D033F02A4A82AD63F7465D2B8335"><enum>(aa)</enum><text>those requirements; and </text></item><item id="id08BEE10988FD4508824828940888B1B3"><enum>(bb)</enum><text>any other requirements that the Commission determines to be necessary to provide adequate notice.</text></item></subclause></clause><clause id="id8A0471FE2BF34DBAB9F9EA7B2C445356"><enum>(iii)</enum><header>Service</header><subclause id="id817DC3C25290452588D6135A9182B7E9"><enum>(I)</enum><header>In general</header><text>An applicant may not serve notice on an interested party under paragraph (1) unless the notice has been approved by the Commission under clause (ii).</text></subclause><subclause id="id6BDC1B3378EB42CBAECEDBE4E06DE530"><enum>(II)</enum><header>Deadline</header><text>A notice under paragraph (1) shall be served on an interested party not later than 90 days before the last day on which the interested party may intervene in the proceeding described in the notice.</text></subclause></clause></subparagraph><subparagraph id="id5F28F77A3FEE4BE4BD9CED9860BCE361"><enum>(C)</enum><header>Public availability of information relating to interested parties</header><text>On request of any person, the Commission shall disclose the names and addresses submitted to the Commission under subparagraph (A)(i), subject to such reasonable terms and conditions as the Commission determines to be appropriate.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idC7CC8E1F45C74693886769BA6C0DA92B"><enum>(b)</enum><header>Subsequent notice</header><text display-inline="yes-display-inline">Section 7(e) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f(e)</external-xref>) is amended—</text><paragraph id="idC4E634A8CB8A4D58B72353A777548C84"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the subsection designation and all that follows through <quote>of this section,</quote> in the first sentence and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id57FDDE41B95F47D393875158BBCE46AF"><subsection id="id5D2E962CFBB64D6A911EB339056B1205"><enum>(e)</enum><header>Issuance of certificate</header><paragraph id="id31845953A1404126B9940A136231E339"><enum>(1)</enum><header>In general</header><text>Except in the cases governed by the provisos in subparagraphs (A) and (B) of subsection (c)(1), and subject to paragraphs (2) through (4),</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id058C1FBC3BF7474697C69AD2641F11F0"><enum>(2)</enum><text>in paragraph (1) (as so designated), by striking <quote>necessity; otherwise</quote> in the first sentence and all that follows through <quote>The Commission</quote> in the second sentence and inserting the following: “necessity.</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE2E13B8263934E1EA4AB2570D3BFC3D6"><paragraph id="id64C2CC735B7446B487BF887A1BE73DEC"><enum>(2)</enum><header>Requirement</header><text>The Commission shall deny any application for which the Commission has not made the findings described in paragraph (1).</text></paragraph><paragraph id="id43BEF454E8794CE880D7D5FC2D540DD6"><enum>(3)</enum><header>Terms and conditions</header><text>The Commission</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idBF425144E8F5435D881B73942B0F4B97"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id62CE84C1C07F48C78B74B986D00D7FF4"><paragraph id="id3B944286DD08490A8F371584EDB7DBF2"><enum>(4)</enum><header>Notice of issuance</header><subparagraph id="id02862940775641388650DC4EA5AE815D"><enum>(A)</enum><header>In general</header><text>On issuance of a certificate of public convenience and necessity by the Commission, the applicant requesting the certificate shall provide to each interested party on whom the applicant served notice of the application under subsection (d) a notice of the issuance of the certificate.</text></subparagraph><subparagraph id="idA5E788636B86401DA16B68A0F5E87E2B"><enum>(B)</enum><header>Requirements</header><text>Each notice under subparagraph (A) shall include—</text><clause id="id936653E629594522B85B8B684BDD5F6D"><enum>(i)</enum><text>complete instructions on how the recipient of the notice may apply for a rehearing before the Commission;</text></clause><clause id="id3BE603D7B8DF435A8218630F7042E3F9"><enum>(ii)</enum><text>a clear statement of the contents required to be included in an application for a rehearing before the Commission;</text></clause><clause id="id6E0CDB16E80E42E6B7CF61319FA53AEF"><enum>(iii)</enum><text>the deadline for the recipient to file that application;</text></clause><clause id="id02E3F558FB48474E99353D59255CBCA1"><enum>(iv)</enum><text>the time period for seeking judicial review of a decision of the Commission on an application for rehearing;</text></clause><clause id="id5F21AF8E08304C32AFFF4C634F376D4D"><enum>(v)</enum><text>a