which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food and Nutrition Act of 2008 to make permanent the moratorium on benefit transaction fees, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H1E76732CE5FB4190BDFCA220B779D7B5"><section commented="no" section-type="section-one" id="HFFD359F2A545468EA3BA4C6DB8ADCA89"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Fee-Free Benefit Transactions Act of 2023</short-title></quote>.</text></section><section id="H97EF0945033F4FECBA4F71213531A6C4"><enum>2.</enum><header>Fee-free benefit transactions</header><subsection commented="no" display-inline="no-display-inline" id="id26a13530c9cf4ca883afe7aeb408986c"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 7 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2016">7 U.S.C. 2016</external-xref>) is amended—</text><paragraph id="H9506047C65854A35991622A52206AF71"><enum>(1)</enum><text>in subsection (d), by striking the period at the end and inserting <quote>, including completeness of fraud protection and fraud prevention tools and coverage of infrastructure costs.</quote>;</text></paragraph><paragraph id="H3CB2C68DF24449018525243A1142B9A8"><enum>(2)</enum><text>in subsection (f)(5)(B)(ii)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idee11c1aeb03b4c168f5497d2bf5a7771"><enum>(A)</enum><text>by striking <quote>shall consider</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="id55017A69F820485F835815FA5C7168DC"><text>shall—</text><subclause commented="no" display-inline="no-display-inline" id="idf03b165ec5c0466bb8eada674de73f5f"><enum>(I)</enum><text display-inline="yes-display-inline">consider</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd278df282ee94c3baadbec275b318d9f"><enum>(B)</enum><text>in subclause (I) (as so designated), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9b33bc2b95e748c684ca7f7fdc362cf0"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD614423BD87F4B73B9A98B80BE8C163F"><subclause commented="no" display-inline="no-display-inline" id="idc1e341c408ba4151a59113da2733ce44"><enum>(II)</enum><text display-inline="yes-display-inline">require State agencies to review existing technology and contract requirements during each contracting period to ensure that EBT technology reflects commercial standards to ensure security of benefits.</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HAD0A151EDD0E44038473709615CF99BE"><enum>(3)</enum><text>in subsection (h)(13), by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCA3EE98778454C57AB5A1A34C2CD6F68"><subparagraph commented="no" display-inline="no-display-inline" id="ida4ce2f4a695344e589332951d0a97e1e"><enum>(B)</enum><header>Other fees</header><text>No State, or any agent, contractor, or subcontractor of a State who facilitates the provision of supplemental nutrition assistance program benefits in that State, may impose a fee for—</text><clause commented="no" display-inline="no-display-inline" id="id8dc84858f4324d3e91a72085f5c651ee"><enum>(i)</enum><text display-inline="yes-display-inline">switching (as defined in subsection (j)(1)) or routing those benefits;</text></clause><clause commented="no" display-inline="no-display-inline" id="id50c6f93363814991820df2fa2cec5bec"><enum>(ii)</enum><text>costs to implement subsections (d) and (f)(5)(B); or </text></clause><clause commented="no" display-inline="no-display-inline" id="id947b17bb6e534ee1a8bab179623a3f6c"><enum>(iii)</enum><text display-inline="yes-display-inline">other costs associated with updating the EBT processing infrastructure.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H276B20023A634A1E834EA931335C6D75"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in the amendments made by subsection (a) shall modify or affect the provisions of title IV of division HH of the Consolidation Appropriations Act, 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>), or any agency action taken pursuant to those provisions.</text></subsection></section><section id="H2808899EFDAD4BD09C0CC66AE2B8BC3C"><enum>3.</enum><header> Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on October 1, 2023.</text></section></legis-body></bill>
