which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Farm Security and Rural Investment Act of 2002 to improve the biobased markets program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Biomanufacturing and Jobs Act of 2023</short-title></quote>.</text></section><section id="idbf172fa899a94686b344863fcfb9f4f1"><enum>2.</enum><header>Findings; purposes</header><subsection id="idc93094d79c5f49958ae47577a2712029"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="id5a98f21534304c0cba2682cd2f4b0449"><enum>(1)</enum><text>biobased products provide additional markets for farm commodities, reducing the reliance of the United States on petroleum and increasing the use of renewable agricultural resources while driving rural economic development and growth;</text></paragraph><paragraph id="idcf1d7ba0a3e343d7848f6027b63ffa78"><enum>(2)</enum><text>United States farmers produce feedstock used to produce a variety of biobased products, including personal care products, industrial paints solvents, construction materials, and apparels and textiles;</text></paragraph><paragraph id="id5d29324c10ab46daa4b7064b3b477831"><enum>(3)</enum><text>the BioPreferred Program of the Department of Agriculture is designed to increase the purchase and use of biobased products through a mandatory Federal purchasing initiative and a voluntary labeling initiative, thereby supporting additional markets for agricultural commodities and rural economic development;</text></paragraph><paragraph id="idab59dc2f45bf4804ab39a4cce95b2141"><enum>(4)</enum><text>according to the Department of Agriculture, there are approximately 15,000 biobased products participating in the BioPreferred Program, with approximately 2,600 biobased products authorized to display the <quote>USDA Certified Biobased Product</quote> label under the voluntary labeling initiative; and</text></paragraph><paragraph id="ide8e8c3dda5d34a7ebfaa401f2ff7d55c"><enum>(5)</enum><text>the Department of Agriculture has estimated that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id50ab2d7ba8824cd8aba4b2ad345dfc76"><enum>(A)</enum><text display-inline="yes-display-inline">as of 2008, there were more than 17,000 biobased products in the United States; and</text></subparagraph><subparagraph id="idd371505666a247cd8b59c94c18d1bc16" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>as of 2014, there were more than 40,000 biobased products in the United States, demonstrating an increase in biobased products in the United States of 135 percent in 6 years. </text></subparagraph></paragraph></subsection><subsection id="id477a153e6eb94e04bb527af8b1bc286e"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text><paragraph id="id3215463fc1534cf09c8f4f4523945fb4"><enum>(1)</enum><text>to recognize the value that biobased products bring to agriculture in the United States;</text></paragraph><paragraph id="ide99c205ba03f43bc980876d3fd535520"><enum>(2)</enum><text>to support domestic manufacturing of biobased products made from agricultural commodities, including corn and soybeans;</text></paragraph><paragraph id="idc7d5813bf3734112a425cc7771a7e119"><enum>(3)</enum><text>to expand the role of the Department of Agriculture in the promotion of biobased products;</text></paragraph><paragraph id="id59b8d4705aa6461f90315869ddcedf2c"><enum>(4)</enum><text>to build on procurement programs administered by the Department of Agriculture to increase Federal purchasing of biobased products;</text></paragraph><paragraph id="id124c7c3e0d194ad5b4c8e01c92205744"><enum>(5)</enum><text>to strengthen domestic manufacturing of biobased products; and</text></paragraph><paragraph id="id2cd71674c9b642da97688e790a612681"><enum>(6)</enum><text>to make a national commitment to the rural and agricultural economies of the United States. </text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id99c78032ea3b4183a4c9fe1c2b4f988a"><enum>3.