statement in bold print informing the recipient that judicial review will not be available with respect to a decision of the Commission on any issue for which the recipient has not sought rehearing before the Commission; and</text></clause><clause id="id1E209E0AE8A34109A1E8C39D79F7AF32"><enum>(vi)</enum><text>a clear reference to—</text><subclause commented="no" display-inline="no-display-inline" id="idA324B413BECD4AC7ACE1B114AE3D4F01"><enum>(I)</enum><text>subsections (a) and (b) of section 19; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idA2FAB8517D17402BA975AD8ACEC8A26B"><enum>(II)</enum><text>any rules issued under those subsections relating to the time or manner of seeking—</text><item commented="no" display-inline="no-display-inline" id="id51D8C4D91D3A4EB88EE67E63423B3293"><enum>(aa)</enum><text>a rehearing before the Commission; or </text></item><item commented="no" display-inline="no-display-inline" id="idA3F55B5CDBED4C718AD6CB0F338349F9"><enum>(bb)</enum><text>judicial review of a decision of the Commission under this section, including any decision on a rehearing. </text></item></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAA3B191A2D004ADD8A5A3430B0F6514C"><enum>(C)</enum><header>Effect of notice</header><text>No court shall have jurisdiction over any action to exercise the right of eminent domain under subsection (h) with respect to any property covered by the applicable certificate of public convenience and necessity issued under this subsection unless the holder of the certificate has provided notice under this paragraph to each interested party described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id5215EBDE2D924F0C841F7459A0F02CE8"><enum>3.</enum><header>Conditioned certificates</header><text display-inline="no-display-inline">Section 7(e) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f(e)</external-xref>) (as amended by section 2(b)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id37935D06647A4097B1545BC0B7A4A769"><paragraph id="idC63E615A031540BD8D0DE28797CEB0ED"><enum>(5)</enum><header>Restrictions</header><subparagraph id="idD8C67C7AAB7742E7B68E7901BC4B1778"><enum>(A)</enum><header>Eminent domain</header><clause id="id59B8DE43EC564A5A91833C6A1FAE6907"><enum>(i)</enum><header>Commencement of action</header><text>A holder of a certificate of public convenience and necessity may not commence an action under subsection (h) until the earlier of—</text><subclause id="id3238462E517A422DA7814F975F9CE572"><enum>(I)</enum><text>the earliest date on which all timely applications for rehearing under section 19(a) have received a ruling on the merits by the Commission under that section; and</text></subclause><subclause id="id64882693021A4D4F8AF50584A75F5347"><enum>(II)</enum><text>the date that is 90 days after the latest date on which a timely application for rehearing under section 19(a) has been deemed denied under paragraph (3)(B)(i) of that section.</text></subclause></clause><clause id="idB1ECFE31215D44C3B5596FE280A5E0A3"><enum>(ii)</enum><header>Jurisdiction over eminent domain actions</header><text>No court shall have jurisdiction over any action to exercise the right of eminent domain under subsection (h) with respect to any property covered by the applicable certificate of public convenience and necessity if the holder of that certificate has not received all certifications, authorizations, approvals, permits, or other permissions required under Federal law—</text><subclause id="id990D7D930C8D481CBEA11DC7F91832D4"><enum>(I)</enum><text>to begin construction; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9998FA40570046029CE493292CD54571"><enum>(II)</enum><text>to complete the entire project for which the certificate was issued.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id92FD864E027D4E4BA36C899E707929E8"><enum>(B)</enum><header>Construction</header><clause commented="no" display-inline="no-display-inline" id="id0BED18A0F8644FA59668921F9D751F3D"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), the holder of a certificate of public convenience and necessity may not begin construction, preconstruction, or land-disturbing activities under that certificate until the later of—</text><subclause commented="no" display-inline="no-display-inline" id="idAD8DE165C61D4EBAB9A3FBA38A7CF327"><enum>(I)</enum><text>the earliest date on which the holder has received all required certifications, authorizations, approvals, permits, or other permissions described in subparagraph (A)(ii); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idCF5E4984D085430A8599685478EDC39B"><enum>(II)</enum><text>the earliest date on which all timely applications for rehearing under section 19(a) have either—</text><item commented="no" display-inline="no-display-inline" id="idB4BA32323A57465A81E09B7046A073DF"><enum>(aa)</enum><text>received a ruling on the merits by the Commission under that section; or</text></item><item commented="no" display-inline="no-display-inline" id="id9DEABD8632DC4B2280A1BB7693B9A3AB"><enum>(bb)</enum><text>been deemed denied under paragraph (3)(B)(i) of that section.