<section section-type="section-one" id="H6B004E3414AA486FB30098D90C926DA8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Funding Our Adversaries Act of 2023</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id697ae90c4db048298e4c46452113b1fd"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id3dc6a36a85b34d448f5513f5d6b4608d"><enum>(1)</enum><text>to ensure that Federal funding does not support any research in China; and </text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id5623858ff7504ea18d87ed11908340d7"><enum>(2)</enum><text display-inline="yes-display-inline">to combat the military-civilian fusion policy of the People's Republic of China.</text></paragraph></section>
<section commented="no" display-inline="no-display-inline" id="ideb1b201735d647a7b9860e9f8910263b"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="id60057ea59ba7485fa5426150f8fbc8a6"><enum>(1)</enum><header>Chinese Communist Party</header><text>The term <quote>Chinese Communist Party</quote> includes any agent or instrumentality of the Chinese Communist Party and any entity owned by or controlled by the Chinese Communist Party.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id9f5d499eae66404ba96d7c98038eb99a"><enum>(2)</enum><header>Federal agency</header>
<subparagraph commented="no" display-inline="no-display-inline" id="ide54e50d36ecc4fb0b4459e277023f1c1"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>Federal agency</quote> has the meaning given the term in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>).</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id48908dbc79e04dc599a6d5818ae5a4ea"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <quote>Federal agency</quote> includes the Department of Defense, the Department of Veterans Affairs, the Department of Energy, the Environmental Protection Agency, the Department of the Interior, the Department of Transportation, the Department of Health and Human Services, the Department of Agriculture, the Department of Homeland Security, the Department of Commerce, the Department of Education, the Department of Housing and Urban Development, the Department of Justice, the Department of Labor, the Department of State, the Department of the Treasury, the Small Business Administration, the United States Agency for International Development, the National Science Foundation, and the Smithsonian Institution.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id1f305ec783af4fe58b80d796706b44b6"><enum>(3)</enum><header>Federal funding</header><text display-inline="yes-display-inline">The term <quote>Federal funding</quote>—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idd825eea9adfd4baeae92cf0a9136aab9"><enum>(A)</enum><text display-inline="yes-display-inline">means any grant, subgrant, contract, cooperative agreement, and any other method through which the Federal Government provides funding to a recipient; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id5de8f9a566eb4a95adc768403d110075"><enum>(B)</enum><text>includes a method through which the Federal Government provides funding to a subrecipient at any tier.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id7ccb7d90ac5e41848ba0f5d32d0b6817"><enum>(4)</enum><header>Government of the People's Republic of China</header><text>The term <quote>Government of the People's Republic of China</quote> includes—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="idc90ea2a922af405c8e0611d0487cb0e9"><enum>(A)</enum><text display-inline="yes-display-inline">any agent or instrumentality of the Government of the People's Republic of China;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id5eca70bc01214a13a493b3f9edf178a1"><enum>(B)</enum><text display-inline="yes-display-inline">any entity owned by or controlled by the People’s Republic of China; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id12352d7a723e45228fe05fdf25dfdd7b"><enum>(C)</enum><text>any organization managed by the Government of the People's Republic of China, the People's Liberation Army Ground Force of China, and any public institution of higher learning in China.</text></subparagraph></paragraph></section> <section id="H952704F5169F468999DEA8C0A15707F1"><enum>4.</enum><header>Prohibition on funding research in China</header><text display-inline="no-display-inline">The head of a Federal agency may not directly or indirectly support, through any Federal funding, research that will be conducted by the Government of the People's Republic of China or the Chinese Communist Party.</text></section>
