<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 2490</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230725">July 25, 2023</action-date><action-desc><sponsor name-id="S381">Mr. Rounds</sponsor> (for himself and <cosponsor name-id="S338">Mr. Manchin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to authorize the head of a department or organization within the Department of Defense to place an order with any other such department or organization for certain construction projects on a reimbursable basis.</official-title></form><legis-body><section id="id35a8fd2b398f4c5288def5b0d138eab0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Taxpayer-Funded Facility Restoration Stewardship Act</short-title></quote>.</text></section><section id="id7ed7baaf054348c795f481c0635ded7d"><enum>2.</enum><header>Ordering authority for maintenance, repair, and construction of facilities of Department of Defense</header><subsection id="id79a27c29e2f14c47b4f93bece2fe51f1"><enum>(a)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/169">chapter 169</external-xref> of title 10, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="idf44ba69836d2474ca5a3fa3824e14d55"><section id="id0e03679b8bb5498086e37d4ba6847cac"><enum>2817.</enum><header>Ordering authority</header><subsection id="id1cfc88913f644549a5a2e687943d7157"><enum>(a)</enum><header>In general</header><text>The head of a department or organization within the Department of Defense may place an order, on a reimbursable basis, with any other such department or organization for a project for the maintenance and repair of a facility of the Department of Defense or for a minor military construction project.</text></subsection><subsection id="idb39483e015014f6ca4d2799bb44e39f1"><enum>(b)</enum><header>Obligations</header><text>An order placed by the head of a department or organization under subsection (a) is deemed to be an obligation of such department or organization in the same manner as a similar order or contract placed with a private contractor.</text></subsection><subsection id="id13906afff06a47de867b2f342bd58413"><enum>(c)</enum><header>Contingency expenses</header><text>An order placed under subsection (a) for a project may include an amount for contingency expenses that shall not exceed 10 percent of the cost of the project.</text></subsection><subsection id="id1ffed826a53e42feb8a6089483b47ec7"><enum>(d)</enum><header>Availability of amounts</header><text>Amounts appropriated or otherwise made available to a department or organization of the Department of Defense shall be available to pay an obligation of such department or organization under this section in the same manner and to the same extent as those amounts are available to pay an obligation to a private contractor.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id6f4291e0faae4267958cbb3b0414d012"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such subchapter is amended by adding at the end the following new item:</text><quoted-block style="USC" id="idc9565d8e-401c-4d4f-a543-e44fc75ecd78"><toc><toc-entry level="section" idref="id0e03679b8bb5498086e37d4ba6847cac">2817.