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idA6132A14F0D44A4EB13577FDB0BAA46D"><enum>(ii)</enum><header>Exception</header><text>Clause (i) shall not apply to activities described in that clause that are carried out—</text><subclause commented="no" display-inline="no-display-inline" id="id65FFC0F2E461497EB80470E98ABFE922"><enum>(I)</enum><text>on land that is owned by the holder of the certificate of public convenience and necessity; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idC832DDC2AE474207A51DA19D43424A0A"><enum>(II)</enum><text>in an existing utility right-of-way.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idC171FE1DDE224E55AD2E622C49DF5C71"><enum>4.</enum><header>Eminent domain</header><subsection id="idd7fdacbd00b54cc09c644bb8e2afa372"><enum>(a)</enum><header>Statement of policy</header><text>With respect to the construction and operation of natural gas pipelines, it is the policy of the United States to protect the rights of citizens of the United States to their private property, including by limiting the taking of private property by the Federal Government and the use of eminent domain authority granted under any Federal statute to situations in which the taking is for public use, with just compensation, and required by the public convenience and necessity, and not merely to advance the economic interests of private parties that would be given ownership or use of the property taken.</text></subsection><subsection id="id301db4daa0914dd798ca27ab3285c408"><enum>(b)</enum><header>Just compensation</header><text>Section 7(h) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f(h)</external-xref>) is amended—</text><paragraph id="idC3FB32D70B104F6580AE6A6DB8624738"><enum>(1)</enum><text>by striking the subsection designation and all that follows through <quote>When any holder</quote> in the first sentence and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD1FF0E61BF394DA29EF443139497743D"><subsection id="idCB3D56B465A0433FAB163A5054662E63"><enum>(h)</enum><header>Eminent domain</header><paragraph id="id53E44588043F49C18C66A73D1B638505"><enum>(1)</enum><header>In general</header><text>When any holder</text></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="idFBC2F5EC83CA4585AE21ABAD7BB1B82A"><enum>(2)</enum><text>in paragraph (1) (as so designated), in the second sentence—</text><subparagraph id="idDF4CB30E954843AE886211F47D59EDC8"><enum>(A)</enum><text>by striking <quote>The practice</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id16C41C38AF834531A41C62753F4A6BD4"><paragraph id="idC26F859F3F324739B1045E0AD67CA08A"><enum>(2)</enum><header>Practice and procedure</header><subparagraph id="id81D5CCB47C714D6E86B6AE769101F68D"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the practice</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idA65BE365760D424EA8ABBAD072A90D52"><enum>(3)</enum><text>in paragraph (2)(A) (as so designated), by striking <quote>situated: Provided, That the</quote> and inserting the following “situated.</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1B9308E5C8F649909C48748D0D6F063E"><subparagraph id="idD4236308AFF44E838E3D9F9D2F881EA1"><enum>(B)</enum><header>Limitation</header><text>The</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id38E119D5A623468EA02DC35ABFEA7954"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id403BC3D4A0F74348AD7AC36015A6D5F5"><paragraph id="id4322D0AC24E946E49F46298F0F78A8D5"><enum>(3)</enum><header>Just compensation</header><subparagraph commented="no" display-inline="no-display-inline" id="id108969F4E60440E192A1D68EA8D49753"><enum>(A)</enum><header display-inline="yes-display-inline">Definition of lost conservation value</header><text display-inline="yes-display-inline">In this paragraph, the term <term>lost conservation value</term> means—</text><clause commented="no" display-inline="no-display-inline" id="idA7E69592D54D47458F430E25C6EB58CC"><enum>(i)</enum><text display-inline="yes-display-inline">the value of any use of land for conservation purposes (as defined in section 1.170A–14(d) of title 26, Code of Federal Regulations (or a successor regulation)) that is interrupted or prevented by the exercise of the right of eminent domain under paragraph (1); </text></clause><clause commented="no" display-inline="no-display-inline" id="id066364832215437796F41D01F7FFE71E"><enum>(ii)</enum><text display-inline="yes-display-inline">any decrease in the value of land due to the interruption or prevention of a use described in clause (i); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7E97E41AB1F345C9BEAD023A7F2F60DE"><enum>(iii)</enum><text display-inline="yes-display-inline">any lost benefit or decrease in the value of a benefit due to the interruption or prevention of a use described in clause (i).