which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require covered digital advertising platforms to report their public service advertisements.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advancing Digital Support for Mental Health Services Act</short-title></quote> or the <quote><short-title>ADS for Mental Health Services Act</short-title></quote>.</text></section><section id="id54B45DA0FA1C41E3B0439D0B659CC444"><enum>2.</enum><header>Digital advertising platforms public service advertising reporting</header><subsection id="idFAFC936C8D1A45619F039A4F522E55DA"><enum>(a)</enum><header>In general</header><text>A covered digital advertising platform shall submit to the Commission an annual report that includes the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id64acf827ddd6428d9acb5a975fed990f"><enum>(1)</enum><text>The number and percentage of total advertisements on the platform during the previous 12-month period that were public service advertisements.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id41959682364c48758665a36875d24db3"><enum>(2)</enum><text>The estimated dollar value of such public service advertisements.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id87492FBE632B402798B38DDDD3E025F1"><enum>(3)</enum><text>The number of such public service advertisements that focus on local or regional mental, behavioral, and physical health resources.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id87d78a9ae68a4453b176a019cdeba299"><enum>(4)</enum><text>The number of such public service advertisements that promote free mental, behavioral, or physical health care resources.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0ad9383a68be4c6b8004f719b007046c"><enum>(5)</enum><text>A description of how such advertisements meet the definition of a public service advertisement as described in subsection (c)(3).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd4c5eb3d23ea4cf7802c4bce173765fb"><enum>(b)</enum><header>Report to Congress</header><text>Not later than 180 days after receiving the reports required under subsection (a), and annually thereafter, the Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a publicly available report summarizing the information reported under such subsection.</text></subsection><subsection id="id5C3DC3A88C084242B5BE24C89A325FC3"><enum>(c)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="idB07496651F444212836B54F86FBB0F0E"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="id0E8258568FC74DB6B634CD92E76365A5"><enum>(2)</enum><header>Public service advertisement</header><text>The term <term>public service advertisement</term> means an advertisement that—</text><subparagraph id="id335224606EED4408998B0ACEF4453146"><enum>(A)</enum><text>a covered digital advertising platform displays for free and without receiving any payment or other consideration in exchange;</text></subparagraph><subparagraph id="idA1C4E9A87314413B950C9A851A979333"><enum>(B)</enum><text>promotes mental, behavioral, or physical health care resources, and may include advertisements that—</text><clause id="idF66A3C8F66B940919EC8456FF7FF73B1"><enum>(i)</enum><text>raise awareness of community events to address social isolation; or</text></clause><clause id="idC4A99595DFBE4EBC9E57AD9E815E2455"><enum>(ii)</enum><text>promote State, local, or regional mental health care resources that are approved by the Substance Abuse and Mental Health Services Administration that mitigate—</text><subclause id="idCDD931397D9C47609164654F202801D2"><enum>(I)</enum><text>self-harm, suicide, eating disorders, substance abuse, and other matters that pose a risk to physical and mental health;</text></subclause><subclause id="id5B55AC77355A423AA424DF80FCBD3E3D"><enum>(II)</enum><text>patterns of addiction-like behaviors; or</text></subclause><subclause id="idFDE230E3DBA745FB9126C2AF95B707BF"><enum>(III)</enum><text>social isolation; and</text></subclause></clause></subparagraph><subparagraph id="idBA5C22443A644E568554BEBA6FF090E9"><enum>(C)</enum><text>is relevant and accessible to targeted audiences.</text></subparagraph></paragraph><paragraph id="id3B8A06006DE14C28BC03FFBDE8B056DE"><enum>(3)</enum><header>Covered digital advertising platform</header><text>The term <term>covered digital advertising platform</term> means a social media platform, search engine, or other public-facing website, online service, or application that— </text><subparagraph commented="no" display-inline="no-display-inline" id="id2f783ca1522149e4a8e666e24dd3502c"><enum>(A)</enum><text display-inline="yes-display-inline">sells digital advertising space; and</text></subparagraph><subparagraph id="id489b0a51e4094f3fb95186d316df59c1"><enum>(B)</enum><text>has more than 100,000,000 unique monthly users.</text></subparagraph></paragraph></subsection><subsection commented="no" id="id51A89D54AADE404D8D6B550490E05E4B"><enum>(d)</enum><header>Relationship to other laws</header><text>Nothing in this Act shall be construed to supersede any applicable privacy or data security laws.</text></subsection></section></legis-body></bill>
