<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 2468</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230725">July 25, 2023</action-date><action-desc><sponsor name-id="S350">Mr. Rubio</sponsor> (for himself, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, and <cosponsor name-id="S397">Mr. Braun</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title III of division H of the Consolidated Appropriations Act, 2023 to prohibit the expenditure of funds on divisive concepts under the priorities noticed in the proposed rule submitted by the Department of Education relating to Proposed Priorities-American History and Civics Education.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6387452B9B2F4501A24B803BDB02419C"><section section-type="section-one" id="H90FC7203647F4126A5A89B23AED28486"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Equality And Civics Education Act of 2023</short-title></quote> or the <quote><short-title>PEACE Act of 2023</short-title></quote>. </text></section><section id="H39F21ADA907C42A1AFD0D053F74B9B84"><enum>2.</enum><header>Limitation on use of funds</header><text display-inline="no-display-inline">After section 314 of title III of division H of the Consolidated Appropriations Act, 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>), insert the following:</text><quoted-block style="appropriations" display-inline="no-display-inline" id="idcce39e8d36ca47adbc2b761ec297bd45"><section id="HD78D8FC78FFC47E0A07062548D4A8CAD"><enum>315.</enum><subsection commented="no" display-inline="yes-display-inline" id="id7AF67413D36D42248891C7EE021B85B5"><enum>(a)</enum><text display-inline="yes-display-inline">None of the funds made available by this title for an American history and civics education program under subpart 3 of part B of title II of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6661">20 U.S.C. 6661 et seq.</external-xref>) may be used to fund curriculum, or teaching or counseling, that promotes or compels a divisive concept under the priorities noticed in the proposed rule submitted by the Department of Education relating to Proposed Priorities-American History and Civics Education (published at 86 Fed. Reg. 20348 (April 19, 2021)).</text></subsection><subsection id="id78F4BCDA9E5449F58CFB27D31A804841"><enum>(b)</enum><text display-inline="yes-display-inline">In this section: </text><paragraph id="id60a2e8adcf4c48ad87e05db279d39eb4"><enum>(1)</enum><text>The term <term>promotes or compels a divisive concept</term>, means race stereotyping or race scapegoating, or promotion of one or more of the following concepts:</text><subparagraph id="idfc08a12516554e3bbcaaedda89e0acf9"><enum>(A)</enum><text>One race is inherently superior to another race.</text></subparagraph><subparagraph id="id1dfba2a705234756bf2f84812fb8a1cd"><enum>(B)</enum><text>The United States is fundamentally racist.</text></subparagraph><subparagraph id="id79ef549ec3614934b554a915e968c8d6"><enum>(C)</enum><text>An individual, by virtue of his or her race, is inherently racist or oppressive, whether consciously or unconsciously.</text></subparagraph><subparagraph id="idd46c9d985f7144f9afc281ecde016b8d"><enum>(D)</enum><text>An individual should be discriminated against or receive adverse treatment solely or partly because of his or her race.</text></subparagraph><subparagraph id="idcdaf714ce95b446b9ef550ba04f69904"><enum>(E)</enum><text>Members of one race cannot and should not attempt to treat others without respect to race.</text></subparagraph><subparagraph id="id401846ed881c4e47ba495b00e3c0a193"><enum>(F)</enum><text>An individual's moral character is necessarily determined by his or her race.</text></subparagraph><subparagraph id="idf3349e4a15c44aa7b613f2f04ec924b9"><enum>(G)</enum><text>An individual, by virtue of his or her race, bears responsibility for actions committed in the past by other members of the same race.</text></subparagraph><subparagraph id="id3d1878ba8dbd492eb3a7c7c4e64330ef"><enum>(H)</enum><text>Any individual should feel discomfort, guilt, anguish, or any other form of psychological distress on account of his or her race.</text></subparagraph><subparagraph id="id5706c50af59d42a39015d5ae26351e88"><enum>(I)</enum><text>Meritocracy or traits such as a hard work ethic are racist, or were created by a particular race to oppress another race. </text></subparagraph></paragraph><paragraph id="id5f4e987ad45b46f8af104b168b559952"><enum>(2)</enum><text>The term <term>race scapegoating</term> means assigning fault, blame, or bias to a race, or to members of a race because of their race.</text></paragraph><paragraph id="idbe2dd2d5fe32434bb71973a6d654a2fc"><enum>(3)</enum><text>The term <term>race stereotyping</term> means ascribing character traits, values, moral and ethical codes, privileges, status, or beliefs to a race, or to an individual because of the individual’s race.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
