which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide requirements for the appropriate Federal banking agencies when requesting or ordering a depository institution to terminate a specific customer account, to provide for additional requirements related to subpoenas issued under the Financial Institutions Reform, Recovery, and Enforcement Act of 1989, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H8C3511CE2F864C749290C7B49DD25C16"><section section-type="section-one" id="HD848896496DA41F0875DD46B3DB92110"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Financial Institution Customer Protection Act of 2023</short-title></quote>.</text></section><section id="H0EE2ACCBF06C45BF9CAB9E1DEBCCF301"><enum>2.</enum><header>Requirements for deposit account termination requests and orders</header><subsection id="HBB613B22B17342F5BFE6A539FBAB6A35"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="H173452CF2EE24134A2D882D142518D22"><enum>(1)</enum><text>the term <term>appropriate Federal banking agency</term>—</text><subparagraph id="H1AA0E12F60E54E3BA545642CF4C02F08"><enum>(A)</enum><text>has the meaning given the term in section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>); and</text></subparagraph><subparagraph id="H681CA049041B4064A8D70062AA0BDCE0"><enum>(B)</enum><text>in the case of an insured credit union, means the National Credit Union Administration Board;</text></subparagraph></paragraph><paragraph id="HCE5D1FD228814A82BCDF70015650EBBF"><enum>(2)</enum><text>the term <term>depository institution</term>—</text><subparagraph id="H7744CB6809FF410BA4F3092915531EE7"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given the term in section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H664FE8262CEE40F382C508CCA310BC93"><enum>(B)</enum><text>includes an insured credit union; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6718C6E160DD4117846AE3C602328E87"><enum>(3)</enum><text>the term <term>insured credit union</term> has the meaning given the term in section 101 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1752">12 U.S.C. 1752</external-xref>).</text></paragraph></subsection><subsection id="HAFBC2CB1B3534DF4AE0E529202052A8E"><enum>(b)</enum><header>Termination requests or orders must be material</header><paragraph id="HF47B9290F9214ADE8C7FF2187BE5CF2F"><enum>(1)</enum><header>In general</header><text>The appropriate Federal banking agency may not formally or informally request or order a depository institution to terminate a specific customer account or group of customer accounts or to otherwise restrict or discourage a depository institution from entering into or maintaining a banking relationship with a specific customer or group of customers unless—</text><subparagraph id="H120DCDDC20C2443FBC567E9055C83025"><enum>(A)</enum><text>the agency has a material reason for the request or order; and</text></subparagraph><subparagraph id="H6BB9983596304D45BA49846E23C8B3D5"><enum>(B)</enum><text>that reason is not based solely on reputation risk to the depository institution.</text></subparagraph></paragraph><paragraph id="H5DC53F7786BA43718EAFCC6C64FF0FE2"><enum>(2)</enum><header>Treatment of national security threats</header><text>The appropriate Federal banking agency shall satisfy the requirement under paragraph (1) if the agency believes a specific customer or group of customers is, or is acting as a conduit for, an entity that—</text><subparagraph id="H745FF33B772F421B8FD06D033377B785"><enum>(A)</enum><text>poses a threat to national security;</text></subparagraph><subparagraph id="HCC5F043D12D648BE806F8254B946653E"><enum>(B)</enum><text>is involved in terrorist financing;</text></subparagraph><subparagraph id="HD513A9D5649349A78D4597B93C6E62E3"><enum>(C)</enum><text>is an agency of the Government of Iran, North Korea, Syria, or any country listed from time to time on the state sponsor of terrorism list;</text></subparagraph><subparagraph id="HBBBA8F88949444A1B2A341AB55FB3B6E"><enum>(D)</enum><text>is located in, or is subject to the jurisdiction of, any country described in subparagraph (C); or</text></subparagraph><subparagraph id="H27EAC8772C904FDB830F15CEED733FF5"><enum>(E)</enum><text display-inline="yes-display-inline">does business with any entity described in subparagraph (C) or (D), unless the appropriate Federal banking agency determines that the customer or group of customers has used due diligence to avoid doing business with any entity described in subparagraph (C) or (D).</text></subparagraph></paragraph></subsection><subsection id="HA5F8D57FCA104192989356D244593CCA"><enum>(c)</enum><header>Notice requirement</header><paragraph id="H83EF586338C54DF6993E73D1A049E7B7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If the appropriate Federal banking agency formally or informally requests or orders a depository institution to terminate a specific customer account or a group of customer accounts, the agency shall—</text><subparagraph id="H909084F50D47460E8E3E00B36A0239D9"><enum>(A)</enum><text>provide the request or order to the institution in writing; and</text></subparagraph><subparagraph id="H47D95022B1354672A11A965AFD6229C1"><enum>(B)</enum><text>include with the request or order a written justification for why the termination is necessary, including any specific law (including regulation), the agency believes that the customer or group of customers is violating.