which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve the transparency of purchases by the Federal Government of data or information that can be used to identify an individual, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Purchased Data Inventory Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ida1254f667bad4e48880b706e441d1dc4"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 3502 of title 44, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idf911f7f7752d4ed9a075e5f4d70bda93"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (22), by striking <quote>; and</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id94cf3698768d46a4a77dbfcf4fd60c3f"><enum>(2)</enum><text>in paragraph (23), by striking the period and inserting a semicolon; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfb01b0e7831f47de9bb4c6b0fb63dc3e"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id146328364F6E4EF6AB4CDB74FCE2F819"><paragraph commented="no" display-inline="no-display-inline" id="idc4e50b882b1b4a9db100dd4a5ccdbea7"><enum>(24)</enum><text>the term <term>covered data purchase</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3A3746609E9D41F498E966C65C428DEE"><enum>(A)</enum><text display-inline="yes-display-inline">means data or information, including data or information accessed through a database, that is—</text><clause commented="no" display-inline="no-display-inline" id="id18C04051C2BA4930886E9F0E121608F2"><enum>(i)</enum><text display-inline="yes-display-inline">obtained by an agency in exchange for anything of value; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idC711A242DAC243AF8F64861CD7D119A8"><enum>(ii)</enum><text display-inline="yes-display-inline">reasonably can be used, alone or in combination with other data or information, to identify an individual;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF8D654B5638A46268806A1678A3013A6"><enum>(B)</enum><text>does not include bulk data obtained by an agency to be used for statistical purposes; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9f93df90a9a34b2e95dcb5d43a8aae12"><enum>(C)</enum><text>does not include data obtained in exchange for anything of value from another agency; and</text></subparagraph></paragraph><paragraph id="idE8661543046844A4BCF6953E5E7D382C" commented="no" display-inline="no-display-inline"><enum>(25)</enum><text>the term <term>obtain in exchange for anything of value</term> means to purchase, receive in connection with services provided for consideration, or otherwise obtain in exchange for considerations, including an access fee, service fee, maintenance fee, or licensing fee.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id38e956e6117f44b1bc0f722d3535dd1d"><enum>3.</enum><header display-inline="yes-display-inline">Chief Data Officers</header><text display-inline="no-display-inline">Section 3520 of title 44, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id8d2209ee587f43fd941cd87e3e00791f"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)—</text><subparagraph id="id465eea27cf924c368b332e811aa272b4" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text>in paragraph (13), by striking <quote>and</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id41c4e5489bb644528d28e47b50d50b07"><enum>(B)</enum><text>in paragraph (14), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6896875229be4076947d129229ec21d9"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0697BDA116F5492480D25BA7182BB9DA"><paragraph commented="no" display-inline="no-display-inline" id="id6006a3982e664a3d835b81a338924634"><enum>(15)</enum><text>compile the covered data purchases of the agency.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id67d1e89736da4b8f952381fe914b9c49"><enum>(2)</enum><text>by striking subsection (e) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0074A2CD5EA440F6AB7BE6A9A97F636D"><subsection id="id53a43f188ee74edb8d47ba1f8953f440"><enum>(e)</enum><header>Reports</header><text>The Chief Data Officer of an agency shall submit to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Oversight and Accountability of the House of Representatives</committee-name>—</text><paragraph commented="no" display-inline="no-display-inline" id="id7116c78cb05647d5a6f2e8837791f58a"><enum>(1)</enum><text display-inline="yes-display-inline">an annual report on the compliance of the agency with the requirements of this subchapter, including information on each requirement that the agency could not carry out and, if applicable, what the agency needs to carry out such requirement; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idce11b98adc6e4000bf3db07ba894195c"><enum>(2)</enum><text display-inline="yes-display-inline">an annual report on the covered data purchases of the agency described in subsection (f), which may include an annex of any material that is properly classified pursuant to an Executive order.