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id22DB9C0CDC5847119638EB12EEF0F98B"><enum>(B)</enum><header display-inline="yes-display-inline">Land subject to a conservation easement</header><text display-inline="yes-display-inline">In determining the just compensation for property acquired by the exercise of the right of eminent domain under paragraph (1), in the case of land subject to a conservation easement, the court with jurisdiction over the proceeding shall consider the lost conservation value of that land.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idF165F7B44F0C40AFBEC85FF898858BAD"><enum>5.</enum><header>Appraisals, offers of compensation, and possession</header><text display-inline="no-display-inline">Section 7(h) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f(h)</external-xref>) (as amended by section 4(b)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id58513BBF7FA64299BAFD30EB6EBE97D6"><paragraph id="idF23A7A148D65463EAF302A1E571FCD88"><enum>(4)</enum><header>Appraisals and offers of compensation</header><subparagraph id="id567DEF66245D4342BEBEB1BAD9CCFAE3"><enum>(A)</enum><header>Appraisals</header><clause id="id675D044F803040058A02079E0C19CBF0"><enum>(i)</enum><header>In general</header><text>The holder of a certificate of public convenience and necessity shall have the property covered by the certificate independently appraised in accordance with generally accepted appraisal standards.</text></clause><clause id="id96317648AEDC4F6988D644DBE09B784E"><enum>(ii)</enum><header>Requirement</header><text>The owner of the applicable property (or a designated representative of the owner) shall be given the opportunity to accompany the appraiser during any inspection of the property that is part of an appraisal under clause (i).</text></clause><clause id="idC8DA50E0485146F98C6122C37B0859C6"><enum>(iii)</enum><header>Timing</header><text>An appraisal under clause (i) shall be carried out before the holder of the certificate of public convenience and necessity makes an offer of compensation to the owner of the applicable property.</text></clause></subparagraph><subparagraph id="id8AB6E3945F824D58B93344C9D7CB7EF1"><enum>(B)</enum><header>Offers of compensation</header><text>Any offer of compensation made to an owner of property that is covered by a certificate of public convenience and necessity—</text><clause id="idF357F7F25E774E7E92F37360A3B1762C"><enum>(i)</enum><text>shall be made in writing;</text></clause><clause id="id135E772BE01A481CB124FAB79E7E5847"><enum>(ii)</enum><text>may not be for an amount less than the fair market value of the property, as determined by an appraisal carried out under subparagraph (A); and</text></clause><clause id="id70ED92F6926A403083F832A704F1E315"><enum>(iii)</enum><text>shall include damages to any property of the owner that is adjacent to the property covered by the certificate.</text></clause></subparagraph></paragraph><paragraph id="idAAD81BBDAFA94613A1C60A65D10620B3"><enum>(5)</enum><header>Jurisdiction over eminent domain actions</header><text>No court shall have jurisdiction over any action to exercise the right of eminent domain under this subsection unless—</text><subparagraph id="id8BD42F8D0EAD4E3184BD3F0A4A4497A4"><enum>(A)</enum><text>an appraisal has been carried out in accordance with subparagraph (A) of paragraph (4); and</text></subparagraph><subparagraph id="id4A57BFA056F340C2B9EB31DA452910C5"><enum>(B)</enum><text>the holder of the certificate of public convenience and necessity has made an offer of compensation to the owner of the applicable property in accordance with subparagraph (B) of that paragraph.</text></subparagraph></paragraph><paragraph id="id5774F361B0744A7B99BE63020C2E3C66"><enum>(6)</enum><header>Right of possession</header><text>An owner of property covered by a certificate of public convenience and necessity shall not be required to surrender possession of the property unless the holder of the certificate—</text><subparagraph id="idE9C208D95ACE4183990322317DF06AA1"><enum>(A)</enum><text>has paid to the owner the agreed purchase price; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCB3C6119C4054D21A3E85978015CE994"><enum>(B)</enum><text>has deposited with the applicable court the amount of the award of compensation in the condemnation proceeding for the property.