which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To assist trafficking survivors who lack government issued identification in accessing air travel, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Jimmy Deal Trafficking Survivors Assistance Act of 2023</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id49fcb6f9e2f5407a85c8a21effe000cc"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="ide5a5717698b24672981265c99eab1562"><enum>(1)</enum><header>Administration</header><text>The term <term>Administration</term> means the Transportation Security Administration.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb098f182779641eeb959e0dce1f992bb"><enum>(2)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Transportation Security Administration.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf96e88f0c71d471aa3b1325f52c9e754"><enum>(3)</enum><header display-inline="yes-display-inline">Airport</header><text>The term <term>airport</term> has the meaning given the term <term>air carrier airport</term> in section 47102 of title 49, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9a73235af0324c01944c47063f517826"><enum>(4)</enum><header>Human trafficking</header><text display-inline="yes-display-inline">The term <term>human trafficking</term> has the meaning given the term “severe forms of trafficking in persons” in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idedb01bce2271472fb63bc37e613842d1"><enum>(5)</enum><header>Responsible party</header><text>The term <term>responsible party</term> means an individual who is eligible under the policies of the relevant airline to pick up a minor at the destination airport.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1deb546e2b124a8c8d9db4cba132ce85"><enum>(6)</enum><header display-inline="yes-display-inline">Service provider</header><text>The term <term>service provider</term> means a non-profit organization that provides services to individuals who are victims of human trafficking, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id70eceb9dfcfd480b8d94623ce1c819ae"><enum>(A)</enum><text display-inline="yes-display-inline">emergency services, such as shelter, food, clothing, and transportation; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id797f675031b6412aa3212d6aca08dce9"><enum>(B)</enum><text display-inline="yes-display-inline">case management or wrap-around services; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3237eaf6e13a4e0c8bb290c56b297b61"><enum>(C)</enum><text display-inline="yes-display-inline">mental health care or other medical services; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id460335f574fb46a5be38233585b8a728"><enum>(D)</enum><text display-inline="yes-display-inline">legal services.</text></subparagraph></paragraph><paragraph id="id59c2a9c056d54fe088db40b5f9a70df2"><enum>(7)</enum><header>TSPoC</header><text>The term <term>TSPoC</term> means a Trafficking Survivor Point of Contact designated under section 3.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="idbc3fb563eaf3434fa0b74e1e99647585"><enum>3.</enum><header>Establishment of process to assist trafficking survivors with air travel</header><subsection id="id60c049d52d854c1e8bfb41d9165ab430"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the Administrator of the Transportation Security Administration shall at each airport where the Administration conducts screening of passengers and property in accordance with section 44901 of title 49, United States Code—</text><paragraph commented="no" display-inline="no-display-inline" id="id9fba876efd0e49359328311a888aa573"><enum>(1)</enum><text display-inline="yes-display-inline">establish the position of Trafficking Survivor Point of Contact; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide62ddb463d8c41dfa61db6500be4d22a"><enum>(2)</enum><text display-inline="yes-display-inline">designate as TSPoC an individual who—</text><subparagraph commented="no" display-inline="no-display-inline" id="id54194261546149ca8eea860ab6455c80"><enum>(A)</enum><text display-inline="yes-display-inline">is an employee of the Administration; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id94c5dd21901e45ea9d9ab45b97e32b88"><enum>(B)</enum><text>holds the position of passenger support specialist within the Administration.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idff2fa61119eb4bbca1d63e31ce021d02"><enum>(b)</enum><header>Duties</header><text>A TSPoC shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id6e0c3702e8fb4c6989603e1bb9092305"><enum>(1)</enum><text display-inline="yes-display-inline">liaise and establish relationships with service providers; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id42f4302c78e449f0a8aee3d93b7901dc"><enum>(2)</enum><text>upon a request made via TSA Cares or direct contact by a service provider that is eligible to receive assistance under section 4, provide air travel assistance as described in section 4.