</enum><header>Biobased markets program</header><text display-inline="no-display-inline">Section 9002 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8102">7 U.S.C. 8102</external-xref>) is amended— </text><paragraph commented="no" display-inline="no-display-inline" id="id1e19c1a87e8e4285b31327df8df9e821"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1f293d7aa7ed4e4b80cee06baca93317"><enum>(A)</enum><text>in paragraph (2)—</text><clause commented="no" display-inline="no-display-inline" id="id6a11f44c9c184ebe9113967161a69f7d"><enum>(i)</enum><text>in subparagraph (A)(i)—</text><subclause commented="no" display-inline="no-display-inline" id="idc0fb294d53604060ae7f17607bd8b44f"><enum>(I)</enum><text display-inline="yes-display-inline">in subclause (II)(bb), by striking <quote>and</quote> at the end;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id277eac3dfcaa45228c0d7b4ee1ccb824"><enum>(II)</enum><text>in subclause (III), by striking the period at the end and inserting <quote>; and</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide26c4b2a39604408a836f8ef24dbdd86"><enum>(III)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idcce91f0ca8da4896952c7d99a07bc815"><subclause id="ida4cbffe9722b48a1a71c1714986b5d46"><enum>(IV)</enum><text>on an annual basis, update the procurement requirement described in subclause (III) by increasing the number of biobased-only contracts or the volume purchased under those contracts from the previous year.</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id6adaec8f9662453aadfc4fd4dcb5492c"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking clause (iii) and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id392EE04EC9A741C6936C249BE033571B"><clause commented="no" display-inline="no-display-inline" id="id4099fdf66df84ad59c7740d84e960185"><enum>(iii)</enum><text display-inline="yes-display-inline">are available only at a price that exceeds the price premium established under paragraph (3)(B)(viii) for those items.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="id403de2b02b2d47e79efd4c51898369d5"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFB8710FD00AD474C95A83643094CB3F8"><subparagraph id="id7c00d917fbf849619948fae73f4b0708"><enum>(G)</enum><header>Guidance</header><text>The Secretary, in coordination with the Office of Federal Procurement Policy, shall issue guidance to procuring agencies to consider product lifespan, savings, and efficacy when making procurement decisions under this subsection.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="ide57a834b9298439ab97da8e3e4644f57"><enum>(B)</enum><text>in paragraph (3)(B)—</text><clause commented="no" display-inline="no-display-inline" id="ida042a2a94e5d41feb3e144b2e1659f2b"><enum>(i)</enum><text>in clause (vii), by striking <quote>and</quote> at the end;</text></clause><clause commented="no" display-inline="no-display-inline" id="idbc3160be5fb141119cd91d7c1863f8f2"><enum>(ii)</enum><text>by redesignating clause (viii) as clause (ix); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8ba5e97ef663487e870c4362ee2520bd"><enum>(iii)</enum><text>by inserting after clause (vii) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id04ef8708293f440c91851e0984933ac5"><clause id="id3ad4d236a8ca4c6ab9cdd093a28f4c42"><enum>(viii)</enum><text>establish price premiums for different types of biobased products; and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id9322545af49f450b96f5c6ef852b767c"><enum>(C)</enum><text>in paragraph (4)—</text><clause id="idd53c7dc342d6458eb483a72a0b23c134"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="id982f68e72b84469b982f0e969389d1b7"><enum>(I)</enum><text>by striking clause (ii); and</text></subclause><subclause id="id63d3a0ab2e8144feb9674df57b8f56df"><enum>(II)</enum><text>by redesignating clauses (iii) and (iv) as clauses (ii) and (iii), respectively;</text></subclause></clause><clause id="id1c96f474266a41d39d6a5acc3387fded"><enum>(ii)</enum><text>in subparagraph (B)(i)—</text><subclause id="id4f8f8025beff40989b05cb5d6b8a484b"><enum>(I)</enum><text>in the matter preceding subclause (I)—</text><item id="id2ee2b8bff47346819633f7bf6842d703"><enum>(aa)</enum><text>by inserting <quote>and the Secretary</quote> after <quote>Policy</quote>; and</text></item><item id="id81a13129f71f4e919a45376b9d00d324"><enum>(bb)</enum><text>by striking <quote>information concerning—</quote> and inserting <quote>a report that describes, for the year covered by the report—</quote>;</text></item></subclause><subclause id="id2857ada2e4a14462a93c9c93c7d414b0"><enum>(II)</enum><text>in subclause (I), by inserting <quote>, including the actions taken by the procuring agency to establish and implement the biobased procurement program of the procuring agency under that paragraph</quote> before the semicolon;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idebeec07d8b1b4458a4c6fd026497c401"><enum>(III)</enum><text>in subclause (IV), by striking <quote>and</quote> at the end; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idab09a59b82cd48969c66777b298afe3d"><enum>(IV)</enum><text display-inline="yes-display-inline">in