<official-title>To prohibit unfair and deceptive advertising of prices for hotel rooms and other places of short-term lodging, and for other purposes. </official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hotel Fees Transparency Act of 2023</short-title></quote>.</text></section> <section id="idc88aa5dbabcf4a40a43aa544d2adb064"><enum>2.</enum><header>Prohibition on unfair and deceptive advertising of hotel rooms and other short-term lodging prices</header> <subsection id="id757dd9aad7b3447d819f7c2aa8be3489"><enum>(a)</enum><header>Prohibition</header> <paragraph commented="no" display-inline="no-display-inline" id="ideb4650bb6d1b4bb18e91fa1cec32de7e"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No covered person may advertise, display, market, or offer in interstate commerce, including through direct offerings, third-party distribution, or metasearch referrals, a price for a place of short-term lodging that does not include all required fees (excluding any taxes or fees imposed by a government or quasi-government entity and assessment fees of a government-created special district or program). </text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ide4a7f8a0e8fd4842addd0a8f313a909d"><enum>(2)</enum><header>Individual components</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to prohibit the display of— </text> <subparagraph commented="no" display-inline="no-display-inline" id="id02f90f40de014f7a913748da9695d39b"><enum>(A)</enum><text display-inline="yes-display-inline">individual components of the total price; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idbfb5c25ef75743d685a7a85793a12907"><enum>(B)</enum><text>details of taxes or other items not required by paragraph (1). </text></subparagraph></paragraph></subsection> <subsection id="id4f11843eb1a34eb286a513e53865cb2c"><enum>(b)</enum><header>Enforcement</header> <paragraph commented="no" display-inline="no-display-inline" id="id2ce47b28d86d4cd897306ef3603c06f8"><enum>(1)</enum><header display-inline="yes-display-inline">Enforcement by the Commission</header> <subparagraph id="id50001e3674d34bbaa19fe70ee7dfdbab"><enum>(A)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of subsection (a) shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></subparagraph>
<subparagraph id="idb546a939c00e4ede8846943f8c0beb4c"><enum>(B)</enum><header>Powers of the Commission</header>
<clause id="id9594bf4e912648c792f6b33df69dc63a"><enum>(i)</enum><header>In general</header><text>The Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act. </text></clause> <clause commented="no" display-inline="no-display-inline" id="id5f35e849440f46ecb2039d502120b406"><enum>(ii)</enum><header>Privileges and immunities</header><text display-inline="yes-display-inline">Any person who violates this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></clause>
<clause commented="no" display-inline="no-display-inline" id="id39741850847d414b899e8e3077c0c807"><enum>(iii)</enum><header>Authority preserved</header><text>Nothing in this section shall be construed to limit the authority of the Commission under any other provision of law.</text></clause></subparagraph></paragraph> <paragraph id="id2d0fe011e587413daf844e89475d3d51"><enum>(2)</enum><header>Enforcement by states</header> <subparagraph id="idadea3c0f757349259cde7b7437024ff2"><enum>(A)</enum><header>In general</header><text>If the attorney general of a State has reason to believe that an interest of the residents of the State has been or is being threatened or adversely affected by a practice that violates subsection (a), the attorney general of the State may, as parens patriae, bring a civil action on behalf of the residents of the State in an appropriate district court of the United States to obtain appropriate relief. </text></subparagraph>
<subparagraph id="id0927cd4aa359435e83df19ef1fb23ec3"><enum>(B)</enum><header>Rights of the Commission</header>
<clause id="id6cc10b368d2c47ac9c9cddd7a9a2eae0"><enum>(i)</enum><header>Notice to the Commission</header>
<subclause id="id2b8aa3afce20401290e4973ea7c7409d"><enum>(I)</enum><header>In general</header><text>Except as provided in subclause (III), the attorney general of a State, before initiating a civil action under subparagraph (A) shall notify the Commission in writing that the attorney general intends to bring such civil action.</text></subclause> <subclause id="id433babb9015f44d482d82b2c356fc1ab"><enum>(II)</enum><header>Contents</header><text>The notification required by subclause (I) shall include a copy of the complaint to be filed to initiate the civil action.</text></subclause>
<subclause id="id41ce4b00536f46109b0fbe455a9af5a8"><enum>(III)</enum><header>Exception</header><text>If it is not feasible for the attorney general of a State to provide the notification required by subclause (I) before initiating a civil action under subparagraph (A), the attorney general shall notify the Commission immediately upon instituting the civil action.</text></subclause></clause> <clause id="idb1b000a6209041a9be893a7836d2f12e"><enum>(ii)</enum><header>Intervention by the Commission</header><text>The Commission may—</text>
<subclause id="id8b9ecf2e47b44cdfa16df32f46f5bd01"><enum>(I)</enum><text>intervene in any civil action brought by the attorney general of a State under subparagraph (A); and</text></subclause> <subclause id="id1d625af2c816433081d4699e003f5837"><enum>(II)</enum><text>upon intervening—</text>
