which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to provide for penalties for the unauthorized disclosure of confidential information by officers or employees of the Supreme Court, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD72950E823E24A40B21E36B86332B741"><section section-type="section-one" id="id9dc21f1924b24d21a1663e10f8540e72"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Supreme Court Leakers Act of 2023</short-title></quote>.</text></section><section id="H572C31424DC9428DBB9C4BEA23F2CBB9"><enum>2.</enum><header>Obstruction of Supreme Court deliberations</header><subsection id="HA70201AB7C0C423FBE7DE8DC5D53A8DB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/73">Chapter 73</external-xref> of title 18, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="H952019D7B6E64F43848866E2242616D6"><section id="HCCAED849B5B741A79D2B0AFF8BB94655"><enum>1522.</enum><header>Obstruction of Supreme Court deliberations</header><subsection id="id6BC9F03298C44C8FBE6733D47D489BD7"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>confidential information</term> includes—</text><paragraph id="id8E22A9C174A84D76915AD0027BA29D01"><enum>(1)</enum><text>internal notes taken by an employee of the Supreme Court of the United States on cases heard by the Supreme Court;</text></paragraph><paragraph id="idB09ADD3AF1044E028DF817CFF797B034"><enum>(2)</enum><text>any communication between the Chief Justice of the United States or an associate justice of the Supreme Court of the United States and an employee or officer of the Supreme Court;</text></paragraph><paragraph id="id274F02EE1E9F496DA71E91D90EBEEFAE"><enum>(3)</enum><text>a communication between officers and employees of the Supreme Court of the United States on a matter pending before the Supreme Court;</text></paragraph><paragraph id="id205670F4E2EF40FBAE0306D511D002E4"><enum>(4)</enum><text>a draft opinion or a final opinion prior to the date on which such opinion is released to the public;</text></paragraph><paragraph id="id3940A77D88B74415B1C99C229C37D8AE"><enum>(5)</enum><text>personal information of the Chief Justice of the United States or an associate justice of the Supreme Court of the United States that is not otherwise legally available to the public; and</text></paragraph><paragraph id="idC2D136D87BAE41C892E81D0E2B94F2AD"><enum>(6)</enum><text>any other information designated to be confidential by the Chief Justice of the United States prior to the date on which a violation of subsection (b) occurs.</text></paragraph></subsection><subsection id="H72CA72D3452F4774A73DA7409A6FEB49"><enum>(b)</enum><header>Prohibition</header><text display-inline="yes-display-inline">It shall be unlawful for any person, while serving as an officer or employee of the Supreme Court, to knowingly publish, divulge, disclose, or make known in any manner or to any extent not authorized by law any confidential information coming to that officer or employee in the course of the employment or official duties of that officer or employee.</text></subsection><subsection id="idB678DFEB2DEF422EBAE7003C950F9DFB"><enum>(c)</enum><header>Criminal penalties</header><paragraph id="id0F2E2E18FE2E46B7B183D4973D89E332"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), any individual who violates, or conspires to violate, subsection (b) shall be imprisoned not more than 10 years and fined under this title.</text></paragraph><paragraph id="idA5BB426CB5C04DE9A0161FE288046D11"><enum>(2)</enum><header>Internal notes</header><text>Any individual who violates, or conspires to violate, subsection (a) with confidential information described in subsection (a)(1) shall be fined $10,000.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id99cf93f40d114321a9a79cad44cb5606"><enum>(b)</enum><header>Criminal forfeiture</header><text>Section 982(a)(2)(B) of title 18, United States Code, is amended by striking <quote>1029, or 1030</quote> and inserting <quote>1029, 1030, or 1522</quote>.</text></subsection><subsection id="HAAD609865D964A59A1D5BD8147E2C5D6"><enum>(c)</enum><header>Table of contents</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/73">chapter 73</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9AFD6C5105D54F2AA11B4476248CEB29"><toc regeneration="no-regeneration"><toc-entry level="section">1522.
