<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 2388</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230719">July 19, 2023</action-date><action-desc><sponsor name-id="S385">Ms. Cortez Masto</sponsor> (for herself and <cosponsor name-id="S381">Mr. Rounds</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Consolidated Farm and Rural Development Act to establish a cybersecurity circuit rider program to provide cybersecurity-related technical assistance to certain entities that operate rural water or wastewater systems.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cybersecurity for Rural Water Systems Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idaa184d84c3cb4cc7abd43f48d8ad4dc6"><enum>2.</enum><header>Rural water and wastewater cybersecurity circuit rider program</header><text display-inline="no-display-inline">Section 306(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926">7 U.S.C. 1926(a)</external-xref>) is amended by inserting after paragraph (22) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9B397BCB25B8486D8F7964D37696A84D"><paragraph id="ide79b162879254ced8273e331167af3ea"><enum>(23)</enum><header>Rural water and wastewater cybersecurity circuit rider program</header><subparagraph id="id8ff9ad024cfb48deb0bd5c269ae5254d"><enum>(A)</enum><header>In general</header><text>The Secretary shall establish a cybersecurity circuit rider program, which shall be structured similarly to the circuit rider program under paragraph (22), to provide technical assistance to associations described in paragraph (1) that operate rural water or wastewater systems—</text><clause id="iddf329efe68604c69bfa537ce23e7ac03"><enum>(i)</enum><text>to provide rapid assessments of the current ability or inability of those associations—</text><subclause commented="no" display-inline="no-display-inline" id="id376b1fc8ccd94ce3a03d9303cb3fab5e"><enum>(I)</enum><text display-inline="yes-display-inline">to respond to cybersecurity threats; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idade98cc5a5f444879a59cd3165053bed"><enum>(II)</enum><text display-inline="yes-display-inline">to protect the cyberinfrastructure of those associations and public health;</text></subclause></clause><clause id="idc13c5f6392584cb792664ca362e915a3"><enum>(ii)</enum><text>to develop reasonable protocols to enhance cybersecurity protection;</text></clause><clause id="id07d8a4c8d94e451fb081abca22ffbcf4"><enum>(iii)</enum><text>to provide assistance to address inadequate cyber protection plans; and</text></clause><clause id="id0a95b7a0d5f44ef0aeac2db71a95017d"><enum>(iv)</enum><text>to document the state of cyber protection with respect to the water supplies of those associations.</text></clause></subparagraph><subparagraph id="idfb0a3b7577144a02a0fd6d3315666282" commented="no"><enum>(B)</enum><header>Report requirement</header><text>A circuit rider that receives funding under this paragraph shall submit to the Secretary a report documenting—</text><clause commented="no" display-inline="no-display-inline" id="id8F88A23A8D7A48B7A789D104D80F4E5A"><enum>(i)</enum><text display-inline="yes-display-inline">the associations served by the circuit rider under this paragraph; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id7C6E608328634DB68DEFF0BD016D7B51"><enum>(ii)</enum><text display-inline="yes-display-inline">the activities performed by the circuit rider under this paragraph.</text></clause></subparagraph><subparagraph id="idab08da2ab8114872afc8bb406a4d3c7e"><enum>(C)</enum><header>Requirements for circuit riders</header><text>To provide technical assistance under subparagraph (A), a circuit rider shall possess the necessary experience and certification to effectively carry out the activities described in that subparagraph, as determined by the Secretary.</text></subparagraph><subparagraph id="idb8867a11218049b599ca52ffd664c35c"><enum>(D)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this paragraph $10,000,000 for each of fiscal years 2024 through 2028.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