</text></subparagraph></paragraph><paragraph id="H96C8DADF265143F0916256C2B324EE5B"><enum>(2)</enum><header>Justification requirement</header><text display-inline="yes-display-inline">A written justification under paragraph (1)(B) may not be based solely on the reputation risk to the depository institution.</text></paragraph></subsection><subsection id="H0BBD300E55044EB3B5CB8D79DCEAA3FF"><enum>(d)</enum><header>Customer notice</header><paragraph commented="no" id="HC96B506766534C03BBEE980DED4F6103"><enum>(1)</enum><header>Notice required</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), if the appropriate Federal banking agency orders a depository institution to terminate a specific customer account or a group of customer accounts, the depository institution shall inform the customer or customers of the justification for the termination of the account or accounts under subsection (c)(1)(B).</text></paragraph><paragraph id="HF4B5CABF8B2845B7A1AD964F61D17773"><enum>(2)</enum><header>Notice prohibited in cases of national security</header><text display-inline="yes-display-inline">If the appropriate Federal banking agency requests or orders a depository institution to terminate a specific customer account or a group of customer accounts based on a belief that the customer or customers pose a threat to national security, or are otherwise described in subsection (b)(2), neither the depository institution nor the appropriate Federal banking agency may inform the customer or customers of the justification for the termination of the account or accounts.</text></paragraph></subsection><subsection id="H0690D9AA50E24B009152D07AFBA7973E"><enum>(e)</enum><header>Reporting requirement</header><text display-inline="yes-display-inline">Each appropriate Federal banking agency shall issue an annual report to Congress stating—</text><paragraph id="H37ED3229DE7647DBAA37C5FCCA7E3CB2"><enum>(1)</enum><text>the aggregate number of specific customer accounts that the agency requested or ordered a depository institution to terminate during the 1-year period preceding the issuance of the report;</text></paragraph><paragraph id="H99DBDD6F3C394546B6AABE3AB70A3002"><enum>(2)</enum><text display-inline="yes-display-inline">the legal authority on which the agency relied in making the requests and orders described in paragraph (1); and</text></paragraph><paragraph id="id8832E626C53D42FEACDC4492B13B25D7"><enum>(3)</enum><text display-inline="yes-display-inline">the frequency with which the agency relied on each authority described in paragraph (2).</text></paragraph></subsection></section><section id="H47EF0D0652E14C98A83C02F510FBA5EB"><enum>3.</enum><header>Amendments to the Financial Institutions Reform, Recovery, and Enforcement Act of 1989</header><text display-inline="no-display-inline">Section 951 of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/12/1833a">12 U.S.C. 1833a</external-xref>) is amended—</text><paragraph commented="no" id="HBD1E0B89C2214EDBB513CDF24E7D06AB"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(2)—</text><subparagraph commented="no" id="id4D78B5F95124493B97794A9B220D416C"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting a comma after <quote>1341</quote>; and</text></subparagraph><subparagraph commented="no" id="id3B4104DB71F04F3C8E1C15EB54B093D9"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>affecting a federally insured financial institution</quote> and inserting <quote>against a federally insured financial institution or by a federally insured financial institution against an unaffiliated third person</quote>; and</text></subparagraph></paragraph><paragraph id="HB599E8715F4C403E9AB49E72C347368F"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (g)—</text><subparagraph id="H7DE70C58E2FC42E1A31B68E2C5E75665"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">subpoenas</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">investigations</header-in-text></quote>; and</text></subparagraph><subparagraph id="HB8356F6DD8C94C1F8A2B16ADD3D16060"><enum>(B)</enum><text>by striking paragraph (1)(C) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA55225501B1E4DB498989312EB665EB6"><subparagraph id="H1DF230B17C2E4D87B4A535F50DA86087"><enum>(C)</enum><text display-inline="yes-display-inline">summon witnesses and require the production of any books, papers, correspondence, memoranda, or other records which the Attorney General deems relevant or material to the inquiry, if the Attorney General—</text><clause id="HE5FEBF21F0D7473FBC5291758F4CEDE3"><enum>(i)</enum><text display-inline="yes-display-inline">requests a court order from a court of competent jurisdiction for such actions and offers specific and articulable facts showing that there are reasonable grounds to believe that the information or testimony sought is relevant and material for conducting an investigation under this section; or</text></clause><clause id="H4CCC54EEDD994039BEB01052DEF089BB"><enum>(ii)</enum><text display-inline="yes-display-inline">either personally or through delegation no lower than the Deputy Attorney General, issues and signs a subpoena for such actions and such subpoena is supported by specific and articulable facts showing that there are reasonable grounds to believe that the information or testimony sought is relevant for conducting an investigation under this section.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
