which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a grant to provide mental and behavioral health services and diversion programs to at-risk youth, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eliminating Debtor’s Prison for Kids Act of 2023</short-title></quote>.</text></section><section id="id05b4c075c08b49599b52c965dc9fce28"><enum>2.</enum><header>Youth mental health and diversion program grants</header><subsection id="iddf01be6be1bd40009c9ac1a38da1a478"><enum>(a)</enum><header>In general</header><text>Beginning not later than 180 days after the date of enactment of this Act, the Attorney General shall carry out a program under which the Attorney General makes grants to eligible States for the purpose of—</text><paragraph commented="no" display-inline="no-display-inline" id="idef2026421b5c4f248ddd3a17bbbd56ca"><enum>(1)</enum><text display-inline="yes-display-inline">providing evidence-based and trauma-informed mental and behavioral health services to at-risk youth, including juveniles in secure detention facilities or secure correctional facilities in the State; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4e484836ca9145308d9b0ab3089c5759"><enum>(2)</enum><text display-inline="yes-display-inline">implementing pre-adjudication and post-adjudication diversion programs for at-risk youth to limit their involvement in the juvenile system.</text></paragraph></subsection><subsection id="idc1c4935d68344960adea8d43cff0906c"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this section, a State shall—</text><paragraph id="iddb442aa6f78f4f54b02a53876bf3fab1"><enum>(1)</enum><text>certify to the Attorney General that the laws of the State prohibit an adjudicated youth or a parent or guardian of such a youth from being ordered to pay probation supervision fees or court administrative fees, including the cost of court-appointed attorneys or public defenders, the cost of prosecution, or other administrative costs of the court;</text></paragraph><paragraph id="id4ef1c9bab5c6475d9ade40407fc358e1"><enum>(2)</enum><text>certify to the Attorney General that the laws of the State prohibit a parent or guardian of an adjudicated youth from paying child support or other costs for detention or post-adjudication placement to the State; and</text></paragraph><paragraph id="id8137d49385944b5389cf2597eaca2c15"><enum>(3)</enum><text>submit to the Attorney General an application at such time, in such manner, and containing such information as the Attorney General may require.</text></paragraph></subsection><subsection id="id8384cdc9a94a4b2397ca69c226901882"><enum>(c)</enum><header>Use of funds</header><text>A State that receives a grant under this section shall use the grant—</text><paragraph commented="no" display-inline="no-display-inline" id="idd202047db94c48e29161753baaa5fa43"><enum>(1)</enum><text display-inline="yes-display-inline">to provide evidence-based and trauma-informed mental and behavioral health services to at-risk youth, including juveniles in secure detention facilities or secure correctional facilities in the State; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5de1b543d6614f339ccab2b95decad09"><enum>(2)</enum><text display-inline="yes-display-inline">to implement pre-adjudication and post-adjudication diversion programs.</text></paragraph></subsection><subsection id="id5af64bfe3eef4b6792a01f5e71c24555"><enum>(d)</enum><header>Contracts and subgrants</header><paragraph id="id87f4d5d063304160910f3c6f5ed8f9be"><enum>(1)</enum><header>In general</header><text>A State may, in using a grant under this section for purposes authorized by subsection (c), use all or a portion of that grant to contract with or make one or more subgrants to one or more units of local government.</text></paragraph><paragraph id="idd57479de5c724315b9881ed80827c541"><enum>(2)</enum><header>Use of funds</header><text>An entity that receives a contract or a subgrant under this subsection may use such funds to provide services or benefits described under subsection (c).</text></paragraph></subsection><subsection id="idbfe50b863dff4561b7c4f5a32bec8c6b"><enum>(e)</enum><header>Information for report</header><text>A State that receives a grant under this section shall provide to an independent criminal justice organization, selected by the Attorney General, such information as is necessary to complete the report described in section 3.</text></subsection><subsection id="id204a9b2148ed47da8627e67702a02fcf"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $500,000,000 for each of fiscal years 2023 through 2027.</text></subsection></section><section id="ida2452c60792b4031a4d39a5103a4d66b"><enum>3.</enum><header>National report</header><subsection id="id36de001b05264c5382715b724ecbc9af"><enum>(a)</enum><header>Independent report</header><text>Not later than 18 months after the date of enactment of this Act, an independent criminal justice organization, selected by the Attorney General, shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives and a national report on fines and fees imposed on adults and juveniles in the criminal justice system, including—</text><paragraph id="ida9a357c8023044e2bede297206b7511b"><enum>(1)</enum><text>information with respect to the monetary amount of fines and fees imposed, including the race, ethnicity, Tribal affiliation, and other demographic data of the individuals upon whom such fines and fees are imposed and the rate at which individuals are reincarcerated within 1 year of release