<official-title>To require each public housing agency to establish and maintain an online portal for tenants and applicants, and for other purposes.</official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Housing Transparency Improvement Act</short-title></quote>.</text></section> <section id="idECE7E1A58C854F13BBB0FB037609EED2"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="idB9EAE5B6A4544F9C80BF527516449C33"><enum>(1)</enum><header>Covered housing</header><text>The term <term>covered housing</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id2ffe937b53b9446cbff68f21093613a7"><enum>(A)</enum><text display-inline="yes-display-inline">low-income housing; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="id7eed0521a0024b9bb81a329a6d0210a6"><enum>(B)</enum><text>any property with assistance converted under the Rental Assistance Demonstration program authorized under title II of the Consolidated and Further Continuing Appropriations Act, 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/55">Public Law 112–55</external-xref>; 125 Stat. 673). </text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id2a2798666f0a42d2a07b355a791c451c"><enum>(2)</enum><header display-inline="yes-display-inline">Families; low-income housing</header><text>The terms <term>families</term> and <term>low-income housing</term> have the meanings given those terms in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>).</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="id5099ada1eb7e42e4b0dc65c99514a4ac"><enum>(3)</enum><header>Public housing agency</header><text display-inline="yes-display-inline">The term <term>public housing agency</term>—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id21e03a3611a34ab884a3e2e4bd1d555f"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given the term in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>); and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="id6bba14f5ef624a49b87b78931480c38a"><enum>(B)</enum><text>includes any owner of low-income housing that enters into a housing assistance payments contract under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437o">42 U.S.C. 1437o</external-xref>).</text></subparagraph></paragraph> <paragraph id="idADCC120D92884AC384235D26709E9C3A"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="idbf33ba225ccf437da87d38c7c243e029"><enum>(5)</enum><header>Small public housing agency</header><text>The term <term>small public housing agency</term> means a public housing agency that—</text> <subparagraph id="id2975ca5a04684cb1b9eac78be8c745d0"><enum>(A)</enum><text>owns, assists, or operates not more than 250 covered housing dwelling units; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="id04e2084be3204b4da029b5efea1e9036"><enum>(B)</enum><text display-inline="yes-display-inline">predominantly operates in a rural area, as described in section 1026.35(b)(2)(iv)(A) of title 12, Code of Federal Regulations, or any successor regulation.</text></subparagraph></paragraph></section> <section id="id56795237B96841E492652239DD5B2B53"><enum>3.</enum><header>Online portal</header> <subsection id="idBC3F05C946A441E4BCA32C61B2361D69"><enum>(a)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of this Act, each public housing agency shall establish and maintain an online portal on the website of the public housing agency through which families residing in and applicants for a covered housing dwelling owned, assisted, or operated by the public housing agency may— </text> 
<paragraph commented="no" display-inline="no-display-inline" id="id378ddb5d37e84c25a15f35cca705a70a"><enum>(1)</enum><text display-inline="yes-display-inline">access information, including contact information, relating to the performance evaluation, management, and control of the covered housing dwelling;</text></paragraph> <paragraph id="id478613e49dc24e1d8239ab045edf648e"><enum>(2)</enum><text>access a plain language list of the legal rights of each family residing in or applying for the covered housing dwelling, which shall be available for translation; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="idfb688688c0de4a968c0768e794d435fd"><enum>(3)</enum><text display-inline="yes-display-inline">track service requests and complaints submitted to the public housing agency through a tracking system described in subsection (b).</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="idffc9b0edf65c43339cdf5f01c65ccfa8"><enum>(b)</enum><header>Tracking system</header> <paragraph commented="no" display-inline="no-display-inline" id="id869da4a6ca1245d8a827e1bf14c65f11"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Each public housing agency shall establish, using existing software or through new software, a request tracking system, including for inquiry on the status of an application, short-term and long-term capital improvements, service requests, and complaints, submitted by a family residing in a covered housing dwelling owned or operated by the public housing agency through which the families and applicants may track requests with real-time updates provided by the public housing agency.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="id2b444334dff04ff6b5fadc0aa11138d3"><enum>(2)</enum><header display-inline="yes-display-inline">Service request and complaint database</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="id23795d1a9446401f848c82037c48ac17"><enum>(A)</enum><header display-inline="yes-display-inline">Assignment of number</header><text>The tracking system described in paragraph (1) shall contain a database under which the public housing agency shall assign each family residing in a covered housing dwelling owned or operated by the public housing agency and each applicant for a covered housing dwelling owned or operated by the public housing agency a ticket number or a private access number to use to make requests or complaints described in paragraph (1).</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id836a98556ea8455ba302d4bd63ec89cc"><enum>(B)</enum><header>Required information</header><text display-inline="yes-display-inline">Each inquiry described in subparagraph (A) shall—</text> 
<clause commented="no" display-inline="no-display-inline" id="id88f09a350584494c9ec2114e6c67425f"><enum>(i)</enum><text display-inline="yes-display-inline">be searchable through the tracking system described in paragraph (1); </text></clause> <clause commented="no" display-inline="no-display-inline" id="id0d747bb7339d4acd8a23584a6fb4066f"><enum>(ii)</enum><text>have associated with it a description of—</text> 