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id828dd6e8dd8444a0b8e6fa1ccf68c07e"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7C05B06905214B2FA648701C2C82F654"><subsection commented="no" display-inline="no-display-inline" id="id23def01cb9294b188a1b1758199956e8"><enum>(f)</enum><header>Covered data purchases</header><paragraph id="id21b6a56284684d4f97bb96e8f80e5f0a"><enum>(1)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this subsection, and annually thereafter the Chief Data Officer of each agency shall compile a report on the covered data purchases of each agency.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd1a8febd708147679774cafbc92dab77"><enum>(2)</enum><header>Consistency</header><text>The Chief Data Officer Council, in consultation with the Federal Privacy Council, or any successor thereto, and the Chief Acquisition Officer Council, shall provide direction to the Chief Data Officers of each agency for consistent interpretation of this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01d1fddd898c4152a194a04dd96206e9"><enum>(3)</enum><header>Contents of report</header><text>The report described in paragraph (1) shall include, with respect to each covered data purchase made by the agency during the 3-year period before the date on which the report is submitted—</text><subparagraph id="id1b69b7d2d5a74820ba567b7d224e5ac5"><enum>(A)</enum><text>a plain language description of the purpose of the covered data purchase, including, if applicable, a justification for obtaining the data in exchange for anything of value rather than acquiring the data through other means, including through the use of interagency data sharing, subpoena, or other process;</text></subparagraph><subparagraph id="idcaea6efc82914f07857e1cf2fcb569eb"><enum>(B)</enum><text>if applicable, the procurement instrument identifier for the covered data purchase;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4324532842a64af28700733096364666"><enum>(C)</enum><text>the identity of the vendor that provided the covered data purchase;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddf24fabd0ce14de6a211775d69b0584e"><enum>(D)</enum><text>if applicable, links to the relevant privacy documents, including systems of records notices and privacy impact assessments;</text></subparagraph><subparagraph id="idba9b109dd73f42f4be87cd4a2e21997c"><enum>(E)</enum><text>a plain language description of the contents of the data contained in the covered data purchase;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id28a8619acb314dd398fa0fd60696bb28"><enum>(F)</enum><text>the number of distinct individuals who are reasonably linkable in the covered data purchase;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id52957a03651b436da86d239ef6899519"><enum>(G)</enum><text>an indication of whether data contained in the covered data purchase is reflected in the data inventory of the agency, as required under section 3511 of title 44, United States Code; and</text></subparagraph><subparagraph id="id4d954ce20f574fb580355cf3fc37a3c6"><enum>(H)</enum><text>an indication of whether the covered data purchase includes data, metadata, or information relating to—</text><clause id="id2175cb931dd54b4eb5a6272beaa26a57"><enum>(i)</enum><text>location;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9c589b0131d74ea98056080e501d2e0e"><enum>(ii)</enum><text display-inline="yes-display-inline">electronic device usage;</text></clause><clause commented="no" display-inline="no-display-inline" id="idcde70034c2704a4991c9fc96055acd78"><enum>(iii)</enum><text display-inline="yes-display-inline">the contents of communications of an individual with other individuals;</text></clause><clause commented="no" display-inline="no-display-inline" id="ide39ba266c8ab4805a8f550a0e70b2243"><enum>(iv)</enum><text display-inline="yes-display-inline">communications metadata;</text></clause><clause commented="no" display-inline="no-display-inline" id="idb8d9e876039843cab6fd96efcc3536dc"><enum>(v)</enum><text display-inline="yes-display-inline">network system traffic;</text></clause><clause commented="no" display-inline="no-display-inline" id="idbafb22ee546c4df4958af024301bccff"><enum>(vi)</enum><text display-inline="yes-display-inline">web browsing history;</text></clause><clause commented="no" display-inline="no-display-inline" id="idebbebb2ce98e4b57930aec2920f418bf"><enum>(vii)</enum><text display-inline="yes-display-inline">social media history;</text></clause><clause commented="no" display-inline="no-display-inline" id="idfa84b8aa58d94ffc801d9f99d1e341af"><enum>(viii)</enum><text>media consumption;</text></clause><clause