</text></paragraph></subsection><subsection id="ide4bffe171517493cb14ea3b8307aea41"><enum>(c)</enum><header>Training</header><paragraph commented="no" display-inline="no-display-inline" id="id37228ef5ed6a47a8be69edf00b39888d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the designation of a TSPoC under subsection (a), such TSPoC shall review training materials on human trafficking, trauma-informed approaches to working with survivors of sexual assault or violence, and post traumatic stress disorder made available by the Department of Homeland Security, including any such training materials made available on a website of the Department. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddb72f3137e4e4e73a0da61c6f9bebed8"><enum>(2)</enum><header>Prior training</header><text>The review of training materials required by paragraph (1) shall be in addition to any prior training provided by the Administration.</text></paragraph></subsection><subsection id="id79b36f75b4bf44d18a96c8aab8fa04e2"><enum>(d)</enum><header>Online information</header><text>Not later than 30 days after the designation of a TSPoC under subsection (a), the airport at which such TSPoC is stationed shall publish on a publicly available website of the airport—</text><paragraph commented="no" display-inline="no-display-inline" id="id39f2c75a533d4dd185d7c580863129b0"><enum>(1)</enum><text display-inline="yes-display-inline">the contact information of the TSPoC;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id920b07c2eecc4605bca4355ca444945a"><enum>(2)</enum><text>information on the services provided by the TPSoC; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id90028acb20e24d0685158a336b9e53e9"><enum>(3)</enum><text display-inline="yes-display-inline">the processes for engaging such services, including information about TSA Cares.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id49023d72a2e14107916aeafea38e11c3"><enum>4.</enum><header>Air travel assistance for survivors of human trafficking</header><subsection id="id475d8ba4afa043dca80d47c73d65ac8b"><enum>(a)</enum><header>Identification assistance</header><text>At the request of any service provider that is eligible to receive assistance under this section and is arranging air travel for an individual who is a survivor of human trafficking who does not have the identification documents necessary for air travel, a TPSoC shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id1492b38c465b4051b3689db889c4cf80"><enum>(1)</enum><text display-inline="yes-display-inline">provide to such service provider information regarding the process by which the Administration will attempt to verify the identity of such individual when the individual arrives at the screening checkpoint; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0816cebceecd42c68a71e5b191f5013e"><enum>(2)</enum><text display-inline="yes-display-inline">assist the service provider or the individual with the submission of a formal request for travel assistance via TSA Cares; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd9178a8cda9646ae8363a0ca145c4052"><enum>(3)</enum><text>act as a liaison between the National Vetting Center, other personnel of the Administration involved in the vetting process, and the individual to ensure that the individual—</text><subparagraph commented="no" display-inline="no-display-inline" id="id054ad796383949e58ff2085ab0468b73"><enum>(A)</enum><text display-inline="yes-display-inline">understands the vetting process; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf1d2fc7988a348198d30973e2c9d20ba"><enum>(B)</enum><text display-inline="yes-display-inline">is treated in a trauma-informed manner. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idebdff30100c1487f9b9912e98241e45c"><enum>(b)</enum><header>Eligible non-Profit service providers</header><text>A service provider shall be eligible to receive assistance under this section, if such service provider has provided to the TSPoC—</text><paragraph commented="no" display-inline="no-display-inline" id="idda7e36b2f6ed491686f7c9e9030511d8"><enum>(1)</enum><text display-inline="yes-display-inline">not fewer than 30 days prior to submitting a request for assistance under this section, information with respect to such service provider, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9b274416afc14354824cda3ac8433875"><enum>(A)</enum><text display-inline="yes-display-inline">the name of the service provider;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3f1b80a39ad74efba8e087d92466b88c"><enum>(B)</enum><text>the physical address of the main office or principal place of business of the service provider; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idedb2514cf1794bc28e6b7aedd5356195"><enum>(C)</enum><text>the