which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Defense to submit to Congress annual reports on the unfunded priorities of the Department of Defense-wide research, development, test, and evaluation activities, and for other purposes.</official-title></form><legis-body><section id="id5ec49fcc3f1142f184aaff752fbd0751" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Research, Development, Test and Evaluation Unmet Needs Act of 2023</short-title></quote>.</text></section><section id="idFAEDD3EC0A3C4E58BD581F2D1ADB2FF2"><enum>2.</enum><header>Annual report on unfunded priorities for research, development, test, and evaluation activities</header><subsection commented="no" display-inline="no-display-inline" id="id3de7c2888e5c4f77b6dcc9e82d3d408d"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/9">Chapter 9</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/222d">section 222d</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="idBCC8B914CDE947F19E19867AB616022D"><section commented="no" display-inline="no-display-inline" id="idc1bd37cb30574f40849f7d659ef3537c"><enum>222e.<?LEXA-Enum 222e.?></enum><header>Unfunded priorities for research, development, test, and evaluation activities</header><subsection id="idc960d9ce19424361b82d8575a7472461"><enum>(a)</enum><header>Annual report</header><text>Not later than 10 days after the date on which the budget of the President for a fiscal year is submitted to Congress pursuant to section 1105 of title 31, the Secretary of Defense shall submit to the congressional defense committees a report on the unfunded priorities of the Department of Defense-wide research, development, test, and evaluation activities.</text></subsection><subsection id="id519a616f67ba4da9bfc30a607a27d6d4"><enum>(b)</enum><header>Contents</header><paragraph id="idb2242e29436b45cc903c9adfd6d18bea"><enum>(1)</enum><header>In general</header><text>Except as provided in subsection (c), each report submitted under subsection (a) shall specify, for each unfunded priority covered by such report, the following:</text><subparagraph id="iddf9b481e9a5c44de848a1e9897a12813"><enum>(A)</enum><text>A summary description of such priority, including the objectives to be achieved if such priority is funded (whether in whole or in part).</text></subparagraph><subparagraph id="ida2df1a67b9ae491ab831fcb2d3596964"><enum>(B)</enum><text>The additional amount of funds recommended in connection with the objectives under subparagraph (A).</text></subparagraph><subparagraph id="id998192d41b0c4309855c595b48e73919"><enum>(C)</enum><text>Account information with respect to such priority, including the following (as applicable):</text><clause id="idcce923cc2b3c4ad683fba4daea980d3c"><enum>(i)</enum><text>Line Item Number (LIN) for applicable procurement accounts.</text></clause><clause id="id1716bfbb6cee43e5a5e20c3f71dbd279"><enum>(ii)</enum><text>Program Element (PE) number for applicable research, development, test, and evaluation accounts.</text></clause></subparagraph></paragraph><paragraph id="id672003244ad44d2ba15c817c40d43648"><enum>(2)</enum><header>Prioritization of priorities</header><text>The report under subsection (a) shall present the unfunded priorities covered by such report in order of urgency of priority.</text></paragraph></subsection><subsection id="ide5914d2724c442ccaa3f2d87adf7d9eb"><enum>(c)</enum><header>Exclusion of priorities covered in other reports</header><text>The report submitted under subsection (a) shall not include unfunded priorities or requirements covered in reports submitted under—</text><paragraph id="id17e59660991e4c22be6d950993f86c4d"><enum>(1)</enum><text>section 222a or 222b; or</text></paragraph><paragraph id="idbd22057f49874c49a4cd53461b5bd9df"><enum>(2)</enum><text>section 2806 of the National Defense Authorization Act for Fiscal Year 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/91">Public Law 115–91</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/222a">10 U.S.C. 222a</external-xref> note).</text></paragraph></subsection><subsection id="id00b6cf5d0a2f44ea99a89564a6f1893e"><enum>(d)</enum><header>Unfunded priority defined</header><text>In this section, the term <term>unfunded priority</term>, in the case of a fiscal year, means a program, activity, or mission requirement, that—</text><paragraph id="id5d173a0ff73e4be8aa562665cb02e10a"><enum>(1)</enum><text>is not funded in the budget of the President for the fiscal year as submitted to Congress pursuant to section 1105 of title 31; and</text></paragraph><paragraph id="id4f667640f93a42f181da637e640b8de4"><enum>(2)</enum><text>would have been recommended for funding through that budget if—</text><subparagraph id="idfb9ec8638ece479ca70b0856b437527e"><enum>(A)</enum><text>additional resources had been available for the budget to fund the program, activity, or mission requirement; or</text></subparagraph><subparagraph id="id1bb5fa60d4824242a2027ea8eb2ce620"><enum>(B)</enum><text>the program, activity, or mission requirement has emerged since the budget was formulated.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id4dda3c9bc6384c48845d219ba6dcdd34"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 9 of such title is amended by inserting after the item relating to section 222d the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7B7AE8F109F14D0EBE0303B3110730A4"><toc><toc-entry level="section" bold="off">222e.