subclause (V), by striking <quote>and</quote> at the end; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc79b1e3bc7084e2dbcc3f36e632f06ca"><enum>(V)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAB4F5193BE574DD18B297784B5E4F7EA"><subclause commented="no" display-inline="no-display-inline" id="id42ce9f18485a45d2b3c1ffa6db4b4e4e"><enum>(VI)</enum><item commented="no" display-inline="yes-display-inline" id="idf8305d8b18bd41a18a100e095641d0b5"><enum>(aa)</enum><text>the specific categories of biobased products that are unavailable to meet the procurement needs of the procuring agency; and </text></item><item commented="no" display-inline="no-display-inline" id="id8e66ac53c7904830821ce5906e2f33c1" indent="up1"><enum>(bb)</enum><text display-inline="yes-display-inline">the desired performance standards and other relevant specifications for those products; and</text></item></subclause><subclause id="ida1b1f9f33b4248f4aefe18174443442b"><enum>(VII)</enum><text>if applicable, the procurement requirement or updated procurement requirement established under paragraph (2)(A)(i) that the procuring agency failed to meet and reasons for the failure; and</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idddb73cb214de492590b5556f9ef2ee05"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCF38F1C8B1774300AAB6397C5293B5B6"><subparagraph id="id643ff21f44304751bedb9ecd375be4a1"><enum>(D)</enum><header>Verification</header><text>The Office of Federal Procurement Policy, in consultation with the Secretary, shall—</text><clause id="idc9c9eec6223e4fff8936fb056363cee4"><enum>(i)</enum><text>annually collect the information required to be reported under subparagraph (B) and make the information publicly available; and</text></clause><clause id="id74044ddae02541c5bbd86f06df4edda2"><enum>(ii)</enum><text>annually verify, using the information collected under subparagraph (B), that each procuring agency under paragraph (2)(A)(i), as applicable, has established a procurement program in accordance with subclause (I) of that paragraph.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcf6732c004044b2cbd7c4ee1d100d0d6"><enum>(E)</enum><header>Training</header><clause commented="no" display-inline="no-display-inline" id="id709fb7ef4e1e4f0dabc4ac318733b7c9"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this subparagraph, each procuring agency shall have completed training on biobased product purchasing for the appropriate staff of the procuring agency, including contracting officers, purchase card managers, and purchase card holders.</text></clause><clause commented="no" display-inline="no-display-inline" id="idbf9b8b8616ac4997923ae6a4511a594e"><enum>(ii)</enum><header>Materials</header><text display-inline="yes-display-inline">The Office of Federal Procurement Policy, in cooperation with the Secretary, shall provide training materials for procuring agencies conducting training pursuant to clause (i).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5a9bac71857c49e78a2e4e7011eb37eb"><enum>(F)</enum><header>Federal catalog updates</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this subparagraph, the Administrator for Federal Procurement Policy, in cooperation with the Secretary, shall—</text><clause commented="no" display-inline="no-display-inline" id="id25479250ceb946a6b8317db7393bfd3a"><enum>(i)</enum><text display-inline="yes-display-inline">direct the Administrator of General Services to update the Federal Procurement Data System described in section 1122(a)(4) of title 41, United States Code, or any successor system, to include biobased product designations; </text></clause><clause commented="no" display-inline="no-display-inline" id="ida549f2e014e94dc2bf98ed2600c4f5c0"><enum>(ii)</enum><text display-inline="yes-display-inline">direct that the System for Award Management collect biobased product purchasing data;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7f47cbe35a024ba9bbed8a0cb4910b31"><enum>(iii)</enum><text display-inline="yes-display-inline">direct that Federal online procurement systems, including GSA Advantage! and FedMall, include designations for products that meet the guidelines under paragraph (3); </text></clause><clause commented="no" display-inline="no-display-inline" id="idf5d030f74dc5446c93fc39c1074f0703"><enum>(iv)</enum><text display-inline="yes-display-inline">require, to the maximum extent practicable, that Federal online procurement systems, including GSA Advantage! and FedMall, use North American Industry Classification System codes, North American Product Classification System-based product codes, and other product codes, as determined in consultation with the Secretary, when identifying products that meet the guidelines under paragraph (3); and </text></clause><clause commented="no" display-inline="no-display-inline" id="idda0ece38e3264de2814b00775f381350"><enum>(v)</enum><text display-inline="yes-display-inline">require agencies with online Federal sales platforms to include reporting of these purchases in their reporting on products that meet the guidelines under paragraph (3).