telephone number of the service provider;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id561428f594e2482c813513886f7b3948"><enum>(D)</enum><text>the website, if available, of the service provider; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc94784f408394a018e1cb8dbce453d86"><enum>(E)</enum><text>the employer identification number of the service provider; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideb5cfbd493ce423985611ca24ee63205"><enum>(2)</enum><text display-inline="yes-display-inline">confirmation that the service provider—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2e4e79d9de36451a886b23852a31875c"><enum>(A)</enum><text display-inline="yes-display-inline">is actively assisting an individual who the service provider, in the professional judgment of the service provider, has reasonably determined to be a survivor of human trafficking; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id119d9896711c4812b47ad57a1caab173"><enum>(B)</enum><text display-inline="yes-display-inline">has assessed the travel needs of the individual; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7323c65961ff484eb1ca345403c99fbd"><enum>(C)</enum><text display-inline="yes-display-inline">has or will purchase an airline ticket for the individual, if necessary; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id44b4d7aedc01448ba461a6fe50256be4"><enum>(D)</enum><text display-inline="yes-display-inline">has arranged for a family member of the individual, a representative of a service provider, or another individual to meet the individual at the destination airport; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf55e3351c75b49d6b11a114bbf988836"><enum>(E)</enum><text display-inline="yes-display-inline">with respect to any minor receiving assistance from such service provider, is aware of and will comply with all relevant airline policies regarding travel for unaccompanied minors, including by—</text><clause commented="no" display-inline="no-display-inline" id="id64617deff34949bb851d2452d3ecfcb3"><enum>(i)</enum><text display-inline="yes-display-inline">paying any fees required by such airline; and </text></clause><clause commented="no" display-inline="no-display-inline" id="ided38beb38fef4de3a169230195da5262"><enum>(ii)</enum><text display-inline="yes-display-inline">ensuring that a responsible party greets the minor at the arrival gate of the destination airport; and </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1d0f486a1a6443358348a3537c729d97"><enum>(F)</enum><text display-inline="yes-display-inline">will assist the individual in providing to the National Vetting Service any available information or documentation necessary to verify the identify of the individual.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc374d31ae37c49b0aaddee1d290c62cd"><enum>(c)</enum><header>Travel procedures</header><paragraph commented="no" display-inline="no-display-inline" id="idf6b0510fcb244153a0633a51a2d23aa7"><enum>(1)</enum><header display-inline="yes-display-inline">Arrangements prior to departure</header><text>If the Administrator permits an individual who is a survivor of human trafficking to travel by air—</text><subparagraph commented="no" display-inline="no-display-inline" id="id044ca889c2614451b7b19d387a498bdb"><enum>(A)</enum><text display-inline="yes-display-inline">the TSPoC shall contact the TSPoC at the destination of the individual to arrange for such individual to be greeted by the TSPoC, or a designee, at the destination airport; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id911959b5407444a09dd51d83945b2b3a"><enum>(B)</enum><text>on the date of the departing flight of the individual, the TSPoC, or a designee, shall accompany the individual—</text><clause commented="no" display-inline="no-display-inline" id="id427de218caf34f4b85eba5a5fdcd61db"><enum>(i)</enum><text display-inline="yes-display-inline">through all security screenings at the airport; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0ad41dd71b9843bb892ff052d575c751"><enum>(ii)</enum><text display-inline="yes-display-inline">at the request of the individual, to the departure gate of the flight.</text></clause></subparagraph></paragraph><paragraph id="id0b8b0ea55db046299bf16e75437158a3" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Arrival at destination airport</header><text>Upon the arrival at the destination airport of an individual whose travel was arranged under paragraph (1), the TSPoC, or a designee, at such airport shall meet the individual at the arrival gate and accompany the individual to a representative from a service provider in the receiving community, a family member of the individual, or such other individual designated by the applicable service provider.</text></paragraph></subsection></section></legis-body></bill>