<subclause commented="no" display-inline="no-display-inline" id="id44babe8ae2c04902a364b2fa8eba0439"><enum>(I)</enum><text>the nature of the inquiry, complaint, or request;</text></subclause> <subclause id="id85930b91a417466c80750c8ffccdf951"><enum>(II)</enum><text>the most recent status of the inquiry, complaint, or request;</text></subclause> 
<subclause id="id22b7f222ae7c4143bce9d695b574e8d5"><enum>(III)</enum><text>whether or not the inquiry, complaint, or request is open or closed;</text></subclause> <subclause id="id1a0c1a5effcf464e9078638ed491512f"><enum>(IV)</enum><text>any action taken on the inquiry, complaint, or request, and any next steps to be taken; and</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="id5e0b720929b0441db02aef41587c4fee"><enum>(V)</enum><text>any additional information as the public housing agency determines appropriate; and</text></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="id36b60ebcced244c88b48deeb9301901a"><enum>(iii)</enum><text>not publicly disclose any personal information relating to the inquiry, complaint, or request, including the unit number, name of the resident or applicant, or any other identifying information that is prohibited from disclosure under applicable laws.</text></clause></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="ida50a716aac4e4ef8900fd6c4bba6920f"><enum>(3)</enum><header>Prohibition</header><text>A public housing agency may not require a family residing in a covered housing dwelling owned or operated by the public housing agency to use the tracking system described in paragraph (1) to submit requests or to receive updates relating to service requests and complaints submitted by the family. </text></paragraph></subsection> <subsection id="id03CD8865F603466493336EAD253E5B4C"><enum>(c)</enum><header>Updates</header><text>Each public housing agency shall ensure that the online portal established under subsection (a) is updated on a regular basis and contains the most recent information regarding inquiries, service requests, and complaints described in subsection (a)(3).</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="idd1b58ba5b1cb466294b7cc58a5a2ff2a"><enum>(d)</enum><header>Reporting</header><text>Each public housing agency shall, on an annual basis, develop a fact sheet for tenants residing in and applicants for a covered housing dwelling owned, assisted, or operated by the public housing agency that—</text> <paragraph commented="no" display-inline="no-display-inline" id="id1b7aec26f1ec4ec092afeda0b4707d27"><enum>(1)</enum><text display-inline="yes-display-inline">includes, in a clear and easily discernible manner—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="id4d2ab0b3e8a549cd81b4b72b09b7858e"><enum>(A)</enum><text>the total amount and type of Federal, State, and local funds received for the fiscal year;</text></subparagraph> <subparagraph id="id4bd591680b024157881d98aaaa899942"><enum>(B)</enum><text>the funding streams for ongoing and upcoming capital improvement projects;</text></subparagraph> 
<subparagraph id="ida71f75212c844c918883d7d9976ac0f5"><enum>(C)</enum><text>the most recent inspection date and score;</text></subparagraph> <subparagraph id="id4dfa015825384329a4f35b1672130210"><enum>(D)</enum><text>any major renovation, capital, or redevelopment plans; and</text></subparagraph> 
<subparagraph id="id55c3476126dd4c20926ca865cd85df33"><enum>(E)</enum><text>the name and contact information for the manager or management of the dwelling, if operating independently; </text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id02b8c214f95f488cadc715ae31f43426"><enum>(2)</enum><text>is posted on the website of the public housing agency, if applicable, is available in paper format, is available for translation, is available upon request, and is submitted as an addendum as part of the public housing agency plan provided to the Resident Advisory Board and provided at a public hearing as required under section 5A of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437c-1">42 U.S.C. 1437c–1</external-xref>).</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="id06b94c9edc1948a29e3662bf1c2bab65"><enum>(e)</enum><header>Grants</header> 
<paragraph commented="no" display-inline="no-display-inline" id="id0a1ec7933236465a8786a4f9b353f424"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary may make grants to public housing agencies in the amount necessary for the public housing agency to purchase, establish, and maintain the online portal required under this section.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id989dd984a6e041b79e027b612aaa3cc1"><enum>(2)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text>There is authorized to be appropriated such sums as may be necessary to carry out this subsection.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="id61e2230c1e1a41f3b909255b222880c3"><enum>(f)</enum><header>Reporting</header><text>Each public housing agency shall, on an annual basis, submit to the Secretary information on grants made under subsection (e), including how the amounts were used related to the online portal required under this section.</text></subsection> <subsection id="idb099334792f84aa19a6d5a15b53a734d"><enum>(g)</enum><header>Incentives</header><text display-inline="yes-display-inline">The Secretary shall consider the implementation and maintenance by a public housing agency of the online portal required under this section in the annual public housing assessment system described in part 902 of title 24, Code of Federal Regulations, or any successor regulation.</text></subsection> 
<subsection id="id98ed090b1c454f449ddd2fa36025325f"><enum>(h)</enum><header>Exemptions</header> 
<paragraph commented="no" display-inline="no-display-inline" id="id27b53d67cc6f410c8f8bc32a98b6bd1b"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The requirement to create and maintain an online portal under this section shall not apply to small public housing agencies.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id3709c4756e9b485cac827de84d42e47d"><enum>(2)</enum><header>Alternate method</header><text>A small public housing agency that is exempted under paragraph (1) shall develop, implement, and submit to the Secretary alternate methods for fulfilling the requirements under subsections (a) through (d), in particular paragraphs (1) and (2) of subsection (a).</text></paragraph></subsection></section>
