which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require verification of the financial independence of financial services counselors in the Department of Defense.</official-title></form><legis-body><section id="ida4a26ef32ed04d248cdea2c91cd50d16" section-type="section-one"><enum>1.</enum><header>Verification of the financial independence of financial services counselors in the Department of Defense</header><subsection id="H7D1F83D6E9594295983A4A7143108406"><enum>(a)</enum><header>Verification of financial independence</header><text display-inline="yes-display-inline">Section 992(b) of title 10, United States Code, is amended—</text><paragraph id="HBDD56BAD966446EE93F6CA4F6D8FFCEE"><enum>(1)</enum><text>in paragraph (2)(A)—</text><subparagraph id="HFA8CC3895F1F458B9B5D842272EE6BF4"><enum>(A)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H1C965A6BA63844AA973D5EF874214A54"><enum>(B)</enum><text>in clause (ii)—</text><clause id="H571A553F0E524164A84DDD01BBDFF57A"><enum>(i)</enum><text>by striking <quote>may</quote> and inserting <quote>shall</quote>;</text></clause><clause id="H9A553A2642634406AB4821C76D1B4859"><enum>(ii)</enum><text>by striking <quote>installation by any means elected by the Secretary from among the following:</quote> and inserting <quote>installation—</quote>;</text></clause><clause id="H072CFACD42E44FB8AC9C7784DB9FB72F"><enum>(iii)</enum><text>in subclause (I)—</text><subclause id="HFC77C76F51AF4B0B879EC4559E754C11"><enum>(I)</enum><text>by striking <quote>Through</quote> and inserting <quote>through</quote>; and</text></subclause><subclause id="H937340F9E10C43D7842414B44603897F"><enum>(II)</enum><text>by striking <quote>Defense.</quote> and inserting <quote>Defense;</quote>;</text></subclause></clause><clause id="HC4A11225FA194339852244B743798FA4"><enum>(iv)</enum><text>in subclause (II)—</text><subclause id="HB3F12686BDF54367914C8C0904B8FF88"><enum>(I)</enum><text>by striking <quote>By contract</quote> and inserting <quote>by contract</quote>; and</text></subclause><subclause id="H54F2D004CD3743CEB936C24546A33247"><enum>(II)</enum><text>by striking <quote>Internet.</quote> and inserting <quote>Internet; or</quote>; and</text></subclause></clause><clause id="HDBE7BB43353D4B9CB110F178ECA0E8D1"><enum>(v)</enum><text>in subclause (III)—</text><subclause id="H4252AA7CE10A4B0391CB31214733BBC1"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>Through</quote> and inserting <quote>through</quote>; and</text></subclause><subclause id="HF51696ED31A14416945EED2714C00601"><enum>(II)</enum><text>by striking <quote>counseling.</quote> and inserting <quote>counseling; and</quote>; and</text></subclause></clause></subparagraph><subparagraph id="H59D40305B9AF46B694D477751437B380"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following new clause:</text><quoted-block style="USC" id="H9DAC3ED64838498A8CFC2B0801EC739C" display-inline="no-display-inline"><clause id="HF3DCAE289AC246DEA37F91F444877FA5" indent="up2"><enum>(iii)</enum><text display-inline="yes-display-inline">may not provide financial services through any individual unless such individual agrees to submit financial disclosures annually to the Secretary.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H639B87C2FD6A4304AF384AE426A12EFE"><enum>(2)</enum><text>in paragraph (2)(B), by striking <quote>installation by any of the means set forth in subparagraph (A)(ii), as elected by the Secretary concerned.</quote> and inserting <quote>installation in accordance with the requirements established under clauses (ii) and (iii) of subparagraph (A).</quote>; and</text></paragraph><paragraph id="HA4827DA23135474A93F4A9CC485ED30D"><enum>(3)</enum><text>in paragraph (4)—</text><subparagraph id="H4E634D9858B44084A1442625252F0996"><enum>(A)</enum><text>by inserting <quote>(A)</quote> before <quote>The Secretary</quote>; and</text></subparagraph><subparagraph id="H8781649B304A4000A1BA23EA9A367B71"><enum>(B)</enum><text>by inserting at the end the following new subparagraphs:</text><quoted-block style="OLC" id="HC7DC1E9D4ACF48D1A29733DA83557AC4" display-inline="no-display-inline"><subparagraph id="H0AE5381EE25F42F58E5543D5E7768E73" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">In carrying out the requirements of subparagraph (A), the Secretary concerned shall establish a requirement that each financial services counselor under paragraph (2)(A)(i), and any other individual providing counseling on financial services under paragraph (2), submit financial disclosures annually to the Secretary.</text></subparagraph><subparagraph id="H80D7756233E6442EA36EF20B033FE8A4" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary concerned shall review all financial disclosures submitted pursuant to subparagraph (B) to ensure the counselor, or the individual providing counseling, is free from conflict as required under this paragraph.</text></subparagraph><subparagraph id="H069F4A9696ED4113AF6885342C74514B" indent="up2"><enum>(D)</enum><text display-inline="yes-display-inline">If the Secretary concerned determines that a financial services counselor under paragraph (2)(A)(i), or any other individual providing counseling on financial services under paragraph (2), is not free from conflict as required under this paragraph, the Secretary shall ensure that the counselor, or the individual providing counseling, does not provide such services until such time as the Secretary determines that such conflict is resolved.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H41D3D8E2A1C04AE88B32E3D69109058F"><enum>(b)</enum><header>Report on financial independence</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and annually thereafter, each Secretary concerned shall submit to Congress a report on the percentage of financial services counselors under paragraph (2)(A)(i) of section 992(b) of title 10, United States Code (as amended by subsection (a)), and other individuals providing counseling on financial services under paragraph (2) of such section (as amended by subsection (a)), whom the Secretary determined to be free from conflicts as required under paragraph (4) of such section (as amended by subsection (a)). </text></subsection><subsection id="HD834B8BAC254489996BF1D5E6F1B6D00" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Secretary concerned defined</header><text display-inline="yes-display-inline">In this section, the term <term>Secretary concerned</term> has the meaning given to such term in section 101 of title 10, United States Code. </text></subsection></section></legis-body></bill>
