which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Bill Emerson Good Samaritan Food Donation Act to provide protection for the good faith donation of pet products, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HF9135C82901B49DBB8A3917B40ED2624"><section section-type="section-one" id="H4A1F7AE04BE04B7A979A0475605AC413"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bring Animals Relief and Kibble Act of 2023</short-title></quote> or as the <quote><short-title>BARK Act of 2023</short-title></quote>.</text></section><section id="H5910E12713CC498CA8A7AA72E0FE624A"><enum>2.</enum><header>Liability for pet product donations</header><text display-inline="no-display-inline">The Bill Emerson Good Samaritan Food Donation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1791">42 U.S.C. 1791</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id7456e821e67b4568abc83fb40ae02464"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="HEADFA661662A4E558021A6B9B2F92AF8"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (4) through (11) and (12) as paragraphs (5) through (12) and (15), respectively;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide981634ef5bc44f184d5ee307be2c507"><enum>(B)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id26B8E4DFA0404CB3A5AFF8FCD752FFF6"><paragraph id="HDFD9C5AE8A954809B7A82979179DDA02"><enum>(4)</enum><header>Emotional support animal</header><text display-inline="yes-display-inline">The term <term>emotional support animal</term> means an animal that is—</text><subparagraph id="H9AC127DCB2CB4835B9EF470F3D22AB38"><enum>(A)</enum><text>covered by the exclusion described in section 5.303 of title 24, Code of Federal Regulations (or a successor regulation); and</text></subparagraph><subparagraph id="H164C4C2BFEDE427CA06F7F6AEAE8BBAC"><enum>(B)</enum><text>not a service animal.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H80283111AF7A4305A6090CE88A0ADC4D"><enum>(C)</enum><text>in paragraph (5) (as so redesignated), by striking <quote>for human consumption</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="HA06E26BFA4F24F33BD6E03DBA7196045"><text>for—</text><subparagraph id="H2112F1EC4EB542EBAEE32EFDE56BD560"><enum>(A)</enum><text display-inline="yes-display-inline">human consumption; or</text></subparagraph><subparagraph id="H887DA135F31948AE84F4C1C2847F098E"><enum>(B)</enum><text>consumption by a pet, emotional support animal, or service animal</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HB6B59D5AD4FA4CC8A59B8034C9D81D53"><enum>(D)</enum><text>in paragraph (8) (as so redesignated), by inserting <quote>pet supply,</quote> after <quote>household cleaning product, </quote>;</text></subparagraph><subparagraph id="H8E78E11D47B74451969550F1A967DF7A" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text>in paragraph (12) (as so redesignated), in the first sentence, by inserting <quote>pet food supplier,</quote> after <quote>farmer,</quote>; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id43c549542ce641b28df4f1ed2762c8d7"><enum>(F)</enum><text>by inserting after paragraph (12) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA336282514EA4B8BA0657D07DA5160DD"><paragraph id="HF15C4FC54AEC42398E27883BF1C4D462"><enum>(13)</enum><header>Pet</header><text>The term <term>pet</term> means a domesticated animal, such as a dog, cat, bird, rodent, fish, or turtle, that is kept for pleasure rather than for commercial purposes.</text></paragraph><paragraph id="H6E4D2BA91E5C442D9DBB818B0462F1C4"><enum>(14)</enum><header>Pet supply</header><text display-inline="yes-display-inline">The term <term>pet supply</term> means tangible personal property used for a pet, including a pet carrier, crate, kennel, house, cage, article of clothing, bedding, toy, collar, leash, lead, tie-out, feeder, bowl, dish, pet gate, and pet door.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide056b0e1a1244d10b52a4e70df23ed3e"><enum>(G)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFB9935979D3B4B4DBA92146549D4637E"><paragraph id="H13DA88FE8F334FE98D730FDB80FF70E6"><enum>(16)</enum><header>Service animal</header><text>The term <term>service animal</term> has the meaning given the term in section 36.104 of title 28, Code of Federal Regulations (or a successor regulation).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0282ed0ff7484757b997e11f3f7c3284"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="H0E4D6F6ADB9E4327B1999981A5FCB949"><enum>(A)</enum><text>by redesignating paragraph (4) as paragraph (5);</text></subparagraph><subparagraph id="HCCC979813A0A4860BB574144438975B3"><enum>(B)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block id="HEB9D6EA13BA249ACBE7005AD738AB744" display-inline="no-display-inline" style="OLC"><paragraph id="HB9D84ED4CBC945F194F44AA81C2F3D19"><enum>(4)</enum><header>Liability with respect to pets, service animals, or emotional support animals</header><subparagraph id="H1A3659D11FD549F5BA7A9054868B9AEF"><enum>(A)</enum><header>Donations made</header><text display-inline="yes-display-inline">A person or gleaner shall not be subject to civil or criminal liability arising from the nature, age, packaging, or condition of food described in subsection (b)(5)(B) or pet supplies that the person or gleaner donates in good faith to a nonprofit organization or State or unit of local government for direct distribution to pets, service animals, or emotional support animals.</text></subparagraph><subparagraph id="H197F2F00EFB342A1BF5C664C4FFB5842" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Donations received</header><text display-inline="yes-display-inline">A nonprofit organization or State or unit of local government shall not be subject to civil or criminal liability arising from the nature, age, packaging, or condition of food described in subsection (b)(5)(B) or pet supplies that the nonprofit organization or State or unit of local government receives as a donation in good faith from a person or gleaner for direct distribution to pets, service animals, or emotional support animals.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HD109B6081AC44A7A8F571B6947B23537"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (5) (as so redesignated)—</text><clause id="HB62080208D994FDABEEC08CE75A1B720"><enum>(i)</enum><text>by striking <quote>and (3)</quote> and inserting <quote>(3), and (4)</quote>; and</text></clause><clause id="H173F18A1C8BD494CA23DAC9ECFD8012E"><enum>(ii)</enum><text>by inserting <quote>State or local government,</quote> after <quote>gleaner,</quote>; and</text></clause></subparagraph></paragraph><paragraph id="id91346b1778704bf9ad80614333348305" commented="no"><enum>(3)</enum><text>in subsection (d), by inserting <quote>, pets, service animals, or emotional support animals</quote> after <quote>needy individuals</quote>.</text></paragraph></section></legis-body></bill>
