which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Labor to award grants to develop, administer, and evaluate early childhood education apprenticeships, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H43FC2D9BFAC94894A42DD8EE58A747A4"><section section-type="section-one" id="idC0A3535511224AA98F4DC4C8F8D520E4"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Early Educators Apprenticeship Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H8521DDED9319459984738779079DF4C1"><enum>2.</enum><header>Grants for apprenticeship programs</header><subsection id="HEB8ED4F0C21F44CD9799C5A3E339BB94"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H5C8F8C041FE6496E99090C27F9B0132A"><enum>(1)</enum><header>Apprentice</header><text display-inline="yes-display-inline">The term <term>apprentice</term> means an individual participating in a registered apprenticeship program focused on early childhood education.</text></paragraph><paragraph id="H3B01BDC1DFF846F2AE1E6E7E3BE76F4C"><enum>(2)</enum><header>Apprenticeship</header><text display-inline="yes-display-inline">Except when used in referring to or defining the term <term>registered apprenticeship program</term>, the term <term>apprenticeship</term> means a registered apprenticeship program that trains apprentices.</text></paragraph><paragraph id="id6F8BEDB9DBC848A1B0D30D35C9BFD048"><enum>(3)</enum><header>Credential or degree</header><text>The term <term>credential or degree</term> means a recognized secondary or postsecondary credential, a high school diploma or its recognized equivalent, or a postsecondary degree (including an associate, baccalaureate, or other degree).</text></paragraph><paragraph id="id34B4DD0044D44C2F838FC0626EFEC3F2"><enum>(4)</enum><header>Eligible partnership</header><text>The term <term>eligible partnership</term> means a partnership that—</text><subparagraph id="id5f604f4446444672a0df977f61176d36"><enum>(A)</enum><text>includes an individual employer or a consortium of employers (including schools and child care centers and family child care providers), and an institution of higher education; and</text></subparagraph><subparagraph id="idD19DDF1D90F94994A886A9E164D8EE5E"><enum>(B)</enum><text>may include one or more—</text><clause id="ide7083c870cce470ab894a32948b1a42d"><enum>(i)</enum><text>labor organizations;</text></clause><clause id="id5be21e031ec94ec4adfbb2fc1e3c5591"><enum>(ii)</enum><text>workforce intermediaries;</text></clause><clause id="iddb39b118b8484822ab74231971b4e874"><enum>(iii)</enum><text>economic development agencies;</text></clause><clause id="idc143f11b5b644d5f9dcce5c6951f0892"><enum>(iv)</enum><text>community-based organizations;</text></clause><clause id="iddaaf40f3d13d4083812c4dc564be9334"><enum>(v)</enum><text> State educational agencies or local educational agencies, as such terms are defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>); and</text></clause><clause id="id25edfc5c4a1e42138eb421c9125bbd6d"><enum>(vi)</enum><text> providers of support or specialized services for apprentices.</text></clause></subparagraph></paragraph><paragraph id="HE26A7E4E11BE49C7A9C4A57E60760768"><enum>(5)</enum><header>Institution of higher education</header><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given the term in section 101, and subparagraphs (A) and (B) of section 102(a)(1), of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>, 1002(a)(1)).</text></paragraph><paragraph id="H010F5DAC952E42ABA4610983E73A00F8"><enum>(6)</enum><header>Registered apprenticeship program</header><text display-inline="yes-display-inline">The term <term>registered apprenticeship program</term> means an apprenticeship program registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>), including any requirement, standard, or rule promulgated under such Act as in effect on December 30, 2019. </text></paragraph><paragraph id="HCEA63AF3496341CBB36C51EB289C5BFB"><enum>(7)</enum><header>Secretary</header><text display-inline="yes-display-inline">Except as otherwise specifically provided, the term <term>Secretary</term> means the Secretary of Labor.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7FFF554381C54BFA9906D864ED16A8D6"><enum>(8)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States, the District of Columbia, and the Commonwealth of Puerto Rico.