<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 2346</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230718">July 18, 2023</action-date><action-desc><sponsor name-id="S417">Mr. Budd</sponsor> (for himself and <cosponsor name-id="S369">Mr. Markey</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Health and Human Services to develop a strategy for public health preparedness and response to artificial intelligence threats, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strategy for Public Health Preparedness and Response to Artificial Intelligence Threats</short-title></quote>.</text></section><section id="id6498f2bb0c804dc6b1be3fa0cc8661f7"><enum>2.</enum><header>Strategy for public health preparedness and response to artificial intelligence threats</header><subsection id="idb15c70fbc93c496eb1cccb7d41021a50"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="ida55882f4f9d54ee68ca0049643e30d50"><enum>(1)</enum><header display-inline="yes-display-inline">Artificial intelligence</header><text>The term <term>artificial intelligence</term> has the meaning given the term in section 238(g) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (10 U.S.C. note prec. 4061; <external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id13037e7c3c90461b8b66f78e9221d5e5"><enum>(2)</enum><header>PHSA definitions</header><text>The terms <term>qualified countermeasure</term>, <term>security countermeasure</term>, and <term>qualified pandemic or epidemic product</term> have the meanings given the terms in sections 319F–1(a)(2), 319F–2(c)(1)(B), and 319F–3(i), respectively, of the Public Health Service Act (42 U.S.C. 247d–6a(a)(2); (42 U.S.C. 247d–6b(c)(1)(B); (42 U.S.C. 247d–6d(i)).</text></paragraph><paragraph id="idea1011008f7f4c80bbbafedc3d105e92"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph></subsection><subsection id="iddf74cf44e84845b1afc188fc53ef3304"><enum>(b)</enum><header>Strategy for public health preparedness and response to artificial intelligence threats</header><paragraph id="idd35145bc9d42436bbf71b700421b4155"><enum>(1)</enum><header>Strategy</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary, in consultation with stakeholders, including stakeholders developing qualified countermeasures, security countermeasures, or qualified pandemic or epidemic products and stakeholders with an understanding of artificial intelligence technologies, shall prepare and submit to the relevant committees of Congress a strategy for public health preparedness and response and biodefense to address the risks of misuse of artificial intelligence that present a threat to national health security. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5f072a24c7bc44fa95bf14ed6c2989f4"><enum>(2)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The strategy under paragraph (1) shall include—</text><subparagraph id="id2ab18e64ac6d42eb84bb5fbc21adef91"><enum>(A)</enum><text>a framework for public health preparedness and response to mitigate the risks of misuse of artificial intelligence that present a threat to national health security;</text></subparagraph><subparagraph id="id8d0849c4900d4832af91b59c56ebb581"><enum>(B)</enum><text>identifying the duties, functions, and preparedness goals for which the Secretary is responsible in order to prepare for, respond to, and mitigate the risks of such artificial intelligence threats, including metrics by which to measure success in meeting preparedness and risk mitigation goals;</text></subparagraph><subparagraph id="id27451ea7a28741268e064814d0b96f33"><enum>(C)</enum><text>identifying gaps in public health capabilities to achieve such preparedness and risk mitigation goals; </text></subparagraph><subparagraph id="id3dc01ce1cfed45319909d6a5c6c0f3d1"><enum>(D)</enum><text>strategies to address identified gaps and strengthen public health emergency preparedness and response capabilities to address such artificial intelligence threats; and</text></subparagraph><subparagraph id="idc8b4aa84f7d340b583cc1b26bcd25b16"><enum>(E)</enum><text>strategies to mitigate—</text><clause commented="no" display-inline="no-display-inline" id="idba765cde85384bc4a6e3fb76c581233e"><enum>(i)</enum><text display-inline="yes-display-inline">the risks posed by the threat of the misuse of artificial intelligence, at a minimum of—</text><subclause commented="no" display-inline="no-display-inline" id="idd78e3ea866354cfaa75351593e27a8d3"><enum>(I)</enum><text display-inline="yes-display-inline">the development of biological weapons; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc91285682aff458a9dd54f3c3fb9fd2b"><enum>(II)</enum><text display-inline="yes-display-inline">the design of viruses and bacteria that are resistant to treatment; and </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idd1836f4381c04e9fa603b1555d051681"><enum>(ii)</enum><text display-inline="yes-display-inline">such other risks posed by the threat of the misuse of artificial intelligence as are determined by the Secretary. </text></clause></subparagraph></paragraph><paragraph id="idabbc9790952a4120af373155839446a4"><enum>(3)</enum><header>Protection of national security</header><text>The Secretary shall make the strategy under paragraph (1) available to the Committee on Health, Education, Labor, and Pensions of the Senate, the Committee on Energy and Commerce of the House of Representatives, and other congressional committees of jurisdiction, in a manner that does not compromise national security.</text></paragraph></subsection><subsection id="id1591cd5f602f4120aa455b6246cef5e3"><enum>(c)</enum><header>Coordination of preparedness for and response to all-Hazards public health emergencies</header><text>Section 2811(b)(4)(D) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300hh-10">42 U.S.C. 300hh–10(b)(4)(D)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id9894ed8cf27a48d7a8f6accbe72b8d76"><enum>(1)</enum><text>by striking <quote>deployment of the Federal response</quote> and inserting the following: “deployment of—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7285f233d9bf42a89161911b2cb4a803"><clause commented="no" display-inline="no-display-inline" id="ida9861929f47e4d57877acf4d0ed626e2"><enum>(i)</enum><text display-inline="yes-display-inline">the Federal response</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id187d98a9df8b45de8591ebe10528281f"><enum>(2)</enum><text>in clause (i) (as so designated), by striking <quote>and such Federal responses</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3221FC3C816747278DB6B4873DF94DEF"><clause commented="no" display-inline="no-display-inline" id="ida3bab38618b94aa29740505b049b12b9"><enum>(ii)</enum><text>such Federal responses</text></clause><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id29f86c27a8834f47bb151271cbbc3471"><enum>(3)</enum><text>in clause (ii) (as so designated), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id157b7ab331904238b6decc25ffa52fc0"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0F4FAA0360AB40DA9E5D19B51B11AAB0"><clause id="idb814d03bc7fa4f2ebed0b67f68bc9b94"><enum>(iii)</enum><text>such Federal responses covered by the strategy for public health preparedness and response to address the risks of misuse of artificial intelligence that present a threat to national health security described in section 2(b) of the <short-title>Strategy for Public Health Preparedness and Response to Artificial Intelligence Threats</short-title>.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