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id28F90ED4A6314C4EB171E4F4AFF198AC"><enum>6.</enum><header>Process coordination for environmental review</header><text display-inline="no-display-inline">Section 15 of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717n">15 U.S.C. 717n</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA903FC00F3AA49A4AB172A57C06180DA"><subsection id="idF50F35A3D7A74A32AB5ABCB2DBE329B2"><enum>(g)</enum><header>Environmental review for interstate natural gas pipelines</header><paragraph id="idD9FD15AD624F49B48A38AC14D903AE5E"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id6F9476F179C840838E689DEA1C8DE270"><enum>(A)</enum><header>Federal authorization</header><clause id="idFA7DC1C6EBC34E3389040A128AAF435D"><enum>(i)</enum><header>In general</header><text>The term <term>Federal authorization</term> means any authorization required under Federal law with respect to an application for a certificate of public convenience and necessity under section 7.</text></clause><clause id="id5003716DE14042C2B234CF1C15C786B2"><enum>(ii)</enum><header>Inclusions</header><text>The term <term>Federal authorization</term> includes any permits, special use authorizations, certifications, opinions, or other approvals as may be required under Federal law with respect to an application for a certificate of public convenience and necessity under section 7.</text></clause></subparagraph><subparagraph id="idCCE256D917164F75966CB6CBBB677D1A"><enum>(B)</enum><header>Project</header><text>The term <term>project</term> means a project for the construction or extension of facilities for the transportation in interstate commerce of natural gas that requires Federal authorization.</text></subparagraph></paragraph><paragraph id="id4E447F1434D2433B97A7D4796D058A7E"><enum>(2)</enum><header>Cumulative impacts analysis</header><text>In considering an application for Federal authorization for a project in a State, if, during the 1-year period beginning on the date on which the application is filed, an application for Federal authorization for a separate project is filed, and that project is located in the same State and within 100 miles of the first project, the Commission shall consider both projects to be 1 project for purposes of complying with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></paragraph><paragraph id="id6D9C6A5577F146D48F6C9D0BDF31D325"><enum>(3)</enum><header>Supplemental environmental impact statements</header><subparagraph id="idFDFAC69857A6495A9B3212FA6316DCD0"><enum>(A)</enum><header>In general</header><text>If the Commission determines that comments submitted in response to a draft environmental impact statement prepared with respect to an application for Federal authorization raise issues that exceed the initial scope of the draft environmental impact statement, a supplemental environmental impact statement shall be prepared for the project.</text></subparagraph><subparagraph id="id5d2cd72d5ebd4592b118bdc7f74e3b10"><enum>(B)</enum><header>Mitigation plans</header><text>If a draft environmental impact statement prepared with respect to an application for Federal authorization does not include information about mitigation plans for adverse impacts that cannot reasonably be avoided, a supplemental environmental impact statement shall be prepared that includes that information.</text></subparagraph></paragraph><paragraph id="id7CDCF70D1170406D9BD2BDB5E1B57EA2"><enum>(4)</enum><header>Public meeting requirements</header><subparagraph id="id7C0F1F72C0BC4FD6BF95C28A3C8A7819"><enum>(A)</enum><header>In general</header><text>In complying with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) with respect to an application for Federal authorization, the Commission shall ensure that public meetings shall be held—</text><clause id="id67BE17086CCA40C495B4E7693F779082"><enum>(i)</enum><text>in each county or equivalent subdivision in which the project will be located; and</text></clause><clause id="id3FA034C1F1474E3E9CCAFE00B15B173D"><enum>(ii)</enum><text>during each period of public comment preceding, if applicable, publication of—</text><subclause id="idA40A365672404A39A77B089362E32D9B"><enum>(I)</enum><text>a draft environmental impact statement;</text></subclause><subclause id="id7A49EEC111FE4D1EBAAA796A8F9AA55D"><enum>(II)</enum><text>a final environmental impact statement; and</text></subclause><subclause id="id49E630CA74614B09A59D8BCF378C6E9B"><enum>(III)</enum><text>any supplemental environmental impact statement.