<item id="id17872fa0e3154c68b0a9c49a81a250ad"><enum>(aa)</enum><text>be heard on all matters arising in the civil action; and</text></item> <item id="id43b39887bdd94ebfb2372b87022ee158"><enum>(bb)</enum><text>file petitions for appeal of a decision in the civil action.</text></item></subclause></clause></subparagraph>
<subparagraph id="idf8420429759d49c6ba1352032af3d901"><enum>(C)</enum><header>Investigatory powers</header><text>Nothing in this paragraph may be construed to prevent the attorney general of a State from exercising the powers conferred on the attorney general by the laws of the State to conduct investigations, to administer oaths or affirmations, or to compel the attendance of witnesses or the production of documentary or other evidence.</text></subparagraph> <subparagraph id="idc7e1a60b835d406a910b64d7ade0623b"><enum>(D)</enum><header>Coordination with the Commission</header><text>If the Commission institutes a civil action or an administrative action with respect to a violation of subsection (a), the attorney general of a State shall coordinate with the Commission before bringing a civil action under subparagraph (A) against any defendant named in the complaint of the Commission for the violation with respect to which the Commission instituted such action.</text></subparagraph>
<subparagraph id="idc8e6e5ea548c4a6aa14107d0ebb3462c"><enum>(E)</enum><header>Venue; service of process</header>
<clause id="ida473c6921e304af79e6b707bc3aff035"><enum>(i)</enum><header>Venue</header><text>Any action brought under subparagraph (A) may be brought in—</text> <subclause id="id2b56b6a22e794704857aa22a56107592"><enum>(I)</enum><text>the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28, United States Code; or</text></subclause>
<subclause id="id057f647fadfa41cb8d19112044727760"><enum>(II)</enum><text>another court of competent jurisdiction.</text></subclause></clause> <clause id="id4a4066a8e9c6433f928732d0ca6676a8" commented="no"><enum>(ii)</enum><header>Service of process</header><text>In an action brought under subparagraph (A), process may be served in any district in which—</text>
<subclause id="id5d6001ce11034ee691a67db5b995218e" commented="no"><enum>(I)</enum><text>the defendant is an inhabitant, may be found, or transacts business; or</text></subclause> <subclause id="id7244a5eb41414d5eafb8f0931c40b662" commented="no"><enum>(II)</enum><text>venue is proper under section 1391 of title 28, United States Code.</text></subclause></clause></subparagraph>
<subparagraph id="ide6f9ce28e5df48a5b67cc8c95ecf4c5d"><enum>(F)</enum><header>Actions by other state officials</header>
<clause id="id7a0ccf05052447e3a419cc29becc6c8c"><enum>(i)</enum><header>In general</header><text>In addition to civil actions brought by an attorney general under subparagraph (A), any other officer of a State who is authorized by the State to do so may bring a civil action under subparagraph (A), subject to the same requirements and limitations that apply under this paragraph to civil actions brought by attorneys general.</text></clause> <clause id="idab7a42eb6ff94966a0a0c0773e0188a4"><enum>(ii)</enum><header>Savings provision</header><text>Nothing in this paragraph may be construed to prohibit an authorized official of a State from initiating or continuing any proceeding in a court of the State for a violation of any civil or criminal law of the State.</text></clause></subparagraph></paragraph></subsection>
<subsection id="ide8a07fbbfae5471b8ffe215cb9bef06c"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="id809452b957474338bbea918407ae39f5"><enum>(1)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idb479c284ae5a473c9d4d93c47dfe3236"><enum>(2)</enum><header>Covered person</header><text>The term <term>covered person</term> means a person with respect to whom the Commission has jurisdiction under section 5(a)(2) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(a)(2)</external-xref>), including a place of short-term lodging, an online travel agency, a metasearch website, or any other person determined appropriate by the Commission.</text></paragraph> <paragraph id="id1b1af62761a84118a88716c0953f43ce"><enum>(3)</enum><header>Place of short-term lodging</header><text>The term <term>place of short-term lodging</term> means a hotel, motel, inn, short-term rental, or other place of lodging that advertises at a price that is a nightly, hourly, or weekly rate.</text></paragraph>
<paragraph id="idea203eeb2aa84c4b863f282ef44494cf"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means each of the 50 States, the District of Columbia, and any territory or possession of the United States.</text></paragraph></subsection> <subsection id="id35190afffcb9421f9710e1de7dfe61ad"><enum>(d)</enum><header>Effective date</header> <paragraph commented="no" display-inline="no-display-inline" id="id08c968f862474f6abad351864d94be04"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the prohibition under subsection (a) shall take effect 450 days after the date of the enactment of this Act.</text></paragraph>
<paragraph id="idf031b44f1d7541349c2928a6a762c774"><enum>(2)</enum><header>Application to prior bookings</header><text>The prohibition under subsection (a) shall only apply to bookings for a place of short-term lodging made on or after the effective date described in paragraph (1).</text></paragraph></subsection></section> </legis-body> </bill>