</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf293a06757fb442f99960fab0d8f3a0c"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id29c6a8548ad04881b770eeb631015e73"><enum>(A)</enum><text>in paragraph (3), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9089199025b34f3790aa6ccedf672bd2"><subparagraph id="idf959c6adf0104501923ac95085fb4949"><enum>(C)</enum><header>Regulations</header><text>The Secretary shall promulgate such regulations as the Secretary determines to be appropriate to ensure the integrity of the label described in paragraph (1), including regulations to define additional terms necessary to avoid or reduce public confusion relating to the label.</text></subparagraph><subparagraph id="ida61a10c3b6c148bda8658846b4b925fc"><enum>(D)</enum><header>Unauthorized use</header><text>Not later than 120 days after the date of enactment of this subparagraph, the Secretary shall, in coordination with the Inspector General of the Department of Agriculture, notify the public of how to report an instance of unauthorized use of the label described in paragraph (1).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida4ae4d2bc5d3436a80b71c22ee94a430"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id91BDE9FC3B634C64B59458EC2B651D81"><paragraph id="id9cc26f8092274bc78f0c28573e252133"><enum>(5)</enum><header>Public marketing and education</header><text>The Secretary may conduct outreach to educate the public on and promote the use of biobased products, including by—</text><subparagraph id="id8506748f5e374d3186a4cb6044cd559c"><enum>(A)</enum><text>conducting outreach to small businesses producing biobased products that seek a label under this subsection;</text></subparagraph><subparagraph id="idd44570b75ba6464c8d42ee3e99b664f7"><enum>(B)</enum><text>providing information about biobased product procurement preferences to State procurement agencies; and</text></subparagraph><subparagraph id="idbfa204f79f544b489e0629e3b3f6fdd3"><enum>(C)</enum><text>establishing public-private partnerships to further increase awareness and use of biobased products.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80ed00dc8a344f7d8f405c8de54bc582"><enum>(6)</enum><header display-inline="yes-display-inline">Acceptance and use of contributions</header><subparagraph id="id547493f9532f46c3ace656b9eeb1ac7f"><enum>(A)</enum><header>In general</header><text>The Secretary may establish an account to accept contributions of non-Federal funds to carry out public marketing and education under paragraph (5).</text></subparagraph><subparagraph id="ida37239b6b6454b6082a365ac635ee752"><enum>(B)</enum><header>Deposit and use of contributions</header><text>Contributions of non-Federal funds received to carry out the activities under paragraph (5) shall—</text><clause id="idf0db63552548410aac2eb654d5f5126f"><enum>(i)</enum><text>be deposited into the account established under this paragraph for those activities;</text></clause><clause id="id4339580d2ada46a0acf0e95a05e5769d"><enum>(ii)</enum><text>be available to and subject to the control of the Secretary, without further appropriation and until expended, to carry out those activities; and</text></clause><clause id="id7179b571ca2a4fab88d17deb53f116e5"><enum>(iii)</enum><text>supplement any funding made available under subsection (k) and allocated by the Secretary for those activities.