</text></paragraph></subsection><subsection id="HBAFE181B7003447CBDA14748E381B192"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of Health and Human Services and the Secretary of Education, shall award grants to eligible partnerships to pay the Federal share of the costs of developing, administering, and evaluating apprenticeships.</text></subsection><subsection id="HCCCA246D4FAA48D2957E68490012D9A4"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible partnership seeking a grant under this Act shall submit an application to the Secretary for approval at such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="HD6232D4CB6EE4AC597330535037F8A80"><enum>(d)</enum><header>Uses of funds</header><paragraph id="H8C50B18622BB4E0B83536E72AFC91BD9"><enum>(1)</enum><header>Required uses</header><text>A grant under subsection (b) shall be used for activities that develop, administer, and evaluate an apprenticeship, including—</text><subparagraph id="HF543C593E2EC485CAF56C52DD5ADAB93"><enum>(A)</enum><text display-inline="yes-display-inline">equipping apprentices with specialized knowledge, skills, and competencies required to work in early childhood education;</text></subparagraph><subparagraph id="HCBCE0FA7681640789AD78FA242DA9FEC"><enum>(B)</enum><text display-inline="yes-display-inline">increasing the number of individuals who complete an apprenticeship program and obtain a credential or degree or a certificate of completion of an apprenticeship program, including increasing such number in areas that are underserved or rural;</text></subparagraph><subparagraph id="H725043BBF19D4233A948A4FCD70E7F10"><enum>(C)</enum><text display-inline="yes-display-inline">promoting recruitment and retention of apprentices;</text></subparagraph><subparagraph id="H471E65A73ED140729A2BBFB887DCD427"><enum>(D)</enum><text display-inline="yes-display-inline">providing a pathway to career advancement for apprentices by assisting such apprentices in completing an apprenticeship;</text></subparagraph><subparagraph commented="no" id="H71F18DFC72F54DF298684BC63C81E8C2"><enum>(E)</enum><text display-inline="yes-display-inline">providing for evaluation and longitudinal data regarding apprentices participating in the program to determine long-term outcomes, including information needed for purposes of subsections (g) and (i);</text></subparagraph><subparagraph id="H0D9129F6E4604BD7B233614978B68D78"><enum>(F)</enum><text display-inline="yes-display-inline">supporting partnerships with institutions of higher education in the State in which the eligible partnership serves, or will serve, apprentices, businesses, and other entities participating in an apprenticeship to provide for—</text><clause id="idC0768909A2834D1993FCDB30CB6A944F"><enum>(i)</enum><text display-inline="yes-display-inline">the award of postsecondary academic credit for related instruction or on-the-job training provided through the apprenticeship; and </text></clause><clause id="id6FA3F9AF1DE544A38FAA5BD234BEC52D"><enum>(ii)</enum><text display-inline="yes-display-inline">the application of such credit toward a credential or degree from an institution in the partnership; and</text></clause></subparagraph><subparagraph id="H043E1B2611B5409FBD9639DA4A624EA2"><enum>(G)</enum><text display-inline="yes-display-inline">developing strategies to hire and retain qualified supervisors for apprentices that support such apprentices through—</text><clause id="H7EEC88C4D05E46A98175C9E08AE6E170"><enum>(i)</enum><text>professional development;</text></clause><clause id="HF132CDFD58C942E897882C70DF036E41"><enum>(ii)</enum><text>mentorship;</text></clause><clause id="HE96D858D20664D00A3DC91B2F554FD39"><enum>(iii)</enum><text>evaluation; and</text></clause><clause id="H746E147FAC7D446BA083E64F0BB515F0"><enum>(iv)</enum><text>training.