<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 2520</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230726">July 26, 2023</action-date><action-desc><sponsor name-id="S409">Mr. Luján</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the standardization of reciprocal fire suppression cost share agreements, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H981F30A00BD946C1B08F6F470E102B4C"><section section-type="section-one" id="H41B47B3809C7473BBE78E1745EC3420F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fire Department Repayment Act of 2023</short-title></quote>.</text></section><section id="HF8EA8D54105F421A8EA86BC360F9AE48"><enum>2.</enum><header>Requirements relating to certain fire suppression cost share agreements</header><subsection id="H141E357FB2E447E4A52C1FFAF90D601D"><enum>(a)</enum><header>Secretaries defined</header><text>In this section, the term <term>Secretaries</term> means—</text><paragraph id="HCB5023F19F704ACF9A31204514744D03"><enum>(1)</enum><text>the Secretary of Agriculture;</text></paragraph><paragraph id="H23BAFC1550C94968AEC414D4888F38EE"><enum>(2)</enum><text>the Secretary of the Interior;</text></paragraph><paragraph id="H196827EA8C9C4C2D9F3EE3B1D083C168"><enum>(3)</enum><text>the Secretary of Homeland Security; and</text></paragraph><paragraph id="HCB7747CB337741C3A472E64AA48D0D21" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>the Secretary of Defense. </text></paragraph></subsection><subsection id="H7AB5749040A84D47969A3C15D8455908"><enum>(b)</enum><header>Establishment of standard operating procedures</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Secretaries shall—</text><paragraph id="HFF9F33B8692A4A09A47A01FDA20731ED"><enum>(1)</enum><text display-inline="yes-display-inline">establish standard operating procedures relating to fire suppression cost share agreements established under the Act of May 27, 1955 (<external-xref legal-doc="usc" parsable-cite="usc/42/1856a">42 U.S.C. 1856a</external-xref>) (commonly known as the <quote>Reciprocal Fire Protection Act</quote>); and</text></paragraph><paragraph id="H4EF850653AD64B7492DABE2F568F85AA"><enum>(2)</enum><text>with respect to each fire suppression cost share agreement in operation on such date—</text><subparagraph id="H0191308486AA42BF95545CBA515E2E38"><enum>(A)</enum><text>review each agreement; and</text></subparagraph><subparagraph id="H6210E9467108454BA4E6F33CB3522584"><enum>(B)</enum><text>modify each agreement as necessary to comply with the standard operating procedures required under paragraph (1).</text></subparagraph></paragraph></subsection><subsection id="HE33C43516D934558B94317221E632EC3"><enum>(c)</enum><header>Alignment of fire suppression cost share agreements with cooperative fire protection agreements</header><text display-inline="yes-display-inline">The standard operating procedures required under subsection (b)(1) shall include a requirement that each fire suppression cost share agreement be aligned with each of the cooperative fire protection agreements applicable to the entity subject to the fire suppression cost share agreement.</text></subsection><subsection id="HEE7CB75A77A542159635F76BC72E0A60"><enum>(d)</enum><header>Second-Level review</header><text>The standard operating procedures required under subsection (b)(1) shall include—</text><paragraph id="H95CBDA1F8314464B8F18C4046805034C"><enum>(1)</enum><text>a requirement that the Secretaries, to the maximum extent practicable, complete reviews, including second-level reviews of a fire suppression cost share agreement, as soon as practicable after a wildfire relating to the area covered by the fire suppression cost share agreement is contained; and </text></paragraph><paragraph id="H07F4CDEBFB604D5FA7743BE029C97753"><enum>(2)</enum><text>a requirement that in completing the reviews under paragraph (1), the Secretaries consult with State and local fire suppression organizations.</text></paragraph></subsection></section></legis-body></bill>