</text></subclause></clause></subparagraph><subparagraph id="id469EA6563B8A482EAFBA4F2CB965F286"><enum>(B)</enum><header>Notice</header><text>The Commission shall ensure that notice of each meeting held under subparagraph (A)—</text><clause id="id362D19053EBF433EB4C3D93E7719D39C"><enum>(i)</enum><text>is provided to the public and each interested party not later than 30 days before the date of the meeting; and</text></clause><clause id="idA2D26F1DA0D14C4784DA176EB640125C"><enum>(ii)</enum><text>includes the information described in section 7(d)(2)(B)(i).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id4171f15ba6f44ae3aa14e89d7cddf89d"><enum>7.</enum><header>Impacts on critical natural resources</header><text display-inline="no-display-inline">Subsection (g) of section 15 of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717n">15 U.S.C. 717n</external-xref>) (as added by section 6) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id38B96947ED544F4DBAECEF49C8A75211"><paragraph id="idb6a29f2c7b154a5f8ea149267037aa7e"><enum>(5)</enum><header>National scenic trails</header><subparagraph id="idD31F8976D109490389C97D8BE0C8876C"><enum>(A)</enum><header>In general</header><text>In preparing an environmental impact statement with respect to an application for Federal authorization for a project, any evaluation of the visual impacts of the project on a national scenic trail designated by the National Trails System Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1241">16 U.S.C. 1241 et seq.</external-xref>) in the environmental impact statement shall—</text><clause id="id787E1F09389B4DB49CA0A6F52E5C8593"><enum>(i)</enum><text>consider the cumulative visual impacts of any similar proposed project—</text><subclause id="id7821387AC70148AF8C8A792B908549C8"><enum>(I)</enum><text>for which an application for Federal authorization is in the pre-filing or filing stage; and</text></subclause><subclause id="id5030F6E150E1458394E997DD2A7F9AA6"><enum>(II)</enum><text>that impacts the same national scenic trail within 100 miles of the first project; and</text></subclause></clause><clause id="id283110D75F664B54902FA1C67B29636D"><enum>(ii)</enum><text>include visual impact simulations depicting leaf-on and leaf-off views at each location where major visual impacts occur, as identified, authenticated, and justified during the period of public comment preceding the publication of a draft environmental impact statement by the head of the Federal agency or independent agency administering the land at the applicable location.</text></clause></subparagraph><subparagraph id="id62f2dcfb2c5d4e11bebda876993fa8ce"><enum>(B)</enum><header>National forest management plans</header><text>No amendment to a National Forest management plan under the <act-name parsable-cite="FRRRP">Forest and Rangeland Renewable Resources Planning Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600 et seq.</external-xref>) shall be considered if the result of the amendment represents net degradation to the resources of a national scenic trail designated by the National Trails System Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1241">16 U.S.C. 1241 et seq.</external-xref>).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idEB2BCED683224C499F98FE5B526EC83C"><enum>8.</enum><header>Judicial review</header><text display-inline="no-display-inline">Section 19(a) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717r">15 U.S.C. 717r(a)</external-xref>) is amended—</text><paragraph id="id5DFE5CA81F984C8DB3A88427C6082D77"><enum>(1)</enum><text>in the sixth sentence, by striking <quote>Until the record</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id48E4266DD02344988A440CF84A299DE9"><paragraph general</header><text>If the Commission has not ruled on the merits of an application for rehearing under this subsection by the date that is 30 days after the date on which the application for rehearing is filed with the Commission, the application for rehearing shall be deemed denied on that date.</text></clause><clause id="id35c91954f1b34b26aa89abbe32397fbe"><enum>(ii)</enum><header>Orders granting rehearing for further consideration</header><text>For purposes of clause (i), an order granting an application for rehearing solely for the purpose of further considering the issues raised in the application for rehearing shall not be considered to be a ruling on the merits of the application for rehearing.</text></clause><clause id="ida28e276d4d4d4049aa5308d5bf65c71e"><enum>(iii)</enum><header>Judicial review</header><text>An application for rehearing that is deemed denied under clause (i) may be reviewed by a court of appeals of the United States in accordance with subsection (b).</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id43B43F4CCC2448EF80579B6F8CC12830"><enum>(4)</enum><text>in the third sentence,