</text></clause></subparagraph></paragraph><paragraph id="HADDD73F67446482B80E90013BBFF3CC8"><enum>(2)</enum><header>Permitted uses</header><text display-inline="yes-display-inline">In addition to the requirements under paragraph (1), a grant under subsection (b) may be used—</text><subparagraph id="H8E8170473C784132979B9EA2C2007C17"><enum>(A)</enum><text>in cooperation with the State agency responsible for apprenticeships in the State in which the eligible partnership serves or will serve apprentices, to create or maintain a statewide resource database for businesses, institutions of higher education, or other entities participating in an apprenticeship to share best practices, curricula, and other resources that directly contribute to administering an effective apprenticeship; </text></subparagraph><subparagraph id="H03EFD3C43FD74121B282B17AE2568431"><enum>(B)</enum><text display-inline="yes-display-inline">to establish primary indicators of performance with respect to apprentices and individuals who have completed an apprenticeship to be shared on any workforce registry of such State and the registered apprenticeship program data system maintained by the Secretary of Labor, including—</text><clause id="H037D05C0A3794EF8A613C9BBBC84921B"><enum>(i)</enum><text display-inline="yes-display-inline">the percentage of individuals who have completed an apprenticeship and remain employed full-time in early childhood education—</text><subclause id="HBC15C8BAC3714412A46B1864B9598C8F"><enum>(I)</enum><text>6 months after completing such apprenticeship; and</text></subclause><subclause id="HE7D4EA9668874E9BAB84365F7C2D5231"><enum>(II)</enum><text>1 year after completing such apprenticeship;</text></subclause></clause><clause id="HF6E1E67DC5AA426D9C724495E5F95095"><enum>(ii)</enum><text display-inline="yes-display-inline">the median earnings of individuals who have completed an apprenticeship and are employed full-time in early childhood education within 6 months after completing such apprenticeship;</text></clause><clause id="HE88B2FBBF5BC488A923F08A193DDC2D6"><enum>(iii)</enum><text display-inline="yes-display-inline">the percentage of apprentices who obtain a credential or degree while participating in an apprenticeship; and</text></clause><clause id="HF1A04C43D65C4ADABF76A29A083D7ABB"><enum>(iv)</enum><text display-inline="yes-display-inline">the percentage of individuals who have completed an apprenticeship and who begin or obtain a credential or degree within 1 year after completing the apprenticeship; and</text></clause></subparagraph><subparagraph commented="no" id="idA7461F61462747CCB5E499746EA1AC35"><enum>(C)</enum><text>to pay the costs of tuition and fees for apprentices enrolled in programs of education leading to a credential or degree. </text></subparagraph></paragraph></subsection><subsection id="H42F1F2AF27EA471C86F7433FFE20294F"><enum>(e)</enum><header>Priority</header><text display-inline="yes-display-inline">The Secretary shall prioritize eligible partnerships that—</text><paragraph commented="no" id="H7FD13738C0A04124B0C755855E3BD6EA"><enum>(1)</enum><text display-inline="yes-display-inline">include in the eligible partnership, or have developed partnerships with—</text><subparagraph commented="no" id="HBF1DD4B240BD427DADC37C259ED6663E"><enum>(A)</enum><text>Indian Tribes in the State in which the eligible partnership serves or will serve apprentices; or</text></subparagraph><subparagraph commented="no" id="H48AB0DC980D7440B93E8837E1E2CA9E1"><enum>(B)</enum><text>institutions of higher education that serve minority populations;</text></subparagraph></paragraph><paragraph id="H587B091C7FA847A4AE3B236C1F0A5651"><enum>(2)</enum><text display-inline="yes-display-inline">operate or serve an apprenticeship program in a State that has a statewide credit articulation agreement in place that ensures credit transfer between participating institutions of higher education in the State and other relevant credential programs; or</text></paragraph><paragraph id="HF12827F4B57245B29CDEE4CE2E7DB109"><enum>(3)</enum><text display-inline="yes-display-inline">provide an assurance that not less than 25 percent of the grant funds will be used to support apprenticeships in underserved or rural communities.</text></paragraph></subsection><subsection id="HE49C04076FC74E5EA949AD911BBE4CA9"><enum>(f)</enum><header>Grant term and limitation</header><paragraph id="HFF869D2575064A539BC77542480CA436"><enum>(1)</enum><header>Term</header><text display-inline="yes-display-inline">The term of a grant made under this Act shall be 3 years.</text></paragraph><paragraph id="H8E316566D1F94C7BB407109CBAECD527"><enum>(2)</enum><header>Limitation</header><text>The Secretary shall award no greater than 20 grants under this section each fiscal year.