</text></clause></subparagraph></paragraph><paragraph id="id658f332190444076b5474729fb272d44"><enum>(7)</enum><header>Report</header><text>Not later than December 31, 2024, and annually thereafter, the Secretary shall make publicly available on the website of the Department of Agriculture and submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives a report that includes—</text><subparagraph id="idbd0b5cb69bb3450eba57f7bc8eeadf03"><enum>(A)</enum><text>a list of the biobased products that were authorized to use the label described in paragraph (1) during the preceding fiscal year;</text></subparagraph><subparagraph id="idae1904c7f2ef49eb90af71647c1d0bfb"><enum>(B)</enum><text>a description of the audit and compliance activities conducted under paragraph (3)(B) during the preceding fiscal year, including any findings of noncompliance and any actions taken by the Secretary to address the noncompliance;</text></subparagraph><subparagraph id="ideb121d2580e14bb8a2c8b4ce7000eceb"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id2b0bf892d818457ba18a73f69ddde85e"><enum>(i)</enum><text>a description of the public marketing and education conducted by the Secretary under paragraph (5); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf670f5bcbb494f28ac3a6fc285236d0a" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">a plan for conducting public marketing and education under that paragraph for the following two fiscal years that is designed to increase the use of the label described in paragraph (1) and the purchase of biobased products; and</text></clause></subparagraph><subparagraph id="id0c8ffc1079be47da8827f92dbbe816b9"><enum>(D)</enum><text>the total amount of contributions of non-Federal funds accepted into the account established under paragraph (6).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5df05a17c3e641b590064578b1579f4c"><enum>(3)</enum><text>in subsection (f)(1), in the matter preceding subparagraph (A), by striking <quote>The Secretary and the Secretary of Commerce shall jointly</quote> and inserting <quote>The Secretary of Commerce, in consultation with the Secretary, shall</quote>;</text></paragraph><paragraph id="id95806d2dc8c94a9d9420e2cd2c347f2a"><enum>(4)</enum><text>in subsection (j)(3)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id418625e6b35143479227bf4f7fa71c1f"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="id365ab2381ae7426ea1fc66bfe214e17f"><enum>(i)</enum><text>in clause (v), by striking <quote>; and</quote> and inserting <quote>, including greenhouse gas emissions reduced and avoided;</quote>;</text></clause><clause id="id8fe6132f17784fd28c845abf9e48f14d"><enum>(ii)</enum><text>in clause (vi), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida5ca673e6bc84e9cbee21fcf50100cde"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAB22FCE4B93C4FC6BAF3ABEDD0FB1085"><clause id="id5021c9a856d1430d9f17f5947f572e29"><enum>(vii)</enum><text>identifying available industry methodologies to establish a lifecycle greenhouse gas emissions assessment methodology for biobased products.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="iddd3f019b6cdd461a99f4fce474af5891"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8C87A88A42334DC4B33978D363EB0F3A"><paragraph id="idc6b8d1ffdf6742e7ac6eccdf719b83be"><enum>(2)</enum><header>Standard</header><text>The Secretary shall use the most recent version of the ASTM–D–6866 standard of ASTM International to determine the contents of biobased products.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="ide0d9d3b3166c48dba289214ad5a41e5e"><enum>4.</enum><header>Biobased Task Force</header><text display-inline="no-display-inline">Title IX of the Farm Security and Rural Investment Act of 2002 is amended by inserting after section 9003 (<external-xref legal-doc="usc" parsable-cite="usc/7/8103">7 U.S.C. 8103</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAC3B0A2D16314520907B4D985FAA8D7D"><section id="idd5b8b1d9fe164a65ac00d7b796bbfd5e"><enum>9004.</enum><header>Biobased task force</header><subsection id="id2e2d287a79f04939bb592c3306157015"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a task force (referred to in this section as the <quote>task force</quote>)—</text><paragraph id="id3e65cb32ca9149d4bcf085eca4a09570"><enum>(1)</enum><text>to coordinate programs and activities within the Department of Agriculture relating to the research, development, promotion, marketing, and analysis of biobased products, including to support the use of agricultural commodities and forest products in biobased products;</text></paragraph><paragraph id="id1457d1b75724471195bb8aabb31deb9e"><enum>(2)</enum><text>to maximize the resources allocated towards the research, development, promotion, marketing, and analysis of biobased products by the Department of Agriculture;</text></paragraph><paragraph id="idbb0fc7b96dbf41c99ef0804f9b4dc128"><enum>(3)</enum><text>to determine the effectiveness of the programs and activities described in paragraph (1); and</text></paragraph><paragraph id="idd7d251ae0cc44ef2b0b807af6cb8cbbc"><enum>(4)</enum><text>to make recommendations for improvements to those programs and activities.