which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Agricultural Credit Act of 1978 to remove barriers to agricultural producers in accessing funds to carry out emergency measures under the emergency conservation program, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency Conservation Program Improvement Act of 2023</short-title></quote>.</text></section><section id="id31CA6677C12F40E7B9AC73768457496B"><enum>2.</enum><header>Improving the Emergency Conservation Program</header><text display-inline="no-display-inline">Section 401 of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2201">16 U.S.C. 2201</external-xref>) is amended—</text><paragraph id="id6DFFAE0E255E4F00B568E06ABC947B0D"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id7500CD5EC55541D1BE2D5CDB45157D3D"><enum>(A)</enum><text>in the subsection heading, by inserting <quote><header-in-text level="subsection" style="OLC">and other emergency conservation measures</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">fencing</header-in-text></quote>; and</text></subparagraph><subparagraph id="id0BBC331B049E494CB31AE2F4DD0F2ABD"><enum>(B)</enum><text>in paragraph (1)—</text><clause id="id6AEF0642218C482897C67482EF7AA2C5"><enum>(i)</enum><text>by inserting <quote>or other emergency measures to replace or restore farmland or conservation structures requiring an immediate response (as determined by the Secretary),</quote> after <quote>replacement of fencing,</quote>; and</text></clause><clause id="id8E93FA0C39B2423C9F1982675E74F823"><enum>(ii)</enum><text>by striking <quote>option of receiving</quote> and all that follows through the period at the end and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="id2E50895B6FA3463D9343EC59F4ED2634" act-name=""><text>option of receiving, before the agricultural producer carries out the repair, replacement, or restoration—</text><subparagraph id="id6F08864FD91B47D19EDCB92717B3B328"><enum>(A)</enum><text>with respect to a payment to the agricultural producer for a replacement, 75 percent of the cost of the replacement, as determined by the Secretary based on the fair market value of the cost of the replacement using the estimated cost of the applicable practice published in the Field Office Technical Guide of each State by the Natural Resources Conservation Service; and</text></subparagraph><subparagraph id="idB4283207A92944E294C143D0BD48A656"><enum>(B)</enum><text>with respect to a payment to the agricultural producer for a repair or restoration, 50 percent of the cost of the repair or restoration, as determined by the Secretary based on the fair market value of the cost of the repair or restoration using the estimated cost of the applicable practice published in the Field Office Technical Guide of each State by the Natural Resources Conservation Service.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id85211ECAE0444BEE9666EC64030BAF82"><enum>(2) </enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="idB4704730F30F4C6AAE832927E7473A52" act-name=""><subsection id="idBE937EED885E495A884D872205B9A35C"><enum>(c)</enum><header>Wildfire determination</header><text>A wildfire that causes damage eligible for a payment under subsection (a) includes—</text><paragraph id="id6FC6DB1F0A7847A3B80A2D8873ED0A78"><enum>(1)</enum><text>a wildfire that is not caused naturally if the damage is caused by the spread of the wildfire due to natural causes; and</text></paragraph><paragraph id="id1E2B3BE338F348BEBBFC78D8936C672D"><enum>(2)</enum><text>a wildfire that is caused by the Federal Government.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id594A8EFB5C974D3B9E03BAC1543D3163"><enum>3.</enum><header>Improving the Emergency Forest Restoration Program</header><text display-inline="no-display-inline">Section 407 of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2206">16 U.S.C. 2206</external-xref>) is amended—</text><paragraph id="idFF1BFD222D37437B85A96AD2801A5B24"><enum>(1)</enum><text>in subsection (a)(2), by striking <quote>wildfires,</quote> and inserting <quote>wildfires (including a wildfire that is not caused naturally if the damage is caused by the spread of the wildfire due to natural causes and a wildfire that is caused by the Federal Government),</quote>;</text></paragraph><paragraph id="id98048963617A4CBBB11BEB04F372929B"><enum>(2)</enum><text>by redesignating subsection (e) as subsection (f); and</text></paragraph><paragraph id="id00DA65019CF048EF90E43DA1D1D470D9"><enum>(3)</enum><text>by inserting after subsection (d) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id176582CF4A2E4C81A3EE588818A37F39"><subsection id="id17A2728C5DF844928E8FD639C11C4FA4"><enum>(e)</enum><header>Advance payments</header><paragraph id="id3B9C110073E740C4BC63872EC3D124F6"><enum>(1)</enum><header>In general</header><text>The Secretary shall give an owner of nonindustrial private forest land the option of receiving, before the owner carries out emergency measures under this section, not more than 75 percent of the cost of the emergency measures, as determined by the Secretary based on the fair market value of the cost of the emergency measures using the estimated cost of the applicable practice published in the Field Office Technical Guide of each State by the Natural Resources Conservation Service.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2B27968AFE334AFB8165A1F5FDE5207D"><enum>(2)</enum><header display-inline="yes-display-inline">Return of funds</header><text display-inline="yes-display-inline">If the funds provided under paragraph (1) are not expended by the end of the 60-day period beginning on the date on which the owner of nonindustrial private forest land receives those funds, the funds shall be returned within a reasonable timeframe, as determined by the Secretary.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