</text></paragraph></subsection><subsection id="HA2B7C14D0629476498089130A029EF2E"><enum>(g)</enum><header>Grant recipient evaluation and report</header><text display-inline="yes-display-inline">Not later than 1 year after receiving a grant under this Act, and annually thereafter for the duration of the grant, an eligible partnership shall submit to the Secretary a report containing—</text><paragraph id="id6C3FF41838E44476A83D4D3B67595484"><enum>(1)</enum><text display-inline="yes-display-inline">an evaluation of the eligible partnership's apprenticeships to determine which program strategies made progress toward—</text><subparagraph id="HD4081687E0064812B46BB940EEA916A8"><enum>(A)</enum><text>increasing the aggregate number of apprentices; and</text></subparagraph><subparagraph id="HD1473BFA160E45198DD37315726F4298"><enum>(B)</enum><text display-inline="yes-display-inline">increasing the retention rates of apprentices; and</text></subparagraph></paragraph><paragraph id="idE27FC26C52F74CC092CBC083E8B2BC82"><enum>(2)</enum><text>the number of individuals served by the grant who are enrolled in, or completed, an educational credential, in the aggregate and disaggregated by type of credential or degree (including secondary school diploma, the recognized equivalent of a secondary school diploma, a certificate, a credential, an associate degree, a baccalaureate degree, and any other category of secondary or postsecondary credential) and as applicable, by specific educational program within the credential or degree (including, if applicable, a child development associate credential).</text></paragraph></subsection><subsection id="H57774608A2044335B226AB48C45605E3"><enum>(h)</enum><header>Cost-Sharing</header><paragraph id="H191CBAC3C77D484D9BD4C1E972E0A33C"><enum>(1)</enum><header>In general</header><text>The Federal share of the cost of any activity carried out using a grant made under this Act shall be not more than 75 percent.</text></paragraph><paragraph id="H90C9DE0F855F45DD93D7A80D4B067301"><enum>(2)</enum><header>In-kind contributions</header><text display-inline="yes-display-inline">The non-Federal share of the total cost of any activity carried out using a grant made under this Act may be in the form of donations or in-kind contributions of goods or services fairly valued.</text></paragraph></subsection><subsection commented="no" id="HC0EB65D73DF64C42A74356E69EA45E8D"><enum>(i)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 5 years after the date of enactment of this Act, the Secretary shall submit to Congress a report on the effectiveness of each eligible partnership that received a grant under this Act to develop, administer, and evaluate apprenticeships, including evaluating—</text><paragraph commented="no" id="H6CDE5E501C2B4D58955A1BE66E7D744C"><enum>(1)</enum><text display-inline="yes-display-inline">any increase in the number of apprentices in early childhood education;</text></paragraph><paragraph commented="no" id="HB4DEBBBE17A54FDFA6089392D2735AF8"><enum>(2)</enum><text display-inline="yes-display-inline">any increase in the retention rates of individuals who work in early childhood education after completing an apprenticeship;</text></paragraph><paragraph commented="no" id="H73BDBAAA31A440329A75ECB40A7821BA"><enum>(3)</enum><text display-inline="yes-display-inline">the career path of apprentices and individuals who have completed an apprenticeship; and</text></paragraph><paragraph id="H672DC09E546E4E868FB3C6DE6F803770"><enum>(4)</enum><text>any increase in the number of credentials and degrees obtained by apprentices.</text></paragraph></subsection><subsection id="H24078ECEDF784E8A83C791899D6D632B"><enum>(j)</enum><header>Funding</header><text display-inline="yes-display-inline">To carry out the grant program under this Act, the Secretary shall use amounts allocated under section 414(c) of the American Competitiveness and Workforce Improvement Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/3224a">29 U.S.C. 3224a</external-xref>).</text></subsection></section><section id="id2A222341792E47A5BEC9BB48821F2188"><enum>3.</enum><header>Department of Agriculture loan restrictions</header><text display-inline="no-display-inline">The Secretary of Agriculture shall revise section 3555.102(c) of title 7, Code of Federal Regulations, to exclude a business that is a licensed child care provider. </text></section></legis-body></bill>
