<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 2429</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230720">July 20, 2023</action-date><action-desc><sponsor name-id="S350">Mr. Rubio</sponsor> (for himself and <cosponsor name-id="S402">Ms. Rosen</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XIX of the Social Security Act to increase the ability of Medicare and Medicaid providers to access the National Practitioner Data Bank for the purpose of conducting employee background checks.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id896C8EE22C5A45F594356C81562C77CB"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <short-title></short-title><quote><short-title>Promote Responsible Oversight and Targeted Employee background Check Transparency for Seniors Act</short-title></quote> or the <quote><short-title>PROTECTS Act</short-title></quote>.</text></section><section id="idF3CCD6F319E54E08803CF0F002B2441D"><enum>2.</enum><header>Permitting Medicare and Medicaid providers to access the National Practitioner Data Bank to conduct employee background checks</header><text display-inline="no-display-inline">Section 1921(b)(6) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-2">42 U.S.C. 1396r–2(b)(6)</external-xref>) is amended—</text><paragraph id="id9A5E57FEEB1B419D85981D3DC94A0585"><enum>(1)</enum><text>by striking <quote>and other health care entities (as defined in section 431 of the Health Care Quality Improvement Act of 1986)</quote> and inserting <quote>, other health care entities (as defined in section 431 of the Health Care Quality Improvement Act of 1986), providers of services (as defined in section 1861(u)), suppliers (as defined in section 1861(d)), and providers of items or services under a State plan under this title (or a waiver of such a plan)</quote>; and</text></paragraph><paragraph id="id21A526C9E8BF4B64BBCD70777B7A1481"><enum>(2)</enum><text>by striking <quote>such hospitals or other health care entities</quote> and inserting <quote>such hospitals, health care entities, providers, or suppliers</quote>.</text></paragraph></section></legis-body></bill>