from a secure detention facility or a secure correctional facility;</text></paragraph><paragraph id="id221181429d4a43258d318b2adb536695"><enum>(2)</enum><text>a description of each type of service for which a fee is imposed;</text></paragraph><paragraph id="id526f4bd60b6b4660a726db4cd952fa40"><enum>(3)</enum><text>a description of each type of charge for which a fine is imposed;</text></paragraph><paragraph id="id5d710e8ff6b54263b13debc4cb469ce0"><enum>(4)</enum><text>a comparison of the average length of incarceration or detention for individuals who are unable to pay a fine and the average length of incarceration or detention for individuals who are able to pay a fine based on the amount of the fine; and</text></paragraph><paragraph id="id91d8fb956cec48dcb48164b458ed558b"><enum>(5)</enum><text>a disclosure of the sum total of fines and fees collected minus the cost to collect such sum.</text></paragraph></subsection><subsection id="idf264f72420a74d46a6778d3961e0fe5d"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $2,000,000 for fiscal year 2023, which shall remain available until expended.</text></subsection></section><section id="id8941107d0f014f01b1c294f7b17348ba"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id9343ea068d10435ebcaf6accf10873fb"><enum>(1)</enum><header>Adjudicated youth</header><text>The term <term> adjudicated youth</term> means an individual—</text><subparagraph id="iddc57fb4e383d40878f103187eb5d2e13"><enum>(A)</enum><text>who has not attained the age of 21; and</text></subparagraph><subparagraph id="id1004512a1ed142b498836cec26bc1a74"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id1dffa7d1262a4c7aad19cc18acf8f4fd"><enum>(i)</enum><text>against whom a petition is filed for the adjudication of a delinquency offense under the laws of a State or the United States; or</text></clause><clause id="id12167dccfcff490486097e67425cd82e" commented="no" display-inline="no-display-inline" indent="up1"><enum>(ii)</enum><text>who has been adjudicated delinquent for a delinquency offense under the laws of a State or the United States. </text></clause></subparagraph></paragraph><paragraph id="id6de44438963746e69e02d703fdcd577c"><enum>(2)</enum><header>At-risk youth</header><text>The term <term>at-risk youth</term> means an individual who—</text><subparagraph id="id0df1a3b3a3254abea9dbd9d78bd5ecf0"><enum>(A)</enum><text>has not attained the age of 21; and</text></subparagraph><subparagraph id="idcc1cb927cc2b482d9582b23746e58f0b"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="ida2de78dcc6d9462d943cd48336878195"><enum>(i)</enum><text>is likely to fail academically without intervention, including an individual who—</text><subclause id="idb361352a8b93403fb51c21b3b24c2745" indent="up1"><enum>(I)</enum><text>has a high truancy rate;</text></subclause><subclause id="idaa0543e1b6234f68b76f43b55eace98f" indent="up1"><enum>(II)</enum><text>has withdrawn from school previously;</text></subclause><subclause id="id1710b14cfaa74848a1bdcc69cc4b24ac" indent="up1"><enum>(III)</enum><text>is not less than 1 year behind the appropriate grade level for an individual of the same age; or</text></subclause><subclause id="idf37097e306924b67a2b271d33c7f8b95" indent="up1"><enum>(IV)</enum><text>has limited English language proficiency;</text></subclause></clause><clause id="idc09dc93cd71e4d93a092c03ea89ee9b4" indent="up1"><enum>(ii)</enum><text>has a history of or is actively using drugs or alcohol;</text></clause><clause id="id1038e30249864d779aa5a8382430c4af" indent="up1"><enum>(iii)</enum><text>is pregnant or a parent;</text></clause><clause id="id5ff0d605f1304321a065972b7de044a8" indent="up1"><enum>(iv)</enum><text>is a gang member;</text></clause><clause id="idd4881997e4d34326a929e13c72fb739f" indent="up1"><enum>(v)</enum><text>is in contact with the juvenile justice system; or</text></clause><clause id="id5a26b790a1004f1badc88ddec1a8f9d4" indent="up1"><enum>(vi)</enum><text>is homeless, has run away from home, or is in foster care.</text></clause></subparagraph></paragraph><paragraph id="id47ab8aabb1fe416d86f90cb39b70c701"><enum>(3)</enum><header>Evidence-based</header><text>The term <term>evidence-based</term> has the meaning given such term in section 103 of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11103">34 U.S.C. 11103</external-xref>).</text></paragraph><paragraph id="idedbe39aa06bf484e99ed8d5e7d263234"><enum>(4)</enum><header>Secure correctional facility</header><text>The term <term>secure correctional facility</term> has the meaning given such term in section 103 of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11103">34 U.S.C. 11103</external-xref>).</text></paragraph><paragraph id="id70d6e7c1c20f49799fa5ac761555cd44"><enum>(5)</enum><header>Secure detention facility</header><text>The term <term>secure detention facility</term> has the meaning given such term in section 103 of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11103">34 U.S.C. 11103</external-xref>).</text></paragraph><paragraph id="id861292fa952c4ce28d052a3dafc8a4f6"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and any possession of the United States.</text></paragraph><paragraph id="id44e2df2ef75644e28aed43aad26c49c4"><enum>(7)</enum><header>Trauma-informed</header><text>The term <term>trauma-informed</term> has the meaning given such term in section 103 of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11103">34 U.S.C. 11103</external-xref>). </text></paragraph></section></legis-body></bill>
