which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit agreements between employers that directly restrict the current or future employment of any employee.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idF9ADAF64AFCD4CA69F450C26627BE63C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Employer Collusion Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id7217FDEEAA8242E3B6FEACFE797E6185"><enum>2.</enum><header>Unfair methods on competition relating to restrictive employment agreements</header><subsection id="id89A44CC095A8419AA6D7E97C0EBE56E6"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id0FB3393D0F7B429A8FD3CE1C122E67AE"><enum>(1)</enum><header>Employer</header><text>The term <term>employer</term> has the meaning given the term in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>).</text></paragraph><paragraph id="idB35F0D029975470486C7226E41C0E21F"><enum>(2)</enum><header>Restrictive employment agreement</header><text>the term <term>restrictive employment agreement</term> means any agreement that—</text><subparagraph id="idDED0718B91CB4ED8BC4D34143427AF1A"><enum>(A)</enum><text>is between 2 or more employers, including through a franchise agreement or a contractor-subcontractor agreement; and</text></subparagraph><subparagraph id="idad3e9f9234ce48f3b1b43c2ea3dcbe2d"><enum>(B)</enum><text>prohibits or restricts one such employer from soliciting or hiring the employees or former employees of another such employer.</text></subparagraph></paragraph></subsection><subsection id="id41F10AC435334EE99223D95DBB6893EA"><enum>(b)</enum><header>Conduct prohibited</header><text display-inline="yes-display-inline">It shall be unlawful for any entity to—</text><paragraph id="idE6D01FB426234744A9EBD1911B130B21"><enum>(1)</enum><text display-inline="yes-display-inline">enter into a restrictive employment agreement; or</text></paragraph><paragraph id="idd4ddb7a1ad06488597188d168120b08d"><enum>(2)</enum><text>enforce or threaten to enforce a restrictive employment agreement.</text></paragraph></subsection><subsection id="id9d2a2665c34e4b8d8dea5d1f2f555afe"><enum>(c)</enum><header>Enforcement</header><paragraph id="id0d42f659da404f6d88c923a093e39f70"><enum>(1)</enum><header>Private right of action</header><subparagraph id="idAFAE43D13534413798EFE0EC370065B8"><enum>(A)</enum><header>In general</header><text>Any person who violates subsection (b) shall be liable to any individual harmed as a result of such violation in an amount equal to the sum—</text><clause id="idE14B2A6BD1B440D2B4A262C84FFA34E4"><enum>(i)</enum><text>of any actual damages sustained by the individual as a result of the violation;</text></clause><clause id="id968cd22d3a6a47c9b25ab1041d83df33"><enum>(ii)</enum><text>such amount of punitive damages as the court may allow; and</text></clause><clause id="idab50067ee37d4e28b62765f26deee51f"><enum>(iii)</enum><text>in the case of any successful action to enforce any liability under this section, the costs of the action and any reasonable attorney’s fees, as determined by the court.</text></clause></subparagraph><subparagraph id="id32817DC6EC354FCA9B90216C2C046286"><enum>(B)</enum><header>Venue</header><text>An individual described in subparagraph (A) may bring a civil action under subparagraph (A) in any appropriate district court of the United States.</text></subparagraph></paragraph><paragraph id="ida96d8d0eba86413b979cd204e516da7b"><enum>(2)</enum><header>Federal Trade Commission</header><subparagraph id="id668f0d6aff56491695990c410c5e1dd3"><enum>(A)</enum><header>In general</header><text>The Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section.</text></subparagraph><subparagraph id="id97098537092743ac9b1c027c78f0bc29"><enum>(B)</enum><header>Privileges and immunities</header><text>Any person who violates subsection (b) shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph></paragraph></subsection></section></legis-body></bill>