commented="no" display-inline="no-display-inline" id="id17783a975f1940f19cbd182321b1cb3f"><enum>(ix)</enum><text display-inline="yes-display-inline">health;</text></clause><clause commented="no" display-inline="no-display-inline" id="ideeecf55b67184d77b3071963bb1b2005"><enum>(x)</enum><text display-inline="yes-display-inline">purchase history;</text></clause><clause commented="no" display-inline="no-display-inline" id="idff9d129bbf3a41d0b42a86a25ffddca6"><enum>(xi)</enum><text display-inline="yes-display-inline">personal finances or credit;</text></clause><clause commented="no" display-inline="no-display-inline" id="id501572c5cfe749f59afa78d54521069b"><enum>(xii)</enum><text display-inline="yes-display-inline">education;</text></clause><clause commented="no" display-inline="no-display-inline" id="idabbe34f1fc92499ea760c22abc6c70e9"><enum>(xiii)</enum><text>work history;</text></clause><clause commented="no" display-inline="no-display-inline" id="id705e6711c27d433c98a3dbac43cebe3a"><enum>(xiv)</enum><text>interests;</text></clause><clause commented="no" display-inline="no-display-inline" id="idf4351917e1ac4536b77b572ba575e77c"><enum>(xv)</enum><text display-inline="yes-display-inline">biometrics; </text></clause><clause commented="no" display-inline="no-display-inline" id="id39c443632421476d8e741f0f73ccb422"><enum>(xvi)</enum><text display-inline="yes-display-inline">identifiable characteristics of protected classes;</text></clause><clause commented="no" display-inline="no-display-inline" id="id3990fd2733544563b5832b24c2f7e39e"><enum>(xvii)</enum><text display-inline="yes-display-inline">criminal history;</text></clause><clause commented="no" display-inline="no-display-inline" id="id74e558344d65480895d96a548dbc7aec"><enum>(xviii)</enum><text display-inline="yes-display-inline">court records, including civil cases; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id20cc174ca22b41829b08a1caa8e7db59"><enum>(xix)</enum><text>the family members or friends of an individual.</text></clause></subparagraph></paragraph><paragraph id="id060a40bc96454d9da403a11b16cd29c9"><enum>(4)</enum><header>Report publication</header><subparagraph commented="no" display-inline="no-display-inline" id="id14c7e24ce0a64042867244d2631a4593"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each agency shall make the report submitted under paragraph (1) available to the public on the website of the agency in a machine-readable, open format and without restrictions on reuse, except for an annex described in subparagraph (B).</text></subparagraph><subparagraph id="id03585a1597924b22827da30553ee23e0"><enum>(B)</enum><header>Annex</header><text>A report under subparagraph (A) shall include in an annex any necessary information that is properly classified pursuant to an Executive order.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="ida8def555b7e9474f863c49320e5f6438"><enum>4.</enum><header>Chief Data Officer Council</header><text display-inline="no-display-inline">Section 3520A of title 44 is amended—</text><paragraph id="idd9807b97f6484316b7e2f133b5f36abb"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5290a4f622d845098391d54cf96ed5de"><enum>(A)</enum><text>in paragraph (4), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb0516e4e5c034701a692864b060da8ed"><enum>(B)</enum><text>in paragraph (5), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id98e4dac15fb4403e8276e02744ef9365"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2CA2DA530F384200BD394EDA30AAAC06"><paragraph commented="no" display-inline="no-display-inline" id="id70657bbfa44d47a598a8ed6fc6eb2686"><enum>(6)</enum><text>study agency data purchasing habits.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbce47b4bf4214317891348649e039d4d"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbdd8e28c95f74d6283ae0d8f961ec489"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>, in consultation with the Federal Privacy Council, or any successor thereto, and the Chief Acquisition Officer Council,</quote> after <quote>The Council</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide1d420f60d03466bbf741a2bff1c0a74"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>the Committee on Oversight and Government Reform of the House of Representatives</quote> and inserting <quote>the <committee-name committee-id="">Committee on Oversight and Accountability of the House of Representatives</committee-name></quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id525528a384784ecfbfa20406c659ac67"><enum>(C)</enum><text>by inserting <quote>, including recommendations specified in section 3(e) of the <short-title>Purchased Data Inventory Act</short-title></quote> after <quote>the work of the Council</quote>.</text></subparagraph></paragraph></section></legis-body></bill>
