<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 240</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230202">February 2, 2023</action-date><action-desc><sponsor name-id="S355">Mr. Cruz</sponsor> (for himself and <cosponsor name-id="S338">Mr. Manchin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the use of Federal funds to ban gas stoves.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Gas Stove Protection and Freedom Act</short-title></quote>.</text></section><section id="id25DF700527714292AC092D6B41A5E68A"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id6057587d99504de39b226cc4b261a71c"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Consumer Product Safety Commission.</text></paragraph><paragraph id="id8A496687329C45CC85EA7A30F513AD31"><enum>(2)</enum><header>Gas stove</header><text>The term <term>gas stove</term> means any gas range, gas stove, or household cooking gas appliance that meets the standard set forth in American National Standards Institute (ANSI) Z21.1/ CSA Z21.1 or any successor standard.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd2ea3e1c9e3443bb867e91223b884861"><enum>(3)</enum><header>Substantially increase the average price of gas stoves</header><text>The term <term>substantially increase the average price of gas stoves</term> means that the average price of a gas stove, annualized over its expected life, would likely be substantially higher than the average spending by United States homeowners on cooking stoves and ovens based on the most recent data for consumer expenditures reported by the Bureau of Labor Statistics.</text></paragraph></section><section id="id5CCC700AB2174402B0154A4C4F63DC9D"><enum>3.</enum><header>Prohibition</header><text display-inline="no-display-inline">No Federal funds may be used by the Commission to regulate an existing or new gas stove as a banned hazardous product under section 8 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2057">15 U.S.C. 2057</external-xref>) or to impose or enforce any consumer product safety standard or rule on existing or new gas stoves under section 7 or 9 of such Act (15 U.S.C. 2056 or 2058) that would otherwise result in a prohibition on the use or sale of gas stoves in the United States or would otherwise substantially increase the average price of gas stoves in the United States. </text></section></legis-body></bill>