</text></paragraph></subsection><subsection id="id9a271770ccc54d7c9cd9da20e051dd5e"><enum>(b)</enum><header>Membership</header><text>The task force shall be composed of not less than 1 representative from each of the following mission areas or offices of the Department of Agriculture:</text><paragraph id="id0867374e62ae41b2adf9f359545a0c4e"><enum>(1)</enum><text>The rural development mission area.</text></paragraph><paragraph id="idfbdbee00a4024e458194c5e79820259b"><enum>(2)</enum><text>The National Institute of Food and Agriculture.</text></paragraph><paragraph id="iddba6449655ae42d7a7e89b9acd5d8768"><enum>(3)</enum><text>The Economic Research Service.</text></paragraph><paragraph id="id10a5045f56614ae2bc204df2a33bee49"><enum>(4)</enum><text>The Agricultural Research Service.</text></paragraph><paragraph id="ide70f561164d74a8c9e8c8c3c7b3f9bd1"><enum>(5)</enum><text>The National Agricultural Statistics Service.</text></paragraph><paragraph id="id606ac4dffbbf44dd982a2aecc5e2e73b"><enum>(6)</enum><text>The Office of the Chief Scientist.</text></paragraph><paragraph id="idabbdbcad9a8a450a857370b2092544b5"><enum>(7)</enum><text>The Office of the Chief Economist.</text></paragraph><paragraph id="idc02e57a16b6040388bf743724074c5f1"><enum>(8)</enum><text>The Office of Energy Policy and New Uses.</text></paragraph><paragraph id="id7cd8db909ad24071b71956a7d41a10bd"><enum>(9)</enum><text>Any other mission area or office with responsibilities relating to the research, development, promotion, marketing, or analysis of biobased products.</text></paragraph></subsection><subsection id="ide3c012409357451bb86f9fba9da22027"><enum>(c)</enum><header>Lead mission area</header><text>The rural development mission area of the Department of Agriculture shall be the lead mission area for the task force.</text></subsection><subsection id="id3ba04974f9e04f62a79c856bee46e0c6"><enum>(d)</enum><header>Process for public input</header><text>The task force shall establish a process for public input to help inform the determination of the task force under subsection (a)(3) of the effectiveness of the programs and activities described in subsection (a)(1).</text></subsection><subsection id="idf7912b3e1d0d448fb89b1e7fcfb8a546"><enum>(e)</enum><header>Study and report</header><paragraph id="iddbbb61ccb6ac46f28336eee7d23a9e64"><enum>(1)</enum><header>In general</header><text>The task force shall conduct a study that—</text><subparagraph id="id05169cfc69dc4834bbe44815e3cbbf22"><enum>(A)</enum><text>identifies any existing programs and activities of the Department of Agriculture that may offer new opportunities to advance the research, development, promotion, marketing, and analysis of biobased products; and</text></subparagraph><subparagraph id="id064efb5a3ae747edbec10ba04022dd54"><enum>(B)</enum><text>describes those new opportunities and how those programs and activities may be used to advance and support the research, development, promotion, marketing, and analysis of biobased products.</text></subparagraph></paragraph><paragraph id="id01bc1c9cc21c4734a4af650a91d75c5e"><enum>(2)</enum><header>Report</header><text>Not later than 3 years after the date of enactment of the <short-title>Biomanufacturing and Jobs Act of 2023</short-title>, the task force shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives a report that describes—</text><subparagraph id="id98062b858992467a9857426ecef53df8"><enum>(A)</enum><text>a summary of the work conducted by the task force;</text></subparagraph><subparagraph id="id28f357e4a1c54fbfbfaa8ec89cff2fbb"><enum>(B)</enum><text>the findings of the study conducted under paragraph (1); and</text></subparagraph><subparagraph id="id1f61c7fa0c5941e8a3a55e849837f677"><enum>(C)</enum><text>recommendations for improvements to the programs and activities described in subsection (a)(1) and identified under paragraph (1)(A).</text></subparagraph></paragraph></subsection><subsection id="idaccaa0f3bb6d442fbd4615c8f599469e"><enum>(f)</enum><header>Termination</header><text>The task force shall terminate on the date that is 4 years after the date of enactment of the <short-title>Biomanufacturing and Jobs Act of 2023</short-title>.</text></subsection><subsection id="idd5e7a574987941cc8eea32a21f29786b"><enum>(g)</enum><header>Nonapplicability</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code, shall not apply to the task force.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
